International audience; Les recherches de traitements de la COVID-19 s’appuient sur des principes actifs connus couverts par des titres de propriété industrielle (brevets ou certificats complémentaires de protection). Ces titres confèrent à leur titulaire un droit exclusif d’exploitation sur les substances revendiquées. Partant, la fabrication par des tiers de médicaments contre la COVID-19 dont la composition comprendrait des molécules protégées nécessitera l’obtention d’autorisations d’exploitation, en principe consenties à la discrétion des titulaires de droits. Le mécanisme de la licence d’office dans l’intérêt de la santé publique permet de passer outre l’octroi de ces autorisations en contraignant les titulaires à concéder des droits d’usage des inventions brevetées à des tiers.Pourtant, en l’état du droit, le recours à la licence d’office se heurterait des difficultés. Pour les surmonter, il conviendrait d’assoupler le mécanisme pour assurer l’efficacité de sa mise en oeuvre. Ce rapport, intitulé COVID-19 : Comment mettre en oeuvre la licence d’office, présente des propositions de modifications à apporter aux dispositions législatives et réglementaires en vigueur.

Abstract

Research has been conducted on yeast mitochondrial formylation. The study of the growth conditions where the absence of mitochondrial formylation would impair yeast cell growth has been carried out, and the results demonstrate that Saccharomyces cerevisiae strains which lack chromosomal formylase gene show a thermosensitive respiratory growth and a slower growth rate.

Abstract

The article focuses on the problems of gene patenting in France. It is stated that the French law, the Legal Protection of Biotechnological Inventions (98/44/EC) European Directive, has caused uncertainty about patent protection of isolated gene sequences in France. The law was implemented with the aim to forbid patenting human gene sequences, but to allow the use of these sequences to be patented. The L 611-18 and L 613-2-1 articles of the Intellectual Property Code are also discussed.
