Coordenação de Aperfeiçoamento de Pessoal de Nível Superior (CAPES) O presente estudo tem como objetivo analisar a contribuição das políticas afirmativas – de acesso ao ensino superior – para a igualdade racial na advocacia paranaense, a partir da percepção de advogadas negras que utilizaram tais políticas, entre elas: as cotas raciais, PROUNI e FIES. Para o alcance deste objetivo, tem-se como hipótese que as políticas afirmativas são imprescindíveis para a democratização do acesso ao Ensino Superior, destacando-se a relevância das cotas raciais para a promoção da igualdade racial no âmbito da advocacia paranaense, a partir de um enfoque à experiência de cotas na Universidade Federal do Paraná, particularmente no curso de Direito. Como metodologia de pesquisa, decidiu-se por realizar pesquisa qualitativa, mesclando, na fase documental, o levantamento de dados em fontes primárias de legislação brasileira e normas internacionais, tendo como foco a questão racial. Como fonte de informações e instrumento de coleta de dados, utilizaram-se entrevistas, buscando-se analisar em que medida as políticas afirmativas de acesso ao ensino superior propiciam a igualdade na advocacia paranaense. A investigação contou com seis advogadas auto declaradas negras, que utilizaram políticas afirmativas para o ingresso no curso de Direito. Todas tiveram um tempo mínimo de dois anos no exercício da atividade profissional da advocacia no Paraná. O trabalho analisa o arcabouço legal referente à garantia da igualdade racial no âmbito internacional e no ordenamento jurídico interno, focalizando o Brasil frente ao sistema de proteção de direitos humanos. Releva-se que ao princípio da igualdade, previsto na Constituição de 1988, é atribuído dois conteúdos distintos e complementares: a não discriminação e a promoção da igualdade, sendo que neste último se justificam as políticas afirmativas. Compreende-se neste trabalho que a igualdade entre os seres humanos é um pressuposto, e ao mesmo tempo um dos mais relevantes direitos humanos, por isso deve-se buscar a sua efetivação. Dentre as categorias doutrinárias que tratam da concepção de igualdade, dá-se ênfase na igualdade material, em sentido do reconhecimento de identidades, no caso, da identidade racial. As políticas afirmativas, no ensino superior, para a promoção da igualdade racial são fundamentais para tanto, e por isso são examinadas, tendo destaque as cotas raciais no âmbito da UFPR. A verificação da atividade profissional da advocacia e da trajetória da trabalhadora negra contribuiu para a reflexão sobre a situação das mulheres negras na advocacia, apoiada nos conceitos de relações de gênero, racismo e interseccionalidades. A partir das entrevistas, confirmou-se a imprescindibilidade das políticas afirmativas para acesso ao ensino superior. Confirmouse igualmente a existência (e resistência) do racismo também no âmbito jurídico, destacando-se a importância da utilização da interseccionalidade como ferramenta para combater a discriminação interseccional que atinge as mulheres negras. Como conclusão principal desta pesquisa, verificou-se a necessidade da manutenção das políticas afirmativas, no contexto do ensino superior, dada a comprovação de sua relevância para a promoção da igualdade racial, destacando a especial importância das cotas raciais, pois, conforme verificado, esta possui maior potencial para colaborar na construção de uma sociedade realmente mais justa e igualitária. The present study aims to analyze the contribution of affirmative policies – of access to higher education – to racial equality in Paraná’s advocacy, from the perception of black lawyers who used such policies, among them: racial quotas, PROUNI and FIES. In order to achieve this objective, it is hypothesized that affirmative policies are essential for the democratization of access to Higher Education, highlighting the relevance of racial quotas for the promotion of racial equality within the scope of Paraná’s advocacy, based on a focus on the experience of quotas at the Federal University of Paraná, particularly in the Law Course. As a research methodology, it was decided to carry out qualitative research, mixing documentary phase, with data collection in primary sources of Brazilian legislation and international standards, focusing on the racial issue. As a source of information and a tool for data collection, interviews were used, seeking to analyze the extent to which affirmative access policies to higher education provide equality in Paraná’s advocacy. The investigation counted on six self-declared black lawyers, who used affirmative policies to enter the Law Course. All of them had a minimum time of two years in the exercise of the professional activity of law in Paraná. The paper analyzes the legal framework regarding the guarantee of racial equality at the international level and in the internal legal system, focusing on Brazil in the face of the human rights protection system. It should be noted that the principle of equality, provided for in the 1988 Constitution, is attributed two distinct and complementary contents: non-discrimination and the promotion of equality, with affirmative policies justified in the latter. It is understood in this work that equality between human beings is an assumption, and at the same time. One of the most relevant human rights, that is why it must be sought to bring it into effect. Among the doctrinal categories that deal with the concept of equality, emphasis is placed on material equality, in the sense of recognizing identities, in this case, racial identity. Affirmative policies, in higher education, for the promotion of racial equality are fundamental for this, and for this reason they are examined, with emphasis on racial quotas within the scope of UFPR. The verification of the professional activity of the advocacy, and the trajectory of the black worker contributed to the reflection on the situation of black women in the advocacy, supported by the concepts of gender relations, racism and intersectionality. From the interviews, the affirmation of affirmative policies for access to higher education was confirmed. The existence (and resistance) of racism was also confirmed in the legal sphere, highlighting the importance of using intersectionality as a tool to combat intersectional discrimination that affects black women. As the main conclusion of this research, the need to maintain affirmative policies was verified, in the context of higher education, given the evidence of its relevance for the promotion of racial equality, highlighting the special importance of racial quotas, because, as verified, this has the greatest potential to collaborate in the construction of a truly more just and egalitarian society.

Este estudo investigou o brincar no contexto da proteção social básica da Política Nacional de Assistência Social (PNAS), especificamente na modalidade de Serviço de Convivência e Fortalecimento de Vínculos (SCFV) para crianças de 6 a 15 anos. O estudo esteve vinculado a linha de pesquisa “Tecnologia e Trabalho” do Programa de Pós Graduação em Tecnologia e Sociedade (PPGTE) da Universidade Tecnológica Federal do Paraná (UTFPR) que propõe análise e reflexão crítica e contextualizada do trabalho no âmbito das relações e neste sentido reflete acerca do trabalho de Educadoras Sociais e as relações em seu cotidiano de trabalho e como o brincar se faz uma tecnologia que pode mediar essas relações. A pesquisa se desenvolveu através de um estudo descritivo-exploratório, de caráter qualitativo e buscou identificar os significados do brincar no cotidiano de trabalho de Educadoras Sociais em instituições que atendem crianças e adolescentes (de 6 a 15 anos) em vulnerabilidade social na modalidade de SCFV. Os procedimentos de pesquisa envolveram o estudo teórico, revisão de literatura e pesquisa de campo através da aplicação de entrevista semiestruturada e análise de imagens. Participaram do estudo de campo 5 Educadoras Sociais de 2 instituições não governamentais da assistência social do município de Curitiba, Paraná, que, conforme previsto nos documentos norteadores da PNAS e do SCFV, executam SCFV atendendo crianças e adolescentes, de 6 a 15 anos. O estudo teórico resultou na identificação de quatro conceitos sobre o brincar que são centrais na perspectiva histórico cultural e um conceito central nos documentos norteadores do SCFV: (1) o conceito da situação imaginária; (2) função e ação dos objetos na situação de brincadeira; (3) Mobilidade – entrar e sair do mundo real e imaginário; (4) Imaginário coletivo e individual; (5) Convivência e vínculo. Estes conceitos se traduziram em categorias teóricas do estudo. Já as categorias empíricas relacionadas ao brincar foram selecionadas pela pesquisadora posteriormente a pesquisa de campo, sendo elas: (1) Brincar como ferramenta de trabalho; (2) Brincar como facilitador da expressão de emoções e facilitador do desenvolvimento da criatividade; (3) Brincar como meio de compreender a realidade da criança; (4) Brincar promove a socialização e o vínculo; (5) Brincar facilita a introdução de temas relativos ao trabalho da Educadora Social; (6) Brincar direcionado pela educadora social X Brincar livre. A análise e discussão a partir dos dados teóricos e empíricos permitiram estabelecer um diálogo entre as informações encontradas a partir das imagens e das respostas das Educadoras Sociais e os dados teóricos. O resultado do estudo evidencia como o brincar está presente no cotidiano de trabalho das Educadoras Sociais a partir dos significados atribuídos ao brincar pelas próprias profissionais. O estudo contribuiu para o avanço das reflexões sobre as políticas públicas existentes no contexto de atendimento de SCFV com enfoque no direito de superação da situação de vulnerabilidade através de dinâmicas que propiciem o brincar. Além disso, a discussão dos dados demonstra a importância e necessidade de aprofundamento das discussões acerca da formação da profissional Educadora Social. This study investigates play in the context of the basic social protection of the National Social Assistance Policy (PNAS), specifically in the form of Coexistence Service and Strengthening Bonds (SCFV) for children aged 6 to 15 years. The study is linked to the research line “Technology and Work” of the Post-Graduation Program in Technology and Society (PPGTE) of the Federal Technological University of Paraná (UTFPR), which proposes critical and contextualized analysis and reflection of work within the scope of relationships and in this context. Sense reflects on the work of Social Educators and the relationships in their daily work and how playing is a technology that can mediate these relationships. The research was developed through a descriptive-exploratory study, of a qualitative character and sought to identify the meanings of playing in the daily work of Social Educators in institutions that serve children and adolescents (from 6 to 15 years old) in social vulnerability in SCFV modality. The research procedures involved theoretical study, literature review and field research through the application of semi-structured interviews and image analysis. Participated in the field study 5 Social Educators from 2 non-governmental social assistance institutions in the city of Curitiba, Paraná, who, as provided for in the PNAS and SCFV guiding documents, execute SCFV serving children and adolescents, from 6 to 15 years old. The theoretical study resulted in the identification of four concepts about playing that are central to the cultural historical perspective and a central concept in the SCFV guiding documents: (1) the concept of the imaginary situation; (2) function and action of objects in the play situation; (3) Mobility – entering and leaving the real and imaginary world; (4) Collective and individual imagery; (5) Coexistence and bond. These concepts were translated into theoretical categories of the study. The empirical categories related to playing were selected by the researcher afterwards the field research, which are: (1) Playing as a work tool; (2) Play as a facilitator of the expression of emotions and a facilitator of the development of creativity; (3) Playing as a means of understanding the child’s reality; (4) Playing promotes socialization and bonding; (5) Play facilitates the introduction of themes related to the work of the Social Educator; (6) Play directed by the social educator X Play free. The analysis and discussion from the theoretical and empirical data allowed to establish a dialogue between the information found from the images and the responses of the Social Educators and the theoretical data. The result of the study shows how playing is present in the daily work of Social Educators based on the meanings attributed to playing by the professionals themselves. The study contributed to the advancement of reflections on the existing public policies in the context of assisting SCFV with a focus on the right to overcome the situation of vulnerability through dynamics that encourage play. In addition, the discussion of the data demonstrates the importance and need to deepen the discussions about the formation of the professional Social Educator.
