The process of public assurance is a sequence of stages, following which you can obtain the right to use it, the service or the work, as a result of the award of a public procurement contract. The contracting authority carries out in the framework of the public insurance process various ways of awarding public service contracts in order to award contracts for products, services or works. On choosing the course of the process to make public, the contracting authority uses those qualification and/or selection criteria as well as award criteria, at different moments of the process. Most of the time in the development of the ways of assigning the specifics of the domain and the public ones, even specialists “impede” the understanding of three categories of previously mentioned criteria, and that is why it is necessary, on the one hand, to clarify the concepts of qualification criteria and/or of selection. and award criteria, and on the other hand it is necessary to identify the moment in which they are applied but also the way in which they are applied in this way depending on the method of award assumed by the contracting authority.

Objective: To advance the development of an ideal and sustainable framework agreement for the public procurement of vaccines in Spain, and to agree on the desirable award criteria and their relative weight. Methods: A multidisciplinary committee of seven health-care professionals and managers developed a partial multi-criteria decision analysis to determine the award criteria that should be considered and their specific weights for the public procurement of routine vaccines and seasonal influenza vaccines, considering their legal viability. A re-test of the results was carried out. The current situation was analyzed through 118 tender specifications and compared to the ideal framework. Results: Price is the prevailing award criterion for the public procurement of both routine (weighting of 60% versus 40% for all other criteria) and influenza (36% versus 64%) vaccines. Ideally, 22 criteria should be considered for routine vaccines, grouped and weighted into five domains: efficacy (weighting of 29%), economic aspects (27%), vaccine characteristics (22%), presentation form and packaging (13%), and others (9%). Per criteria set, price was the most important criterion (22%), followed by effectiveness (9%), and composition/formulation (7%). Regarding influenza vaccines, 20 criteria were selected, grouped, and weighted: efficacy (29%), economic aspects (25%), vaccine characteristics (20%), presentation form and packaging (16%), and others (11%). Per criteria set, price was also the most relevant criterion (19%), followed by composition/formulation (8%), and effectiveness (8%). Conclusions: Contrary to the current approach, technical award criteria should prevail over economic criteria in an ideal and sustainable framework agreement for the public procurement of vaccines.

The purpose of this article is to provide a concise analysis of the rules applicable to the rejection of abnormally low and non-compliant tenders in the European Union. The paper will deal with a case decided by the European Court of Justice which deals with violations of rights or fundamental freedoms regarding the (potential) irregularities of tenders. The study is exploratory and interpretative in nature. Data used for this research is secondary data: the author analyses prior research, regulations and decisions of the European Court of Justice and national authorities. The first section of this paper will examine the history and development of the institute of abnormally low tenders within the European Union and Slovenian positive law. The main research part of the paper is the analysis of the most relevant cases stemming from the European Court of Justice. Finally, the main scientific contribution of this paper, in addition to the analysis, is the de lege ferenda observations, which may contribute to resolving challenges related to abnormally low tenders in the EU. 11. Sustainability in subcontractor and supplier selection: Qualitative research on the effectiveness of environmental EMAT criteria on achieving sustainability in the selection of subcontractors and suppliers in the Dutch infrastructure sector

- Abstract
The rapidly growing infrastructure sector has a detrimental effect on climate change. The infrastructure sector is responsible for approximately 10% of worldwide emissions. In the past years, sustainability became more important in the procurement of infrastructure projects. One of the ways to implement sustainability in infrastructure projects is by award criteria in the tender phase of the project, called EMAT criteria, which stands for Economically Most Advantageous Tender. In this way, the client or procurer can determine the added value of the quality per contractor. So, the EMAT criteria is a way of tendering through the best quality/price ratio. Selecting a suitable subcontractor and supplier will considerably improve the professional services capabilities of the main contractor. Approximately 80 – 90 percent of large infrastructure projects are subcontracted. This means that to have a transition towards a sustainable sector, the subcontractors and suppliers must help too. This research, therefore, aims to generate insight into how the EMAT criteria influence the selection of subcontractors and suppliers A literature study and case study with three cases were performed in this research. The results of the case study show that the EMAT criteria influenced the selection of subcontractors and suppliers, especially when it comes to sustainability. The EMAT criteria are an incentive for the contractor to look at the sustainability level and development of the subcontractors and suppliers. When the client asks for sustainability in the tender through EMAT criteria, the contractor will use sustainability as one of the selection criteria for subcontractors and suppliers. Moreover, the importance of the EMAT criteria (read the percentage of deduction of the tender bid) influence the trade-offs between the selection criteria as well. 12. Off-Patent Biologicals and Biosimilars Tendering in Europe—A Proposal towards More Sustainable Practices

Background: In Europe, off-patent biologicals and biosimilars are largely procured by means of tender procedures. The organization and design of tenders may play a key role in the evolving biosimilar market, and currently, it is not fully elucidated how tenders for off-patent biologicals and biosimilars are designed and if approaches are aligned with sustaining market competition and societal savings for healthcare systems over the long term. This study aims to (i) explore the design and implementation of tender procedures for off-patent biologicals and biosimilars in Europe, (ii) identify learnings for sustainable tender approaches from purchasers and suppliers, and (iii) formulate recommendations in support of competitive and sustainable tender practices in the off-patent biologicals market. Methods: A mixed methods design was applied. A quantitative web-survey was conducted with hospital pharmacists and purchasers (N = 60, of which 47 completed the survey in full), and qualitative expert-interviews with purchasers and suppliers (N = 28) were carried out. Results: The web survey results showed that the organization and design of tenders for off-patent biologicals and biosimilars, and the experience of hospital pharmacists and purchasers with this, considerably varies on several elements across European countries. From the qualitative interviews, signals emerged across the board that some of the current tender approaches might negatively affect market dynamics for off-patent biologicals and biosimilars. The focus on generating short-term savings and existence of originator favouring tender practices were identified as elements that may limit timely competition from and market opportunity for biosimilar suppliers. The need to optimize tender processes, considering a more long-term strategic and sustainable view, was expressed. In addition, challenges appear to exist with differentiating between products beyond price, showing the need and opportunity to guide stakeholders with the (appropriate) inclusion of award criteria beyond price. Due to the variety in tender organization in Europe, a ‘one size fits all’ tendering framework is not possible. However, on an overarching level, it was argued that tender procedures must aim to (i) ensure market plurality and (ii) include award criteria beyond price (warranted that criteria are objectively and transparently defined, scored and competitively rewarded). Depending on the market (maturity), additional actions may be needed. Conclusions: Findings suggest the need to adjust tender procedures for off-patent biologicals and biosimilars, considering a more long-term strategic and market sustainable view. Five main avenues for optimization were identified: (i) safeguarding a transparent, equal opportunity setting for all suppliers with an appropriate use of award criteria; (ii) fostering a timely opening of tender procedures, ensuring on-set competition; (iii) ensuring and stimulating adherence to laws on public procurement; (iv) securing an efficient process, improving plannability and ensuring timely product supply and (v) safeguarding long-term sustainable competition by stimulating market plurality.

Public procurement relies in an apparent irreconcilability between competition, which implies some confidentiality, and transparency. The latest Public Procurement Directives have made e-procurement a mandatory feature. Since blockchain technology has been developed and designed to accomplish integrity, transparency, efficiency and data accuracy, goals which are very much appreciated in public procurement, an interesting question then arises: is there room to apply this technology within public procurement procedures? Will smart contracts be an interesting tool within public procurement? Considering public duties such as data protection, which must be complied with by contracting authorities, and some blockchain features such as non-withdrawable information and the likely broad access to the information there enclosed, one can be drawn to conclude that there is no possible conciliation between these two procedures. To this aim, a new method for assessing environmental award criteria in GPP processes is introduced in this study, providing easy and effective communication of the environmental benefits of the products and services purchased. The method is intended for its use by public authorities and companies. The main novelty of the method lies in its ability to evaluate the achievement of each award criterion during the GPP process using a simplified life cycle assessment methodology and a further simplification of the environmental indicators in one score using TOPSIS. Abstract The Competitive Dialogue (CD) is a procurement procedure that was introduced in Norway in 2007. The procedure enables the client to have a dialogue phase with pre-qualified contractors before awarding the contract. When the dialogue phase is over, the client evaluates the tenders based on pre-defined and project-specific most economically advantageous tender (MEAT) award criteria. The purpose of this study is to explore the experience from the use of the award criteria in a project that has used the CD procedure. In addition to an initial literature study and a document study, 14 in-depth semi-structured interviews were carried out. This research investigates the infrastructure project E6 Helgeland South with NPRA as a client. The case study indicates that the client finds it demanding to determine suitable award criteria at an early stage. There are uncertainties regarding the weighting of the award criteria and the evaluation process. Both the client and the contractor request more focus on the award criteria at an early phase of the project to align them with the project goal and purpose. The quality of the goods or services that government procures is obviously a very important consideration in deciding which supplier should be awarded a particular public tender. It follows that in the regulation of public procurement, particular attention should be given to the role of quality (also called functionality) in the adjudication of public tenders and the final award decision. In South African public procurement law, the role of functionality in public tender adjudication has been a fairly controversial issue that has resulted in a continuing interaction between courts and law-makers on how and when quality should be assessed and should impact on the final award decision within the framework for public procurement found in section 217 of the Constitution. This contribution tracks the development of the role of functionality in public tender adjudication as prescribed by public procurement regulation since the enactment of the Preferential Procurement Policy Framework Act 5 of 2000, which spearheaded the development of contemporary public procurement regulation in South Africa. The analysis shows how the role of functionality has constantly changed since the enactment of the PPPFA and remains uncertain. This uncertainty relates to different interpretations of the constitutional requirements for public procurement primarily contained in section 217(1) of the Constitution. Whether functionality is used as a qualification criterion, an award criterion or both holds particular practical implications for both suppliers and contracting authorities. It is accordingly important to have certainty on this question. However, it cannot be said that the Constitution and section 217 in particular dictates one approach rather than another. The issue should thus be resolved with reference to the statutory scheme adopted under the PPPFA.

Tomando como referencia la doctrina fijada por el TJUE, el análisis se centra en las interpretaciones que los tribunales administrativos de recursos contractuales han ido marcando en sus resoluciones respecto a la dimensión cualitativa y cuantitativa de los criterios de adjudicación., This study analyzes the interpretive difficulties that the inclusion of social criteria in the contract award phase has raised, especially those related to the necessary link with its object. Taking as a reference the doctrine established by the CJEU, the analysis focuses on the interpretations that the administrative courts of contractual appeals have been marking in their resolutions regarding the qualitative and quantitative dimension of the award criteria.

Purpose The purpose of this paper is to propose and test a multi-criteria decision analysis (MCDA) approach based on an additive value function (AVF) to select the most economically advantageous tender under European Union public procurement regulations. Design/methodology/approach A case study in which the AVF tender evaluation model is constructed by the procurement personnel and the results of the original, real-life public procurement evaluation model are compared to those discovered by the MCDA approach. Findings The AVF model captures the preferences of the procurement authority in a more reliable and transparent manner than commonly used evaluation models based on scoring formulas. Practical implications While commonly used in public procurement, relative scoring formulas can neither present the preferences of a procurement unit accurately nor do they enable bidders to draft bids according to these preferences. The proposed MCDA approach can achieve both. Originality/value The contribution of this paper is threefold. First, the successful construction of the AVF model with procurement personnel is introduced. Second, the model is used in an actual, real-life case. Third, a thoughtful comparison of features, structures and results of the AVF model and the evaluation model using scoring formulas is presented.

Through the bibliographic and analytical method, real case studies and successful models will be presented, in order to determine common elements that prevail in the awarding procedures of the awarding SMEs and that, therefore, are a sample of the democratization of public procurement. Finally, in order to carry out this study, the work will consist of the development of the regulatory framework relating to public procurement, case law in this area, relevant scientific articles, European and Spanish regulations and case studies.

Diese Masterarbeit beschäftigt sich mit dem Thema Forcierung kreislaufgerechter Ausschreibung im Bauwesen. Die Masterarbeit soll Möglichkeiten zur Förderung der Kreislaufwirtschaft innerhalb der Bauindustrie im Rahmen der Ausschreibung aufzeigen und damit einen Beitrag zur Ressourcenschonung leisten. Vor allem das Bauwesen ist für einen hohen Anteil des Abfallaufkommens auf der gesamten Welt verantwortlich und verbraucht gleichzeitig viele Ressourcen. Daher ist eine Umstellung in Richtung eins zirkulären Wirtschaftssystems unumgänglich, um einen nachhaltigen Umgang mit den natürlichen Ressourcen sicherzustellen. Eine Möglichkeit das Modell der Kreislaufwirtschaft zu fördern ist die Ausschreibung von Bauleistungen. Um dazu Möglichkeiten einer kreislaufgerechten Ausschreibung aufzuzeigen, bietet die Masterarbeit zunächst einen Überblick über den rechtlichen Rahmen der Abfallwirtschaft auf europäischer und nationaler Ebene. Anschließend wird das allgemeine Modell der Kreislaufwirtschaft erläutert und der Bezug zur Baubranche hergestellt. Dabei werden die wichtigsten Beweggründe zur Forcierung der Kreislaufwirtschaft im Bauwesen sowie europäische und nationale Maßnahmen zur Förderung der Kreislaufwirtschaft vorgestellt. Außerdem werden die aktuell in Österreich bestehenden Ausschreibungsstandards analysiert. Um die aktuelle Ausschreibungspraxis in Österreich, Deutschland sowie der Schweiz darstellen zu können, wurden Interviews mit erfahrenen Experten aus der Branche geführt. Das Ergebnis dieser Masterarbeit ist ein Maßnahmenkatalog mit Vorschlägen zur Verbesserung der Ausschreibungsbedingungen in Österreich, um eine Forcierung kreislaufgerechter Ausschreibungen zu ermöglichen. This thesis deals with the promotion of the application of circular economy in tenders of the construction industry. The thesis should show possibilities for promoting the circular economy within the construction industry in the context of tenders and thus contribute to resource conservation. The construction industry in particular is responsible for a large proportion of the waste generated around the world and at the same time consumes many resources. Therefore, a change towards a circular economic system is essential to ensure sustainable use of natural resources. One way to promote the circular economy model is the tendering of construction work. To show the possibilities of a circular tender the thesis first offers an overview of the legal framework of waste management at European and national level. The general model of the circular economy is then explained and the connection to the construction industry is established. The most important reasons for promoting the circular economy in the construction industry as well as European and national measures to promote the circular economy are presented. In addition, the tendering standards currently in force in Austria are analyzed. To be able to present the current tendering practice in Austria, Germany and Switzerland, interviews were conducted with experienced experts from the industry. The result of this thesis is a catalog of measures with suggestions for improving the tendering conditions in Austria to enable the promotion of circular tenders. The second of the three tunnelling contract sections of the Semmering Base Tunnel is of comparable complexity to the first contract section SBT2.1. The geotechnical and hydrological conditions for sequential tunnelling are demanding and require extensive grouting and investigation measures in advance of the drives. The enormous extent of the construction works and the need to access parts of the running tunnels through an intermediate construction access are a logistical challenge. The construction time is also very ambitious. These circumstances had to be considered in the production of the tender documents. Die zweite Ausschreibung für eines der drei Tunnelbaulose des Semmering-Basistunnels schließt hinsichtlich Komplexität nahtlos an das erste Baulos an. Die Vortriebe haben unter geotechnisch und hydrogeologisch anspruchsvollen Bedingungen zu erfolgen und beinhalten intensive Erkundungs- und Injektionskampagnen. Der enorme Bauumfang sowie die Erschließung der Vortriebe über einen komplexen temporären Zwischenangriff stellen eine große logistische Herausforderung dar. Durch einen engen Bauzeitrahmen wird diese noch verstärkt. Diesem Umstand musste auch in der Vertragsgestaltung Rechnung getragen werden. [ABSTRACT FROM AUTHOR]

The Act on Public Contracts defines two basic evaluation criteria: the lowest tender price and the economic advantageousness of the tender. The paper concentrates on the price, discusses its advantages and disadvantages, risks and consequences of the evaluation according to the price. The analysis of the usage of the price is based on the data from the Czech Republic from years 2011 - 2013. Contract notices were collected from the Information System on Public Contracts, large data file consisting of several thousand forms was retrieved. The dataset was cleared for errors. A standard set of statistical tools is used for the analysis including descriptive statistics. Czech contracting entities choose the lowest tender price more often than the economic advantageousness of the tender. Research shows dependency between the subject-matter of the contract and the basic evaluation criterion. The typical difference is observed between types of construction works that is execution and design. The data reveal changes within the analyzed years caused mainly by frequent act amendments. The research provides insight in the real behavior of contracting entities. Recommendations for the use of price as the only criterion are provided and discussed. The discussion can serve as a guidance for contracting entities to gain more quality outcome of the tender. The main impact of the paper is the quantitative analysis focusing not only on sample data but all tenders realized under the Act on Public Contracts in the Czech Republic. [ABSTRACT FROM AUTHOR]

Background: In Europe, off-patent biologicals and biosimilars are largely procured by means of tender procedures. The organization and design of tenders may play a key role in the evolving biosimilar market, and currently, it is not fully elucidated how tenders for off-patent biologicals and biosimilars are designed and if approaches are aligned with sustaining market competition and societal savings for healthcare systems over the long term. This study aims to (i) explore the design and implementation of tender procedures for off-patent biologicals and biosimilars in Europe, (ii) identify learnings for sustainable tender approaches from purchasers and suppliers, and (iii) formulate recommendations in support of competitive and sustainable tender practices in the off-patent biologicals market. Methods: A mixed methods design was applied. A quantitative web-survey was conducted with hospital pharmacists and purchasers (N = 60, of which 47 completed the survey in full), and qualitative expert-interviews with purchasers and suppliers (N = 28) were carried out. Results: The web survey results showed that the organization and design of tenders for off-patent biologicals and biosimilars, and the experience of hospital pharmacists and purchasers with this, considerably varies on several elements across European countries. From the qualitative interviews, signals emerged across the board that some of the current tender approaches might negatively affect market dynamics for off-patent biologicals and biosimilars. The focus on generating short-term savings and existence of originator favouring tender practices were identified as elements that may limit timely competition from and market opportunity for biosimilar suppliers. The need to optimize tender processes, considering a more long-term strategic and sustainable view, was expressed. In addition, challenges appear to exist with differentiating between products beyond price, showing the need and opportunity to guide stakeholders with the (appropriate) inclusion of award criteria beyond price. Due to the variety in tender organization in Europe, a ‘one size fits all’ tendering framework is not possible. However, on an overarching level, it was argued that tender procedures must aim to (i) ensure market plurality and (ii) include award criteria beyond price (warranted that criteria are objectively and transparently defined, scored and competitively rewarded). Depending on the market (maturity), additional actions may be needed. Conclusions: Findings suggest the need to adjust tender procedures for off-patent biologicals and biosimilars, considering a more long-term strategic and market sustainable view. Five main avenues for optimization were identified: (i) safeguarding a transparent, equal opportunity setting for all suppliers with an appropriate use of award criteria, (ii) fostering a timely opening of tender procedures, ensuring on-set competition, (iii) ensuring and stimulating adherence to laws on public procurement, (iv) securing an efficient process, improving plannability and ensuring timely product supply and (v) safeguarding long-term sustainable competition by stimulating market plurality.

A presente investigação versa sobre os critérios de adjudicação e os seus possíveis impactos na qualidade do fornecimento e dos serviços públicos. As organizações, privadas ou públicas, necessitam adaptar a sua conduta às novas necessidades de forma a alcançar o sucesso competitivo. A administração pública, em particular, possui um papel de relevância para a sociedade, na medida que esta deve agir em prol da comunidade de forma a proporcionar à sociedade o melhor serviço possível.Este relatório teve como objetivo avaliar a importância da qualidade do serviço público e fazer uma análise aos critérios de seleção de fornecedores mais utilizados pelas organizações públicas. Para o efeito, este estudo explorou a temática através da revisão da literatura e dos dados fornecidos pelo Instituto dos Mercados Públicos, do Imobiliário e da Construção (IMPIC). This report approaches the theme “Relevance to the Award Criteria in the Choice of Suppliers – The Impact on Improving Quality of Supply” and it results on a curricular internship from the Master’s Degree in Public and Private Administration, from the Faculty of Law of the University of Coimbra, fulfilled between October 2019 and February 2020, at Câmara Municipal de Arganil, namely on the areas of Quality Management and Public Procurement. Over the last years, the need to implement a service with quality is increasingly shown in the organizations. The present investigation is about the award criteria and their possible impacts on the supply quality and public services. The organizations , private and public, need to adapt their behavior to the new needs, in order to achieve competitive success. The public administration, in particular, has a major relevance role for the society, in the way that it should act for the community, giving them the best possible service. This report had the objective to evaluate the importance of public service quality and analyze the most used supplier selection criteria by the public organizations. This theme was explored by reviewing literature and from data supplied by Institute of Public Markets, Real Estate and Construction (IMPIC). The results of the study show that the majority of the public contests use the lower price award criteria when choosing their suppliers.

Price is by excellence the award criterion in public procurement. Similarly, when there are several award criteria, the choice of the mathematical formula for its assessment by the contracting authority is essential, not being a neutral decision for the bidder. In this sense, one of the issues that has aroused the greater interest in the evaluation of economic offers is what the doctrine has come to call "satiety thresholds". That is to say, the use in the bidding documents of different mathematical formulas that serve to limit the evaluation of the offers and not to grant additional points to those proposals that are less than a certain figure. Its legality has not been without controversy, and in this sense there are contradictory pronouncements from different Administrative Courts of Contractual Resources. In light of the regulations, jurisprudence and legal doctrine on the matter, this work addresses the analysis of the "price" award criterion and the legal viability of this type of mathematical formulas. All this, from the perspective of the imperative need to guarantee the general principles of public procurement., El precio constituye el criterio de adjudicación por excelencia en la contratación pública. De igual modo, cuando existen varios criterios de adjudicación, la elección de la fórmula matemática para su valoración por el órgano de contratación resulta esencial, no siendo una decisión neutra para el licitador. En este sentido, una de las cuestiones que mayor interés ha despertado en la valoración de las ofertas económicas es lo que la doctrina ha venido a denominar “umbrales de saciedad”. Es decir, el empleo en los pliegos de licitación de distintas fórmulas matemáticas que sirven para limitar la valoración de las ofertas y no conceder puntos adicionales a aquellas proposiciones que sean inferiores a una determinada cifra. Su legalidad no ha estado exenta de polémica, existiendo, en este sentido, pronunciamientos contradictorios de diferentes Tribunales Administrativos de Recursos Contractuales. A la luz de la normativa, jurisprudencia y doctrina legal en la materia, este trabajo aborda el análisis del criterio de adjudicación “precio” y la viabilidad jurídica de este tipo de fórmulas matemáticas. Todo ello, desde la perspectiva de la imperiosa necesidad de garantizar los principios generales de la contratación pública.

In connection with the many national and international attempts to improve 'cooperation in construction', a working group of the ITA Austria has been formed and has developed a new 'Tender Model for Infrastructure Projects - VIP'. The mostly complete basic concept, which at the moment is being discussed and further developed together with representatives of employers, is the subject of this article. The VIP has the essential intention of moving away from the currently dominant 'cheapest bidder principle' or 'best bidder principle', in which quality criteria play no role or are of only minor importance. The VIP lays more emphasis on qualitative award criteria and intends the award of the contract to the bidder whose bid has the highest 'benefit to society'. Im Zusammenhang mit mehreren nationalen und internationalen Bestrebungen, die 'Kooperation im Bauwesen' zu verbessern, hat sich eine Arbeitsgruppe der ITA Austria formiert und ein neues 'Vergabemodell für Infrastrukturprojekte - VIP' entwickelt. Das weitgehend fertiggestellte Grundkonzept, welches zurzeit mit Vertretern von Auftraggebern abgestimmt und weiterentwickelt wird, ist Gegenstand dieses Beitrags. Das VIP verfolgt als wesentliches Ziel eine Abkehr vom derzeit dominanten 'Billigstbieterprinzip' bzw. 'Bestbieterprinzip', bei dem qualitative Kriterien keine oder nur eine untergeordnete Rolle spielen. The quality of the goods or services that government procures is obviously a very important consideration in deciding which supplier should be awarded a particular public tender. It follows that in the regulation of public procurement, particular attention should be given to the role of quality (also called functionality) in the adjudication of public tenders and the final award decision. In South African public procurement law, the role of functionality in public tender adjudication has been a fairly controversial issue that has resulted in a continuing interaction between courts and law-makers on how and when quality should be assessed and should impact on the final award decision within the framework for public procurement found in section 217 of the Constitution. This contribution tracks the development of the role of functionality in public tender adjudication as prescribed by public procurement regulation since the enactment of the Preferential Procurement Policy Framework Act 5 of 2000, which spearheaded the development of contemporary public procurement regulation in South Africa. The analysis shows how the role of functionality has constantly changed since the enactment of the PPPFA and remains uncertain. This uncertainty relates to different interpretations of the constitutional requirements for public procurement primarily contained in section 217(1) of the Constitution. Whether functionality is used as a qualification criterion, an award criterion or both holds particular practical implications for both suppliers and contracting authorities. It is accordingly important to have certainty on this question. However, it cannot be said that the Constitution and section 217 in particular dictates one approach rather than another. Green public procurement (GPP) aims to integrate environmental criteria into public tender as instrument to develop and encourage production and consumption of sustainable products and services. Inclusion of award criteria in GPP is a key factor of its success. To this aim, a new method for assessing environmental award criteria in GPP processes is introduced in this study, providing easy and effective communication of the environmental benefits of the products and services purchased. The method is intended for its use by public authorities and companies. The main novelty of the method lies in its ability to evaluate the achievement of each award criterion during the GPP process using a simplified life cycle assessment methodology and a further simplification of the environmental indicators in one score using TOPSIS. This method is applied to public procurement of urban furniture as a case study.

Background: In Europe, off-patent biologicals and biosimilars are largely procured by means of tender procedures. The organization and design of tenders may play a key role in the evolving biosimilar market, and currently, it is not fully elucidated how tenders for off-patent biologicals and biosimilars are designed and if approaches are aligned with sustaining market competition and societal savings for healthcare systems over the long term. This study aims to (i) explore the design and implementation of tender procedures for off-patent biologicals and biosimilars in Europe, (ii) identify learnings for sustainable tender approaches from purchasers and suppliers, and (iii) formulate recommendations in support of competitive and sustainable tender practices in the off-patent biologicals market. Methods: A mixed methods design was applied. A quantitative web-survey was conducted with hospital pharmacists and purchasers (N = 60, of which 47 completed the survey in full), and qualitative expert-interviews with purchasers and suppliers (N = 28) were carried out. Results: The web survey results showed that the organization and design of tenders for off-patent biologicals and biosimilars, and the experience of hospital pharmacists and purchasers with this, considerably varies on several elements across European countries. From the qualitative interviews, signals emerged across the board that some of the current tender approaches might negatively affect market dynamics for off-patent biologicals and biosimilars. The focus on generating short-term savings and existence of originator favouring tender practices were identified as elements that may limit timely competition from and market opportunity for biosimilar suppliers. The need to optimize tender processes, considering a more long-term strategic and sustainable view, was expressed. In addition, challenges appear to exist with differentiating between products beyond price, showing the need and opportunity to guide stakeholders with the (appropriate) inclusion of award criteria beyond price. Due to the variety in tender organization in Europe, a 'one size fits all' tendering framework is not possible. However, on an overarching level, it was argued that tender procedures must aim to (i) ensure market plurality and (ii) include award criteria beyond price (warranted that criteria are objectively and transparently defined, scored and competitively rewarded). Depending on the market (maturity), additional actions may be needed. Conclusions: Findings suggest the need to adjust tender procedures for off-patent biologicals and biosimilars, considering a more long-term strategic and market sustainable view. Five main avenues for optimization were identified: (i) safeguarding a transparent, equal opportunity setting for all suppliers with an appropriate use of award criteria; (ii) fostering a timely opening of tender procedures, ensuring on-set competition; (iii) ensuring and stimulating adherence to laws on public procurement; (iv) securing an efficient process, improving plannability and ensuring timely product supply and (v) safeguarding long-term sustainable competition by stimulating market plurality. Within public tendering procedures, economic operators are given many references by which they can evaluate human resources (staff) which they will have at their disposal after being awarded public contracts (e.g. standing conditions and award criteria). In addition, the so-called commitment to dedicate personal means is also stated at public tendering procedures. Economic operators in this respect face two main issues on a daily basis; the qualification of such commitment as confidential and the potential conflict with labour legislation in the case of relying on the capacities of other entities. This paper intends to analyse the earlier legislation on which the most recent and important doctrines and caselaws are founded, and the current legislation which comes into force due to the fourth generation of public procurement Directives. This paper has been formulated from the bidder´s perspective, the forgotten party in this kind of analysis and for whom this is a main aspect to be considered in his daily business activity. It is hoped that this paper will help tenderers understand the importance of not only evaluating their human resources (staff) but also fulfilling their legal obligations, Los operadores económicos vienen encontrándose en los procedimientos de licitación numerosas referencias a la valoración de los medios personales de los que, en caso de ser adjudicatarios, dispondrán para la ejecución de los contratos (e.g. condiciones de solvencia de los licitadores y criterios de adjudicación de los procedimientos de licitación). Aparecen, asimismo, dentro de dichas posibilidades de valoración los llamados compromisos de adscripción de medios personales, respecto de los cuales para los operadores económicos se plantean diariamente dos dudas principales; la calificación como confidencial de su contenido y la posible colisión con la legislación laboral en el caso de acreditarlos a través de medios externos. El presente artículo pretende analizar la normativa anterior, sobre la que se basa la doctrina y jurisprudencia más reciente e importante, y la nueva normativa tras la entrada en vigor de las Directivas de contratos públicos de cuarta generación. Y todo ello se ha planteado desde la perspectiva del licitador, un tanto olvidado en este tipo de análisis y para el que éste es un importante punto a considerar en su actividad empresarial diaria. Dissertação de Mestrado em Direito: Especialidade em Ciências Juridico-Forenses apresentada à Faculdade de Direito A Contratação Pública, ao nível da formação dos contratos públicos, assume importância relevante nos quadrantes socioeconómicos do Estado, sendo merecedora de uma abordagem relativamente aos procedimentos adjudicatórios em vigor, concretamente no que respeita aos critérios de adjudicação na formação dos contratos públicos, tendo em conta a dinâmica contratual entre entidades adjudicantes, operadores económicos e sociedade em geral. Atendendo às alterações em curso no contexto legislativo nacional, na sequência da publicação de três Directivas no JOUE, em 28/03/2014, em matéria de Contratação Pública, pretende-se fazer a ligação dos critérios de adjudicação no âmbito da formação dos contratos públicos em vigor, enunciando as alterações plasmadas nas ditas Directivas, e as consequências decorrentes da transposição destas, para o Direito Português, segundo uma perspectiva pessoal. No âmbito do direito comparado, faz-se alusão, ainda que de forma breve, sobre os procedimentos adjudicatórios ao nível da Contratação Pública, bem como em alguns casos, ao enquadramento histórico dos contratos públicos. As regras jurídicas, e preceitos normativos implementados, a forma como se realiza a Contratação Pública nos Estados mencionados, as quais, e em alguns deles, espelham a primazia de factores políticos que estão subjacentes a tais tomadas de posição, em detrimento, a factores socioeconómicos, e ambientais, apesar de terem suporte na legislação portuguesa vigente. O Estado, na qualidade de autoridade adjudicante, e no exercício da sua actividade de prossecução do interesse público deve, com a abertura do procedimento concursal ter presente que lhe assiste o dever legal de proceder à adjudicação. A adjudicação firma-se em critérios, critérios estes que foram alvo de alterações legislativas no âmbito do Direito Comunitário, concretamente com o Directiva 2014/24/UE.Com os critérios de adjudicação efectivam-se as relações contratuais entre as entidades públicas e os operadores económicos (privados), no âmbito dos contratos públicos.Actualmente são dois os critérios de adjudicação em vigor, conforme preceitua o art.º 74º do CCP, os quais são objecto de alteração, cfr. pontos 89 e 90 do preâmbulo da Directiva e art.ºs 67º e 68º da Directiva 2014/24/UE, consistindo a alteração mais visível, na concreta forma como se irá proceder à escolha por parte da entidade adjudicante, sobre qual o critério a lançar no procedimento adjudicatório.Nesta medida, os critérios da proposta economicamente mais vantajosa para a entidade adjudicante e da proposta do mais baixo preço, são substituídos, predominantemente, pelo da proposta economicamente mais vantajosa, em termos económicos segundo o ponto de vista da entidade adjudicante, designadamente, ponderando uma abordagem custo-eficácia, custos do ciclo de vida, podendo, nessa medida, aferir-se a melhor relação qualidade-preço. No decurso de todo o processo de análise, podem/devem estar subjacentes outros critérios que incluam aspectos qualitativos, ambientais e/ou sociais ligados ao objecto do contrato público em causa.Cabe à entidade adjudicante especificar a ponderação atribuída a cada um dos critérios escolhidos para determinar a proposta economicamente mais vantajosa, excepto se esta for escolhida com base no preço. A Directiva 2014/24/UE deixa, no entanto, ao critério dos Estados-Membros o poder de decisão quanto à proibição ou restrição da utilização exclusiva do preço ou custo como critério avaliador da proposta economicamente mais vantajosa, se assim considerarem adequado. Public procurement, and especially writing public contracts, is of great importance in socio-economic sectors of the State, so careful attention should be given to current procedures for awarding contracts, and in particular to the criteria for awarding contracts, taking in to account the contractual dynamic between contracting authorities, economic operators and society at large. Given the changes currently being made in the context of Portuguese legislation since the publication of the three directives on public procurement in the OJEU of 28/03/2014, the aim of this work is to make a link between the criteria used in awarding public contracts already in force, the alterations in the aforementioned directives, and the consequences for Portuguese law resulting from the changes they bring, from a personal prospective. In comparative law, mention is made, even if only briefly, of procedures for awarding contracts for public procurement as well as, in some cases, the historical context of public contracts. The legal rules, legislative provisions implemented and the way public procurement is carried out in the States mentioned, often reflect the pre-eminence of underlying political factors, rather than socio-economic and environmental factors, despite there being legislation in force to support these issues in Portuguese law. As the contracting authority, the State, which has the responsibility for acting in the public interest, should, at the time of opening tender procedures, remember its legal duty in awarding contracts. Awarding a contract is based on criteria, and these criteria have been subject to legal changes under EU law, specifically from Directive 2014/24/EU.Using the award criteria, contractual relationships are established between public entities and (private) economic operators in the guise of public contracts.There are currently two award criteria currently in force, according to article 74 of the CCP (Portuguese Code of Public Contracts), which are subject to change, cf. points 89 and 90 of the preamble of the directive and articles 67 and 68 of the Directive 2014/24/EU. This is the most visible alteration regarding which criterion is used in the procurement process, and will have a direct effect on the procedure for how the contracting authority will choose contract winners.With these new measures, the criteria for the most economically advantageous proposal for the contracting authority and the lowest price proposal are replaced, predominantly, by criteria seeking the most economically advantageous proposal in economic terms from the standpoint of the contracting authority, which means looking at cost-efficiency and life-cycle costs to assess which is the best proposal in terms of price-quality. During the process of analysis, other underlying criteria can and must be accounted for, including qualitative, environmental and/or social factors linked to the public contract in question.The contracting authority is responsible for specifying the thinking behind how and what criteria are chosen to determine the most economically advantageous proposal, except where the choice is based solely on price. Directive 2014/24/EU does, however, leave it to the discretion of member states as to whether there is a prohibition or restriction on using price or cost as the sole criterion in evaluating the most economically advantageous proposal, should they consider that to be sufficient.

The current European regulation on public procurement recognizes the Most Economically Advantageous Tender as the main award criterion for awarding public contracts through competitive procedures. This leaves, though, public buyers with potentially many options for evaluating tenders. This paper discusses the main economic features of «scoring rules», that is, the mathematical methods to attribute financial scores. We consider a class of scoring rule commonly used in Italy, with a particular focus on the likely impact on the degree of (price) competition and the interaction with other elements of competitive tendering design.

Diese Arbeit beschäftigt sich mit der Bestangebotsvergabe von Bauaufträgen nach Bundesvergabegesetz. Aufgrund der aktuell anstehenden Neuauflage des Bundesvergabegesetzes wird nicht nur auf die aktuelle Gesetzeslage mit dem Bundesvergabegesetz 2006 und der Novelle 2015 eingegangen, sondern ein Vergleich der Handhabung des Bestangebotsverfahrens mit dem Begutachtungsentwurf des Bundesvergabegesetzes 2017 hergestellt. Es wird definiert, für welche Auftraggeber das Bundesvergabegesetz anzuwenden ist und welche Regeln vom öffentlichen Auftraggeber und welche vom Sektorenauftraggeber anzuwenden sind. Unter Anwendung der Gesetzesmaterie werden die für das Vergabeverfahren notwendigen Begriffe wie Eignungskriterien, Zuschlagskriterien etc. sowie Anwendungsregeln und Schwellenwerte beschrieben. Die Voraussetzungen zur verpflichtenden Anwendung des Bestangebotsverfahrens werden erörtert, der Umfang und verpflichtende Inhalt einer solchen Ausschreibung mit Umsetzungsbeispielen erklärt. Zur Verdeutlichung des Umfanges einer Vergabe nach dem Prinzip des technisch und wirtschaftlich günstigsten Angebotes werden verschiedene Bewertungsmethoden und Bewertungssysteme erklärt und miteinander verglichen, um für den Anwender eine Entscheidungsgrundlage zu schaffen, auf deren Basis eine Ausschreibung erstellt werden kann. Die durch die Neuerungen im Bundesvergabegesetz 2017 vorgesehenen Kostenmodelle auf der Grundlage von Lebenszykluskosten werden erklärt. Die Herausforderungen und Risiken werden nachstehend zusammengefasst, um eine Grundlage für zukünftige widerspruchsfreie und dem Gesetz entsprechende Bestangebotsverfahren zu bilden, die dem Auftraggeber einen Mehrwert liefert und dem qualifizierten Auftragnehmer eine faire Vergabe ermöglicht. This thesis attempts to determine the best offer procedure for building contracts, according to the Federal Procurement Act. Due to the currently pending new edition of the Procurement Law, this thesis not only addresses the current legal situation of the Bundesvergabegesetz 2006 and the 2015 Amendment, but also compares the best offer procedure and the draft of the Bundesvergabegesetz 2017. This thesis further delineates which contracting authorities are to be applied by the Federal Procurement Law, which rules are to be applied by the public contracting authority and which by public-sector awarding authorities. The application rules and threshold are described using legal terms like eligibility criteria, award criteria, etc. The conditions for the compulsory application of the best bidding procedure are also discussed within this thesis, and the scope and binding content of such an invitation are explained with examples of implementation. To clarify the scope of an award, according to the principle of the most technically and economically advantageous tender, different assessment methods and assessment systems are explained and compared. This is done to create a foundation for the user upon which an invitation to tender can be drawn up. The cost models are explained in terms of lifecycle costs, provided for by the innovations in the Bundesvergabegesetz 2017. The challenges and risks are summarized to provide a basis for future non-conflict. Se hace especial incidencia en el Derecho civil aragonés (uno de los Derecho civiles que coexisten en el territorio español), dado su tratamiento novedoso del tema y, en particular, su clara opción por la custodia compartida como modelo de custodia que mejor responde al interés de los hijos menores y al objeto de promover la igualdad de los progenitores., This study aims to examine the legal treatment of the guardian of minor children in crisis situations of couple in Spanish law. There is a special emphasis on the Aragonese civil law (one of the civil law that coexist in the Spanish territory), in response to its novel treatment of the subject, and particularly its clear option for joint guardian as guardian model that best meets becomes the best interests of minor children and in order also to promote equality of parents.
