2. Administrative liability of juveniles for smoking

The research relevance is determined by the prevalence of smoking among minors, as well as by the insufficient effectiveness of administrative liability measures taken against minors if they have committed an administrative offence – smoking in prohibited places. The research aims to determine the theoretical and legal features of administrative liability and to analyse the measures taken against juvenile offenders. The research aim was achieved by a comprehensive and in-depth analysis of Ukrainian and foreign scientific sources and provisions of current legislation. The author examines the peculiarities of administrative liability of minors for smoking. It is established that, according to the current Ukrainian legislation, administrative liability of minors for smoking may be imposed on persons aged 16-18 years, and the main measure is an administrative penalty (fine) paid by parents. The author provides arguments in favour of lowering the age limit for administrative liability of minors to 13-15 years. The author substantiates the expediency of educational influence on minors through pedagogical and social training aimed at solving the problem of tobacco use among minors. It is noted that such measures will be preventive in nature and will help to reduce the number of cases when minors smoke in prohibited places and will also contribute to solving the problem of smoking among minors in general. It is emphasised that the issue raised in this paper is not only legal but also pedagogical, social, and medical in nature. The practical significance of the results obtained is that they identify gaps in Ukrainian legislation and provide recommendations for improving approaches to the administrative liability of minors for smoking and addressing the problem of smoking among minors

The article examines the problems of crime prevention in the field of taxes and fees. It is noted that offenses in the field of taxation have an extremely negative impact on the socio-economic development of society. Tax evasion significantly reduces the planned results of the development of the Ukrainian state. This makes it necessary to take strict measures to counteract the mentioned actions, since stable trends in recent years indicate a fairly high proportion of offenses committed in the field of tax law. Violations of tax legislation are mainly related to the procedure for calculating and paying the largest taxes to the state and local budgets. At the same time, an important element of legal support for the stable functioning of the economy is the use of means of legal influence aimed at eliminating violations of tax legislation and bringing the guilty to legal responsibility. In this, perhaps the most important function of legal responsibility is preventive (warning), which encourages legal entities and individuals to comply with tax legislation. Such a function should be considered as the main goal of the financial activity of the state, which consists in creating the necessary ethical prerequisites capable of preventing tax offenses in the field of taxes and fees. It was emphasized that it is important to intensify preventive and informative work in order to improve tax culture and educate a law-abiding taxpayer. This is due to the fact that one of the causes of tax crime is the moral and psychological state of society, which is characterized by a negative attitude towards the existing taxation system. This attitude is to a large extent explained by the low level of tax culture, to improve which it is necessary to widely inform the population about tax legislation and its application. At the same time, educational work with taxpayers, formation of law-abidingness and tax discipline should be in the foreground. In order to raise tax culture among citizens, it is necessary to introduce the subject «Tax culture» in schools and institutions of higher education. [ABSTRACT FROM AUTHOR]

The topic of this article is illegal employment under Section 5(e)(1) of Act No. 435/2004 Coll., on Employment, as amended, and its punishment in the Czech Republic. It deals exclusively with the fulfilment of the definition of illegal employment through the performance of work outside the employment relationship, i.e. situations where dependent work is either concealed, performed without a validly concluded employment contract or performed on a trial basis. The author objects to connect the employment area with the area of administrative punishment and to provide coherent knowledge on illegal work and its detecting and combating in the Czech territory. Hence, the article provides a detailed analysis of the current legal regulation of illegal work and links its wording with selected case law, thus creating a comprehensive overview of this issue. 5. The Gaps in the Regulation of Prohibition of Reformatio in Peius in Slovak Administrative Law in Central European Perspective.

The prohibition of reformatio in peius is an important procedural institute of the remedies procedure. The prohibition of reformatio in peius means the prohibition of changing a decision for the worse, i.e. to the detriment of the person who has been affected by the contested decision and has himself brought an appeal against that decision or in whose favour such an appeal has been brought. The legal regulation of this institute in the Slovak Republic is unsatisfactory, since there is a different legal regime in the application of the prohibition of reformatio in peius in the derivation of administrative liability for offences and other administrative offences. In the present article, the author compares the legal regulation of the institute of the prohibition of reformatio in peius in the Slovak legal system with the aim of possible inspiration of the legal regulation of this institute in the legal systems of selected states (Poland, Hungary, Czech Republic). The article analyzes the informational and psychological impact of modern internet television on the basis of the materials taken from news video coverings of the official YouTube channel of the Russian Television and Radio Broadcasting Company. The research work provides the results of online polls and consolidated opinions of traffic police officers who analyzed the aforementioned video materials as part of the study. Parts of the videos are described that have potentially positive informational and psychological effect on the consciousness and behavior of road users and pertaining to the dynamics of traffic law violation events, the offending driver's life circumstances, the significance of correct professional action of traffic patrol officers of the State Road Traffic Safety Inspectorate. Based on the progress made in different sciences and practical domains of human activity, several recommendations have been formulated aiming to develop methodologies for positive informational and psychological effect on road users.

7. The Practice of Using Specialized Knowledge to Counteract Dissemination of Extremist Materials

The paper describes the directions of counteracting extremist materials dissemination in Russia and their results as seen in the Federal List of Extremist Materials of the Ministry of Justice of the Russian Federation, statistics of the State Information and Analytical Agency of the Ministry of Internal Affairs of Russia on the number of registered crimes and persons brought to criminal responsibility as well as the Judicial Department at the Supreme Court of the Russian Federation on the state of criminal record and activities of the federal courts of general jurisdiction and justices of the peace.The study aims to develop recommendations to optimize the judicial and investigative use of specialized knowledge to counteract the dissemination of extremist materials. The research tasks are: examining the shortcomings of preliminary investigation, analyzing the current judicial practice of administrative proceedings, and formulating proposals for the best use of specialized knowledge to identify the signs of hatred and enmity in the disseminated products. The study reveals the problems of the investigative practice related to the definition of the forensic examination subject for various categories of objects in terms of their material carriers. The author also notes cases of unjustified expansion of the subject of expert examination of extremist materials. Furthermore, the article identifies the shortcomings and positive experience in judicial practice on publicly available administrative cases on recognition materials as extremist and prosecution persons for inciting hatred or hostility or for posting on the Internet materials included in the Federal List of Extremist Materials. Finally, forensic recommendations on using specialized knowledge in the analysis of disseminated extremist materials are offered.

9. Conceptual Problems of the Third Codification of the Legislation on Administrative Offenses

The article deals with problems related to the development of the concept of the new Code of the Russian Federation on Administrative Offenses. Retrospective analysis of the development of the legislation on administrative offenses is conducted, a brief description of the legislation of foreign “Western traditional” countries, regulating similar issues, as well as the legislation of former Republics of the USSR - Belarus, Kazakhstan and Kyrgyzstan, which successfully reformed the national legislation on administrative offenses. The Author grades the draft of the Code of Administrative Responsibility and the Code of Administrative Offences submitted to the State Duma in 2014-2015, as well as the initiative concept of the new code, according to which plans are made to start drafting a new bill. According to the Author, the proposed concept needs to be finalized, it does not define the basic idea, purpose and subject of legal regulation, place in the system of the current legislation (especially connection with criminal legislation).

The subject of study in this paper are administrative-delict legal relations and the terms associated with this kind of relations. The purpose of the study is to analyze the nature of offences and administrative delicts. It is stated that the use of the term “delictum” it's been a certain evolution from private legal term in the sense of “delicta private” to the term, which can be used both in the sense of “delicta private” and value of “delicta publica”. The conclusion is that the term “delict” may be used in public relations and administrative legal use of the term “administrative delict”. Expanding the range of investigated administrative and delict relations, entails a change and the essential characteristics of administrative offenses, and also creates preconditions for formation of administrative-tort system of prevention of offenses, including not only administrative offences but also other offences that are not related to crimes and civil offenses. In this case, the responsibility should be named administrative and delict, which, in essence, will include a modern administrative and administrative-disciplinary liability. Depending on the nature of the administrative delict may be subdivided into administrative offense and administrative misdemeanor. The essential characteristics of an administrative offense should be upheld, and administrative misdemeanor must be attributed those acts which are now administrative and disciplinary misconduct. With this division of administrative delicts it is possible to realize a codification of administrative and delict legislation, i.e. the creation of Administrative-delict code of the Russian Federation. The work also made the assumption that procedural violations are treated as administrative delict. An attempt is made to distinguish between material legal relations in administrative law and administrative procedural legal relations. Concluded that you cannot mix administrative-tort legal relations, as a kind of material with tort and procedural legal relations. In turn, tort and procedural legal relations are an integral part of administrative and legal proceedings, and administrative delict production is an integral part of the administrative process. The methodological basis of the article is dialectical, formal logical methods, formal-legal method and method of interpretation of law.

This article discusses issues of the classification and systematization of public-legal delicts in legislation on administrative offences and the criminal legislation of the Russian Federation. It is noted that the legislation on administrative offences and criminal legislation evolve in different directions; a negative assessment of current trends of development of the legislation on administrative offences is given; attention is drawn to dangerous social consequences of such a development.The Author assesses the proposal on the formation of an independent category of delicts “criminal misdemeanor” and draws attention to the fact that in the Russian legislation already has a multilevel delictolisation and the inclusion of several intermediate levels of criminal offences does not affect the situation.According to the Author, administrative offences and crimes have a common legal nature, as evidenced by the numerous attempts by Russian and Soviet scientists to distinguish between them by any criteria, and should be in a single system that would ensure the proportionality of the coercive State importance protected by legislation values.

The Spanish legislation does not regulate in any law the protection of employees against mobbing (with the exception of public administration). Violence on workplace violates fundamental rights included in the Constitution, mainly the right for equal handling and the right for dignity. Even though the Labour Code, nor the Law for Prevention of Hazard on Workplace do not contain definition of prohibition of mobbing, but protection of employees can be found in general provisions of the law. The legislation of administrative penalties in labour relations can be found in the Law of Offences and Sanctions in Social Order. The protection is provided by the Social Court Order in case of violation. The activity of the inspection of labour in the field of harassment and violence on workplace is regulated by notice which determines the procedure in the administrative trial. The important role plays the jurisdiction in trials dealing with mobbing.

The article analyzes the issue of combating crimes in the financial sphere, establishes the essence of financial responsibility as an institution of financial law. The establishment of Ukraine as a state governed by the rule of law provides for the limitation of various forms of illegal behavior of subjects in the financial sphere and their administrative responsibility. This type of crime poses a significant threat to social relations, as it involves systematic encroachment on financial resources, which mostly ensure the stable, managed, orderly existence of people's lives in society. The concept of responsibility as a category of administrative law was considered and it was established that this concept is a much broader phenomenon, because, in addition to measures of legal responsibility, financial responsibility also includes measures of prevention, termination and recovery. The article also highlights the ideas that position the consideration of combating crimes in the financial sphere as a type of administrative responsibility. The issue of combating crimes in the financial sphere, as an important phenomenon for Ukrainian society, is highlighted. The financial component in the economic system of the state plays a significant role. Finance has turned from a mechanism into a driving force of the economy. At the same time, there are trends towards an increase in the number of illegal encroachments in the financial sphere. Today, financial crimes are characterized by a high level of latency. This indicates the development of financial crime, as a result of which the country's economy is damaged, which prevents the state from effectively implementing its functions and creating conditions for the development of society and the existence and reproduction of the economy. The nature of crime in the financial sphere makes it difficult to detect and prevent crimes. And if detection and disclosure of crimes in the financial sphere is relatively active, then less attention is paid to prevention issues. Although it is easier to prevent a crime than to detect, disclose, investigate and compensate for the damages caused by this crime. At the same time, crime prevention in the financial sphere is a priority area in the work of law enforcement agencies. However, despite the wide range of measures taken by the authorities to prevent offenses in this area, it is too early to say that the state has succeeded in everything. All this conditions the study of a wide range of issues of combating offenses in the financial sphere., У статті аналізується питання протидії злочинам у фінансовій сфері, встановлюється сутність фінансової відповідальності як інституту фінансового права. Утвердження України як правової держави передбачає обмеження різних форм протиправної поведінки суб’єктів у фінансовій сфері та їх адміністративної відповідальності. Даний вид правопорушень становить суттєву загрозу суспільним відносинам, оскільки передбачає систематичні посягання на фінансові ресурси, через які здебільшого забезпечується стабільне, кероване, упорядковане існування життя людей у суспільстві. Розглянуто концепцію відповідальності як категорії адміністративного права та встановлено, що дане поняття є значно ширшим явищем, адже, окрім заходів юридичної відповідальності у фінансовій відповідальності ще містяться заходи попередження, припинення та відновлення. У статті також висвітлено ідеї, що позиціонують розгляд протидії злочинам у фінансовій сфері, як виду адміністративної відповідальності. Висвітлено питання протидії злочинам у фінансовій сфері, як важливого явища для українського суспільства. Фінансовий складник в економічній системі держави відіграє суттєву роль. Фінанси з механізму перетворились на рушійну силу економіки. Водночас спостерігаються тенденції до збільшення кількості протиправних посягань у фінансовій сфері. Фінансові злочини на сьогодні характеризуються високим рівнем латентності. Це свідчить про розвиток фінансової злочинності, внаслідок чого економіці країни завдаються збитки, що заважає ефективно реалізовувати державі свої функції та створювати умови для розвитку суспільства та існування та відтворення економіки. Характер злочинності у фінансовій сфері зумовлює складність виявлення злочинів, що вчиняються та їх профілактики. І якщо виявлення та розкриття злочинів у фінансовій сфері відбувається відносно активно, то питанням профілактики приділяється менша увага. Хоча злочин простіше попередити, ніж виявити, розкривати, розслідувати та відшкодовувати завдані цим злочином збитки. Водночас профілактика злочинності у фінансовій сфері є пріоритетним напрямом у роботі правоохоронних органів. Однак, незважаючи на широке коло заходів, що вживаються владою щодо недопущення правопорушень у зазначеній сфері, говорити про те, що державі все вдалося зарано. Усе це обумовлює дослідження широкого кола питань протидії правопорушенням у фінансовій сфері.

In analysing complaints against the reports on administrative offences, we hereby note that similar problems would perpetuate even in later stages and are included by the parties in the grounds of appeal: the issue of assisting witnesses who signed the reports without having been actually present or having really witnessing the facts, the obligation (or lack of obligation?) of the officials to submit additional evidence in defence, with the exception of the concluded report, not specifying the objections / mentions within these reports, insofar as the heading itself is required to be filled in, if the respective offender wishes, even at the suggestion of the procedural agent. Since we have relatively recently confronted with these issues on the merits of the case, in administrative hearings, we decided to investigate such practical issues, each with its specific nature, starting from concrete cases in relation to the courts of appeal ought to consider the problems mentioned above in connection the principle of equality of arms, in its form derived from the interpretation of art. 6 of the ECHR. Methodological problems of violations detection under the Moscow government procurement are expounded. The great attention is paid to a qualification of these violations in compliance with the requirements of the Code of Administrative Offences of the Russian Federation. The authors conduct the research of common violations in Moscow government order and their causes. The consequences of these violations for Moscow budget are detected. A differentiated approach to estimation of administrative offences according the social danger of committed offence in government order is offered. An exercise of supervisory powers using scheduled, unscheduled check-outs (on the ground of appeals, complaints and the others) and administrative proceedings is considered.

При этом решения суда утрачивают значение актов правосудия., the article is devoted to problem of consideration by courts of general jurisdiction of cases about administrative offences. It is concluded that this consideration is not justice but is administrative jurisdiction which is independent type of state activity. Courte realizes this activity along with justice. Administrative proceedings and proceedings in the case of an administrative offence are fundamentally different in their legal nature. It is not to identify them. Court is considering the case as administrative jurisdiction body. In this case court realizes judicial power which has the character of police coercive measure. Then court decision loses the significance of acts of justice.

The purpose of the article is to study the essence of administrative offences in labour legislation, their classification based on theoretical and legal approaches, the areas defined in scientific studies and debatable issues regarding the legal category «administrative offences». In the article the concept of administrative offences in labour law, their difference and significance is examined. Based on general scientific methods, the article investigates the essence of the concepts of «administrative offences» in labour legislation and «types of administrative violations». By analyzing the existing legal framework, the place of administrative offenses in the system of offences in the labour legislation is determined, the difference between the types of labour legislation offences regulated by the Codes is clarified, and based on the composition of administrative offences, their type classification is proposed. Results: the article determines the main areas of research on administrative offences and also identifies debatable issues regarding this object of research. The result of the research was determination of the place of administrative offences in the system of offences of labour legislation. The types of offences regulated by the Labour Code of Ukraine, the Code of Criminal Procedure and the Criminal Code of Ukraine were examined out by comparative analysis. Finally, type classification of administrative offences of Labour legislation, which is characterized by a structure that includes the main elements of labour relations that are violated is proposed. Discussion: the imperfection of labour legislation causes the violation of the rights of citizens by employment process. The existing need to improve labour legislation requires a comprehensive approach to the study of administrative offences in labor legislation, in particular, the proposed classification takes into account the variety of features of labour relations, for violations of which administrative liability is provided. Метою статті є дослідження сутності адміністративних правопорушень у сфері праці, їх видова класифікація з теоретико-правових підходів, визначення напрямів наукових студіювань та дискусійні питання стосовно правової категорії «адміністративні правопорушення». У статті розглядається поняття адміністративних проступків у трудовому праві, їх відмінність та значущість. Крім того, спираючись на загальнонаукові методи, досліджується сутність понять «адміністративні правопорушення у сфері праці», «види адміністративних порушень». Шляхом аналізу існуючої правової бази визначається місце адміністративних правопорушень у системі правопорушень у сфері праці, з’ясовується відмінність видів правопорушень трудового законодавства, що регулюються Кодексами, і виходячи зі складу адміністративних правопорушень пропонується їх видова класифікація. Результати: визначено основні напрями досліджень адміністративних правопорушень, виявлено дискусійні питання щодо цього об᾽єкта досліджень, визначено місце адміністративних правопорушень у системі правопорушень трудового законодавства, здійснено на компаративних засадах аналіз видів, правопорушень, що регулюються КЗпПУ, КУпАП, ККУ, а також запропоновано видову класифікацію адміністративних порушень у сфері праці, яка характеризуються структурою, що включає до себе основні елементи трудових відносин, що порушуються. Обговорення: недосконалість трудового законодавства спричиняє порушення прав громадян під час реалізації права на працю. Існуюча необхідність вдосконалення трудового законодавства потребує комплексного підходу до вивчення адміністративних порушень у сфері праці, зокрема запропонована класифікація враховує різноманітність особливостей трудових відносин, за порушення яких передбачена адміністративна відповідальність.

In Österreich ist das passive Betteln erlaubt und stellt ein Grundrecht nach der Europäischen Menschenrechtskonvention dar. Wer jedoch aufdringlich, gewerbsmäßig, in organisierter Form oder mit einem Kind bettelt, begeht eine Verwaltungsübertretung. Wer aber eine Person mit dem Ausbeutungsvorsatz durch Gewalt oder gefährlicher Drohung zum Betteln zwingt, begeht das Strafrechtsdelikt des Menschenhandels. Die Sache ist gesetzlich eindeutig geregelt, doch gibt es immer wieder unterschiedliche Sicht- und Vorgehensweisen zwischen Bediensteten von Nichtregierungsorganisationen und der Polizei. Opfer des Menschenhandels sollten anhand von Verhaltensmuster identifiziert werden, es sollte aber auch kein Eingriff in die Grundrechte von bettelnden Personen stattfinden. Wissenschaftliche Fachliteratur beschreibt dazu einige Erkennung- und Verhaltensmuster, welche auf Opfer des Menschenhandels durch die Ausbeutung der Bettelei schließen könnten. Durch eine qualitative Methodentriangulation in Form von zwei nichtteilnehmenden Beobachtungen, sechs explorativen Befragungen und drei Expert*inneninterviews wurde in der Stadt Wien, das, zur Zeit des Forschungsprozesses, wahrgenommene Bild der Bettelei in Bezug auf Verhaltens- und Erkennungsmuster, welche auf das Delikt des Menschenhandels hinweisen sowie ein Eingriff in die Grundrechte der Bettelei darstellen könnte, erforscht und durch eine deduktive Vorgehensweise nach der qualitativen Inhaltsanalyse nach Mayring ausgewertet. Das Ergebnis dieser Forschung ergab, dass bedingt durch die Pandemie das Bild der Bettelei in Wien rückläufig ist. Auch änderte sich die Art der Bettelei in eine Bettelei durch eine Dienstleistung, z.B. durch das Reichen eines Einkaufwagens. Viel essenzieller als Erkennungs- und Verhaltensmuster von Personen ist eine auf Vertrauen basierte Zusammenarbeit zwischen den Nichtregierungsorganisationen und der Polizei. In Form einer gemeinsamen, vertrauensbildenden, kommunikativen Partizipation zwischen Bediensteten der Nichtregierungsorganisationen, der Polizei und den betroffenen Personen besteht die Möglichkeit Opfer des Menschenhandels identifizieren sowie das Grundrecht der Bettelei gewährleisten zu können. Der Dreh- und Angelpunkt dabei ist, im Zuge der gesamten Materie nicht zu vergessen, dass der Mensch im Mittelpunkt steht. In Austria passive begging is permitted and constitutes a fundamental right under the European Convention on Human Rights. However, anyone who begs intrusively, commercially, in an organized manner or with a child commits an administrative offence. Furthermore, anyone who forces or coerces a person to beg in order to exploit him commits the crime of human trafficking. The matter is clearly regulated by law. Nevertheless, there are always different views and approaches between non-governmental organizations and the police. Victims of human trafficking should be identified on the basis of behavioural patterns. Although there should be no interference with the fundamental rights of people who are begging. In this regard, scientific literature describes some patterns of recognition and behaviour that can be used to infer the victims of trafficking through exploitation of begging. Using a qualitative method triangulation in the form of two non-participatory observations, six explorative surveys and three expert interviews, the perceived image of begging in the city of Vienna was examined for human trafficking and restrictions on the fundamental right to beg and evaluated through a deductive approach according to the qualitative content analysis by Mayring. The result of this research showed that due to the pandemic, the image of begging in Vienna is declining. In addition, the nature of begging changed from merely sitting on the street to begging by service, e.g., through handing a shopping cart. Much more essential than patterns of recognition and behaviour of individuals is a trustworthy cooperation between the non-governmental organizations and the police. In the form of a collaborative, trust-building, communicative participation between the NGOs, the police and the persons concerned, it is possible to identify victims of human trafficking and to guarantee the fundamental right of begging. The key point is not to forget that in the course of the whole matter the human being takes centre stage. 33. Административная ответственность несовершеннолетних в России: вопросы теории и практики

Актуальность данного исследования обусловлена тем, что воспитание подрастающего поколения, защита прав и интересов несовершеннолетних всегда были в центре внимания российского (а ранее советского) государства и всех его общественных институтов. В настоящее время проблемы административной ответственности несовершеннолетних, совершающих правонарушения в возрасте от 16 до 18 лет (ст. 2.3 Кодекса Российской Федерации об административных правонарушениях) и даже в более юном подростковом возрасте, приобрели как никогда особую актуальность, носят острый (резонансный) характер, периодически привлекают внимание широких слоев общественности и средств массовой информации. Причины этого кроются, с одной стороны, в постоянно меняющемся законодательстве, а с другой стороны, в значительном увеличении совершаемых подростками правонарушений. При этом характер административных деликтов носит порой откровенно антиобщественный, наглый и циничный характер, граничащий с признаками психических отклонений. Надо признать, что в современных условиях несовершеннолетние оказались наименее защищенной категорией граждан нашего общества. Подростки сильнее чем взрослые могут испытывать состояние стресса, большее психическое воздействие и раздражение. Их духовная жизнь может деформироваться под влиянием интернета, компьютерных игр, «дворового общения» с подростками более старшего возраста с негативными социальными установками, которые не соответствуют традиционным ценностным ориентирам современного российского общества. В этой связи непреходящее значение имеет анализ правового статуса несовершеннолетних, в определении которого существует ряд проблем. Это связано не только с правовым регулированием административной ответственности подростков, но и с правоприменительной практикой, реальным исполнением вынесенных им наказаний. Кроме того, действующее административное законодательство, регулирующее ответственность несовершеннолетних, носит двухуровневый характер (Кодекс Российской Федерации об административных правонарушениях и законы субъектов Российской Федерации). По нашему мнению, правовая основа указанной ответственности перешла к нам еще с советского периода и не отвечает сложившимся современным общественным отношениям. В этих условиях устранение «пробелов» и противоречий, предложение различных путей их решения является весьма насущным и актуальным. Постановка проблемы: в сообществе ученых-административистов в настоящее время активно ведутся научные дискуссии и поиски решения проблем административной ответственности несовершеннолетних. Исследование различных научных подходов к этим проблемам значительно обогатит теоретические основы всего института административной ответственности подростков, покажет многообразие применяемых методов и форм при его оценке, укажет на возможные пути его дальнейшего развития. Цель исследования: выработка новых подходов к восприятию сущности административной ответственности несовершеннолетних, освещение современных проблем такого рода ответственности и внесение предложений по их решению. Методы исследования: материалистическая диалектика, философская концептология, логико-юридический, системно-структурный, анализ документов, выработка предложений. Результаты и ключевые выводы: анализ отдельных аспектов совершения административных правонарушений несовершеннолетними в России позволяет констатировать, что на сегодняшний день ни в одном правовом акте не закреплено понятие «административная ответственность несовершеннолетних», что вызывает многочисленные вопросы о его сущности и границах применения, поэтому в научной литературе можно встретить самые разные его определения. Один из вариантов повышения эффективности правовой регламентации такого вида ответственности видится в процессуальном сопровождении правонарушителей в лице комиссий по делам несовершеннолетних, которые призваны защищать их права. Альтернативой в решении насущных проблем административной ответственности несовершеннолетних могло бы стать использование успешного опыта ряда других стран, в которых был понижен возраст наступления такой ответственности с 16 до 14 лет для определенного перечня правонарушений. Однако авторы исследования пришли к выводу о том, что назрела необходимость в более глубокой реформе института административной ответственности несовершеннолетних и связанных с ним социальных служб., The relevance: this study is due to the fact that the upbringing of the younger generation, the protection of the rights and interests of minors have always been the focus of the Russian, and earlier Soviet, state and all its public institutions. Currently, the problems of administrative responsibility of minors who commit offenses at the age of 16 to 18 years (Article 2.3 of the Code of Administrative Offenses of the Russian Federation), and even at a younger adolescence, have become, more than ever, of particular relevance, they are acute (resonant) in nature, periodically attract the attention of the general public and the media. The reasons for this lie, on the one hand, in the constantly changing legislation, and on the other hand, in a significant increase in offenses committed by adolescents. At the same time, the nature of administrative torts is sometimes frankly antisocial, arrogant and cynical, bordering on signs of mental abnormalities. It must be admitted that in modern conditions, minors turned out to be the least protected category of citizens of our society. Teenagers are more likely than adults to experience a state of stress, greater mental impact and irritation. Their spiritual life can be deformed under the influence of the Internet, computer games, “yard communication” with older teenagers with negative social attitudes that do not correspond to the traditional value orientations of modern Russian society. In this regard, the analysis of the legal status of minors, in which there are a number of problems, is of ongoing importance. This is connected not only with the legal regulation of the administrative responsibility of adolescents, but also with law enforcement practice, the actual execution of the punishments imposed on them. In addition, the current administrative legislation regulating the liability of minors is of a two-level nature (the Code of Administrative Offenses of the Russian Federation and the laws of the constituent entities of Russia). In our opinion, the legal basis of this responsibility has passed to us since the Soviet period and does not correspond to the prevailing modern social relations. Under these conditions, the elimination of “gaps” and contradictions, the proposal of various ways to solve them is very urgent and relevant. The problem statement: In the community of administrative scientists, scientific discussions and searches for solutions to the problems of administrative responsibility of minors are currently being actively conducted. The study of various scientific approaches to these problems will significantly enrich the theoretical foundations of the entire institution of administrative responsibility of adolescents, and will show the variety of methods and forms used in its assessment. Indicate possible ways of its further development. The purpose of the study: is to develop new approaches to the perception of the essence of the administrative responsibility of minors, highlight the current problems of this kind of responsibility and make proposals for their solution. The research methods: materialistic dialectics, philosophical conceptology, logical-legal, system-structural, analysis of documents, development of proposals. The results and key conclusions: the analysis of certain aspects of the commission of administrative offenses by minors in Russia allows us to state that today the concept of “administrative responsibility of minors”” is not enshrined in any legal act, which raises numerous questions about its essence and limits of application, therefore, in the scientific literature you can find a variety of definitions. One of the options for increasing the effectiveness of the legal regulation of this type of responsibility is seen in the procedural support of offenders in the person of commissions on juvenile affairs, which are designed to protect their rights. An alternative option in solving the pressing problems of administrative responsibility of minors could be to use the successful experience of a number of other countries in which the age of such responsibility was lowered from 16 to 14 years for a certain list of offenses. However, the authors of the study came to the conclusion that there is a need for a deeper reform of the institution of administrative responsibility of minors and related social services.

The art. 36.17 of Organic Law 4/2015, of March 30, on the Protection of Citizen Security (LOPSC) classifies as a serious administrative offence «The transfer of people, with any type of vehicle, in order to facilitate them access to toxic drugs, narcotic drugs or psychotropic substances, provided that it does not constitute a crime». With this precept, the legislator pursues the phenomenon of drug taxis. However, given the wording of the precept, it seems that the described conduct could also be subsumed in the type of drug-trafficking offence of art. 368 CP, in its aspect of promoting, favouring or facilitating the illegal consumption of toxic drugs. This paper explains the differences between both offences and concludes that the transfer carried out at the request of the trafficker constitutes complicity in the crime of drug trafficking, while the transfer carried out at the request of the consumer constitutes an administrative offence. Con este precepto, el legislador persigue el fenó meno de las cundas o los taxis de la droga. Sin embargo, dada la redacción del pre cepto, parece que la conducta descrita también podría subsumirse en el tipo del delito de tráfico de drogas del art. 368 CP, en su vertiente de promoción, favorecimiento o facilitación del consumo ilegal de drogas tóxicas. En este trabajo se explican las diferencias existentes entre ambos ilícitos y se concluye que, si el traslado se realiza por petición del traficante, constituye complicidad del delito de tráfico de drogas, mientras que, si se realiza a petición del consumidor, constituye infracción adminis trativa de la LOPSC. - Abstract
In the article I deal with the basic requirements of the liability for administrative offences. The administrative offence is defined as a conduct of a natural or legal person which is violating public law duties, interferes into social relations and which has formal as well as material elements expressed by the law. The law defines the punishment applied by the administrative authority. Formal elements of the administrative offence involve physical elements which are: conduct (positive or negative act in violation of public law), causal relationship and the consequence - effect. The administrative liability is based on the existence of the causal relationship (causal nexus) between the conduct and the effect. In the context of administrative punishment it is not enough to detect harmful consequence - effect. A prerequisite for the application of liability for administrative offences is always unlawful conduct which is associated with the effect through the causal realationship. When analysing the administrative liability it must be distinguished between the form of no-fault liability and the fault liability. [ABSTRACT FROM AUTHOR]

1 Proceeding on administrative offences of legal persons in first instance Abstract: The administrative law represents wide and significantly fragmented area of the law system. There is no doubt the part of administrative law are also rules of administrative punishment including the corresponding procedural regulation. This thesis provides the basic analyses of selected aspects of the legal regulation of the proceeding on administrative offences of legal persons in first instance affective in Czech Republic. The basic source of law in this area is Act no. 250/2016 Coll., on the responsibility for administrative offences and on procedure on it, as amended (in this thesis also referred only as "act on administrative offences"). However, that act is not the only on regulation governing the proceeding on administrative offences. - Abstract
This paper examines the fines for administrative offences in public procurement to consider whether their extent can be explained using an econometric approach. These fines, in the Czech Republic, are imposed by the Office for the Protection of Competition. The Public Procurement Act specifies only the maximal level of the fine, however, its actual value depends on the discretion of the Office. This paper analyses the decisions of the Office since 2010 and using multiple linear regression tries to explain the amount of fines. The study examines the significance of parameters such as the size of the contracting authority, the type of award procedure, the number of administrative offences and their nature or the value of the procurement. Moreover, the study identifies which of the parameters are the best to estimate the fines and what accuracy this model achieves. [ABSTRACT FROM AUTHOR]

The main problem of the article is how to separate Article 259 Part 2 of the Criminal Code of the Republic of Lithuania and Article 44 Part 1 of the Administrative Offences Code of the Republic of Lithuania. In spite of the fact that this problem appeared in the doctrine of criminal law and in courts' practice quiet long time ago, it should be admitted that till now it has not been solved. his is the cause why this problem is topical. In author's opinion, the topicality is bigger in the context of times, when the courts' practice has changed. The article gives approval to this courts' practice, which is different of earlier, when the main focus was concentrated on Article 9 of the Administrative Offences Code, which gives priority to criminal liability. After the analysis of the latest court's decisions, it can be concluded that formal rules could not determine that crime or administrative offence was committed, but the biggest attention must be deflected to dangerousness of the offence. Every time there is a need to determine that crime or administrative offence was committed, a lot of various criteria must be analyzed, which describe the dangerousness of the offence: the amount and kind of drugs or psychoactive substances, the consequences of committing an offence, the place, purpose, intensity, duration and motivation of the acts. In spite of the large number of such criteria, according to the author's opinion, the main attention should be given to the amount and kind of drugs or psychoactive substances. Other features should not have a significant value. However, the problematical situation has not been solved, although it became better than before. The next chapter of the article is focused on the most significant criteria that could have the greatest influence on the legislator while deciding to criminalize a certain act. Sustaining these criteria, the author doubts the criminalization of Article 259 Part 2 of the Criminal Code. According to these features, only two alternative acts of this Article are analyzed -- "keeping" and "obtaining", but it is noted that other acts could be assessed in the same way. Therefore, the author proposes decriminalize this crime and put this offence to the Administrative Offences Code. he author notes that there are some others ways to solve this problem, but, according to the author, this way is the best. The article is finished with the findings. It is suggested to pay an appropriate attention to dangerousness of an offence, when delimitating offences is needed. Also, a proposal is given to legislator concerned with the decriminalization of Article 259 Part 2 of the Criminal Code. [ABSTRACT FROM AUTHOR]

The article examines the individualization relative to the administrative liability. The author underlines insufficient attention of the legal science to the issue of individualization of the legal responsibility highlighting this not only regarding the labor, civil legal institutions of responsibility but also administrative, criminal and relevant areas of law, where requirements to individualization are the most focused and are relatively fully and densely manifested. The author underlines that establishing the administrative liability for committed administrative offence requires assessment of the essence and extent of the public danger, as well as the personality of offender with regard to all features characterizing him. The article makes conclusions that the personality of offender has significant value for individualization of the administrative liability. The main conclusion that is made upon results of the research is that individualization of legal liability shall become the fundamental idea ensuring differentiation of administrative liability for committed administrative offence with regard to legal, psychological and social demographic features of the offender personality aimed at protection of rights and legal interests of the offender on the one hand, and public interests on the other hand. Besides, the author has detected the obvious necessity of the further scientific research and introduction into the legal and law enforcement practice of the individualization of administrative liability, the use of the entire range of tools for offence prevention, which ultimately will have positive effect on the state of the fight against offences and crimes, while ignoring of individualization of administrative liability can result in reduction of effectiveness of such liability and its goals, №2(47) (2019)

Relation between Administrative and Criminal Offenses Abstract This thesis deals with the analysis of the relation between two public offenses; administrative offenses as delicts of administrative law to criminal offenses as delicts of criminal law. The thesis introduces the historical development in the Czech lands, illustrating the origin of the division of offenses of public law and its gradual transformation over time. The chapter on history concludes with the description of the models of relation between administrative and criminal offenses which have arisen in civil law over the course of history. It is followed by an analysis of the conceptual features of offenses de lege lata, in which the definition of an administrative offense is compared to the definition of a crime. The main topic of the thesis is the boundary between administrative offenses and criminal offenses, which compares the current legal regulation with the theoretical basis and further analyses the aspects of the division of public-law offenses with the indication of alternative possibilities of this division. 1 Abstract - Administrative penalties and protection measures Description of all administrative penalties and protection measures is the primary goal of this thesis. Due to wide extent of chosen subject, this work aims to individual categories of administrative penalties and protection measures, examines every single condition for its imposition a notices possible contradiction within legislation. The thesis does not include the criteria for imposing penalties, noticed set from section 37 till section 44 Contraventions Act which serve as instruments for determination and length of penalties. Concurrence of contraventions is also not included. In the opening chapter the definition and description of an administrative liability is described as well as basic issues of administrative penalization, considered to be a part of administrative authority's activity. The resemblance of principles of criminal and contravention law is described, that leads to using the same principles either in criminal and contravention law.
