Connexins form intercellular communication channels known as gap junctions (GJs), which are found throughout the vertebrate species. GJs formed by different connexins harbor unique channel properties that have not been fully defined. High-resolution structures of native Cx46 and Cx50 GJs from sheep (sCx46 and sCx50) were recently resolved. Molecular dynamics studies identified the NT domains, especially the 9th position, as key determinants in the differences of energetic barrier to K+ permeation in sCx46 and sCx50 GJs. We studied functional properties of GJs formed by sCx46, sCx50, NT domain swapped chimeras (sCx46-50NT and sCx50-46NT), and point variants at the 9th residue (sCx46-R9N and sCx50-N9R) in GJ-deficient N2A cells. We found that these variants formed functional GJs except sCx46-50NT. Altered single channel conductance, open dwell time, and Vj-gating in these variants indicate that that the NT-domain is important for the rate of ion permeation, open stability, and Vj-gating of these GJs.

In every country in the world parties to private litigation are subject to a predetermined fee shifting regime. While there are no institutionalized opt-out provisions so far, we demonstrate that such provisions could improve welfare. We argue that private negotiations are not a viable alternative to such opt-out provisions. We derive the conditions under which welfare improvements occur and suggest an applicable design for such an opt-out scheme.

Die vorliegende kumulative Dissertationsschrift hat insgesamt drei ausgewählte Themengebiete der Rechtsökonomik zum Gegenstand, die insbesondere von gesellschafts- und wirtschaftspolitischer Relevanz sind und teilweise aktuelle deutsche Rechtsprechungen zum Gegenstand haben. Auf diese Weise behandelt das erste Themengebiet der vorliegenden Arbeit die "Rechtsanwaltsvergütung" mit besonderer Berücksichtigung der anwaltlichen Erfolgshonorare, die in Deutschland seit jeher gemäß § 49 b Abs. 2 BRAO a.F. explizit ausnahmslos untersagt waren. Von weniger aktueller Brisanz, aber von immenser Bedeutung für wesentliche Aspekte eines funktionierenden Rechtssystems befasst sich das zweite Themengebiet mit der "Allokation von Prozesskosten". Abschließend ist die letzte Abhandlung der vorliegenden Dissertation dem Themengebiet des "Rechtsanwaltsfranchising" gewidmet, das hiermit erstmals einer rechtsökonomischen Untersuchung unterzogen wird.

The so-called English Rule in § 91 ZPO has a longstanding tradition in German civil litigation. Although this “loser pays”- fee shifting can raise severe problems like sharply reducing access to the courts for parties of moderate means, the adaption of alternative cost regimes like the U.S.-style American Rule where no fee shifting occurs has never been seriously considered. What is more, the German debate seems to completely ignore the findings of the extensive law and economics literature on fee shifting. This paper addresses this task and surveys the theoretical and empirical literature on the effects of alternative fee shifting systems on a variety of decisions arising during the litigation process. In detail, we put some arguments supporting German-style fee shifting to the test: Does the German system really discourage low-probability-of-prevailing lawsuits that would be brought under the American Rule? Does it encourage the settlement of litigation? And does the German solution lead to lower costs of the legal system compared to alternative fee regimes? The findings indicate that the influence of different fee shifting rules on parties´ decision-making behavior is to a large extent ambiguous. Policy makers should be aware of these problems.
