President Carter's decision to switch diplomatic recognition from the ROC to the PRC created serious consequences for Taiwan. Under the proposals of his administration, the ROC would no longer be treated as a sovereign state in line with what international law considers a constitutive definition of statehood. However, Congress responded with the Taiwan Relations Act to provide stronger protection for its unofficial relations with Taipei. Indeed, the TRA implied that the U.S. would was tacitly applying declaratory theory in regard to the ROC's sovereignty because the TRA treats the ROC as if it were a state on the central issues for declaratory theory: treatymaking powers, securing the rights of Taiwanese litigants in US courts, sovereign immunity, and recognition of Taiwanese companies and property and respect for the Taiwanese judicial system and law and resolving the diplomatic immunities issues.
