In the brutal armed conflicts which take place even in the 21st century, without a basic observance of the rules of war, serious violations of the basic human rights are almost always present. Some of the recent armed conflicts have been so cruel that they have violated everything that has been adopted so far as standards of human behavior in war conditions. In most contemporary armed conflicts, civilians are often deliberately targeted through the use of illegal means and methods of warfare. Almost all contemporary armed conflicts cause serious violations of children's rights, forced displacement, damage to civilian infrastructure, sexual assaults, even using the humanitarian aid as a weapon of war. On many occasions, violations constitute war crimes, crimes against humanity and crimes against international law. Unfortunately, the international community sometimes only witnesses these developments without significant results in their prevention. Human rights violations are often accompanied by impunity for the perpetrators, which in some ways undermines the basic idea of international human rights law and international humanitarian law. For these reasons, one of the conclusions in this paper is that the United Nations as a global international organization is most called upon to act effectively to prevent such crimes, as well as to locate responsibility if war crimes have taken place. Hence, the aim of this paper is to contribute to the debate on impermissible violation of international standards established with the International Human Rights Law and the International Humanitarian Law. The paper provides an overview of the treatment of basic human rights in contemporary armed conflicts, with a special focus on conflicts that have taken place in the past two decades and those that are currently ongoing. The problem of the different ways transnational corporations (TNCs) are held responsible for their violations of human rights standards has its own, long history. All the academic and legal efforts to date that have sought to clarify the proper grounds for effective remedies for wrongs that have been committed, have however failed to overcome the substantive obstacles and objections. Against such a complicated background the Authors present some reflections regarding the question of whether there is any possibility to take a step forward. Bearing in mind the powerful position of the TNCs, the Authors try to argue that – to some extent – mechanisms connected to State obligations in the field of human rights could be effective, if properly used, in relation to this type of corporate entity. Moreover, the absence of legally binding international rules (i.e. hard law) in the field under discussion is undoubtedly a missing factor for success. The article concludes that as long as the obligations and responsibilities of TNCs are not covered by legally binding and effectively enforced international rules, it will be impossible to cut this "Gordian knot". In totalitarian countries, everything is subordinated to a certain ideology and dictator or party. The powers of the state are unified. Crime is part of the system. Violations of human rights occur daily. Strong political police forces are present. An effective method of repression are politically motivated trials (or show trials); their purpose is to eliminate actual and alleged enemies and to intimidate people. The trials are only seemingly being carried out in accordance with legal norms. In reality, their course and outcome are dictated either by the dictator or the party. During the Second World War, the Kočevje trial took place. It served as an example for all post-war show trials in Slovenia. It was not carried out in accordance with legal norms: in the investigation and the actual trial, human rights were violated, only witnesses and evidence that incriminated the accused were considered, the indictment was issued too late which prevented the accused from preparing their defence, the defending counsels faced a conflict of interests, the judges were lay judges. Additionally, the court in Kočevje had no legal basis since the Kingdom of Yugoslavia still existed at the time. more...

The split into the predominantly Muslim Northern Sudan, and Southern Sudan with a Christian and animist majority, had been emerging in the course of many centuries. Without any doubt, one is bound to mention the natural and geographical boundaries, the ethnical diversity of the regions, the influence exercised during the centuries by the Egyptians, Arabs and later on by the British. According to the opinions of some experts on the subject, there can be two distinct matters that have contributed to the split of the North and the South. These were education and religion. Apart from education, also the issue of religion was dividing the Sudan. After the declaration of independence on January 1, 1954 all the Christian private schools in the South were closed down. There remained only state schools with Arabic as the language of instruction and with the upbringing model based on the Koran teaching. Having obtained political independence, the fears of the British administration and Christian missionaries became a reality: Islam was made the state religion. The only way to attain an occupational and social status was to convert to Islam. Frequently, this took place according to the rule of an already accomplished fact or by pressure. In the context of Sudan, one of the biggest country in Africa, with its population of over 37 million, made up of 70 per cent Muslim believers , 14 per cent of Christians, and 12 per cent of animists, it is of great importance for the perception of fundamentalism to be familiar with the history of this country. more...

Transitional justice encompasses three large areas of interest: Human rights law, law and comparative political science. Transitional justice analyses and identifies successful legal frameworks for dealing with past regime atrocities, also it deals with measures for dealing with the past for the purpose of establishing justice and with measures for promoting societal restoration and establishment a state of peace. In general, transitional justice measures are being implemented by newly formed democratic states for the purpose of redressing past state atrocities and facilitate a state necessary for developing a modern country which will, in its core, have a respect for human rights. La Sentencia de Unificación del 29 de enero de 2020, proferida por el Consejo de Estado, sentó precedente sobre la obligatoriedad del término de caducidad común de dos años, contados a partir del conocimiento del daño antijurídico, para interponer contra el Estado pretensiones de reparación directa derivadas de graves violaciones de derechos humanos, como lo son los delitos de lesa humanidad, de genocidio y de crímenes de guerra. Sin embargo, la Corte Interamericana de Derechos Humanos, en múltiples providencias, señaló que, si bien la imprescriptibilidad opera claramente en el ámbito penal, también es posible que dicha garantía de imprescriptibilidad se aplique a otras acciones como las encaminadas a demandar al Estado, pues lo importante es salvaguardar el derecho a la reparación integral, sin importar la acción que se inicie, cuando nos encontramos ante graves violaciones de derechos humanos. Así, teniendo en cuenta la normatividad interna, los pronunciamientos de las Altas Cortes y el contexto histórico colombiano, este trabajo pretende determinar, si opera o no, en Colombia, la caducidad en las pretensiones de reparación directa frente a delitos de lesa humanidad, crímenes de guerra y genocidio., The Unification Sentence of January 29th, 2020, delivered by the Colombian Council of State, set a precedent on the mandatory nature of the common expiration term of two years, counted from the knowledge of the unlawful damage, to claim against the State for direct reparation derived from human rights violations, such as crimes against humanity, genocide and war crimes. However, the case law of Inter-American Court of Human Rights, indicated that, although imprescriptibility clearly operates in criminal actions, it is also possible that this guarantee of imprescriptibility applies to other actions such as those aimed at suing the State. The most important is to safeguard the integral reparation right, regardless of the action that is initiated, when we are faced with human rights violations. Thus, taking into account the internal regulations, the pronouncements of the High Courts and the Colombian historical context, this work aims to determine, whether or not it operates in Colombia, the forfeiture of the petition for direct reparation for crimes against humanity, war crimes and genocide. more...

Los Derechos Humanos a través de la historia han logrado grandes asedias por luchas constantes, sucesos que han sido fundamentales en el desarrollo de las sociedades humanas y que han permitido reconocer y validar ideas que conquistaron lo que hoy conocemos como derechos humanos, razones por la cuales es importante orientar nuestra mirada a educarnos en los mismos. Se debe agregar, que la importancia de capacitarnos obteniendo aprendizaje en derechos humanos es una responsabilidad de todos, ya que quien adquiere conocimientos de derechos humanos posee la sabiduría de exigir que le sean respetados, pero también tiene la gran responsabilidad de respetar, garantizar y proteger los mismos. Es por ello, que en el desarrollo de la práctica I, el objetivo fue generar estrategias de formación y capacitación en Derechos Humanos, a fin de prevenir la posible ocurrencia de violaciones a los DDHH, de ahí, el objetivo de la práctica II, fue presentar un plan de estudios para el desarrollo de competencias en los servidores públicos de migración Colombia mediante la realización de un Diplomado en Derechos humanos en el contexto Migratorio, el programa estaba fundamentado en sensibilizar e incentivar el reconocimiento sobre el respeto, promoción, protección y garantía de los Derechos Humanos. Por otra parte, la pregunta de reflexión personal para la sistematización de experiencias en el contexto psicojuridico fue: ¿De qué manera puede contribuir los operadores jurídicos a los Derechos Humanos en la dignidad frente a la población migrante como pilar fundamental de la psicología jurídica dentro del contexto migratorio?, además, los instrumentos de recolección de información fueron: El diario de campo, la evaluación del proceso de capacitación, los protocolos de sesión y la Matriz DOFA. Palabras claves: Psicología jurídica, Derechos Humanos, capacitación, competencias, servidores públicos, violaciones a los DDHH. Human rights through history have achieved great sieges by constant struggles, events that have been fundamental in the development of human societies and that have allowed to recognize and validate ideas that conquered what we know today as human rights, reasons why it is important to focus our attention to educate ourselves on human rights. It must be added that the importance of educating ourselves in human rights through training is everyone's responsibility, since those who acquire knowledge have the right to demand that their human rights be respected, but also have the responsibility to respect, guarantee and protect the same. That is why in the development of practice I, the objective was to generate training and training strategies in Human Rights, in order to prevent the possible occurrence of violations of human rights, hence, the objective of practice II was to present a curriculum for the development of competencies in the public servants of Migration Colombia through the completion of a Diploma in Human Rights in the migration context, the program was based on raising awareness and encouraging recognition of respect, promotion, protection and guarantee of human rights. In an article published in the International Journal on Minority and Group Rights ('Human Rights Violations in Ethiopia: When Ethnic Identity is a Political Stigma', 15(1) (2008) 49–79), Kjetil Tronvoll from Oslo University argued that in federal Ethiopia, the violations of human rights are in some ways ethnically motivated. Tronvoll's arguments are based on the concluding observations of the UN Committee on the Elimination of Racial Discrimination (CERD) on Ethiopia. The objective of my Reply is to show that both CERD and Tronvoll have made unsubstantiated generalisations in trying to gauge any violation of human rights in Ethiopia as an ethnically-motivated occurrence. With this purpose in view, the current article briefly discusses the constitutional legal framework of the Ethiopian federal system, and critically examines the positions of CERD and Dr. Tronvoll. 14. Uso excesivo de la fuerza policial en la CDMX

This study analyzes complaints of violations of the right to personal integrity received during five years in the Comisión de Derechos Humanos (Human Rights Commission) of Mexico City, with two aims. First, to describe differences in police abuse cases according to their place of occurrence. Second, to know which factors increase the likelihood of serious abuse committed in situations of detention or control a person. These factors allow to compare different theoretical traditions about the excessive use of police force. The results show that the presence of the most consolidated factors from the theoretical perspective of the criminal threat at the situational level, -the active resistance and the situations with serious crimes-, are those that significantly increase the probability of the occurrence of serious police abuses in Mexico City., El presente estudio analiza quejas por violaciones al derecho a la integridad personal recibidas durante cinco años en la Comisión de Derechos Humanos de la Ciudad de México con dos objetivos: en primer lugar, describir diferencias de los casos de abuso policial según su lugar de ocurrencia; en segundo, para conocer, en el caso de los abusos cometidos en situaciones de detención o control a una persona, qué factores aumentan la probabilidad de un abuso grave. Los factores se desprenden de ello y permiten comparar distintas tradiciones teóricas acerca del uso excesivo de la fuerza policial. El resultado muestra cómo la presencia de los factores más consolidados, desde la perspectiva teórica de la amenaza criminal al nivel situacional –la resistencia activa y las situaciones en delitos graves–, aumentan de manera significativa la probabilidad de que ocurran los abusos policiales graves en la Ciudad de México. more...

The objective of this article is to identify the most frequent human rights violations perpetrated against inmates belonging to the LGBT community by prison staff. At the same time, explain in accordance with the provisions of national and international legislation, the responsibility of the State for violations against detainees due to their sexual orientation or gender identity, the obligation of detention centers as responsible for the execution of the penalty of ensuring a treatment based on human dignity with a human rights perspective. Consequently, the aim is to provide certain recommendations based on prison treatment standards., El objetivo del presente artículo es identificar las violaciones a derechos humanos más frecuentes perpetradas contra los reclusos pertenecientes a la comunidad LGBT por parte del personal penitenciario. A su vez, explicar de acuerdo con lo establecido en la legislación nacional e internacional, la responsabilidad del Estado frente a vulneraciones causadas a los detenidos debido a su orientación sexual o identidad de género, la obligación que tienen los centros de detención, como responsables de la ejecución de la pena, de asegurar un trato basado en la dignidad humana con perspectiva en derechos humanos. Resumen En el marco de los estudios sobre lugares de memoria vinculados a las violaciones a los derechos humanos cometidas por la dictadura cívico-militar en Chile (1973-1990), este artículo presenta el análisis de visitas a dos lugares de memoria de Santiago de Chile - Villa Grimaldi y Londres 38 - realizadas por personas de distintos grupos etarios. El análisis aborda la interacción de los visitantes con el lugar, considerando los afectos y percepciones que provoca la visita, y la interpelación que estos lugares hacen a las memorias que los visitantes construyen sobre el pasado reciente. Los resultados muestran que, si bien existe acuerdo en la condena a las violaciones a los derechos humanos y la importancia de una cultura de la memoria y los derechos humanos, se produce una distancia entre las generaciones al valorar conflictos del pasado que refieren a distintos momentos históricos. Resumo No marco dos estudos sobre os lugares de memória vinculados às violações dos direitos humanos cometidos pela ditadura cívico-militar no Chile (1973-1990), este artigo apresenta a análise de visitas a dois lugares de memória de Santiago do Chile - Villa Grimaldi y Londres 38 - realizadas por pessoas de diferentes faixas etárias. O estudo aborda a interação dos visitantes com o lugar, considerando os sentimentos e as percepções que a visita provoca e a interpelação que estes lugares fazem às memórias que os visitantes constroem sobre o passado recente. Os resultados mostram que, embora haja acordo na condenação das violações dos direitos humanos e na importância de uma cultura de memória e dos direitos humanos, um distanciamento entre as gerações aparece ao avaliar conflitos do passado que se referem a diferentes momentos históricos. Abstract In the framework of the studies on places of memory related to human rights violations committed by the Chilean military-civic dictatorship (1973-1990), this article presents the analysis of visits to two places of memory of Santiago de Chile - Villa Grimaldi and London 38 - made by people of different age groups. The analysis addresses the interaction of the visitors with the place, considering the affections and perceptions that the visit caused, and the interpellation that these places cause to the memories that the visitors build on the recent past. Želeli smo ugotoviti, katera pravica je pridržanim in priprtim osebam najpogosteje kršena ali so priporočila nadzornih preventivnih mehanizmov upoštevana ter ali so pravna sredstva, ki jih imajo osebe, dovolj učinkovita, da z njimi odpravijo nastalo kršitev. V diplomskem delu smo uvodoma podrobneje opredelili pridržanje in pripor, ki spadata med primarne posege v človekovo osebno svobodo. Opredelili smo temeljne pravice, ki pripadajo pridržanim in priprtim osebam na podlagi predpisov in drugih aktov, ki veljajo v Republiki Sloveniji, tako notranjih pravnih aktov kot tudi mednarodnih pogodb in drugih mednarodnih dokumentov. V nadaljevanju smo predstavili delovanje nadzornih preventivnih mehanizmov, ki spremljajo in nadzorujejo ravnanje s pridržanimi in priprtimi osebami. Poleg tega smo predstavili tudi najpomembnejša pravna sredstva, ki jih imajo pridržane in priprte osebe. S pomočjo pregleda relevantne sodne prakse in poročil nadzornih preventivnih mehanizmov smo izpostavili probleme, do katerih prihaja pri ravnanju s pridržanimi in priprtimi osebami. Diplomsko nalogo smo zaključili s preverjanjem postavljenih hipotez. Ugotovili smo, da je prepoved mučenja, nečloveškega in ponižujočega ravnanja nedvomno ena izmed pravic, ki je pridržanim in priprtim osebam v Sloveniji pogosteje kršena. Poročila nadzornih preventivnih mehanizmov nakazujejo na to, da problem grdega in nečloveškega ravnanja še vedno ostaja. Nadzorni preventivni mehanizmi vsako leto najdejo kakšno težavo, ki bi jo bilo potrebno odpraviti. Zaradi finančnih in kadrovskih težav, njihova priporočila niso vedno uresničena. Evropsko sodišče za človekove pravice je v svojih sodbah opozorilo, da slovenska pravna sredstva v določenih primerih ne dosegajo standardov 13. člena Evropske konvencije o varstvu človekovih pravic in temeljnih svoboščin. Pridržane in priprte osebe v Sloveniji nimajo dovolj učinkovitih pravnih sredstev, s katerimi bi lahko preprečile kršitve. The purpose of the diploma thesis was to highlight the rights of persons in police custody and detainees in Slovenia. We wanted to find out which right of persons in police custody and detainees is most often violated, whether the recommendations of the supervisory preventive mechanisms are taken into account and whether the remedies are enough efficient. At the beginning of the diploma thesis we defined police custody and detention. By means of key legal acts and international documents, we have defined the fundamental rights that are entitled to persons deprived of their liberty. In the following we have introduced the working of supervisory preventive mechanisms that are monitoring treatment of persons in police custody and detainees. In addition, we have also mentioned some of the legal remedies that are available to the persons. Through the review of relevant case law and the reports of the supervisory preventive mechanisms, we highlighted the problems that arise in dealing with the persons deprived of their liberty. We conclude the diploma thesis with the verification of hypothesis. We found out that the prohibition of torture is one of the rights of persons in police custody and detainees that is among rights that are frequently violated in Slovenia. The recent complaints in the reports of supervisory preventive mechanisms indicate that the problem of inhuman treatment still remains. Every year supervisory preventive mechanisms find some new problem, that needs to be solved. Due to financial and personnel problems, the recommendations of supervisory preventive mechanisms are difficult to implement. According to the European Court of Human Rights, Slovenian remedies do not meet the standards of Article 13 of the European Convention on Human Rights. Ante la latente necesidad de establecer criterios objetivos de determinación de cada uno de los elementos característicos de las masivas violaciones a los derechos humanos, con la finalidad de determinar en que momento las violaciones a los mismos, tanto en el aspecto nacional como internacional constituyen un sistemático atentado contra las normas del Derecho Internacional de los DDHH y del Derecho Penal Internacional, y con la teleología de crear herramientas heurísticas que sirvan a los operadores jurídicos de ambas ramas del Derecho Internacional, atendiendo a las necesidades y finalidades de cada sistema, aunado a la pretensión de corrección dogmática de lo que hasta el momento se ha realizado en la materia, se hace necesario para efectos de establecer cuando se ha cometido sistemáticas violaciones a los Derechos Humanos, instituir con base en elementos dogmáticos del Derecho Penal Internacional un test de sistematicidad, que les permita a los operadores jurídicos definir la naturaleza de tales atentados. Le droit international, notamment le droit international des droits de l’homme, a établi des obligations étatiques pour affronter les défis des sociétés en transition : la recherche de la vérité autour des crimes du passé, la poursuite et la sanction pénale aux auteurs de ces crimes, et la réparation aux victimes. Les limitations politiques, sociales et juridiques de la justice transitionnelle sont énormes et elles représentent de grands défis pour les États et pour la communauté internationale en général. Cette recherche a pour but l’analyse du processus de la justice transitionnelle au Pérou après le conflit armé interne et le régime autoritaire de l’ex-présidente Alberto Fujimori à la lumière du droit international. L’étude conclut que le Pérou a accompli les obligations imposées par le droit international en utilisant une approche intégrale de la justice de transition. Néanmoins, il reste encore quelques défis à surmonter liés aux facteurs politiques et sociaux de la réalité péruvienne., The international human rights law has established obligations on States concerning how they must deal with the challenges inherent to transitioning societies: searching for the truth related to past crimes, persecuting and sanctioning those responsible of these crimes, and providing redress to the victims. Transitional justice has many political, social, and legal limitations that pose a challenge for States as well as for the international community at large. The objective of this research is to analyze – according to international law's parameters – the transitional justice's process that took place in Peru after the internal armed conflict and Alberto Fujimori's authoritarian regime. This study concludes that Peru has implemented international law's obligations while applying an integral approach to transitional justice. El hacinamiento carcelario, presente en la mayor parte de los países latinoamericanos, es un problema de gran calado social que genera el sufrimiento de miles de personas privadas de libertad. El lamentable estado de las infraestructuras penitenciarias y las condiciones deshumanizantes en las que transcurre el día a día de los internos comprometen la posición del Estado como garante de derechos fundamentales. Esta circunstancia ha trascendido a la opinión pública, de modo que se ha suscitado un debate -ya antiguo- sobre las políticas públicas desarrolladas en materia penal y penitenciaria. El presente trabajo tiene como objetivo principal aproximarse a la realidad del sistema penitenciario colombiano, con el fin de analizar, desde una perspectiva descriptiva y longitudinal, el fenómeno del hacinamiento carcelario para formular propuestas de mejora. Para tal fin se examinan fuentes de información secundarias provenientes de distintos ámbitos, como: fuentes estadísticas oficiales, disposiciones legales nacionales e internacionales, así como estudios de investigación elaborados por académicos e instituciones públicas. Los principales resultados ponen de relieve los efectos negativos que ha ocasionado la política criminal en el ámbito penitenciario y la necesidad urgente de una nueva orientación. Family and social reintegration of children and teenagers kept away from their families and institutionalized due to maltreatment, is a challenge of significant proportions. This study aims to evaluate and diagnose the present social and family status of ex-inmates in an institution in the south of Brazil, which shelters them temporarily. The subjects are families that participated in a program of family reintegration carried out by that institution during the period their children stayed there. Data were gathered through an interview and questionnaire. The results evidenced those families’ status in terms of their inclusion in the job market and school; family interactions; main factors that influence favorably or unfavorably in the reintegration process they have been experiencing. Some challenges involved in the process of family and social reintegration of those temporary shelters’ exinmates are discussed. more...

This master thesis focuses on social business and its influence in economy. Social business as a tool to solve social problems is approximated by development aid as its subset and by human rights violations as related social problems. Human rights open a discussion of their relationship to economics and consequently development. The empirical part tests whether human rights are affected by a distribution of development aid to different sectors, namely social and economic infrastructure and services and production sectors. The panel data analysis of 30 least developed countries in three regions according to the Human Development Index over a period 2005 to 2001 brings results that flows of official development aid to the economic infrastructure and services significantly drives human rights violations. Humanitarian intervention lies at the center of contradictory relationsbetween the principle of state sovereignty and the responsibility to protect humanrights. Whereas some theorists define humanitarian interventions as violation ofthe basic principle of international law and relations, that is the non-interventionprinciple, and other theorists see humanitarian interventions as the legal andlegitimate way of protecting the security of all humanity in the world. Thepurpose of this study is to contend that the international community has theresponsibility to intervene to prevent humanitarian crises. A reinserção familiar e social de crianças e adolescentes afastados de suas famílias e institucionalizadas devido a maus tratos é um desafio de proporções significativas. Este estudo objetiva fazer a avaliação e o diagnóstico da situação social e familiar atual dos egressos de uma instituição destinada ao abrigo temporário desses jovens, localizada no sul do Brasil. Os sujeitos são as famílias que participaram de um programa de reinserção familiar desenvolvido por esta casa de passagem, durante o período em que seus filhos estiveram abrigados. Os dados foram colhidos através de entrevista e questionário. Os resultados retratam a situação destas famílias em termos de inserção de seus membros no mercado de trabalho e na vida escolar; interações familiares; principais fatores que influenciam favorável e/ou desfavorávelmente no processo de reinserção que estão vivenciando. This study aims to evaluate and diagnose the present social and family status of ex-inmates in an institution in the south of Brazil, which shelters them temporarily. The subjects are families that participated in a program of family reintegration carried out by that institution during the period their children stayed there. Data were gathered through an interview and questionnaire. The results evidenced those families status in terms of their inclusion in the job market and school; family interactions; main factors that influence favorably or unfavorably in the reintegration process they have been experiencing. Some challenges involved in the process of family and social reintegration of those temporary shelters ex-inmates are discussed.
