International law demands that States provide victims of human rights violations with a right to remedy, also in the case of violations of human rights by legal entities. International law also provides some indications as to how State and non-State based dispute resolution mechanisms should be like, in order to fulfil the human rights standards of the right to remedy. Dispute resolution mechanisms of an initially commercial nature, such as arbitration or mediation, could become very useful grievance mechanisms to provide redress for victims of human rights abuses committed by multinational corporations. Es habitual que los inversores traten de alcanzar estos objetivos introduciendo cláusulas de estabilización en los contratos de inversión. La clasificación, validez y efectos de tales cláusulas está sujeta a cierta controversia porque, entre otras cuestiones, puede afectar a la soberanía legislativa de los estados. Once the applicable law is chosen in order to govern the contract between the sovereign entity and the investor or simply in order to govern their economic relationship as a whole, the investor usually feels the need to protect that choice, making sure the sovereign entity does not alter it by introducing new conditions in their relationship or new regulations. It is common that investors try to achieve these purposes by introducing stabilisation clauses in investment contracts. The classification, validity and effects of such clauses is subject to some controversy because, among other issues, it may affect the legislative sovereignity of states.

Los estudios superiores de Derecho han sido tradicionalmente muy provincianos y los juristas han estado, durante siglos, muy ligados a sus respectivos países. Todavía hoy, a pesar del Mercado Único Europeo, los abogados europeos encuentran más dificultades que otros profesionales para trabajar en el extranjero. Sin embargo, a medida que la globalización se extiende, los abogados deben desarrollar la habilidad de trabajar más eficazmente con clientes y compañeros de diversos estados, en transacciones comerciales altamente complejas. Interesantes iniciativas alrededor del mundo están dando forma a los futuros abogados globales. La Facultad de Derecho de la Universidad de Navarra dirige un programa que ofrece a sus estudiantes formación en Derecho Anglo-Americano, Derecho del Comercio Internacional y diversos ordenamientos jurídicos. Desde el primer curso se ofrecen asignaturas sobre Derecho de los Estados Unidos, dados por profesores de Estados Unidos, usando la metodología de las Escuelas de Derecho norteamericanas. Junto a prácticas en el extranjero y a un elenco de otras ofertas en Derecho comparado, este programa presenta un modelo para la educación jurídica en Europa, dado que estos profesionales jóvenes no sólo se beneficiarán de la perspectiva racionalista continental sino también de la empírica anglosajona y serán más fácilmente asimilados por el mercado global de trabajo.

La presente nota introduce y analiza la Ley Modelo Dahl, elaborada por el jurista argentino Henry S. Dahl y que pretende ayudar y estimular a países latinoamericanos a mejorar sus recursos cara a la Litigación Internacional en materia de Derechos Humanos. En la nota se analizan cuidadosamente la Exposición de Motivos y el articulado de la Ley, que se divide en 7 artículos: competencia (foro de necesidad), aplicación a personas físicas y jurídicas, imprescriptibilidad de las acciones, admisibilidad de la prueba extranjera, indemnizaciones conforme a derecho extranjero, apelaciones y notificaciones por correo certificado. La nota también describe la presente situación de la Litigación Internacional en materia de Derechos Humanos, haciendo referencia a la perspectiva Norteamericana, Europea y de las Naciones Unidas. The note below introduces and analyzes the Dahl Model Law, drafted by the Argentinian jurist Henry S. Dahl and whose intention is to help and stimulate Latin American countries in order to improve their resources in the field of Transnational Human Rights Litigation. There is a careful analysis of the Recitals of the law and its seven sections: jurisdiction (forum of necessity), application to physical and legal persons, the inexistence of a statute of limitation, admissibility of the evidence found abroad, damages according to foreign law, appeals and notifications by certified mail. This note also describes the present state of Transnational Human Rights Litigation, making reference to the US, European and United Nations perspective.
