يريد أن يقدم الباحث في هذا المقال مساهمة من أجل تأسيس مقاربة إشكالية حول المعرفة الفقهية و الحداثة و المواطنة في أفق الفضاء الحضاري العربي الإسلامي. ينطلق المقال من المفارقة التالية : الحداثة و المواطنة قد تَشكَّلَتَا في الفضاء الحضاري الغربي ضمن محدداته الأصيلة ؛ لكن لم تتشكلا حتى الآن في الفضاء الحضاري العربي الاسلامي؛ ليتساءل على ضوء هذه المفارقة : ماهي العوائق التي حالت دون هذا البزوغ و التشكل ؟ يهتم المقال بأحد أوجه هذه العوائق، المتمثلة في البنى الذهنية و الفكرية المنتجة للفكر العربي الإسلامي الحديث، و بالتحديد تلك البنى الذهنية و الفكرية المتعلقة بالحقل الفقهى. ينتقل المقال، استنادا على منهجية تأويلية بنيوية (مضمرة implicite)، عبر ثلاثة لحظات لتأسيس استنتاجاته : يحاول أولا تحديد مفهومي الحداثة و المواطنة ضمن فضاء الانتماء و التأصيل، ليحلل بعد ذلك مسألة إنتاج المعرفة (عامة) و المعرفة الفقهية (خاصة) في مجال تأصيلها الحضاري محاولا في اللحظة الثالثة القيام بتفكيك بنيوي للمجال الفكري و الذهني المتعلق بالحقل الفقهي مستندا على نتائج بحوث سابقة عليه، ليخلص أخيرا إلى مصارحة الذات من خلال وضع في مجالها الإدراكي العناصر البنيوية المعيقة لأي مسعى يُمَكِّن من التحول النوعي لبنى الفكر العربي الإسلامي الذي يتطلبه العصر الـحديث. Le chercheur essaie à travers cet article de présenter une contribution pour instituer une approche problématique sur la connaissance du « fiqh », de la modernité et la citoyenneté dans l’aire civilisationnelle arabo-musulmane.Se basant sur le paradoxe suivant : la modernité et la citoyenneté se sont constituées dans l’espace civilisationnel occidental à partir de ses déterminations originelles, mais ces catégories n’ont pu se constituer que dans l’espace civilisationnel arabo-musulman. Prenant en considération ce paradoxe, l’article s’interroge sur les obstacles qui empêchent cette constitution ? Il s’intéresse aussi à un aspect de ces obstacles, représenté par les structures intellectuelles et mentales qui ont produit la pensée arabo-musulmane moderne, et en particulier les structures intelectuelles et mentales en rapport avec le champ du « fiqh ».A partir d’une méthodologie structuralo-herméneutique implicite, l’article parcourt trois moments en vue de fonder ses conclusions, il essaie d’abord à définir les concepts de modernité et de citoyenneté à travers l’espace d’appartenance et de fondation, puis il analyse la question de la production de la connaissance (en général) et la connaissance du fiqh (en particulier) dans le champ de fondation civilisationnelle, tout en essayant en dernier, de déconstruire les structures du champ intellectuel et mental de la production du fiqh. En s’appuyant sur les résultats réalisés par d’autres travaux de recherche, il conclut enfin à l’autofranchise en mettant en évidence les éléments structurels qui rendent impossible toute tentative de transformation qualitative des structures de la pensée arabo-musulmane, qui répond aux exigences des temps modernes. The research worker has tried throughout this article to give a contribution in establishing a problematic approach on the knowledge of “fiqh”. Learning and science of religious Islamic law covering all aspects of life, from modernity and citizenship in the arab, moslem civilisational area.Based on the following paradox, modernity and citizenship established them selves in a western civilisational spare springing from original resolutions, but these categories could only form themselves in the civilisational arab, moslem space.Considering this paradox, the article questions the obstacles which prevent this forming ?It is also interested in the aspect of these obstacles, represented by intellectual and mental structures which produced modern arab, moslem thinking, and in particular the intellectual and mental structures related to the domain of “fiqh”.From an implicit structural hermeneutical methodology, this article covers three points with a view to founding its conclusions, firstly it tries to define space of belonging and institution, then it analyses the question of producing knowledge (in general) and the knowledge of “figh” (in particular) in the civilisational field of institution, while trying lastly, to dismantle the intellectual and mental field structures producing “fiqh”. By relying on the results achieved by other research work, and finally concluding in all self frankness putting structural elements in evidence which make all attempts at a qualitative transformation of arab – moslem thought structures answering the demands of modern times impossible. El investigador trata, a través de este artículo, presentar una contribución para instituir una aproximación probmemàtica sobre el conocimiento del "fiqh" de la modernidad y la ciudadanía en el àmbito de la civilización arabo-musulmana.Basàndose en la paradoja siguiente :la modernidad y la ciudadanía se han constituído en el espacio civilizacional occidental a partir de sus determinaciones originales, pero estas categorías no pudieron constituirse en el espacio civilizacional arabo-mususlmàn.Considerando esta paradoja, el artículo se interroga sobre los obstàculos que impiden esta constitución ?Se interesa incluso por un aspecto de estos obstàculos, representado por las estructuras intelectuales y mentales que han producido el pensamiento arabo-musulmàn moderno, y particularmente las estructuras intelectuales y mentales modernas con respecto al campo del"fiqh". A partir de una metodología estructuralo-hermeneùtica implícita, el artículo recorre tres mommentos con vista a fundamentar sus conclusiones. Trata primero, definir los conceptos de modernidad y de la ciudadanía a través del espacio de pertenecencia y de fundación, luego analiza la cuestión de la producción del conocimiento (en general) y el conocimiento del "fiqh" (en particular), en el campo de la fundación civilizacional, intentando por ùltimo desconstruir el campo intelectual y mental de la producción del fiqh, apoyàndose en los resultados realizados por otros trabajos de investigación.Se concluye por fin, con la autofranqueza poniendo en evidencia los elementos estructurales que hacen imposible cualquier tentativa de transformación cualitativa de las estructuras del pensamiento arabo-musulmàn que responde a las exigencias de los tiempos modernos.
