Significant work in DH has focused on access, labor, and infrastructure. They fundamentally shape the field, from who is included to what we study (for example, see Graban et al 2019, McGrail et al 2022, and Losh and Wernimont 2018). Often less discussed is the legal systems that impact the field. Laws defining data use including ownership, access, circulation, and privacy shape the analytical possibilities and differ according to geography and nation state. In this article, we address the impact of a specific United States legal framework governing access to data and outline advocacy to change the legal code to facilitate DH research. We specifically discuss the Association for Computers and the Humanities (ACH) work to support a change in text and data mining policy by supporting an effort led by Samuelson Law, Technology & Public Policy Clinic and Authors Alliance. This policy, section 1201 of the US copyright code, imposes a set of restrictions on how people can use digital materials whose access is mediated using technical protection measures, including digital rights management (DRM) code—even when the use would otherwise be permitted by fair use. (Fair use in US copyright law is roughly equivalent to fair dealing in Canada, although inherently more open through not enumerating a specific list of exemptions.) By collaborating with one another and with legal practitioners, DH scholars can play a significant role in changing the legal regime that protects multinational corporations and limits humanities research. We end with a discussion of next steps and how US-based scholars can get involved in changing this legal landscape.D'importants travaux en DH se sont concentrés sur l'accès, l'emploI et l'infrastructure. In this paper, I describe the advantages and disadvantages of incorporating new Artificial Intelligence (AI)-enabling exceptions and limitations to the copyright laws of Latin American countries. Section 1 describes the threats and opportunities AI may pose to the region. Section 2 refers to the effects copyright legislation may have on investment decisions of AI firms, the potential benefits for countries incorporating them, Law & Economics and Comparative Law perspectives, and the current regulatory asymmetry in this matter across the region. Section 3 concludes with policy recommendations.

This paper explores legal considerations for how libraries in Canada can lend digital copies of books. It is an adaptation of A Whitepaper on Controlled Digital Lending of Library Books by David R. Hansen and Kyle K. Courtney, and draws heavily on this source in its content, with the permission of the authors. Our paper considers the legal and policy rationales for the process--"controlled digital lending"--in Canada, as well as a variety of risk factors and practical considerations that can guide libraries seeking to implement such lending, with the intention of helping Canadian libraries to explore controlled digital lending in our own Canadian legal and policy context. Our goal is to help libraries and their lawyers become better informed about controlled digital lending as an approach, offer the basis of the legal rationale for its use in Canada, and suggest situations in which this rationale might be strongest. In this article, a workflow for the digitization of complex and extensive periodicals is presented based on the project "Digitization of the Darmstädter Tagblatt" (funded by the German Research Foundation). The project is a collaboration between the University and State Library Darmstadt and the Institute for Linguistics and Literary Studies of the Technical University of Darmstadt. The steps include the creation of images from the original, the digital post-processing up to the machine-readable full text with basic linguistic annotations, the publicly accessible presentation on the Internet and the detailed research for rights holders of individual articles and photographs as stipulated by §§ 61 ff. 29. From Copyright Cartels to Commons and Care: A Public Infrastructure Model for Canadian Music Communities.

Using research on the political economy of the music industries, interviews with independent musicians about their lived experiences, and the authors' experience participating in government copyright consultations in Canada, this article discusses how the market power of major music companies and their capture of the policy-making process through lobbying has made copyright reform an extremely limited avenue for remedying the variety of hardships facing musicians in the streaming media era. Against the continued consolidation and concentration of power within the music industries, we explore a case study of Edmonton Public Library's Capital City Records as an alternative model that may inspire further initiatives that advocate for artists and users. We conclude by discussing a commons-based, public-infrastructure and governance model that could serve as a tool to circumvent uneven power dynamics in the music industries, facilitate stronger music communities, and maintain sustainable livelihoods for working musicians in Canada. 35. Author Addendum Conundrum: Comparing Author Use of Copyright Addenda With Publisher Acceptance.

The purpose of this paper is simultaneously to investigate researcher use and awareness of author addenda (e.g., the Scholarly Publishing and Academic Resources Coalition [SPARC] author addendum) and publisher awareness and acceptance of the same. Researchers at U15 Group of Canadian Research Universities' institutions were targeted, and a survey was sent to faculty, graduate, and postdoctoral associations to share with their members. Following a low response rate, the survey was sent to a listserv of copyright librarians in Canada with a message that encouraged them to share it with researchers at their institutions. Eighty-one researchers responded to the survey. Eighty-six percent of researchers (n = 70) indicated that they were unaware of author addenda. Researchers were asked to identify how often they negotiate their publishing agreements, and of those who answered the question, 84.2% (n = 64) responded that they never negotiate. Thirteen publishers or publishing organizations were contacted and asked if they would participate in phone interviews about copyright practices and author addenda. Two large multinational publishers agreed to participate. Both publishers indicated that very few authors attempt to negotiate their agreements and that of those who choose to negotiate, even fewer use addenda. Both indicated that they do not accept the SPARC author addendum. This study's small sample sizes mean that more information needs to be collected before firm conclusions can be drawn. Based on the responses from the two large publishers, the best way to help Tri-Agencyfunded researchers may be for libraries and the Tri-Agency to negotiate with publishers for funder-based exceptions. Regulate copyright on his literary and artistic work as a means to rebuke the infringers of these important rights in the advancement and development of peoples., La loi est venue protéger les droits confiés aux personnes en raison de l'importance de cette protection au niveau national et international. 43. From liberalisation to regulation: managerial political work in the European digital copyright policy (2014–2019)

The 2019 Directive on Copyright in the Digital Single Market represents an intriguing departure from the anticipated path of liberalisation in public policy. While it includes provisions seemingly aligned with the liberalisation of the Digital Single Market by relaxing digital copyright enforcement, it also introduces mechanisms that bolster digital copyright protection, signalling a shift towards market regulation. This paper explores why and how Jean-Claude Juncker’s European Commission proposed a directive featuring robust regulatory elements despite initial promises of copyright deregulation within the Digital Single Market. Combining insights from political economy and political sociology, I examine the concept of ‘political work’ as the practice of promoting, defending, and implementing a choice of public action. Within this framework, I identify a managerial dimension of political work involving political practices that influence the institutional structure and management of public action. Utilising a qualitative methodology involving twelve in-depth interviews with Commission officials conducted between 2018 and 2021, alongside document analysis, I demonstrate how Jean-Claude Juncker and his cabinet’s managerial political work, encompassing organisational reforms within the Commission, played a pivotal role in steering the proposed policy towards regulation., SCOPUS: ar.j, info:eu-repo/semantics/published

- Abstract
The present legal research article has the general objective of analyzing the impact of the Marrakesh Treaty on copyrights within the Colombian legal regime. For this purpose, legal research was formulated, from the interpretative paradigm, with a qualitative approach, phenomenological design,and documentary methods such as background, law and jurisprudence analysis files. This made it possible to examine copyrights and their forms of infringement according to Colombian law, to study the Marrakesh Treaty from the point of view of legislation and jurisprudence in Colombia and to analyze the assumptions of the Marrakesh Treaty that have an impact on copyrights within the Colombian legal regime. It resulted that, first, there is a broad legal spectrum that protects all types of intellectual property, which specifically points out copyright infringements and their consequences; second, that the Marrakesh Treaty is consistent with the domestic legal system of the country and offers greater guarantees to persons with disabilities that prevent them from reading physical text, and; third, that, specifically, the treaty introduced two (2) new elements to the Colombian legal context: the inclusion of new beneficiaries of the flexibilization of copyright and the border exchange of copies in accessible format. In this context, it is concluded that the implementation of the treaty has a direct and significant impact on copyright in Colombia., L'objectif général de cet article de recherche juridique est d'analyser l'impact du Traité de Marrakech sur le droit d'auteur dans le système juridique colombien. À cette fin, une recherche juridique a été formulée, à partir du paradigme interprétatif, avec une approche qualitative, une conception phénoménologique et des méthodes documentaires telles que des dossiers d'analyse du contexte, de la loi et de la jurisprudence. Cela a permis d'examiner le droit d'auteur et ses formes de violation en droit colombien, d'étudier le traité de Marrakech du point de vue de la législation et de la jurisprudence en Colombie, et d'analyser les hypothèses du traité de Marrakech qui ont un impact sur le droit d'auteur dans le système juridique colombien. Il s'est avéré que, premièrement, il existe un large spectre juridique qui protège tous les types de propriété intellectuelle et qui souligne spécifiquement les violations du droit d'auteur et leurs conséquences; deuxièmement, le traité de Marrakech est cohérent avec le système juridique national et offre de plus grandes garanties aux personnes handicapées qui les empêchent de lire des textes physiques; et troisièmement, le traité a introduit deux (2) nouveaux éléments dans le contexte juridique colombien : l'inclusion de nouveaux bénéficiaires de la flexibilisation du droit d'auteur et l'échange transfrontalier de copies en format accessible. Dans ce contexte, il est conclu que la mise en œuvre du traité a un impact direct et significatif sur le droit d'auteur en Colombie., O objetivo geral deste artigo de investigação jurídica é analisar o impacto do Tratado de Marraquexe sobre os direitos de autor no âmbito do regime jurídico colombiano. Para tanto, formulou-se uma investigação jurídica, a partir do paradigma interpretativo, com abordagem qualitativa, com delineamento fenomenológico e métodos documentais como fichas de análise de antecedentes, de direito e de jurisprudência. Isto nos permitiu examinar os direitos autorais e suas formas de violação de acordo com a legislação colombiana, estudar o Tratado de Marraquexe sob a perspectiva da legislação e da jurisprudência na Colômbia e analisar os pressupostos do Tratado de Marraquexe que impactam os direitos autorais dentro do regime jurídico colombiano. Descobriu-se que, primeiro, existe um amplo espectro jurídico que protege todos os tipos de propriedade intelectual, que aponta especificamente as violações de direitos autorais e suas consequências; segundo, que o Tratado de Marraquexe é consistente com o sistema jurídico interno do país e oferece maiores garantias às pessoas com deficiência que as impedem de ler textos físicos, e; terceiro, que, especificamente, o tratado introduziu dois (2) novos elementos no contexto jurídico colombiano: a inclusão de novos beneficiários da flexibilidade dos direitos autorais e a troca fronteiriça de cópias em formato acessível. Nesse quadro, conclui-se que a implementação do tratado impacta direta e significativamente os direitos autorais na Colômbia., El presente artículo de investigación jurídica tiene como objetivo general analizar el impacto del Tratado de Marrakech en los derechos de autor dentro del régimen jurídico colombiano. Para ello, se formuló una investigación jurídica, desde el paradigma interpretativo, de enfoque cualitativo, con diseño fenomenológico y métodos documentales como las fichas de análisis de antecedentes, de leyes y de jurisprudencia. Ello permitió examinar los derechos de autor y sus formas de vulneración según la norma colombiana, estudiar el Tratado de Marrakech desde la óptica de la legislación y la jurisprudencia en Colombia y analizar los presupuestos del Tratado de Marrakech que impactan en los derechos de autor dentro de régimen jurídico colombiano. Resultó que, primero, existe un amplio espectro jurídico que protege a todo tipo de propiedad intelectual, que señala específicamente las infracciones a los derechos de autor y sus consecuencias; segundo, que el Tratado de Marrakech es consistente con el ordenamiento jurídico interno del país y ofrece mayor garantía a las personas en condición de discapacidad que les impide leer textosfísicos, y; tercero, que, concretamente, el tratado introdujo dos (2) nuevos elementos al contexto jurídico colombiano: la inclusión de nuevos beneficiarios de la flexibilización de los derechos de autor y el intercambio fronterizo de ejemplares en formato accesible. En tal marco, se concluye que la implementación del tratado impacta directa y significativamente los derechos de autor en Colombia.

- Abstract
Prenant pour cas d’étude le processus décisionnel ayant abouti en 2019 à l’adoption de la directive européenne « Droit d’auteur dans le marché unique numérique », la thèse cherche à comprendre et expliquer la déviation d’une politique publique européenne d’une trajectoire libérale vers celle de la régulation. Analysé au prisme de la sociologie de l’action publique, le droit d’auteur y est défini comme un instrument d’action publique au sens de Lascoume et Le Galès (2005). Le cadre analytique repose ensuite sur l’articulation de trois concepts clés :le champ eurocratique, le travail politique et les espace-temps de l’action publique. La thèse répond alors à la question de recherche suivante :comment et pourquoi le travail politique des agent·es, déployé dans les différents espace-temps du champ eurocratique, a-t-il aboutit à l’adoption du droit d’auteur comme instrument de régulation du marché unique numérique ?Le dispositif méthodologique combine une enquête par entretiens auprès des agent·es ayant pris part au processus décisionnel étudié (n=79) et une fouille de documents divers relatifs au dossier du droit d’auteur européen, et datant majoritairement d’une période courant de 2004 à 2019, c’est-à-dire des premières réflexions sur une nouvelle réglementation du droit d’auteur à l’adoption de la directive finale (n=161).L’analyse des données ainsi collectées montre que la directive droit d’auteur dans le marché unique numérique a dévié de la trajectoire libérale qu’elle avait pourtant entamée dans les années 2000 parce qu’un ensemble d’agent·es défendant une position pro-régulation a d’abord émergé dans l’espace-temps de la Commission, puis s’est maintenu au fil des différents espace-temps de la prise de décision (Conseil de l’UE, Parlement, Trilogues). Książka podejmuje problem wpływu prawa autorskiego na nowoczesne sposoby funkcjonowania i rozumienia literatury. Problematyka ta zostaje usytuowana w kontekście anglojęzycznych badań nad związkami prawa i literatury, a w szczególności - w obrębie kulturowych studiów nad prawem autorskim, których rekonstrukcji poświęcony jest rozdział 1. Historia prawa autorskiego oraz związanych z nią dyskusji literackich zostaje zrekapitulowana w rozdziale 2. W kolejnych rozdziałach przeanalizowane zostają dyskusje literackie, w których prawo autorskie stanowi bądź wprost podejmowany temat, bądź sygnalizowany jedynie kontekst. The book addresses the problem of the influence of copyright law on modern modes of functioning and understanding of literature. This problem is situated in a context of Law and Literature studies and in particular within the cultural studies of copyright, which are summarised in chapter one. The history of copyright law and related literary discussions is recapitulated in chapter two. In the next chapters, the analysis is focused on literary discussions in which copyright law is a directly posed problem, or it is indicated only as context. Particular attention is paid to: philological genealogical research (and texts by Wacław Borowy and John Livingstone Lowes); discussion surrounding T.S. Eliot’s poem ‘The Waste Land’; the debate provoked by Karol Irzykowski’s article ‘Plagiatowy charakter przełomów literackich w Polsce’ [‘The Plagiarising Character of Literary Breakthroughs in Poland’]; analysis of copyright law in the writings of Jacques Derrida and in the novel Muza dalekich podróży [The Muse of Long-Distance Travels] by Teodor Parnicki; finally, anthologies Future of Copyright published at the beginning of the twenty-first century in Poland. In the last chapter, the analysed problems are situated in the context of the debate on the commodification of literature in capitalist societies.

W poznańskim Centrum Kultury Zamek 28 maja 2014 roku odbyła się premiera spektaklu Teren badań: Jeżycjada w reżyserii Weroniki Szczawińskiej. 3 czerwca Małgorzata Musierowicz złożyła do sądu wniosek o zarejestrowanie słownego znaku towarowego „Jeżycjada”, do czego doszło 20 kwietnia 2015 roku.
