Aufgrund des Beschlusses des österreichischen Verfassungsgerichtshof am 11. Dezember 2020 wurde der Strafbestand der „Hilfeleistung zum Selbstmord“, § 78 des Strafgesetzbuches, als verfassungswidrig erklärt. Entscheidungsgrund ist das verfassungsrechtlich verankerte Recht auf Selbstbestimmung. Das wirft die Frage der reflektiven und kritischen Positionierung der Sozialarbeit zur Thematik der Sterbehilfe auf, und deren Herausforderungen. Laut den Aussagen der Professionen – insbesondere, aber nicht ausschließlich der Medizin, dem Hospiz & Palliativ-Care, die Bioethikkommission Österreich, die Österreichische Gesellschaft für ein humanes Lebensende (ÖGHL), den schweizerischen Vereinen EXIT und DIGNITAS und die Soziale Arbeit als Menschenrechtsprofession – kann die Legalisierung eines assistierten Suizid eine Gefahr für vulnerable Menschen in Krisensituationen darstellen. Das Suizidrisiko steigt mit dem Anstieg des Alters an, jedoch ist die Suizidprävention mangelhaft mit Ressourcen ausgestattet. Menschen hohen Alters haben ein erhöhtes Risiko, physisch und psychisch krank zu werden, soziale und familiäre Netzwerke sind vulnerabel und schwerer zu ersetzen, und das gesellschaftliche Bild über das Alter ist verzerrt. Die Soziale Arbeit hat noch keine als Profession selbstständige und einheitliche Positionierung zur Thematik der Sterbehilfe formuliert. Die Gefahr besteht, dass die Soziale Arbeit unreflektiert und unkritisch Positionen anderer Professionen übernimmt. Außerdem ist die Soziale Arbeit als Menschrechtsprofession dazu verpflichtet, die Selbstbestimmung und die Autonomie der Patient*innen zu schützen. Das Fehlen einer eindeutigen Positionierung stellt daher beim Ausführen der Aufgaben der Sozialen Arbeit eine Herausforderung für die Profession dar. Die Soziale Arbeit hätte bei einer gemeinsamen Positionierung eine Chance bei der Debatte und dem Diskurs über die Sterbehilfe Stellung zu beziehen und somit diesen mitzugestalten. Based on a decision of the Austrian Constitutional Court on December 11th, 2020, the punishment of “assisted suicide” – recorded in Paragraph 78 of the Austrian Criminal Code – was declared unconstitutional. The reasoning behind this decision is the constitutionally embedded right of self-determination. This raises the question of the reflected and critical position of social work regarding euthanasia and its challenges when dealing with this topic. According to statements of professionals - especially but not exclusively in the fields of medicine, hospice & palliative care, the Austrian Bioethics Committee, the Österreichische Gesellschaft für ein humanes Lebensende (ÖGHL), Swiss Organisations like EXIT and DIGNITAS and Social Work as human rights profession – legalising assisted suicide can pose a threat for vulnerable people in crisis situations. The risk of suicide increases with age, but suicide prevention is insufficiently equipped with resources. Elderly people have an increased risk of becoming physically or mentally ill, social, and family networks are vulnerable and more difficult to replace, and the societal picture of elderly people is distorted. Social Work as a profession does not yet have an independent and uniform position about euthanasia. There is a risk that Social Work will unreflectively and uncritically take over positions from other profession. Moreover, as a human right profession social work is obliged to protect the right of self-determination and autonomy of its clients. The lack of a clear position poses a challenge for the profession when performing its tasks. When there is a uniform position regarding euthanasia, Social Work has the chance to take part in the discussion and effectively shape it.

From the first contacts with Rome in 146 B.C. until the end of the reign of Septimius Severus in 211, African cities received legal privileges from the Senate or emperors, the most coveted of which was libertas. The third and most important movement came after Caesar’s victory at Thapsus, which put an end to the old libertas and promoted others, increasing the total number of free cities from seven to thirty, all included in the formula provinciae. Finally, the last one is the emancipatory movement of Septimius Severus, which gave birth not to free peregrine cities, but exclusively to free municipalities. This paper examines the third volume of the “Homo sacer” series of Giorgio Agamben, Remnants of Auschwitz. The Witness and the Archive (1998). It shows that his controversial thesis on the paradox of the testimony of Auschwitz and the idea of an “unimaginable” involve a technical concept of image, specific of Agamben’s tought. It asserts that the paradoxical dialectic of visibility and invisibility of bare life’s Muslim described in this book is based on a critical reception of the greek prosopon, the iconography of the Gorgon and roman idea of dignitas. This paper, finally, shows the relevance of this critical reception in the border context of Agamben´s theory of image. Este trabajo analiza el tercer volumen de la serie “Homo sacer” de Giorgio Agamben, Quel che resta di Auschwitz. L’archivio e il testimone (1998), para mostrar que sus controvertidas tesis sobre la paradoja del testimonio de Auschwitz y la idea de que éste es “inimaginable” implican un concepto técnico de la imagen propio de su pensamiento. Para ello, muestra cómo la paradójica dialéctica de visibilidad e invisibilidad de la vida desnuda del musulmán que describe este libro, se basa en una crítica y reelaboración del concepto de imagen contenido en la categoría griega de prósopon, la iconografía de la Gorgona y la idea romana dignitas. El trabajo busca por último resituar estas tesis en el contexto más general del problema de la imagen en otras investigaciones de Agamben.

This paper has a twofold aim. First of all, the idea is to provide an exhaustive bibliographical overview of historical novels set in the period between the Roman civil wars and AD 476. We need to make it clear: the speech can be considered primarily a brilliantly executed statement of one of the important fundamental postulates of Cicero's philosophy of the state rather than a lawyer's or orator's achievement. Pro Sestio is the first occasion on which Cicero, having returned from exile, was able to formulate his program of rethinking the idea of a res publica harrowed by civil strife and the preserving-renewing reorganisation of the state. In this speech Cicero clearly takes a stand for Sulla's "constitution", that is, for what he interpreted as Sulla's constitution: An argument for strengthening the position of the senate meant to govern the state. His defendant was acquitted, owing not only to the brilliant handling of the facts of the case, but most probably also to the political program presented in the speech with such exhaustive details: A captivating pathos that won his audience's approval.

Ardından kavramın Eski Yunan’daki, Roma’daki, Orta Çağ’daki ve Yeni Çağ’daki görünümleri incelenmiştir., Today human dignity is an indispensable concept of human rights. However, the concept has been used in different meanings in different periods. In the study, firstly the definitions of the concept of human dignity was discussed. In this section both judicial decisions and UN documents were used. Then the outlook of the concept in Ancient Greece, Rome, the Middle Age and the Modern Age was examined.

El presente texto responde a la pregunta, ¿Cuáles criterios y conceptos deberíamos, querríamos, y sobre todo, podríamos ser capaces de explicar, entender y transformar a fin de diseñar, y sobre todo, ejecutar eficaz y eficientemente una política pública de vivienda digna basada en criterios de responsabilidad social? El autor asume una postura epistemológica socio-crítica, basada en una metodología de investigación holística; sus principales hallazgos consisten en descubrir la delusión arquitectónica de la forma por la forma y en cómo utilizar la hermenéutica diatópica como antídoto a la misma. Por tanto, sus conclusiones están presentadas a manera de no-acuerdos, como punto de partida entre varios autores, el autor y el lector y su relevancia se basa en la posibilidad de restablecer la resiliencia y la dignidad como los nuevos criterios para definir la sustentabilidad, tanto de la forma como en el comportamiento de los seres humanos, y por supuesto, de su vivienda “digna” en un contexto de responsabilidad social. Il faut y voir une explication dans la nature même de la société romaine de cette période, hautement compétitive et concurrentielle. L’exacerbation des rivalités aristocratiques à la période tardo-républicaine se caractérise en effet par la recherche toujours plus effrénée des honneurs et des marques de distinction. Le fait que cette réflexion collective sur le prestige à Rome a été précédée par la publication des actes d’un colloque consacré au même sujet (voir Hurlet, Rivoal, Sidéra, Le Prestige. Autour des formes de la différenciation sociale, De Boccard, 2014), mais appliqué à un cadre interdisciplinaire plus large présente un avantage certain, celui de fournir un fondement théorique à une notion souvent utilisée par les antiquisants, mais jamais vraiment définie. L’introduction du premier volume interdisciplinaire sur le prestige a ainsi déjà souligné que l'usage de la notion de prestige pose bien entendu le problème classique de l’équivalence d’une notion contemporaine avec la terminologie antique, grecque et romaine. On en reprendra les deux résultats qui ont été de montrer que deux conceptions du prestige se croisent et se recoupent, dans le monde contemporain comme dans l'Antiquité. La première renvoie à l’idée que le prestige est lié à un statut déterminé d’un individu ou d’un groupe d’individu ou à un attribut (le prestige du sénateur ou celui de l’uniforme par exemple), tandis que la seconde désigne les procédés et les manifestations publiques permettant d’afficher sa distinction sociale et de la rendre visible de manière à se voir reconnaître du prestige ou tout simplement à le maintenir (par exemple le prestige qui consiste à participer à une manifestation importante à une place d’honneur). En d’autres termes, le prestige renvoie autant à un statut déterminé qu’à une performance, l’un et l’autre se complétant plus qu’ils ne s’opposent.
