The advent of large language models (LLMs) and their adoption by the legal community has given rise to the question: what types of legal reasoning can LLMs perform? To enable greater study of this question, we present LegalBench: a collaboratively constructed legal reasoning benchmark consisting of 162 tasks covering six different types of legal reasoning. LegalBench was built through an interdisciplinary process, in which we collected tasks designed and hand-crafted by legal professionals. Because these subject matter experts took a leading role in construction, tasks either measure legal reasoning capabilities that are practically useful, or measure reasoning skills that lawyers find interesting. To enable cross-disciplinary conversations about LLMs in the law, we additionally show how popular legal frameworks for describing legal reasoning -- which distinguish between its many forms -- correspond to LegalBench tasks, thus giving lawyers and LLM developers a common vocabulary. Other Political Explanations [...], Scholarship on U.S. litigation and civil procedure has scarcely studied the role of private enforcement in the states. Over the past two decades, scholars have established that, almost uniquely in the world, the U.S. often relies on private parties rather than administrative agencies to enforce important statutory provisions. Take your pick of any area in American governance, and you will find private rights of action: environmental law, civil rights, employment discrimination, antitrust, consumer protection, business competition, securities fraud, and so on. In each of these areas, Congress has deliberately empowered private plaintiffs instead of, or in addition to, government agencies. Yet, despite the vast importance of private enforcement at the federal level, we have no account of how prevalent private rights of action are in state law. And this question is particularly pressing now that a number of states--triggered by the Texas abortion law S.B. 8--are using private enforcement to weaken constitutional rights. Is private enforcement a meaningful method of governance in the states or just at the federal level? Which political conditions lead to the adoption of state private enforcement? And why does it exist? In this Article, we conduct the first systematic empirical investigation of the hidden world of state private enforcement. Using computational linguistics and machine learning, we identify private-enforcement provisions across a unique dataset of all fifty states' laws going back to 2003. Our results show that private enforcement is ubiquitous at the state level. Even by conservative estimates, there are more than 3,500 private-rights-of-action provisions in state law, ranging from traditional areas like antitrust and employment all the way to privacy violations, lawsuits against police, gravedigging, veterinary care, and waste disposal. Counterintuitively, private-enforcement provisions are expanding the most in an ideologically mixed group of small states like Utah, New Hampshire, Connecticut, Nebraska, and Wisconsin. One takeaway from these results is that state private enforcement is strikingly different from that of the federal system--it is sprawling, messy, and even chaotic. We also use our data to test conventional theories behind private-enforcement adoption. The most prominent one--the separation-of-powers theory--posits that Congress enacts private rights of action when the executive is controlled by another political party. Our empirical bottom line is that we broadly fail to find evidence in favor of any of the theories, including separation of powers. Regression analyses based on our best estimates of private-enforcement provisions do not yield a statistically meaningful relationship between divided government and private-enforcement adoption. And, while some of our measures for fee-shifting and damage clauses unearth some evidence pointing toward the separations-of-powers theory, our preferred measures of such clauses do not. We even find no correlation between an increased adoption of private enforcement and legislative control by either Democrats or Republicans. It appears the political economy of private enforcement in the states diverges radically from that of the federal government. With an eye toward future theorizing and empirical testing, we put forth three institutional differences between the states and federal government that may explain this divergence. And we sketch a future comparative research agenda focused on studying federal-state divergence. Reaffirming the central role that private enforcement plays in our system reveals the need to reorient civil procedure and incorporate state private rights of action more explicitly into its core teachings.

For nearly two decades, technologies have reinvented document searches in complex litigation, normalizing the use of machine learning algorithms under the umbrella of "Technology-Assisted Review" ("TAR"). The latest technological developments are placing discovery beyond attorney understanding and firmly in the realm of computer science and engineering. As lawyers struggle to keep up, a creeping sense of anxiety is spreading in the legal profession about a lack of transparency and the potential for discovery abuse. Judges, attorneys, bar associations, and scholars warn that lawyers need to closely supervise the technical aspects of TAR and avoid the dangers of sabotage, intentional hacking, or abuse. But commentators have not fully defined what the risks entail, described in detail the potential dangers, or delineated the boundaries of debate. This Article provides a systematic assessment of the potential for abuse in TAR and offers three contributions. First, our most basic aim is to provide a technical but accessible assessment of vulnerabilities in the typical TAR process. To do so, we use the latest computer science research to identify and catalogue the different ways that TAR can go awry, either due to intentional abuse or mistakes. Second, with a better understanding of how discovery can be subverted, we then map potential remedies and reassess current debates in a more helpful light. The upshot is that abuse of technology-assisted discovery is possible but can be preventable if the right review processes are in place. Finally, we propose reforms to improve the system in the short and long term, with an emphasis on improved metrics that can more fully measure the quality of TAR. By exploring the technical background of discovery abuse, the Article demystifies the engineering substrate of modern discovery. Undertaking this study shows that with the right technical knowledge and assistance, lawyers can safeguard technology-assisted discovery without surrendering professional jurisdiction to engineers.

Objective: To analyze health services in the management of difficult airway in the operating room from the report of a clinical case. Method: Presentation of a clinical case of a 49-year-old male patient with a diagnosis of diabetes mellitus II plus bilateral renal lithiasis, who was prepared for emergency surgery due to a life-threatening condition of gallbladder lithiasis and sepsis. Results and conclusion: The patient was prepared for emergency surgery because of gallbladder lithiasis and life-threatening sepsis, which was first managed under a conductive anesthetic technique, which had to be changed to general anesthesia during the surgical procedure, and which was complicated by the finding of a difficult-to-manage airway., Objetivo: Analizar las enfermedades crónicas no transmisibles como factor de riesgo para una vía aérea difícil desde el reporte de un caso clínico. Método: Presentación de caso clínico de paciente masculino de 49 años, con diagnóstico de diabetes mellitus II más litiasis renal bilateral, que es preparado para cirugía de emergencia por presentar cuadro de litiasis vesicular más sepsis que comprometen su estado vital. Resultados y conclusión: El paciente es preparado para cirugía de emergencia por presentar cuadro de litiasis vesicular más sepsis que comprometen el estado vital, el cual en primera instancia es manejado bajo una técnica anestésica conductiva, que debe ser cambiada a anestesia general durante el procedimiento quirúrgico, y que se ve complicada por el hallazgo de una vía aérea de difícil manejo.

The rules of civil procedure depend on norms and conventions that control their application. Civil procedure is a famously rule-based field centered on textual commands in the form of the Federal Rules of Civil Procedure (FRCP). There are over eighty rules, hundreds of local judgemade rules, due process doctrines, and statutory rules, too. But written rules are overrated. Deep down, proceduralists know that the application of written rules hinges on broader norms that animate them, expand or constrain them, and even empower judges to ignore them. Unlike the FRCP and related doctrines, these procedural norms are unwritten, sociological, flexible, and informal. Norms shape every aspect of the litigation system, from the division of labor between state and federal judges, to the application of Rule 11 sanctions, discovery technology, and multidistrict litigation. Yet the field of civil procedure has not fully grappled with these procedural norms in a systematic way nor appreciated the power of norm-making to resolve current problems. This Article explores the influence of norms in civil procedure with three goals in mind. First, the Article argues that a wide array of litigation practices, culture, and conventions constitute what it calls "procedural norms." Conceptualizing civil procedure in this manner allows the Article to examine how these norms are created, changed, codified, or replaced. It also reveals the importance of norm entrepreneurs and the problem of sticky norms in civil procedure. Second, the Article's core goal is to explain the role of norms in civil litigation--how they organize judicial administration, serve as structural features of our litigation system, and distribute power among different legal actors, including federal and state judges. A surprising amount of our civil procedure law boils down to unwritten practices and conventions that form a large body of procedural norms. It is these norms that often implement the abstract values of our procedural system. And, crucially, because norms can trump textual commands, changes to the FRCP may be less relevant without a deeper account of the norms behind them. Finally, the Article argues that a pivot to norm-making can be an important corrective to the ossification of the federal rulemaking process. Procedural norms can solve litigation problems because they are flexible and sometimes even subversive--they prioritize values that are contrary to the commitments of the FRCP. Ultimately, the Article seeks to make norms a first-class citizen in the study of civil procedure, on par with rules and case law in their importance and significance. [ABSTRACT FROM AUTHOR]

Balloon aortic valvuloplasty (BAV) is a therapeutic option as palliative or bridging therapy in severe aortic stenosis, even though it is a risky procedure, especially in patients with concomitant left ventricular dysfunction. The use of percutaneous ventricular assist devices, such as the Impella CP, in this scenario provides optimal circulatory support and considerably reduces the risk of the procedure. Two patients with severe aortic stenosis and left ventricular dysfunction underwent BAV with the support of the Impella-CP. In order to be efficient, public administration requires changing the bureaucratic scheme for a managerial one, therefore, the adoption of innovative organizational practices is essential. In this sense, a literature review is carried out that aims to identify the relationships studied between knowledge management and innovation in the public sector, as well as the research trends that involve them. The research is developed under a qualitative approach and its scope is descriptive; the study considered a group of articles identified in the scopus database and others were added for consideration by the authors of the document. The results show a low number of documents that deal with studying the relationship between both themes. In the identified articles, the existence of a close relationship of knowledge management as a determinant for public innovation is evidenced, specifically from the knowledge transfer process. It is concluded that this field of study is prolific, with abundant opportunities to investigate and understand knowledge management and innovation in the public sector, given its particularities; Likewise, the need to link these fields of knowledge with topics of current debate, such as living labs, the technologies of the fourth industrial revolution, governance and citizen participation, was identified., Para ser eficiente, a administração pública requer a mudança do esquema burocrático para um gerencial, portanto, a adoção de práticas organizacionais inovadoras é essencial. Nesse sentido, realiza-se uma revisão de literatura que visa identificar as relações estudadas entre gestão do conhecimento e inovação no setor público, bem como as tendências de pesquisa que as envolvem. A pesquisa é desenvolvida sob uma abordagem qualitativa e seu escopo é descritivo; o estudo considerou um conjunto de artigos identificados na base de dados scopus e outros foram acrescentados para apreciação dos autores do documento. Os resultados mostram um baixo número de documentos que tratam de estudar a relação entre os dois temas. Nos artigos identificados, evidencia-se a existência de uma estreita relação da gestão do conhecimento como determinante para a inovação pública, especificamente a partir do processo de transferência do conhecimento. Conclui-se que este campo de estudo é prolífico, com abundantes oportunidades para investigar e compreender a gestão do conhecimento e a inovação no setor público, dadas as suas particularidades; Da mesma forma, identificou-se a necessidade de vincular essas áreas do conhecimento com temas de debate atual, como living labs, tecnologias da quarta revolução industrial, governança e participação cidadã., La administración pública para ser eficiente requiere cambiar el esquema burocrático por uno gerencial, por tanto, es fundamental la adopción de prácticas organizacionales innovadoras. En este sentido, se realiza una revisión de literatura que tiene como objetivo identificar las relaciones estudiadas entre la gestión del conocimiento y la innovación en el sector público, así como también las tendencias de investigación que involucren las mismas. La investigación se desarrolla bajo un enfoque cualitativo y su alcance es descriptivo; el estudio consideró un grupo de artículos identificados en la base de datos scopus y otros se agregaron a consideración de los autores del documento. Los resultados muestran un bajo número de documentos que se ocupan de estudiar la relación entre ambas temáticas. En los artículos identificados se evidencia la existencia de una estrecha relación de la gestión del conocimiento como un determinante para la innovación pública, específicamente desde el proceso de transferencia de conocimiento. Se concluye que este campo de estudio es prolífero, con abundantes oportunidades para investigar y comprender la gestión del conocimiento y la innovación en el sector público, dadas sus particularidades; asimismo se identificó la necesidad de vincular estos campos de conocimiento con temas de debate actual, tales como los living labs, las tecnologías de la cuarta revolución industrial, la gobernanza y la participación ciudadana.

Background Shared decision-making (SDM) between clinicians and patients is one of the pillars of the modern patient-centric philosophy of care. This study aims to explore SDM in the discipline of trauma and emergency surgery, investigating its interpretation as well as the barriers and facilitators for its implementation among surgeons. Methods Grounding on the literature on the topics of the understanding, barriers, and facilitators of SDM in trauma and emergency surgery, a survey was created by a multidisciplinary committee and endorsed by the World Society of Emergency Surgery (WSES). The survey was sent to all 917 WSES members, advertised through the society’s website, and shared on the society’s Twitter profile. Results A total of 650 trauma and emergency surgeons from 71 countries in five continents participated in the initiative. Less than half of the surgeons understood SDM, and 30% still saw the value in exclusively engaging multidisciplinary provider teams without involving the patient. Several barriers to effectively partnering with the patient in the decision-making process were identified, such as the lack of time and the need to concentrate on making medical teams work smoothly. Discussion Our investigation underlines how only a minority of trauma and emergency surgeons understand SDM, and perhaps, the value of SDM is not fully accepted in trauma and emergency situations. The inclusion of SDM practices in clinical guidelines may represent the most feasible and advocated solutions.

- Abstract
El liderazgo, la gestión estratégica y la gestión por procesos juegan un papel decisivo hoy en día. En efecto, las organizaciones y empresas se enfrentan permanentemente a una lucha por ser cada vez más competitivas. Es por lo anterior que se ofrece el Módulo sobre administración y liderazgo, con el propósito de facilitar en los participantes la comprensión sobre la importancia de ejercer el liderazgo de una forma correcta y que obtengan herramientas que les sirvan para el desempeño de su gestión. Entre los temas que cubre este Módulo se encuentra el de cómo liderar equipos, debido a que no solo se necesita fortalecer la confianza y la capacidad de los líderes, sino que ellos también se deben preparar para fomentar una cultura de compromisos en la que los miembros del equipo confíen en sus habilidades y se entusiasmen por contribuir desde los roles que desempeñan. La gestión estratégica se desarrolla en el Módulo a partir del conocimiento de herramientas como la identificación y el diagnóstico de debilidades, oportunidades, fortalezas y amenazas que pueden presentarse en la empresa o negocio, a lo cual se le suma el análisis de las diferentes variables de tipo interno y externo, que son aspectos básicos para la toma de decisiones. - Abstract
Introduction: Restructuring aspects within public organizations, one of them was the issue of professionalization of the public service, although this was initially raised for the high bureaucracy, as a starting point for managerial reform. Objective: The purpose of the article is to reflect on the relationship of the profile of the public administrator in Colombia from the social appropriation of knowledge and the challenges that industry 4.0 implies. Reflection: For both industry 4.0 and the social appropriation of knowledge, the profile of the Public Administrator is based on research and technological development and innovation in the organization and management of the State, citizenship and construction of the public. Conclusions: they correspond to the challenges of the profile of the professional in Public Administration, which must be clearly noticed the bet of what it implies to be located in the orientation of the methods and / or methodologies of research focused on the appropriation of knowledge and the use of technologies related to industry 4.0 that should lead to innovative products and services., Introdução: Aspectos de reestruturação nas organizações públicas, um deles foi a questão daprofissionalização do serviço público, embora esta tenha sido inicialmente proposta para umaelevada burocracia, como ponto de partida para uma reforma de gestão. Objectivo: O objectivo do artigo é reflectir sobre a relação entre o perfil do administrador público na Colômbia a partirda apropriação social do conhecimento e os desafios colocados pela Indústria 4.0. Reflexão: Tantopara a Indústria 4.0 como para a apropriação social do conhecimento, o perfil do administradorpúblico baseia-se na investigação e desenvolvimento tecnológico e na inovação na organização egestão do Estado, na cidadania e na construção da esfera pública. Conclusões: estas correspondemaos desafios do perfil do profissional na Administração Pública, que deve ser claramente vistocomo um compromisso com o que está implícito na orientação de métodos e/ou metodologias de investigação centradas na apropriação de conhecimentos e na utilização de tecnologias relacionadas com a Indústria 4.0 que devem conduzir a produtos e serviços inovadores., Introducción: Reestructurar aspectos al interior de las organizaciones públicas, uno de ellos fue el tema de la profesionalización del servicio público, aunque éste inicialmente se planteaba para alta burocracia, como punto de partida de la reforma gerencial. Objetivo: El propósito del artículo es reflexionar sobre el relacionamiento del perfil del administrador público en Colombia desde la apropiación social del conocimiento y los retos que implica la industria 4.0. Reflexión: Tanto para la industria 4.0 como la apropiación social del conocimiento el perfil del Administrador Público se sustenta en investigación y desarrollo tecnológico e innovación en la organización y gerencia del Estado, ciudadanía y construcción de lo público. Conclusiones: corresponden a los retos del perfil del profesional en Administración Pública, el cual debe advertirse claramente la apuesta de lo que implica ubicarse en la orientación de los métodos y/o metodologías de la investigación enfocado hacia a la apropiación del conocimiento y el uso de las tecnologías relacionadas con la industria 4.0 que deben conducir a productos y servicios innovadores.
