In studying the global spread and implementation of liberal norms, scholars have moved from linear notions of norm diffusion and promotion to an emphasis on norm contestation. Contestation by the supposed beneficiaries and addressees has taken centre stage in both research on the norms that underpin global governance and in studies on democracy promotion and liberal peacebuilding. While the impetus of this scholarship is normative - to overcome the taken-for-granted nature of liberal norms - the concept of contestation itself is mainly used with an analytical interest. Yet, as we show in this article, contestation also comes with - oftentimes implicit - normative connotations. Focusing on the seminal work of Milja Kurki, Oliver Richmond, Antje Wiener, and Amitav Acharya, we reconstruct these normative connotations. It turns out that the normative take on contestation is fairly conventional in all four approaches. Contestation is largely seen as a means to enable dialogue, as illustrated by Acharya's metaphor of the Banyan tree. Fundamental conflicts over liberal norms ('battle scenes') are either not considered or seen as normatively undesirable. As a way forward, we propose a typology that enables scholars to empirically analyse contestation in its different expressions and suggest two strategies to normatively assess practices of contestation.

Heutige soziale, politische, wirtschaftliche und rechtliche Ordnungen erscheinen dagegen immer weniger eindeutig. Ziel dieses Bandes ist es, den Blick transdisziplinär für alternative Konzeptionen von Wirklichkeit zu öffnen. Dabei wird gefragt: Welche Ordnungen institutionalisieren sich jenseits von Demokratie, Nation und Staat? Inwiefern bestehen Ordnungen nebeneinander fort und überlagern sich in Zeit und Raum? Die Beiträge eröffnen eine Debatte, die moderne Paradigmen hinterfragt und die Eindimensionalität und Statik traditioneller sozialwissenschaftlicher Konzepte herausfordert.

At the turn of this cen­tury, a number of hy­brid courts were es­ta­blished to pro­secute the most severe crimes com­mit­ted in war­ring and post-conflict societies. It was hoped that the de­cisions would be viewed as more le­gi­ti­mate and the courts could be more ef­ficient through local inte­gration rather than the use of purely inter­national criminal courts. However, inter­ference by local elites, re­cur­rent fun­ding short­falls and a lack of owner­ship by inter­national actors quickly cooled en­thusiasm for hybrid criminal pro­se­cution. Since 2013, however, a new gen­eration of hybrid in­sti­tutions has been es­tablished. Lisbeth Zimmermann looks at what has been learned from the mis­takes of the first gen­eration, and what sig­ni­fi­cance hybrid courts could have in the future.

An­fang der 2000er Jahre wurde eine Reihe hy­bri­der Ge­richte ein­ge­richtet. Sie sollten schwerste Ver­brechen in Kriegs- und Nach­kriegs­ge­sell­schaf­ten ver­fol­gen. Durch die lokale Ein­bettung er­hoffte man sich höhere Le­gi­ti­mi­tät und Effek­ti­vi­tät als durch rein inter­nat­ionale Straf­gerichte. Doch die Ein­misch­ung lokaler Eliten, Unter­fi­nan­zier­ung und fehl­endes owner­ship inter­nat­io­naler Ak­teure sorgten schnell für Er­nüch­ter­ung und die hy­bride Straf­ver­fol­gung wurde nicht weiter aus­ge­baut. Seit 2013 gibt es eine neue Welle hy­brider In­sti­tu­tionen. Lisbeth Zimmermann unter­sucht, wie weit aus den Fehlern der ersten Ge­ne­ration ge­lernt wurde und dis­ku­tiert, welche Be­deu­tung hy­bride Ge­richte in Zu­kunft haben könnten.

Norms in international relations are frequently contested and subjects of controversy. According to existing research contestation of norms can either lead to their strengthening or weakening. But under which conditions does contestation lead to either one? The authors argue that the type of contestation matters to explain the strengthening or weakening effects. Contestation around the application of norms in a specific situation does not question the norm as such. On the other hand, contestation of the validity of a norm over time often leads to a weakening of the norm.

Die lokalen Reaktionen auf Demokratieförderung in fragilen Postkonfliktstaaten werden selten im Detail untersucht. Klassisch interessieren sich Theorien der Internationalen Beziehungen für Compliance-Prozesse und für die Bedingungen für die Übernahme von internationalen Normen. Kompliziertere Prozesse der 'Lokalisierung' und intermediäre Ergebnisse jenseits der Kategorien Widerstand und Normübernahme werden kaum studiert. Das Working Paper analysiert Lokalisierungskonzepte aus den Internationalen Beziehungen und benachbarten Disziplinen. Es argumentiert, dass eine neue Dimension der 'Aneignung' im Normübernahmemodell helfen kann, ein präziseres Bild von Zwischenergebnissen der Normdiffusion zu entwickeln. Die Kategorien der Einbettung und der Remodellierung von Normsets werden darum dem analytischen Kategoriensystem hinzugefügt. Die Signifikanz dieser Kategorien wird anhand der Analyse dreier Fälle von Demokratieförderung in Postkonflikt-Guatemala demonstriert: der Verbreitung von politischen und zivilen Menschenrechten, von Kinderrechten und von einer internationalen Rechtskommission. Insbesondere die Präzision der Ausarbeitung dieser Normsets scheinen die Ergebnisse der Aneignungsprozesse zu beeinflussen., Local reactions to democracy promotion in fragile post-conflict states are rarely analyzed in detail. Traditionally, International Relations theory is interested in the compliance with and conditions for the take-over of international norms. The more complicated processes of "localization" and intermediate outcomes beyond the categories of rejection and take-over are hardly taken into account. This paper reviews approaches to localization from International Relations and neighboring disciplines. It argues that adding a new dimension of appropriation to the model of norm take-over can help to derive a more precise picture of the intermediate outcomes of norm diffusion. For that reason the categories of "embedding" and "reshaping" of diffused norm sets are added to the analytical tool kit. The significance of these categories is demonstrated by analyzing three cases of democracy promotion in post-conflict Guatemala: the promotion of political and civil human rights, of children rights, and of an international justice commission. In particular the elaborateness and precision of these norm sets seem to influence the outcome of the appropriation process.
