Administrative burden refers to the phenomenon by which the implementation of public policies and, more generally, interactions with the state, are experienced as onerous. Individuals face learning costs when acquiring information about public programs and services, compliance costs when trying to fulfill their rules, and psychological costs (stress, etc.) arising from interacting with these programs and services. This literature, almost exclusively in English, has developed at a breathtaking pace. This review essay takes stock of these recent developments and proposes a discussion structured around three themes: 1) What are administrative burdens and what issues do they raise? 2) What are the sources of burdens? and 3) What are their distributive and political consequences? Digital service platforms provided by academic support departments in Macao assist academic staff and students in various areas such as registry, student affairs, academic activities, and research. As the number of undergraduate students increases and new departments are established, academic staff often face the challenge of dealing with paperwork that contains similar content but different formats. This situation results in redundancies and a waste of time. This paper presents our endeavors to simplify administrative procedures in higher education by automating restructured documentation and developing secondary file systems. The paper presents two case studies: Scenario One focuses on streamlining the publication system for academic staff who submit papers in different formats. At the same time, Scenario Two aims to simplify the daily paperwork process for academic staff. Both cases involve transforming the distribution of administrative documents, transitioning from a standardized form with guidelines to a customized form with concise tips. This approach allows academic staff to handle only the necessary information, which may not be available in the database or requires verification. 4. Upstream and downstream implementation arrangements in two‐level games. A focus on administrative simplification in the Italian National Recovery and Resilience Plan.

The onset of the European NGEU program represented for European member states a formidable opportunity for post‐pandemic recovery and yet a significant challenge at the same time: to receive and retain EU funds, each state had to promptly draw up a National Recovery and Resilience Plan—NRRP) and commit to a pressing timetable for its implementation. Regarding this challenge, the Italian government's response is a case in point: first, Italy is by far the largest beneficiary of NGEU funds; second, it has long had a reputation for being laggard in both the implementation of European directives and the spending of cohesion policy structural funds; and the formulation of the NRRP, the design of the governance in charge of its implementation, and implementation itself, occurred at a particular moment in the country's political life. Based on these premises, the article examines the upstream process by which the Italian government designed the implementation arrangements for the adoption of simplification policies under the NRRP and their downstream recalibration in the first two years, taking the implementation arrangements as the dependent variable. Analytically, the focus is on the interplay between the pressures of EU timetables and internal political dynamics, be they the legacy or strategic political considerations on the part of national policymakers, in determining the design and eventual re‐design of implementation arrangements as the plan unfolds. 7. The impact of administrative simplification on outward foreign direct investment: Evidence from a quasi-natural experiment in China.

Using firm-level data from China from 2007 and 2014, this study assesses the impact of administrative simplification on the performance of an outward foreign direct investment. Results estimated by the difference-in-difference method indicate that the administrative simplification has a positive impact on OFDI. The delegation of approval authority can promote the growth of firms' OFDI in China. This result is robust after addressing the concerns of the endogeneity and sample selection bias. Moreover, results of extension studies show that the growth of OFDI contributed by administrative simplification plays a negative role in firms' export performance. Finally, the policy effect of administrative simplification on OFDI is stronger for non-SOEs than SOEs. [ABSTRACT FROM AUTHOR]

The present paper intends to provide an overview and a critical assessment of the administrative simplification policies implemented in Portugal over the past 20+ years. Throughout these decades, the major instruments for administrative simplification have been: (i) Decree-Law n. 135/99, of 22 April; (ii) the Simplex programme; (iii) the 2015 new Code of Administrative Procedure and its 2021 amendment; and (iv) the COVID-19 legislation. Although Decree-Law n. 135/99 (i) was the first attempt to specifically address simplification, it was a very thin one. The Simplex programme (ii), created in 2006, was the first cross-sectoral robust policy of simplification; its motto is “the simpler the better” and it encompassed reforms in all government areas aiming at cutting red tape, promoting administrative efficiency, and making the citizens’ and the corporations’ lives easier when dealing with State. The new Code of Administrative Procedure (iii), approved in 2015, brought about specific normative solutions to simplify procedures, namely, prior communications, administrative assistance, procedural conferences, and the electronic one-stop shop. Finally, the COVID-19 legislation (iv) was made necessary by the COVID-19 pandemic and by the fact that public health restrictions made it impossible for citizens to establish personal contact with the administration in many cases.

10. Organizational and Structural Approaches on Administrative Simplification: The Case of Kosovo

Administrative simplification is a particular approach that is considered a key aspect to ensure the quality of regulations and legislation. The appropriate organizational and structural approach to managing, coordinating, and monitoring administrative simplification is an important factor. The institutional framework for managing and coordinating administrative simplification initiatives has been the subject of discussions in the Government of Kosovo for several years. The objective of this paper is therefore to analyze the institutional set up in the central administration, as well as gaps and challenges, and their implications for the implementation of such reforms in Kosovo. It also presents the context of the reforms implemented by the Kosovo state administration to simplify administration and reduce administrative burdens. Particular attention is paid to the importance, status of implementation, and administration of the Law on General Administrative Procedures. Several recommendations and options have been made based on the findings of this study, the authors’ first-hand experience, and best comparative international practice.

Koncept bolje regulacije je termin nastao u okviru OECD-a i Europske unije. Nastala je iz potrebe za učinkovitijim, transparentnijim te kvalitetnijim donošenjem politika i programa koji su usmjereni prema korisnicima, a u obzir uzimaju i aktualna globalna zbivanja kao što su u posljednje vrijeme epidemija, migracijska kriza te geopolitička zbivanja. Bolja regulacija se provodi u nekoliko faza u svim državama članicama ali uz određen stupanj samostalnosti. Instrumenti bolje regulacije su: procjena učinaka propisa, javne konzultacije i upravna simplifikacija. U radu je opisan povijesni kontekst nastanka bolje regulacije, instrumenti bolje regulacije na razini Europske unije te njihova primjena u Republici Hrvatskoj., The concept of Better Regulation is a term created by the OECD and the European Union. It emerged from the need for more efficient, transparent and quality policy-making and user-oriented programmes, taking into account current global developments such as the recent epidemic, the migration crisis and geopolitical developments. Better Regulation is implemented in several stages in all Member states but with a degree of autonomy. Instruments of Better Regulation are: regulatory impact assessment, public consultation process and administrative simplification. The paper describes the historical context of the emergence of Better Regulation, instruments of Better Regulation at the EU level and their application in the Republic of Croatia.

Migracija, iako nije nova pojava, posljednjih nekoliko desetljeća postala je zastupljena tema u javnosti kao posljedica ubrzavanja migracijskih tokova tijekom 2015. prema Europi te posebno uslijed rusko-ukrajinskog rata. Pitanje odnosa migranata i zajednice u koju useljavaju, odnosno napetost između ljudskog prava za migiranje i prava nacionalne države za kontroliranjem vlastitog teritorija i odlučivanje o ulascima imigranata dovelo je do potrebe za harmonizacijom europske imigracijske i integracijske politike. Unatoč tome što je Hrvatska pretežito emigracijska zemlja u budućnosti se prognozira značajan i kontinuiran porast imigranata. Unutar Europske unije i njezinih država članica nužno je pronaći inovativna rješenja koja će odgovoriti na izazove koji proizlaze iz novonastale situacije te osigurati visokokvalitetnu integraciju državljana trećih zemalja u zemlji domaćinu. Relevantno pitanje koje se nastoji riješiti je upravljanje integracijom i pružanjem usluga imigrantima. Znamo da se imigranti suočavaju s raznim preprekama za potpuno korištenje javnih usluga zbog različitih faktora npr. nedostatak suradnje između državnih službi i nevladinih organizacija i njihove raspršenosti lokacija, raznolikosti postupaka, složenost birokracije i komunikacijske poteškoće kao rezultat kulturne i jezične raznolikosti. Moguće sredstvo u rušenju administrativnih barijera nudi nam koncept „one-stop-shop“ u kojoj strani državljani mogu pronaći skup usluga „pod istim krovom“ i na taj način znatno olakšati samu integraciju migranata. Cilj ovoga rada je analizirati uređenje politike integracije i njen razvoj i harmonizaciju pod utjecajem euoropeizacije u Hrvatskoj. Između ostaloga, analiziraju se slobode i prava migranata, njihov sadržaj ali i potencijalna ograničenja i prepreke u postajanju punopravnim članom novog društva. Proučava se model „one-stop-shop“ integracijskih centara, primjeri dobre prakse, njegove prednosti i primjenjivost u RH. Posebna pozornost se pridaje stvarnom stanju u praksi i poštivanju i ostvarivanju prava migranata, te se istražuju moguća rješenja za poboljšanje i unaprjeđenje integracije stranaca u društvo., Migration, although not a new phenomenon, has become a prominent topic in public discourse over the past few decades, largely due to the acceleration of migration flows and immigration crisis during 2015. and particularly as a result of the Russo-Ukrainian war. The issue of the relationship between migrants and the host community, as well as the tension between the human right to migrate and the national state's right to control its territory and regulate immigration, has led to harmonization of European immigration and integration policies. Despite being predominantly an emigration country, Croatia is projected to experience a significant and continuous increase of immigration in the future. Within the European Union and its member states, it is necessary to find innovative solutions that address the challenges arising from this new situation and ensure high-quality integration of third-country nationals in the host country. One relevant question that needs to be addressed is the management of integration and the provision of services to immigrants. We know that immigrants face various barriers to accessing public services due to factors such as lack of cooperation between government agencies and non-governmental organizations, dispersed service locations, diverse procedures, bureaucratic complexity, and communication difficulties resulting from cultural and linguistic diversity. One potential approach to overcome administrative barriers is the concept of a "one-stop-shop," where foreign nationals can access a range of services "under one roof," greatly facilitating the process of integration. The aim of this paper is to analyze the organization of integration policy and its development and harmonization under the influence of Europeanization in Croatia. Among other things, it examines the freedoms and rights of migrants, their content, as well as potential limitations and challenges they face in becoming fully integrated members of the new society. The paper explores the model of "one-stop-shop" integration centers, highlights examples of good practice, their advantages, and their applicability in Croatia. Special emphasis is placed on the current state of affairs, ensuring respect for migrants' rights, and exploring potential solutions to enhance the integration of foreign individuals into society.

15. Implementation of the 'regulatory guillotine' and development of the administrative law

The purpose of this study is to analyse the functioning of the “regulatory guillotine” in the context of the development of administrative law. The authors used qualitative methods to identify the features of the “regulatory guillotine” and determine its place among the institutions of administrative law. Quantitative methods were applied to define the scope and consequences of administrative reforms. The use of the legal comparative method made it possible to describe the peculiarities of the “regulatory guillotine” in Russia. The research results were conclusions from the analysis of legislation and the practice of implementing administrative and legal reforms that show the technological nature of the “regulatory guillotine”. In terms of organisation and implementation, the authors attributed the “regulatory guillotine” to administrative reforms, but in terms of content, the “regulatory guillotine” goes beyond even legal reform, as it involves assessing regulatory instruments from the point of view of not only legality but also economic efficiency and social feasibility. The novelty of this research should be considered the conclusion that the “regulatory guillotine” technologies can contribute to the improvement of administrative and legal regulation in Russia, provided they are thoroughly and purposefully applied in conjunction with the updated institutions of administrative procedures, administrative responsibility, licensing, expert and evaluation activities.

The PNAE Qali Warma program obtained ISO 9001: 2008 certification in 2016, with the purpose to paying food suppliers on time. Delayed payment mainly affects the cash flow of the Small and medium-sized enterprises SMEs. The objective of this article is analyze the attention times of payment request process. Results: the mean attention time was 22.9 days, with coefficient of variation (CV) of 38.7%; of which, 17.4 days represent periods with no value added. In each step of the process the CV exceeds 30%, which indicates little certainty to meet the planned deadlines. The files have 57.3% probabilities to stay in the process for more than 20 days and 17.6% for more than 30 days. The variation is explained according to the characteristics of the files. The time to transfer monetary resources doubles at the Administration Unit and the Purchase Committees, simplifying the activity would have saved 4.2 million soles. El PNAE Qali Warma obtiene la certificación ISO 9001:2008 en el año 2016, con el propósito de pagar oportunamente a los proveedores de alimentos; reconociendo que su retraso afecta principalmente el flujo de caja de las Mypes. El objetivo de esta investigación es analizar los tiempos de atención del proceso de solicitudes de pago presentadas a la sede principal del PNAE Qali Warma . Resultados: el tiempo de atención promedio fue 22,9 días, con coeficiente de variación (CV) de 38,7%; de los cuales 17,4 días representan periodos que no agregan valor. En cada etapa del proceso, el CV supera el 30%, indicando poca certeza para cumplir con los plazos planificados. Los expedientes tienen una probabilidad de 57,3% de continuar en trámite por más de 20 días y 17,6% por más de 30 días. La variación se explica según las características de los expedientes y el tiempo de presentación

Although urbanism was excluded from the scope of the application of the Services Directive and from State Act 17/2009, the economic crisis and the need to reactivate the real-state sector has brought the autonomic legislator to implement a feeble adaptation of urbanism to the new airs that come from Europe, basically focused on the simplification of procedural stages and the elimination of non necessary formal requirements. Nevertheless, it is been by the hand of the most recent State Acts that urbanism has taken leap towards a level of administrative simplification of a greater magnitude with the impact of its ambit of application of new techniques of intervention in private activity. The Act about Market Unity puts the cap on this process with the establishment of a basic framework which eases the review of urban licenses in order to establish its merits or the ascertainment in favor of other mechanisms of intervention considered more suitable.

From this point of view, we should remark how administrative procedure is a basic institution to reflect the changes of Administrative Law with regard to the principle of administrative simplification.

Corruption is a widespread phenomenon. No country and no political regime were immune in front of it. Another pessimistic statement related to the issue is that corruption seems to be very “sticky, once is there it stays there” (Rothstein, 2007). This opinion is sustained also by the fact that in the last decades there were only two successful stories in eradicating corruption: Hong Kong and Singapore. But these are small countries and the anticorruption measures were not always consistent with democratic principles. Romania resembles a case of persistent corruption so, according with what was said above, the conclusion would be that there are few chances to improve our country’s situation. Still we present an example that may prove the opposite. During the years 2005- 2006 the Ministry of Administration and Interior undertook a public policy that aimed to simplify the administrative procedures for the documents issued by the ministry. The result was a consistent reduction in the time needed for issuing those documents. Also the petty corruption that flourished previously in the field was eradicated.

La necesidad de abordar la simplificación administrativa es constante en el debate social, económico y político desde hace tiempo. Probablemente, los objetivos y motivos del sector público y del sector privado para reclamarla no coinciden. Pero lo cierto es que se percibe como una necesidad. La Comunidad Autónoma de Aragón la ha impulsado mediante la Ley 1/2021, de 11 de febrero, de simplificación administrativa. Esta Ley impulsa la simplificación en sus tres vertientes esenciales, la regulatoria, la procedimental y la organizativa, e incorpora otras medidas conexas como las palancas de transformación digital o reformas de leyes estructurales para la acción pública como las de contratación, subvenciones o hacienda., The need to address administrative simplification has been a constant in the social, economic and political debate for some time. Probably, the objectives and motives of the public sector and the private sector to demand it do not coincide. But the truth is that it is perceived as a necessity. The Autonomous Community of Aragon has promoted it through Law 1/2021, of February 11, on administrative simplification. ThisLaw regulates simplification in its three essential aspects, normative, procedural and organizational, and incorporates other related measures such as digital transformation levers or reforms of structural laws for public action such as contracting, subsidies or finances.

The purpose of this study is to analyse the functioning of the “regulatory guillotine” in the context of the development of administrative law. The authors used qualitative methods to identify the features of the “regulatory guillotine” and determine its place among the institutions of administrative law. Quantitative methods were applied to define the scope and consequences of administrative reforms. The use of the legal comparative method made it possible to describe the peculiarities of the “regulatory guillotine” in Russia. The research results were conclusions from the analysis of legislation and the practice of implementing administrative and legal reforms that show the technological nature of the “regulatory guillotine”. In terms of organisation and implementation, the authors attributed the “regulatory guillotine” to administrative reforms, but in terms of content, the “regulatory guillotine” goes beyond even legal reform, as it involves assessing regulatory instruments from the point of view of not only legality but also economic efficiency and social feasibility. The novelty of this research should be considered the conclusion that the “regulatory guillotine” technologies can contribute to the improvement of administrative and legal regulation in Russia, provided they are thoroughly and purposefully applied in conjunction with the updated institutions of administrative procedures, administrative responsibility, licensing, expert and evaluation activities.

Relatório de Estágio do Mestrado em Administração Público-Privada apresentado à Faculdade de Direito Na primeira parte do relatório, comentei a experiência que tive no estágio curricular que decorreu na Câmara Municipal de Viseu bem como as tarefas que desempenhei. Numa segunda fase, falo sobre a modernização administrativa e, consequentemente, da simplificação administrativa. A modernização administrativa é orientada por diversos propósitos como a eficiência, simplificação e transparência para que se ofereçam serviços de excelência aos cidadãos. É possível verificar neste relatório algumas alterações que surgiram na Administração Pública, nomeadamente como é que a Administração Pública se moldou às novas Tecnologias de Informação e Comunicação, como alcançou um desempenho de qualidade e como constituiu um Governo Eletrónico. Uma das principais medidas de modernização são os programas “Simplex” e o“Simplex Autárquico”. Um dos propósitos destes programas é a simplificação da vida dos cidadãos e empresas que interagem com a Administração Pública. Por outro lado, também fiz um enquadramento da Diretiva de Serviços e do Regime Jurídico de Acesso e Exercício das Atividades Económicas, em especial as atividades de restauração, comércio e de serviços (Licenciamento Zero - LZ). O objetivo do regime passa por descomplicar e facilitar (simplificação), por tornar mais rápido (agilizar) e por reduzir encargos administrativos que são próprios aos Licenciamentos das atividades já mencionadas. Por último, analisei dois conceitos, Mera Comunicação Prévia (MCP) e Comunicação Prévia com Prazo (CPP). In the first part of the report, I commented on the experience I had in the curricular internship that took place at the Municipality of Viseu as well as the tasks I performed. In a second phase, I am talking about administrative modernization and, consequently, administrative simplification. Administrative modernization is guided by various purposes such as efficiency, simplification and transparency in order to offer excellent services to citizens. It is possible to see in this report some changes that have arisen in the Public Administration, namely how the Public Administration has shaped the new Information and Communication Technologies, how it has achieved quality performance and how it constituted an Electronic Government. One of the main modernization measures are the "Simplex" and "Simplex Autarchic" programs. One of the purposes of these programs is to simplify the lives of citizens and companies that interact with the Public Administration. On the other hand, I also made a framework of the Services Directive and the Legal Regime for Access and Exercise of Economic Activities, in particular the activities of catering, trade and services (Zero Licensing - LZ). The objective of the scheme is to uncomplicated and facilitate (simplification), to make faster (streamline) and to reduce administrative burdens that are proper to the licensing of the activities already mentioned. Finally, I analyzed two concepts, Mere Prior Communication (MCP) and Previous Communication with Deadline (CPP).

This article proposes that democracy moves from an exclusively formal model to a substantive one when, among other conditions, there is a reconfiguration of the General State Administration. A congruent condition is that it focuses on providing quality public services, using the technological resources currently available to meet the expectations and needs of citizens. The case being analyzed is the experience of the government of Ecuador with its public policy of simplifying procedures, and how this initiative was able to increase the quality of democracy and facilitate conditions for the development of a substantive democracy. Este documento plantea que la democracia transita desde un modelo exclusivamente formal, hacia uno sustantivo cuando se da, entre otras condiciones, una reconfiguración de la Administración General del Estado. Una condición congruente es que esta se enfoque en proveer servicios públicos de calidad, usando los recursos tecnológicos disponibles actualmente para atender las expectativas y necesidades de la ciudadanía. El caso que se analiza es la experiencia del gobierno del Ecuador con su política pública de simplificación de trámites, y cómo esta iniciativa pudo incrementar la calidad de la democracia y facilitar condiciones para el desarrollo de una democracia sustantiva. Este documento propõe que a democracia transita de um modelo exclusivamente formal para um substantivo quando, entre outras condições, há uma reconfiguração da Administração Geral do Estado. Uma condição consistente é que esta se concentre na prestação de serviços públicos de qualidade, usando os recursos tecnológicos atualmente disponíveis para atender às expectativas e necessidades dos cidadãos. O caso analisado é a experiência do governo do Equador com sua política pública de simplificação de procedimentos e como essa iniciativa foi capaz de aumentar a qualidade da democracia e facilitar as condições para o desenvolvimento de uma democracia substantiva.

Por ello, en este trabajo se analiza la normativa aplicable a la metodología y condiciones del acceso y de la conexión a las redes de transporte y distribución de las instalaciones de producción de energía eléctrica, pero desde una perspectiva concreta, esta es, las reformas necesarias para acomodar su régimen al marco regulatorio de las autorizaciones y permisos de las instalaciones de producción de energía a partir de fuentes renovables que establece la Directiva 2018/2001. Network access capacity has become a scarce resource and probably one of the main barriers to the development of new electrical energy production facilities from renewable sources. For this reason, this paper tackles the regulations applicable to the methodology and conditions of the access and connection to the transport and distribution networks of electrical energy production facilities. This will be analysed in the light of the necessary reforms to adapt its regime to the regulatory framework of authorizations and permits for energy production facilities from renewable sources set-up by the Directive 2018/2001. 36. Administrative Simplification, Simplified for Hawai'i.

Background: The American health care system contains a layer of administrative controls that has become increasingly burdensome to medical practices in terms of uncompensated physician and staff time and practice costs. A primary care physician in solo practice spends between 4 and 10 hours a week directly interacting with health insurance companies and his or her staff will spend an additional 60 hours a week. This reduces patient-care availability, net practice income and physician job satisfaction. Methods: A literature review was conducted to determine possible solutions to administrative burdens physicians face in Hawai'i. A total of 51 articles were found matching search criteria with five being reports from major organizations. Results: Twenty-seven articles were found that related to administrative simplification. The "administrative complexity" problem has been defined and its financial impact quantified. Promising solutions have been developed and proposed by private not-for-profit organizations and by the government, both state and federal. Discussion: A successful administrative simplification plan would: (1) Provide rapid access to insurance information; (2) Allow medical practices to readily track specific claims; (3) Streamline the preauthorization process through the use of decision-support tools at the practice level and by directing interactions through real-time network connections between insurers and provider electronic health records, thus minimizing phone time; (4) Adopt the Universal Provider Datasource system for provider credentialing; and (5) Standardize (to the greatest degree possible) provider/insurer contracts. Corruption is a widespread phenomenon. No country and no political regime were immune in front of it. Another pessimistic statement related to the issue is that corruption seems to be very "sticky, once is there it stays there" (Rothstein, 2007). This opinion is sustained also by the fact that in the last decades there were only two successful stories in eradicating corruption: Hong Kong and Singapore. But these are small countries and the anticorruption measures were not always consistent with democratic principles. Romania resembles a case of persistent corruption so, according with what was said above, the conclusion would be that there are few chances to improve our country's situation. Still we present an example that may prove the opposite. Administrative simplification is a particular approach that is considered a key aspect to ensure the quality of regulations and legislation. The appropriate organizational and structural approach to managing, coordinating, and monitoring administrative simplification is an important factor. The institutional framework for managing and coordinating administrative simplification initiatives has been the subject of discussions in the Government of Kosovo for several years. The objective of this paper is therefore to analyze the institutional set up in the central administration, as well as gaps and challenges, and their implications for the implementation of such reforms in Kosovo. It also presents the context of the reforms implemented by the Kosovo state administration to simplify administration and reduce administrative burdens. Particular attention is paid to the importance, status of implementation, and administration of the Law on General Administrative Procedures. The present paper intends to provide an overview and a critical assessment of the administrative simplification policies implemented in Portugal over the past 20+ years. Throughout these decades, the major instruments for administrative simplification have been: (i) Decree-Law n. 135/99, of 22 April; (ii) the Simplex programme; (iii) the 2015 new Code of Administrative Procedure and its 2021 amendment; and (iv) the COVID-19 legislation. Although Decree-Law n. 135/99 (i) was the first attempt to specifically address simplification, it was a very thin one. The Simplex programme (ii), created in 2006, was the first cross-sectoral robust policy of simplification; its motto is "the simpler the better" and it encompassed reforms in all government areas aiming at cutting red tape, promoting administrative efficiency, and making the citizens' and the corporations' lives easier when dealing with State. The new Code of Administrative Procedure (iii), approved in 2015, brought about specific normative solutions to simplify procedures, namely, prior communications, administrative assistance, procedural conferences, and the electronic one-stop shop. Finally, the COVID-19 legislation (iv) was made necessary by the COVID-19 pandemic and by the fact that public health restrictions made it impossible for citizens to establish personal contact with the administration in many cases. 42. The Health Insurance Portability and Accountability Act: Does It Live Up to the Promise?

The Health Insurance Portability and Accountability Act of 1996 (HIPAA) was passed by Congress with two formidable tasks: (1) reform the insurance market; and (2) simplify healthcare administrative processes. From these ambitious beginnings, HIPAA has since taken on major healthcare issues including administrative simplification, security, privacy, and patient confidentiality. In November 1997, the Secretary of Health and Human Services (DHHS) introduced the proposed ‘standards’ for what is referred to as ‘administrative simplification’. But, establishing the standards and guidelines necessary for administrative compliance was not an easy undertaking. DHHS estimated that 400 different formats were used in the US for healthcare claims processing. Three years later (August 2000), the Final Rule for Standards for Electronic Transactions and Code Sets was published by DHHS. The rule provided for national standardization of the most common healthcare transactions and several code sets. The compliance deadline for implementation of the new transactions and code sets was set for October, 2002. In January 2001, Congress enacted The Administrative Simplification Compliance Act to provide the industry with additional time to reach compliance. Yet, recent survey results by Phoenix Health Systems and the Health Information and Management Society (HIMSS) indicate many providers and payers are not fully compliant with the security and privacy regulations mandated by HIPAA. This issue threatens the effectiveness of administrative simplification and the integrity of healthcare information. Overall, HIPAA does offer the promise of a more efficient and effective means of sharing and disseminating vital healthcare information. But, many experts have concerns that the implementation and maintenance of HIPAA standards and policies will become a financial burden for many in the healthcare industry. Although DHHS has established mandates for the healthcare industry, many deadlines have been extended and the standards of administrative simplification continue to evolve over time. Others question whether the Department of Health and Human Services is capable of spearheading an information technology revolution in the healthcare industry. Unfortunately, it may take several years before the industry is able to realize any true cost savings from administrative simplification. International audience; The question of simplification arises in the majority of developed States. For example, in 2003, the Organisation for Economic Co-operation and Development published a report entitled "Eliminating Red Tape - Simplification in OECD Countries", which found that excessive paperwork was one of the most frequent grievances of both individuals and businesses in OECD member countries. Indeed, a comparative study of this problem shows that this concern for normative simplification is a priority public policy in a majority of foreign countries experiencing equivalent economic development. Normative and administrative proliferation affects the need for legal security, the competitiveness of economic actors and contributes to the crisis of confidence of the various actors in society towards public action and its actors.Simplification, whether administrative or normative, takes several forms and presents as many advantages as difficulties. Although procedures vary from one country to another, it is clear that certain practices are becoming more widespread: setting up one-stop shops, shortening decision-making times, assistance to SMEs, evaluation of administrative processes, development of a managerial approach to public action, dematerialisation of procedures, etc.While common features can thus be identified in the practical implementation of simplification, different strategies can be identified. Indeed, although the solutions implemented vary from one country to another, they all revolve around two main modalities, either by creating dedicated institutions or by imposing new procedures or procedural steps on the various public players and administrations.; La cuestión de la simplificación se plantea en la mayoría de los Estados desarrollados. Por ejemplo, en 2003, la Organización de Cooperación y Desarrollo Económicos publicó un informe titulado "Eliminación de los trámites burocráticos - Simplificación en los países de la OCDE", en el que se determinó que el exceso de papeleo era una de las quejas más frecuentes de los particulares y las empresas de los países miembros de la OCDE. De hecho, un estudio comparativo de este problema muestra que esta preocupación por la simplificación normativa es una política pública prioritaria en la mayoría de los países extranjeros que experimentan un desarrollo económico equivalente. La proliferación normativa y administrativa afecta a la necesidad de seguridad jurídica, a la competitividad de los agentes económicos y contribuye a la crisis de confianza de los diversos actores de la sociedad hacia la acción pública y sus actores.La simplificación, ya sea administrativa o normativa, adopta varias formas y presenta tantas ventajas como dificultades. Aunque los procedimientos varían de un país a otro, es evidente que ciertas prácticas se están generalizando: creación de ventanillas únicas, reducción de los plazos de decisión, asistencia a las PYMES, evaluación de los procesos administrativos, desarrollo de un enfoque de gestión de la acción pública, desmaterialización de los procedimientos, etc.Así pues, si bien es posible identificar características comunes en la aplicación práctica de la simplificación, también es posible identificar diferentes estrategias. En efecto, aunque las soluciones aplicadas varían de un país a otro, todas ellas giran en torno a dos modalidades principales, ya sea mediante la creación de instituciones dedicadas o la imposición de nuevos procedimientos o trámites a los distintos agentes públicos y administraciones.; La question de la simplification se pose dans la majorité des Etats développés. Ainsi, en 2003, l’Organisation de coopération et de développement économiques rendait un rapport intitulé « Eliminer la paperasserie – La simplification dans les pays de l’OCDE » qui partait du constat que l’excès de paperasserie comptait parmi les griefs les plus fréquents, tant pour les particuliers que pour les entreprises dans les pays membres de l’organisation. En effet, l’étude comparée de cette problématique montre que ce souci de simplification normative constitue une politique publique prioritaire dans une majorité d’Etats étrangers connaissant un développement économique équivalent. La prolifération normative et administrative affecte l’impératif de sécurité juridique, la compétitivité des acteurs économiques et participe à la crise de confiance des différents acteurs de la société envers l’action publique et ses acteurs.La simplification, qu’elle soit administrative ou normative, revêt plusieurs formes et présente autant d’atouts que de difficultés. Si les procédures varient d’un pays à l’autres, force est de constater que certaines pratiques se généralisent : mise en place de guichets uniques, raccourcissement des délais de prise de décisions, aide aux PME, évaluation des processus administratifs, développement d’une approche managériale de l’action publique, dématérialisation des procédures, etc.Si des traits communs peuvent ainsi être dégagés dans la mise en pratique de la simplification, des stratégies différentes peuvent être identifiées. En effet, si les solutions mises en œuvre varient d’un pays à l’autre, elles s’articulent toutes autour de deux modalités principales, soit par la création d’institutions dédiées, soit en imposant de nouvelles procédures ou de nouvelles étapes procédurales auprès des différents acteurs publics et des administrations.

Problemas comuns ao setor público, como a rigidez administrativa, restrição de recursos humanos e tecnológicos e uma forte cultura do “papel”, vêm causando, de maneira geral, grande ineficiência nas estruturas organizacionais. Nesse contexto, este trabalho tem por objetivo propor uma reestruturação organizacional para ACADEPOL. Para tanto, foi realizada uma extensa revisão de literatura sobre os principais temas abordados no processo de reestruturação, com foco em organizações eficazes e gestão por processos, e aplicada uma metodologia de Simplificação Administrativa. O resultado desta pesquisa demonstra, por meio do estudo de caso da ACADEPOL, que para alcançar uma organização mais eficaz é importante se apoiar em três grandes catalisadores: revisão de processos, automatização/informatização desses processos e revisão das normas. Common problems in the public sector, such as administrative rigidities, constraints on human and technological resources, and a strong “paper” culture have generally caused major inefficiencies in organizational structures. In this context, this paper aims to propose an organizational restructuring for ACADEPOL. To this end, an extensive literature review was conducted on the main themes addressed in the restructuring process, focusing on the policies of use and management of processes, and applied a methodology of administrative simplification. The result of this research demonstrates, through the ACADEPOL case study, that for a more effective organization it is important to help with three major catalysts: process review, process automation / computerization, and standards review.

Dissertação de Mestrado em Administração Pública As mudanças mundiais nos diferentes níveis durante as últimas décadas requerem de Estados que garantam respostas oportunas e adequadas às mesmas, e por tanto, a Administração pública deve ser mais eficiente e eficaz com o objetivo de adaptar às suas necessidades com a própria capacidade financeira. A doutrina da governança pública estimula e fomenta a interação dos diferentes atores do Estado, com o propósito de encontrar meios eficazes para atingir os objetivos que têm sido construídos socialmente num ambiente de inclusão, interdependência, administração responsável dos fundos públicos e eficiência. Em conformidade com informação oficial do Ministério de Justiça de Portugal, a modernização da Justiça constitui um dos desígnios do XXI Governo Constitucional, entre outras iniciativas, através do Plano de Ação “Justiça mais Próxima”. Este Plano tem por objetivo contribuir para o desenvolvimento de uma Justiça ágil, transparente, humana e mais próxima do Cidadão. O Plano refere uma estratégia potenciada pelo digital e focada nas reais necessidades dos diferentes públicos-alvo e ambiciona ser um motor de alteração do paradigma vigente no setor. Esta investigação resulta de uma descrição e análise de um processo de modernização dentro do setor de Justiça de Portugal à luz da doutrina da Governança pública, sob dois pilares: inovação e eficiência. The global changes at different levels during the last decades require States to guarantee timely and adequate responses to this changes, and therefore, the Public Administration should be more efficient and effective aiming to adapt their needs with their own financial capacity. The doctrine of Public governance stimulates and encourages the interaction of different actors of the State, with the purpouse of finding effective means to achieve the objectives that have been socially constructed in an environment of inclusion, interdependence, accountability and efficiency. According to official information from the Ministry of Justice of Portugal, the modernization of Justice is one of the aims of the XXI Constitutional Government, among other initiatives, through the Action Plan "Justiça mais Próxima". The objective of this Plan is to contribute to the development of an agile, transparent, human and closer to the Citizen justice. The Plan refers a digital-enhanced strategy focused on the real needs of the different target audiences and aspire to be an engine for changing the current paradigm in the sector. This research stems from a description and analysis of a modernization process within the Justice sector of Portugal in the light of the doctrine of Public governance, under two bases: innovation and efficiency. L'articolo analizza l' "autorizzazione unica", istituto sperimentato con grande intensità nel settore energetico con un obiettivo di semplificazione amministrativa delle procedure per la costruzione e l’esercizio di impianti ed infrastrutture. Pur non disconoscendo il ruolo positivo svolto dall'istituto in termini di coordinamento amministrativo delle politiche energetiche ed ambientali, si evidenziano e si passano rapidamente in rassegna talune significative criticità verificate nella prassi applicativa dell'autorizzazione unica, non sempre censurata dalla giurisprudenza amministrativa, in termini di inadeguatezza del bilanciamento degli interessi e di incompletezza dell'istruttoria, con conseguenti concreti rischi di abbassamento del livello di tutela ambientale. The article analyzes the "single authorization", institute experimented with great intensity in the energy sector with a purpose of administrative simplification of the procedures for the construction and operation of plants and infrastructures. While not disregarding the positive role played by the institute in terms of administrative coordination of energy and environmental policies, certain significant critical issues are highlighted and swiftly reviewed, in terms of inadequate balancing of interests and of incompleteness of the preliminary investigation, verified in the application procedure of the single authorization, not always criticized by the administrative jurisprudence, with consequent concrete risks of lowering the level of environmental protection.

A simplificação e modernização administrativa melhorarão os serviços prestados pela Administração Pública, através da simplificação de procedimentos, ganhos de eficiência e redução de custos. Partindo-se desta exigência, com o projeto que se apresenta pretende-se a implementação de um modelo que se traduz na implementação de procedimentos de verificação, sustentados pelas tecnologias de informação, comunicação e interação eletrónica, enquanto instrumentos potenciadores de trocas informacionais, realizados entre dois organismos da Administração Pública: O ISS, I.P./CNP e o IRN, I.P. com o objetivo de realizar a prova de vida dos pensionistas da segurança social cuja sua execução se encontra suspensa desde o ano de 1997, o que impossibilita, ao organismo pagador das respetivas prestações, a verificação segura da continuidade de vida dos pensionistas evitando o pagamento de prestações indevidas, ou seja, a continuação do pagamento das prestações após o óbito dos pensionistas. Deste modo, privilegiar-se-ia a modernização e simplificação administrativas, através do recurso a mecanismos de interoperabilidade, desonerando os pensionistas de deslocações aos locais de recebimento das pensões, e libertando-os do envio de documentos com elementos que distintos organismos da Administração Pública já possuem. Simplification and administrative modernization will improve the services provided by the Public Administration, through the simplification of procedures, efficiency gains and cost reduction. Starting from this requirement, with the project whereby presented intends to implement a model that translates into the implementation of verification procedures, supported by information technology, communication and electronic interaction while enhancers of informational exchanges, carried out between two bodies of the Public Administration: the ISS, I.P. / CNP and IRN, I.P. in order to carry proof-of-life of social security pensioners whose implementation has been suspended since 1997, which makes it impossible to the paying agency of the respective services, secure verification of the continuity of life of pensioners avoiding payment undue benefits, i.e., the continued payment of benefits after the death of pensioners. Thus, priority would be the modernization and administrative simplification through the use of interoperability mechanisms, exempting pensioners to travel to receive local pensions, and freeing them from sending documents with elements that different agencies of the Public Administration already have.

Además, nos habla sobre la participación de nuevas entidades en el otorgamiento de una concesión minera, del impacto de estas medidas en el proceso de formalización minera, de los efectos de estas en la simplificación administrativa y sobre aspectos relevantes no contemplados por estas normas.
