This book introduces experiential knowledge of the intersectionality of disability, sexuality, and gender equality issues. Scholars and disabled persons’ organizations in different Asian countries such as China, Vietnam, Myanmar, Nepal, and Japan have contributed to the book. It is a preliminary introduction of the frontline practice of Asian disability activism and the experience of women and LGBTIQ people with disabilities. It presents the direct participation of disability advocates in mapping how both women with disabilities and LGBTIQ individuals with disabilities realize their rights such as identity, work rights, personal safety, and sexual rights. Studies presented here explore the experience of empowering diverse disability groups and advocating for equality and non-discrimination. It explains how to use the leverage of the Convention on the Rights of Persons with Disabilities (CRPD) for further human rights campaigns in a broader context for disadvantaged groups. This collection is the product of a participatory research project, which aims to increase the capabilities of local disabled persons’ organizations and NGOs in utilizing human rights laws and encourage dialogue and collaboration between academia, people with disabilities, and human rights advocates. It will be essential reading for academics, researchers, policy-makers, and campaign groups.

Socio-technical systems such as video conferencing, digital care work platforms, and electronic health records are taking an increasing role in mental health-related law, particularly since the COVID-19 pandemic. Reflecting on these experiments can help navigate an increasingly digital future for mental health services and the laws that govern them. This chapter looks to England and Wales, where an explicit policy aim to ‘digitise the Mental Health Act’ has seen three key developments: (1) remote medical assessments of persons facing involuntary intervention, (2) the remote operation of tribunals that authorise involuntary interventions, and (3) and the rise of digital platforms for Mental Health Act assessment setup. The chapter argues that although courts appear responsive to the issues posed by the first two developments, there appear to be less obvious oversight of digital platforms used to setup mental health crisis work. The chapter considers legal issues raised by ‘digitising mental health legislation’ and draws in a political economy perspective to reflect on the role of the private sector in emerging configurations of digitised health and social services. It recommends attention to safeguards in both the procurement and commissioning of private sector practices concerning mental health crisis work and in the proliferation of digital platforms in health and social care services.

Philipp Jaud explores the compatibility of personal data as an economic asset with the European Union's Charter of Fundamental Rights. By analysing the nuanced nature of personal data, the contextual interpretation of the Court of Justice of the EU is brought into focus, with the author delving into data monetisation, profiling, and breaches to highlight the variable value of personal data. Emphasising data subjects' rights, ownership debates and proposals for legal frameworks are discussed, while legislative responses and challenges in the digital age are scrutinised and a balanced approach is advocated for. The Charter's applicability to economic data use is explored, underlining fairness, transparency, and consent. The conclusion allows the reader to contemplate the potential alignment of economic data use with the Charter, accentuating individual autonomy within evolving legal frameworks and societal consciousness.

Religionsunterricht ist nach dem Grundgesetz ordentliches Lehrfach in den öffentlichen Schulen, doch die Zugehörigkeit der Schülerinnen und Schüler zu einer Religionsgemeinschaft ist inzwischen alles andere als selbstverständlich. Das hat Auswirkungen auf die Gestaltung religiöser Bildung an öffentlichen Schulen, auf ihre Inhalte, ihre Didaktik, aber zunehmend auch auf ihre Organisation. Die beiden christlichen Kirchen in Niedersachsen arbeiten an einem neuen Reformmodell, einem von beiden Kirchen gemeinsam verantworteten christlichen Religionsunterricht. Dieser soll über die bisherigen Kooperationsansätze hinausgehen und wirft zahlreiche verfassungs- und kirchenrechtliche, aber auch theologische, insbesondere religionspädagogische Fragen auf. Der vorliegende Band greift diese Herausforderungen auf, dokumentiert bestehende Kontroversen und fragt nach den weiteren Perspektiven.

The UN human rights treaty bodies are still in need of reform, since past initiatives were not as successful as hoped. Therefore, to secure the effective dischargement of their various mandates, particularly under the reporting procedure, the Committees need to be reformers on their own. Nils-Hendrik Grohmann delineates the Committees' powers from both a practical and theoretical perspective and demonstrates how far their legal mandates can reach. Effectiveness-orientated interpretation of procedural provisions that already endow the Committees with certain powers, allows for the extension of mandates. Thereby, the Committees can introduce new powers without State consent. In doing so, they are well-advised to approach the reporting procedure holistically, to develop coherent procedural approaches and to take into consideration the considerable overlap in terms of substantive provisions under the nine UN human rights treaties. Another key factor for reform is cooperation itself among the Committees, which increased in recent years through the Meeting of Chairpersons. Dabei handelt es sich um automatisierte Profile in sozialen Netzwerken, die unter Vortäuschung einer menschlichen Identität am Kommunikationsprozess teilnehmen. Aus verfassungsrechtlicher Perspektive verdeutlichen Social Bots die normativen Konfliktlinien, die der "digitale Strukturwandel der Öffentlichkeit" mit sich bringt: Einerseits verdient auch automatisierte und anonyme Kommunikation grundsätzlich den Schutz der Meinungsfreiheit. Gleichzeitig verzerren Social Bots die öffentliche Meinungsbildung und stehen damit im Konflikt mit dem Prinzip kommunikativer Chancengleichheit. Paul Dürr entwickelt dogmatische Lösungskonzepte, um die Risiken digitaler Manipulationsformen verfassungsrechtlich abzubilden und Regulierungsinitiativen angemessen zu bewerten.

This collection examines case-based reasoning in constitutional adjudication; that is, how courts decide on constitutional cases by referring to their own prior case law and the case law of other national, foreign, and international courts. Argumentation based on judicial authority is now fundamental to the resolution of constitutional disputes. At the same time, it is the most common form of reasoning used by courts. This volume shows not only the strengths and weaknesses of such argumentation, but also its serious methodological shortcomings. The book is comparative in nature, with individual chapters examining similar problems that different courts have resolved in different ways. The research covers three types of courts; namely the civil law constitutional courts of Germany, Italy, Poland, Lithuania, and Hungary; the common law supreme courts of the United States, Canada, and Australia; and the European international courts represented by the European Court of Human Rights and the Court of Justice of the European Union. The authors are distinguished scholars from various countries who specialise in constitutional justice issues. This book explores the relationship between populism or populist regimes and constitutional interpretation used in those regimes. The volume discusses the question of whether contemporary populist governments and movements have developed, or encouraged new and specific constitutional theories, doctrines and methods of interpretation, or whether their constitutional and other high courts continue to use the old, traditional interpretative tools in constitutional adjudication. Divided into four parts, Part I contains three chapters elaborating the theoretical basis for the discussion. Part II examines the topic from a comparative perspective, representing those European countries where populism is most prevalent, including: Austria, Croatia, the Czech Republic, Greece, Hungary, Italy, Poland, Romania, Spain, and the United Kingdom. Part III extends the focus to the United States, reflecting how American jurisprudence and academia have produced the most important contributions to the theory of constitutional interpretation, and recent political developments in that country might challenge the traditional understanding of judicial review. This section also includes a general overview on Latin America, where there are also some populist governments and strong populist movements. Finally, the editors’ closing study analyzes the outcomes of the comparative research, summarizing the conclusions of the book.

This book focuses on the neglected yet critical issue of how the global migration of millions of parents as low-waged migrant workers impacts the rights of their children under international human rights law. The work provides a systematic analysis and critique of how the restrictive features of policies governing temporary labour migration interfere with provisions of the Convention on the Rights of the Child that protect the child-parent relationship and parental role in children’s lives. Combining social and legal research, it identifies both potential harms to children’s well-being caused by prolonged child-parent separation and State duties to protect this relationship, which is deliberately disrupted by temporary labour migration policies. The book boldly argues that States benefitting from the labour of migrant workers share responsibility under international human rights law to mitigate harms to the children of these workers, including by supporting effective measures to maintain transnational child-parent relationships. It identifies measures to incorporate children’s best interests into temporary labour migration policies, offering ways to reduce interferences with children’s family rights. This book fills a gap that emerges at the intersection of child rights studies, migration research and existing literature on the purported nexus between labour migration and international development. It will be a valuable resource for academics, researchers and policymakers working in these areas.

The essay analyses the principle of mutual recognition as a legal technique of coordination of the Member States’ legal systems. We examine its ability of ensuring effectiveness of the individual’s fundamental rights and of favouring the European integration. The study of the principle is both static and dynamic. From a static standpoint, the analysis attempts to delineate the anatomy of mutual recognition, identifying its legal nature, its distinctive features in each of the three areas of its implementation (internal market, judicial cooperation in civil and criminal matters) and the variable geometry that characterises its application. From a dynamic point of view, the research examines the principle of mutual recognition as a technique for coordinating the legal systems of the Member States, in both its horizontal and vertical dimension.

Der Einsatz automatisierter Accounts in sozialen Online-Netzwerken, oftmals als "Social Bots" oder "Political Bots" bezeichnet, erregte im Vorfeld verschiedener politischer Großereignisse internationale Aufmerksamkeit und markiert einen Höhepunkt der voranschreitenden Digitalisierung des Politischen. Die durch die Automatisierung entstehende Möglichkeit zur praktisch unbegrenzten Verbreitung einzelner Meinungen schafft das Risiko einer Manipulation der Meinungsbildung von Rezipienten und folglich einer Verzerrung des Kommunikationsprozesses. Lennart Laude untersucht den Einsatz der neuen Kommunikationsmittel mit Fokus auf die Interpretation des Art. 5 Abs. 1 GG und legt dar, welche rechtliche Bewertung für Versuche automatisierter Meinungsbeeinflussung angezeigt ist. Die Arbeit wurde 2021 mit dem Preis des Schleswiger Forums für eine herausragende Dissertation auf dem Gebiet des Öffentlichen Rechts ausgezeichnet.

A unique political animal, the European Union has given rise to important constitutional conundrums and paradoxes that John Erik Fossum and Agustín José Menéndez explore in detail in this book. The authors consider the process of forging the EU's constitution and the set of fundamental norms that define the institutional structure, the decision-making procedures, and the foundations of the Union's democratic legitimacy. Their analysis illuminates the distinctive features of the EU's pluralist constitutional construct but also the interesting parallels to the Canadian constitutional experience and provides the tools to understand the Union's development, especially during the Laeken (2001–2005) and Lisbon (2007–2009) processes of constitutional reform.

This collection of essays arose from a conference held to mark the silver anniversary of the Australian Sex Discrimination Act (1984). The collection has two aims: first; to honour the contributions of both the spirited individuals who valiantly fought for the enactment of the legislation against the odds, and those who championed the new law once it was passed; secondly, to present a stock-take of the Act within the changed socio-political environment of the 21st century. The contributors present clear-eyed appraisals of the legislation, in addition to considering new forms of legal regulation, such as Equality Act, and the significance of a Human Rights Act. The introduction of a proactive model, which would impose positive duties on organisations, is explored as an alternative to the existing individual complaint-based model of legislation. The contributors also pay attention to the international human rights framework, particularly the Convention on the Elimination of all Forms of Discrimination against Women and the UN Declaration on the Rights of Indigenous People. The essays are illuminated by recourse to a rich vein of historical and contemporary literature. Regard is also paid to the comparative experience of other jurisdictions, particularly the UK and Canada.

This book investigates the problems and possibilities of plural legal orders through an in-depth study of the relationship between the state and customary justice systems in Vanuatu. It argues that there is a need to move away from the current state-centric approach to law reform in the South Pacific region, and instead include all state and non-state legal orders in development strategies and dialogue. The book also presents a typology of models of engagement between state and non-state legal systems, and describes a process for analysing which of these models would be most advantageous for any country in the South Pacific region, and beyond.

Discipline processuali differenziate nei diritti amministrativi europei. Anyone in Europe who considers that they have suffered an abuse of power on the part of a public body can apply to a judge for justice. But this role is not restricted to a single judge. Not only is there a plurality of judges corresponding to the plurality of States in which they exercise their functions, but also (in the majority of cases) within each State there is more than one type of judge appointed to impose respect of the law even on public bodies, just as the procedures and manner in which the judicial action may materialise are also different. The protection of the citizens is differentiated, and this can be explained by the varying requirements or the different motivations which cannot always justify the deriving complications. The book explores this phenomenon, considering some of the principal European State systems, as well as the system of the European Union itself.

Divided into seven thematic sections – Sources, Gender, Age, Disability, Nationality, Race and ethnic origin, Religion and personal convictions – this collection sets up a direct comparison between European legislation and jurisprudence and the Italian enactment decrees. In this manner the editors, Chiara Favilli and Maria Paola Monaco, propose both to academics and to those working in the sector an innovative and useful instrument for combating discrimination on the grounds of gender, race, ethnic group, religion, age or sexual orientation.

The Western and Central Pacific Ocean is home to the largest tuna fishery in the world – around half of the world’s tuna supply – and is a vital economic resource for Pacific island countries. The potential of the Pacific tuna fishery to contribute to economic development in the Pacific island countries is enormous, but will require a cooperative regional strategy to maximise access fees from distant water fishing nations, as well as targeted domestic policy and legislation to encourage local fishing industries. Together with the importance of acting strategically with regard to such a variable resource, the lesson of fisheries management globally is that it is most effective when it takes into consideration social, cultural and political contexts. Based on an extensive study of six Pacific island states, Capturing Wealth from Tuna maps out the aspirations and limitations of six Pacific island countries and proposes strategies for capturing more wealth from this resource in a sustainable and socially equitable manner.

Of the many challenges in public sector management, few are as complex as the management of whistleblowing. Because it can lead to the discovery and rectification of wrongdoing, public interest whistleblowing is widely acknowledged as being positive for organisations and for society at large. However, the conflicts and reprisal risks often associated with whistleblowing also support a widespread belief that every whistleblower is destined to suffer, and nothing can be done to protect them from reprisals. Even if they did it once, sensible employees are often seen as unlikely to ever blow the whistle a second time around. The extensive research in this book reveals a more complex and, fortunately, more positive picture. The product of one of the world’s most comprehensive research projects on whistleblowing, evidence from over 8,000 public servants in over 100 federal, state and local government agencies shows that whistleblowers can and do survive, and that often their role is highly valued. Public sector managers face significant challenges in better managing and protecting whistleblowers. There is great variation between the many public agencies making the effort, and the many agencies where the outcomes — for managers and whistleblowers alike — are still likely to be grim. This book is compulsory reading for all public sector managers who wish to turn this negative trend around, and for anyone interested in public accountability generally.

Indigenous rights to heritage have only recently become the subject of academic scholarship. This collection aims to fill that gap by offering the fruits of a unique conference on this topic organised by the University of Lapland with the help of the Office of the High Commissioner for Human Rights. The conference made clear that important information on Indigenous cultural heritage has remained unexplored or has not been adequately linked with specific actors (such as WIPO) or specific issues (such as free, prior and informed consent). Indigenous leaders explained the impact that disrespect of their cultural heritage has had on their identity, well-being and development. Experts in social sciences explained the intricacies of indigenous cultural heritage. Human rights scholars talked about the inability of current international law to fully address the injustices towards indigenous communities. Representatives of International organisations discussed new positive developments. This wealth of experiences, materials, ideas and knowledge is contained in this important volume.

Art. 22 of the Afghan constitution contains: “The citizens of Afghanistan, man and woman, have equal rights and duties before the law.” According to Art. 7 of the constitution the state shall observe i. a. the international treaties to which Afghanistan has joined. This also covers the Convention on the Elimination of All Forms of Discrimination against Women. At the same time, Art. 3 of the constitution provides that no law should contravene the tenets and provisions of the holy religion of Islam in Afghanistan. But how do these different sources of law interact in conflicting legal fields? There are no exiting provisions of the constitution explicitly offering an answer to this problem. This work focuses on the solution of this question regarding the status of women, especially in the law of divorce.

Hingegen legt Art. 3 der Verfassung fest, dass kein Gesetz dem Glauben und den Bestimmungen der heiligen Religion des Islam widersprechen darf. Doch in welchem Verhältnis stehen diese Rechtsquellen im Falle einer Normenkollision? Explizite Verfassungsbestimmungen hierzu existieren nicht. Im Zentrum der Untersuchung der vorliegenden Arbeit steht die Klärung dieses Verhältnisses betreffend die Stellung der Frau, im Speziellen im Scheidungsrecht.

Das neue Gendiagnostikgesetz vom 31. Juli 2009 wirft im Spannungsfeld divergierender Perspektiven, insbesondere im Zwiegespräch von Humangenetik und Rechtswissenschaften bedeutsame Fragen u.a. über die Ausgestaltung der genetischen Beratung, die Aufgaben der neu geschaffenen Gendiagnostikkommission oder hinsichtlich der vorgeburtlichen genetischen Diagnostik auf. Zugleich stehen auch die klassischen arztrechtlichen Aspekte der ärztlichen Aufklärung und Einwilligung sowie solche aus dem Bereich des Datenschutzes im Mittelpunkt des Interesses. Dieses facettenreiche Spektrum an Fragestellungen war im November 2010 Gegenstand eines Göttinger Workshops zum Medizinrecht, gemeinsam veranstaltet vom Institut für Humangenetik (Medizinische Fakultät) und vom Zentrum für Medizinrecht (Juristische Fakultät). Die Beiträge und Ergebnisse dieser Fachtagung werden im vorliegenden Band der interessierten Öffentlichkeit zugänglich gemacht.

The reception and popularity of the work of Emmanuel Joseph Sieyès has gone through different and erratic phases. Nonetheless, in recent years there has been a remarkable revival of interest in the Abbé's thought. This book is intended to exploit this Sieyès-renaissance, proposing a reconstruction of the constitutional doctrine of the abbot in the light of the latest interpretative acquisitions. The guiding thread of the analysis is the acknowledgement that, underlying the main political-constitutional proposals of Sieyès, we can glimpse a profoundly rationalist philosophical substructure. After presenting the nucleus of this philosophical approach, the book proceeds to shed light on the coherence linking the main constitutional structures upon which the abbot was working in the course of the early years of the Revolution. It focuses in particular on the concepts that contributed to make up the basic grammar of modern and liberal constitutionalism: representation, citizenship, constituent power, rights of man, the division of the powers and the control of constitutionality. The idea is that, by pursuing this approach, it is possible to arrive at an overall picture of the constitutional doctrine of the abbot that reflects both its systematic quality and its originality., La ricezione dell'opera di Emmanuel Joseph Sieyès ha conosciuto diverse ed alterne fasi. Nel corso degli ultimi anni, tuttavia, si è assistito ad un notevole ritorno di interesse per il pensiero dell'abate. Il volume intende inserirsi sulla scia di questa Sieyès-renaissance proponendo una ricostruzione della dottrina costituzionale dell'abate alla luce delle ultime acquisizioni interpretative. Il filo rosso che guida l'analisi è il riconoscimento che alla base delle principali proposte politico-costituzionali di Sieyès vada scorta un'impostazione filosofica profondamente razionalista. Nel volume, dopo aver presentato il nucleo di questo approccio filosofico, viene messa in luce la coerenza che lega fra loro i principali istituti costituzionali sui quali l'abate lavora nel corso dei primi anni della Rivoluzione. Il libro si concentra, in particolare, sui concetti che hanno contribuito a formare la grammatica di base del costituzionalismo moderno e liberale: rappresentanza, cittadinanza, potere costituente, diritti dell'uomo, divisione dei poteri e controllo di costituzionalità. Seguendo questo percorso, si intende restituire un quadro complessivo della dottrina costituzionale dell'abate che ne rispetti la sistematicità e l'originalità.

Das Staatshaftungsrecht, das besser Öffentliches Haftungsrecht hieße, ist ein verrufenes Rechtsgebiet, chaotisch und zersplittert, ein "Flickenteppich" und ein "Durcheinander" zugleich. Diese Abhandlung sinnt auf Abhilfe. Sie schlägt eine neue Dogmatik vor, die das Öffentliche Haftungsrecht zu systematisieren sucht und der ein ökonomisch informierter und unionsrechtlich inspirierter Einheitsanspruch zu Grunde liegt. Der Einheitsanspruch berücksichtigt die Konvergenzen, die im herkömmlichen Staatshaftungsrecht zu beobachten sind, und nimmt Vorwürfe der Sach- und Zeitwidrigkeit auf, die gegen das überkommene Staatshaftungsrecht erhoben werden. Die Schrift wurde in Münster mit dem Habilitationspreis der Juristischen Studiengesellschaft und dem Nachwuchsförderpreis der Universitätsgesellschaft ausgezeichnet.
