Straipsnyje analizuojamos juridinių asmenų nemokumo proceso inicijavimo stadijos problemos. Naujasis Juridinių asmenų nemokumo proceso reguliavimas, kuris įsigaliojo 2020 m. sausio 1 d., reformavo Lietuvos Respublikos bankroto ir restruktūrizavimo procesus ir nustatė naują nemokumo proceso inicijavimo tvarką. Taip pat analizuojama, kaip nauja juridinių asmenų nemokumo proceso inicijavimo tvarka suderinama su nemokumo proceso veiksmingumo tikslu. Aptariama, kokie asmenys turi teisę ar pareigą inicijuoti nemokumo procesą. Straipsnyje keliamas klausimas, kokias pareigas įmonei susidūrus su nemokumo problemomis ir inicijuojant nemokumo procesą turi įmonės vadovas ir kokia tvarka šios pareigos turi būti vykdomos. Straipsnyje nagrinėjama, kokia tvarka turi būti inicijuojamas nemokumo procesas, siunčiami pranešimai apie ketinimą inicijuoti šį procesą. Nustatyta, kad įstatyme reglamentuojama informavimo apie ketinimą inicijuoti nemokumo procesą tvarka yra formali, neskatina skolininko ir kreditorių bendradarbiavimo, neužtikrina realaus informavimo garantijų. Autoriai taip pat nagrinėja naują susitarimo dėl pagalbos institutą nemokumo teisėje. Straipsnyje teigiama, kad tokio susitarimo tikslas yra sudaryti sąlygas skolininkui ir kreditoriams susitarti dėl skolininko prievolių modifikavimo, kad būtų išvengta formalių nemokumo procedūrų. In this article, its authors analyze problems of the commencement of the insolvency proceedings of legal entities. The new regulation on the insolvency proceedings of legal entities, which entered into force in January 1, 2006, reformed the bankruptcy and restructuring proceedings of the Republic of Lithuania and established a new order for the commencement of insolvency proceedings. The article analyzes how the new procedure of the commencement of the insolvency proceedings of legal entities is compatible with the goal of making insolvency proceedings more efficient. It discusses which individuals have the right or obligation to initiate insolvency proceedings. The article also focuses on what duties directors have in the event of insolvency and the initiation of insolvency proceedings and in what order must these duties be performed. The article examines the procedure of the commencement of insolvency proceedings and sends notifications of the intention to initiate such proceedings. It has been established that the procedure of information on the intention to commence insolvency proceedings regulated by the law is formal, does not promote cooperation between the debtor and creditors, and does not ensure guarantees of the addressee’s real information. The authors also analyze the new workout institute in insolvency law. The article suggests that the aim of procedure is to enable the debtor and the creditors to agree on a modification of the debtor’s obligations in order to avoid formal insolvency proceedings.
