Em nítido movimento de promoção da autonomia patrimonial dos cônjuges, o vigente Código Civil autoriza a alteração do regime de bens, nos termos do art. 1.639, § 2º, tendo flexibilizado a aplicação do princípio da imutabilidade do regime matrimonial, que vigorou de modo absoluto sob a égide da Lei Civil anterior. No entanto, a disciplina legal permite a forte presença do Estado, na medida em que a mudança do regime de bens depende de autorização judicial e da apuração da procedência das razões invocadas, além de resguardar os direitos de terceiros. Investiga-se, portanto, se a atual sistemática é compatível com os princípios constitucionais, em especial a mínima intervenção estatal nas relações familiares paritárias, a autonomia negocial dos cônjuges e a privacidade familiar. Neste sentido, o presente texto almeja analisar, em perspectiva crítica, por meio do método indutivo exploratório e pesquisa bibliográfica e jurisprudencial, a configuração da disciplina de alteração do regime de bens à luz da mínima intervenção do Estado nas relações familiares e da promoção da liberdade dos cônjuges, em especial a partir do exame do julgamento do Recurso Especial n. 1.904.498 pelo Superior Tribunal de Justiça.

O consentimento informado é fundamental para respeitarem-se os direitos do paciente psiquiátrico. Trata-se de um direito expressamente previsto na Lei Brasileira de Inclusão da Pessoa com Deficiência, sendo vedada a internação forçada. Até mesmo o paciente submetido à curatela deve participar, na medida de suas condições, sobre as decisões pertinentes ao seu tratamento. Uma internação psiquiátrica involuntária prolongada que desatende aos perfis estrutural e finalístico talhados na lei viola os direitos à autonomia, à integridade, à saúde e à liberdade da pessoa que foi a ela submetida. A responsabilidade civil do médico pela internação psiquiátrica involuntária emerge da culpa assim caracterizada pela dissonância entre a atuação profissional e as normas legais e deontológicas.

Abstract Objective To evaluate the influence of polymorphisms on genes encoding type I collagen and the genetic susceptibility of tendinopathy. Methodology Case-control study involving 242 Brazilian athletes from different sports modalities (55 cases of tendinopathy and 187 controls). The polymorphisms COLIAI (rs1107946) and COLIA2 (rs412777, rs42524, and rs2621215) were analyzed by theTaqMansystem. Odds ratio(OR)withtheir 95% confidence intervals (CIs) were calculated using a nonconditional logistic regression model. Results The mean age was 24.0 ± 5.6 years old and 65.3% were men. Of the 55 cases of tendinopathy, 25.4% had > 1 affected tendon, the most frequent being patellar (56.3%), rotator cuff (30.9%) and elbow or hand flexors (30.9%). Age and amount of time of sports practice were associated with a higher chance of presenting tendinopathy (5 and 8 times, respectively). The frequency of variant alleles in control and case patients, respectively, was: COLIAI rs1107946 24.0 and 29.6%; COLIA2 rs412777 36.1 and 27.8%; rs42524 17.5 and 25.9%; and rs2621215 21.3 and 27.8%. After adjusting for confounding factors (age and years of sports practice), COLIA2 rs42524and rs2621215 polymorphisms were associated with increased risk of tendinopathy (OR = 5.5; 95% CI = 1.2-24.6 and OR = 3.9; IC95% = 1.1-13.5, respectively). The haplotype COLIA2 CGT was associated with low risk for disease development (OR = 0.5; 95%CI = 0.3-0.9). Conclusion Age (≥ 25 years old), time of sports practice (≥ 6years) and polymorphisms in the COLIA2 gene increased the risk of developing tendinopathy.

O presente artigo tem por objetivo analisar os atuais contornos da filiação no direito brasileiro à luz da legalidade constitucional a partir de sua aplicação pelos tribunais superiores brasileiros. A pluralidade dos arranjos familiares e a dinâmica de suas composições repercutem de forma direta nos critérios de atribuição do vínculo de parentesco e enseja renovada e aprofundada análise da filiação a partir da perspectiva dos interesses do filho. Nesse sentido, examina-se a constituição do vínculo jurídico de filiação, investigando os seus modos de imputação a partir dos critérios biológico, socioafetivo e da adoção à brasileira. Através de pesquisa doutrinária e jurisprudencial no âmbito dos tribunais superiores, demonstrou-se a possibilidade de coexistência entre a filiação socioafetiva e biológica, em patamar hierárquico equiparado, e que é direito do filho buscar o reconhecimento de sua parentalidade, mesmo após a morte do pai biológico, uma vez que lhe é facultado ter declarada a verdade biológica a qualquer tempo, com fundamento no princípio da dignidade humana, o qual na atualidade orienta o estabelecimento da filiação. Defende-se, por fim, que o entendimento que suprima os efeitos patrimoniais do reconhecimento da paternidade biológica assume natureza discriminatória, que afronta o princípio da plena igualdade entre os filhos, constitucionalmente assegurado.

Abstract Background High levels of the tumor necrosis factor alpha (TNF-α) induce apoptosis and pro-inflammatory effects for primary degeneration of tendon and development of tendinopathy. The aim of this study was to investigate the association between the TNF-α polymorphisms and tendinopathy in athletes. Methods Two hundred and seventy athletes (135 tendinopathy cases and 135 controls) were included and genotyped (TNF-α -1031T > C; -857 C > T; -308G > A) using TaqMan validated assays. The association of the polymorphisms with tendinopathy was evaluated by a multivariate logistic regression model, using odds ratios (OR) and 95 % confidence intervals (CI). Results The variant allele − 308 A was significantly associated with patellar (OR: 1.9; 95 % CI: 1.01–3.6) or Achilles tendinopathies (OR: 2.7; 95 % CI: 1.1–6.7). No significant differences were found in allele or genotype distributions of the − 1031T > C and − 857 C > T polymorphisms between cases and controls. TNF-α TCA haplotype was associated with increased tendinopathies risk, either considering all cases (OR: 2.6, 95 % CI: 1.3–5.3), patellar (OR: 3.3, 95 % CI: 1.5–7.3), rotator cuff (OR: 3.1, 95 % CI: 1.4–7.2) or Achilles tendinopathies (OR: 3.8, 95 % CI: 1.1–12.7). Conclusions These results suggest that the TNF-α polymorphisms could influence the susceptibility to developing tendinopathy among athletes. Knowledge of the TNF-α polymorphisms associated to tendinopathy in athletes can further understanding of the inflammatory role in the early stages of the disease and contribute for sports injury surveillance programmes, in which athletes with TNF-α TCA haplotype could be early subjected to cryotherapy after training and competition to avoid tendinopathy development.

Objective: A) To evaluate the reliability of a new technique for the measurement of both intermetatarsal and hallux valgus angles. B) To evaluate whether this technique can be performed with the aid of a smartphone application. Methods: Preoperative radiographs of 30 patients were evaluated by four observers, two experienced surgeons and two surgeons in training. They performed measurements of the intermetatarsal angle and hallux valgus angle using the classical method and using the new method, both employing a goniometer and a smartphone application. Analysis of agreement was done by quantifying the raw agreement and calculating the intraclass correlation coefficient (ICC). Results: The hallux valgus angle presented excellent agreement (ICC>0.80) both using the traditional method and the point connection method, while the intermetatarsal angle presented a very good agreement (0.60

Abstract Background Musculoskeletal injuries (MSK-I) are a serious problem in sports medicine. Modifiable and non-modifiable factors are associated with susceptibility to these injuries. Thus, the aim of this study was to describe the prevalence of and identify the factors associated with MSK-I, including tendinopathy and joint and muscle injuries, in athletes. Methods In this cross-sectional observational study, 627 athletes from rugby (n = 225), soccer (n = 172), combat sports (n = 86), handball (n = 82) and water polo (n = 62) were recruited at different sports training centres and competitions. Athlete profiles and the prevalence of MSK-I were assessed using a self-reported questionnaire. Only previous MSK-I with imaging confirmation and/or a positive physical exam by a specialized orthopaedist were considered. The association of the epidemiological, clinical and sports profiles of athletes with MSK-I was evaluated by a logistic regression model. Results The mean age was 25 ± 6 years, and 60% of the athletes were male. The epidemiological, clinical and sports profiles of the athletes were different for the five sport groups. The MSK-I prevalence among all athletes was 76%, with 55% of MSK-I occurring in a joint, 48% occurring in a muscle and 30% being tendinopathy, and 19% of athletes had three investigated injuries. The MSK-I prevalence and injury locations were significantly different among sport groups. There was a predominance of joint injury in combat sports athletes (77%), muscle injury in handball athletes (67%) and tendinopathy in water polo athletes (52%). Age (≥30 years) was positively associated with joint (OR = 5.2 and 95% CI = 2.6–10.7) and muscle (OR = 4.9 and 95% CI = 2.4–10.1) injuries and tendinopathy (OR = 4.1 and 95% CI = 1.9–9.3). Conclusion There is a high prevalence of tendinopathy and joint and muscle injuries among rugby, soccer, combat sports, handball and water polo athletes. The analysis of associated factors (epidemiological, clinical and sports profiles) and the presence of MSK-I in athletes suggests an approximately 4–5-fold increased risk for athletes ≥30 years of age. The identification of modifiable and non-modifiable factors can contribute to implementing surveillance programmes for MSK-I prevention.

A internalização da Convenção Internacional dos Direitos da Pessoa com Deficiência com hierarquia de norma constitucional e a promulgação do Estatuto da Pessoa com Deficiência (Lei n. 13.146/2015) constituem o marco normativo brasileiro de proteção da pessoa com deficiência, cujo objetivo central encontra-se na promoção do exercício das liberdades e dos direitos fundamentais em igualdade de condições com as demais pessoas de modo a permitir a inclusão social e a cidadania. A adoção do modelo social da deficiência impõe o afastamento da visão puramente biomédica e exige uma compreensão pautada na interação entre os impedimentos físicos, sensoriais, mentais e intelectuais, de longa duração e as barreiras que são socialmente impostas e impedem a plena participação social. Nessa esteira, a informação é um direito fundamental da pessoa com deficiência que oportuniza o alcance dos demais direitos, assumindo perfil peculiar vinculado à acessibilidade que depende de informações claras, objetivas e em formato alcançável. O acesso à informação é imprescindível para a busca da superação das barreiras e a efetiva inclusão. Em tempos de pandemia da Covid-19, informações acessíveis e recomendações sobre higienização pessoal, formas de mitigação de infecções, planos de restrições públicas tornam-se ainda mais relevantes para a preservação da saúde e da própria vida das pessoas com deficiência. Por meio do método hipotético-dedutivo e de pesquisa bibliográfica e documental, o presente artigo tem por escopo analisar a efetividade do direito à informação acessível da pessoa com deficiência em razão da pandemia da Covid-19

Motor current signature analysis (MCSA) enables non-invasive monitoring, without interruption of machine operation in a remote and online way, allowing the identification of various types of faults of electrical and mechanical nature without the need of accessing the motor itself, but only its supply cables. Despite its advantages, it has limitations in accurately diagnosing incipient roller bearing faults. For the detection of incipient roller bearing faults, envelope analysis of vibration signals is a well-known and stablished technique used by motor condition monitoring experts for a long time, overcoming MCSA for that purpose. Thus, it is proposed in this paper, that the fault characteristic frequencies of roller bearings are identified in the current spectrum with the aid of envelope analysis on the bearing vibration signal. After this aided identification, the fault related spectral components in the current spectrum can be correctly tracked over time for trending evaluation and decision-making. This approach can represent a significant economic value in a motor condition monitoring program, since vibration envelope analysis is performed only at a first step and, after that, its results can be applied for the MCSA monitoring of all same-model motor drivers in an industrial site. This approach is even more valuable considering the concept of the Self-Supplied Wireless Current Transducer (SSWCT) also proposed in this paper. The SSWCT is an Industrial Internet of Things (IIOT) device for MCSA application in an Industry 4.0 environment. This proposed device has wireless communication interface and wireless/battery less power supply, being supplied by the energy harvested from the magnetic field of the same currents it is transducing. So, it is a completely galvanic isolated monitoring device, without batteries and without any electric connections to the industry electric system, easily installable to the motor cables, not using precious space in the electric panels of the motor control centers and not having any physical contact to the monitored asset.

The objectives of this work were to produce biodegradable composites using starch and different agro-industrial wastes (coconut fiber, soy bran and sugarcane bagasse) using a baking process, and to study the effects of these components on the resultant composite properties. The addition of different residues yielded trays with different properties. Samples manufactured with soy bran showed the highest density and water uptake at relative humidities ≥ 60%. The addition of sugarcane bagasse resulted in less dense and resistant samples whereas coconut fiber composites showed the highest breaking stress. The samples fabricated in this study represent an alternative packaging option for foods with low water content.
