Die Formulierung und Veröffentlichung von Sondervoten ist eine weit verbreitete, aber kontroverse richterliche Praxis. Momentan verbieten nur sieben Mitgliedsstaaten der Europäischen Union die Veröffentlichung von abweichenden richterlichen Meinungen vollständig, während die anderen Mitgliedsstaaten deren Publikation in irgendeiner Form erlauben. Zusätzlich hat die Diskussion um diese richterliche Praxis eine multinationale Bühne erreicht: während viele inter- oder supranationale Gerichte ihren Richtern ein explizites Recht gewähren, ein Sondervotum abzugeben, hat der Gerichtshof der Europäischen Union diesen Schritt noch nicht gesetzt. Die Europäische Union ist somit regelmäßig mit Forderungen hinsichtlich der Einführung von Sondervoten für diese Institution konfrontiert. Zusätzlich zu praktischen Diskussionen wurden abweichende richterliche Meinungen auch immer mehr zum Fokus von akademischen Debatten. Dies ist nicht nur in nationalen Disziplinen der Fall; der aufkommende interdisziplinäre Rechtsbereich des internationalen vergleichenden Verfassungsrechts, auch Global Constitutionalism genannt, untersucht beispielsweise die demokratischen Funktionen von Sondervoten. Unter Beachtung der aktuellen Entwicklungen und deren Anerkennung in der Literatur wird die Relevanz von Sondervoten eindeutig belegt.Viele akademische Diskussionen rund um das Thema Sondervoten kreisen jedoch rein um empirische Aspekte, die diese Praxis mit sich bringt. Normative Diskussionsbeiträge sind selten, und oft nur oberflächlich argumentiert. Diese Diplomarbeit untersucht abweichende richterliche Meinungen daher aus normativer Sicht. Zentrale Argumente gegen und für Sondervoten werden präsentiert. Danach wird geschlossen, dass die Vorteile von Sondervoten deren potenzielle Nachteile überwiegen. Zusätzlich betont die Diskussion die demokratischen Funktionen dieser Praxis. Darauf basierend wird argumentiert, dass Sondervoten in einem demokratischen Verfassungsstaat normativ gefordert sind.Das erste Kapitel enthält eine konzeptuelle und semantische Basis, anhand derer die potenziellen Nachteile von Sondervoten im zweiten Kapitel dargestellt werden. Dazu werden drei Argumente präsentiert und kritisch beleuchtet. Diese Argumente betreffen das Beratungsgeheimnis, die gerichtliche Autorität, und die richterliche Unabhängigkeit. Diesem Kapitel folgt die Diskussion von potenziellen Vorteilen von Sondervoten im dritten Kapitel. Dieses untersucht zudem den positive Einfluss, den Sondervoten in schwachen oder geschwächten Demokratien entfalten können. In diesem Zusammenhang wird die Praxis als demokratisches Instrument dargestellt, welches das Potenzial hat, demokratische Bestrebungen zu erleichtern und zu fördern. Das letzte Kapitel widmet sich einem behaupteten ‘Recht’ sowie einer behaupteten ‘Pflicht’ zur Abgabe eines Sondervotums. Mögliche verfassungsrechtliche Grundlagen für ein solches Recht werden dargestellt. Dem folgt eine Diskussion der Frage, ob es für eine richterliche Pflicht, ein Sondervotum abzugeben, eine normative Grundlage gibt. The expression and publication of separate opinions is a widespread, yet controversial judicial practice. Currently, only seven Member States of the European Union completely prohibit the publication of dissenting opinions, while the other Member States permit their publication in some way. Additionally, the discussion surrounding this practice has reached a multinational stage: while many inter- or supranational courts expressly grant their judges a right to dissent, the European Court of Justice is yet to take this step. The European Union is thus frequently confronted with demands to introduce separate opinions in this context. In addition to practical discussions, separate opinions have increasingly become the focus of scholarly debates. This is not only the case in national dogmatics; the emerging interdisciplinary field of international constitutional law, or global constitutionalism, for instance, particularly examines the democratic functions and impact of judicial dissent. Upon considering the contemporary developments and their recognition in academic debate, the relevance of judicial dissent becomes abundantly clear.However, many scholarly discussions of judicial dissent focus mainly on empirical aspects related to the practice. Normative approaches are scarce, and often only superficially discussed. This thesis thoroughly examines judicial dissent from a normative perspective. Central arguments against and in favour of separate opinions are presented. It is then determined that the benefits related to judicial dissent outweigh potential negative effects. Furthermore, the discussion highlights the democratic functions of judicial dissent. Building on these considerations, it is argued that judicial dissent is a normative requirement in a democratic, constitutionalist state.The first chapter outlines the conceptual and semantic foundations of judicial dissent. Building on this theoretical basis, the potential threats of judicial dissent are addressed in the second chapter. Three arguments, which concern the secrecy of deliberations, judicial authority, and judicial independence, are discussed and critically evaluated. Following the discussion of counter-arguments, the third chapter outlines the potential benefits of judicial dissent. This chapter also examines the healthy impact judicial dissent can have in weak(ened) democracies. In this context, the practice is be presented as a democratic tool with the potential to foster democratic efforts and legal developments. The final chapter addresses claims of a ‘right’ and an ’obligation’ to dissent. Potential constitutional foundations for such a right are outlined, followed by a discussion of the question whether normative grounds for a judicial duty to dissent exist. The improved medical care for craniocerebral injuries caused by traumatic or non-traumatic events leads to a constantly increasing number of patients who remain in a changed state of consciousness after intensive medical treatment. Usually the first stage is the Unresponsive Wakefulness Syndrome (UWS), which may change into a Minimally Conscious State (MCS) from which patients may eventually regain full consciousness. Especially for UWS patients the early detection of first signs of consciousness could support the creation of individual treatment plans. However, in addition to the classification of disorders of consciousness, the prediction of the clinical course is also an important point in the daily lives of practitioners and, above all, the relatives of patients. The thesis deals with the question of how reliably different electroencephalographic (EEG) parameters can determine consciousness in these patients and whether a regaining of consciousness in these patients can be predicted by EEG markers identified in ERP and resting-state EEG data. To this end, it was examined how reliable event-related potentials (ERP) can be measured in patients with impaired consciousness (Study 1, Schorr et al., 2014) and whether UWS patients can be distinguished from MCS patients on the basis of these measurements. Patients were tested with an oddball paradigm several times on the same day and on different days. In the next step, connectivity, more precisely, coherence, i.e., the synchronous activation of different brain areas, was examined in UWS and MCS patients. On the one hand, with regard to the differentiation between these two states of consciousness and on the other hand with regard to the significance of coherence patterns for the course of the disease. EEG data from 73 patients was evaluated (coherence within parietal and frontal brain areas and coherence between frontal and parietal lobe) and patients were reassessed after one year to determine the current state of consciousness (Study 2, Schorr et al., 2016).The aim of the last study was to compare the usefulness of different EEG parameters, to distinguish between non-reactive and minimally conscious patients and to predict an improvement in the state of consciousness. For this purpose, already established methods (such as coherence, power analysis, entropy, microstates and complex network analyses) were compared together on a single data set for the first time and an attempt was made to determine whether an automated prediction is possible (Study 3, Stefan et al., 2018). In summary, it was demonstrated that a) the occurrence of ERPs is subject to strong fluctuations and this is reflected in a low retest reliability; a lack of ERP could be quickly interpreted as a lack of awareness, which could be prevented by repeated measurements at short time intervals; it was also demonstrated that b) coherence, power analysis, entropy, microstates and complex network analyses all predict the recovery of consciousness in UWS patients, and that c) an automated classification scheme can be used to predict recovery from UWS. The results suggest that the above measurements might be useful as biomarkers in predicting a positive course of unconsciousness disorders. This work lays the foundation for further research to apply the methods described on an individual basis in the future.

Gruppenangebote für Kinder aus Trennungs- und Scheidungsfamilien erfahren zur Zeit einen großen Aufschwung bei Trägern der freien und öffentlichen Jugendhilfe. Sie dienen dazu, eine Trennung und Scheidung für Kinder zu normalisieren, die Solidarität untereinander zu fördern und frühzeitig Bewältigungsstrategien zu vermitteln. Die Autor/innen stellen ein ausgearbeitetes Gruppeninterventionsprogramm vor, welches 17 Gruppensitzungen, 2 Elternabende sowie eine Vordiagnostik umfaßt. Ausgehend von amerikanischen Curricula wurde es speziell für Erziehungsberatungsstellen entwickelt. Erfahrungen bei der Indikation, der Durchführung, der Matrialauswahl und der Elternarbeit werden vorgestellt und diskutiert.

A vocation week program is described in which teachers, counselors and community resource people coordinated their activities to provide a comprehensive view to graduating high school students about various job opportunities. Films, seminars and discussions were used to achieve this purpose. A questionnaire answered by students indicated benefits and satisfaction. (SE)
