In nur neun Monaten hat Tunesiens Präsident Kais Saied alle Macht an sich gerissen und die seit dem Umbruch 2011 etablierten Institutionen der jungen Demokratie demontiert. Mit einer neuen Verfassung, die per Referendum am 25. Juli 2022 abgesegnet werden soll, will er eine "Neue Republik" begründen. Saieds Pläne spalten das Land: Es wächst der Widerstand politischer und zivilgesellschaftlicher Akteure, die einen inklusiven Prozess einfordern. Unterdessen nähert sich Tunesien der Zahlungsunfähigkeit. Seine europäischen Partner, die viel in die Demokratisierung investiert haben, kommentieren die Entwicklungen in Richtung Autokratie mit Sorge, haben aber kaum Maßnahmen ergriffen. Mit jedem weiteren Schritt Saieds wird es schwieriger, Einfluss zu nehmen. Im Interesse der Stabilität des Landes gilt es, so bald wie möglich finanzielle und diplomatische Hebel zu nutzen, die Europa und der Internationale Währungs­fonds aufgrund der wirtschaftlichen und finanziellen Abhängigkeit Tunesiens haben. Almost two years after about 80 per cent of Chileans voted for comprehensive constitutional reform and the election of a Constitutional Convention, the new draft constitution was roundly rejected by the voters in a 4 September referendum. Since the majority of those who rejected the proposal are in favour of a new constitution, the constitution-making process will continue, with many unanswered questions going forward. The reasons for the rejection of the constitution are manifold: they lie in the performance of the Constitutional Convention, the quality of the draft, a misjudgement of the political constellation of forces and the interests of the citizens, and changing political and economic conditions since the beginning of the constitution-making process. Even a participatory constitutional process that has been exemplary from a democratic and constitutional perspective can fail. Constitutional poetry may warm the hearts of core supporters but is insufficient to persuade those living in prosaic circumstances. The Constitutional Convention, with its large number of independents and political newcomers, did not live up to expectations. Political parties and Congress will end up playing a crucial role in the next round of constitution-making. Even the supporters of the proposed constitution recognised its shortcomings before the referendum, and most of the opponents also want a new constitution. The dissatisfaction on both sides with the status quo and the reform process could be the basis for a consensus on the core elements of a new constitution and the procedure leading to it. But there is also the risk that the hubris of the left majority in the Constitutional Convention will be replaced by the hubris of the right in the wake of this draft's rejection. The political elite must decide as quickly as possible how to proceed in the constitution-making process. Otherwise, there is a risk of renewed social unrest and of further loss of confidence in political institut

In the space of just nine months, Tunisia's President Kais Saied has centralised power and dismantled the institutions established by the young democracy since the revo­lu­tion of 2011. His new constitution establishing a "New Republic" will be put to a refer­endum on 25 July 2022. Saied's plans have divided the nation, with growing resistance from political and civil society actors demanding the return to an inclusive and demo­cratic process. At the same time, the country is moving closer to default. Tunisia's Euro­pean partners have invested heavily in democratisation and view the autocratic shift with concern. But they have failed to take meaningful action, and each new step by Saied makes it harder to reverse the path. In the interests of Tunisia’s stability, Europe should move decisively and employ the financial and diplomatic leverage it has due to Tunisia's economic crisis. (author's abstract)

Mit 55,9 Prozent der Stimmen und einem Abstand von 11,8 Prozentpunkten gegenüber José Antonio Kast gewann Gabriel Boric am 19. Dezember 2021 die Stichwahl um die chilenische Präsidentschaft. An jenem Tag erreichte die Wahlbeteiligung in Chile mit 55,6 Prozent ein historisches Hoch seit der Abschaffung der Wahlpflicht. Die starke Mobilisierung verhalf Boric, der im ersten Wahlgang noch auf dem zwei­ten Platz gelandet war, zum Sieg. Damit steht der neue Präsident auf solidem demokratischem Fundament, aber auch vor großen Erwartungen in der Bevölkerung. Zudem wird der Regierungschef im Spannungsfeld zweier Institutionen agieren müssen: einer Verfassunggebenden Versammlung und einem parteipolitisch geteilten Kongress. Seine vierjährige Amtszeit, die am 11. März beginnt, könnte die letzte unter der "Pino­chet-Verfassung" und die Anfangs­phase einer demokratischen Transformation sein. (Autorenreferat)

On 19 December 2021, Gabriel Boric won the run-off of the Chilean presidential elec­tion with 55.9 percent of votes, 11.8 percentage points ahead of José Antonio Kast. That day voter participation in Chile reached a historic high (55.6 percent) since the abolition of mandatory voting. This great mobilisation helped Boric - who had finished second in the first round - to victory. The newly elected president therefore has a solid democratic foundation, but Chileans have also invested great hopes in him. Fur­thermore, the new head of government will have to contend with the tensions between two institutions: a Constitutional Convention and a Congress that is divided along party lines. His four-year mandate, starting on 11 March, could be both the last under the “Pinochet Constitution” and the start of a democratic transformation. (author's abstract)

Infolge der Proteste gegen die offiziellen Ergebnisse der Präsidentschaftswahl von 2020 hat Aljaksandr Lukaschenka im Frühjahr 2021 die Pläne zu einer Verfassungsreform wieder aufgenommen. Ziel des Vorstoßes ist es, einerseits dem Wunsch nach Veränderung aus der Bevölkerung entgegenzukommen, ohne auf die Forderung nach Neuwahlen zu reagieren. Andererseits scheint er zu beabsichtigen, die Veränderung so zu gestalten, dass seine Macht im Präsidentenamt vorerst gefestigt wird. Ergebnisse einer Online-Umfrage legen nahe, dass die von Lukaschenka vorgeschlagenen Verfassungsänderungen wohl kaum ausreichen werden, um der breiten gesellschaftlichen Nachfrage nach Demokratisierung und Machtbeschränkung auch nur annähernd nachzukommen - aber auch, dass sich Unterstützer:innen und Gegner:innen Lukaschenkas nicht in jeder Hinsicht unversöhnlich gegenüberstehen.

Recent political changes across Latin America that challenge mainstream conceptions of liberal democracy have led to speculation about some kind of postliberal democracy possibly emerging in the region. Up to now, however, there has been no systematic assessment of this proposition or any explicit conception of post-liberal democracy. This article fills this research gap by proposing a conceptual framework for analysing political change in the direction of post-liberal democracy, in Latin America and beyond, and probes the plausibility of this framework in a case study of Bolivia. It shows that the concept of post-liberal democracy helps us make sense of the contemporary transformation of Bolivian democracy and that it has comparative advantages over alternative conceptual frameworks such as radical populism and defective - that is, illiberal or delegative - democracy.

Turkey's new Presidential System has failed to realise the goals that it was said to achieve with its introduction despite the disapproval of half the population. Contrary to the ruling party’s claims in favour of the new governance system, two and a half years after its introduction, parliament is weaker, separation of powers is undermined, the judiciary is politicised, institutions are crippled, economic woes are mounting and authoritarian prac­tices prevail. Despite the almost unlimited and unchecked power that the new system grants to the President over institutions, his space for political manoeuvre is, surprisingly, narrower than it was in the parliamentary system. Providing the otherwise divided opposition a joint anchor of resistance, the Presidential System unintentionally breathed life into the inertia of Turkey’s political party setting. The formation of splinter parties from the ruling party, primarily address­ing the same conservative electorate, alongside the changing electoral logic with the need to form alliances to win an election, poses a serious challenge to the ruling party and its leader - the President. Despite the oppositional alliance’s electoral victory in 2019 local elec­tions, it is at the moment unclear whether the forming parties share a common vision for steps towards democratic repair. Together with the institutional havoc caused by the Presidential System, the blurry outlook of the opposition requires caution about an easy and rapid positive transformation. While the European Union should be realistic in regard to expectations towards democratic reform, it should also strike a balance between cooperation in areas of mutual benefit and confronting Ankara when necessary to protect the interests of the Euro­pean Union and its member states. Mit der Bildung einer Einheitsregierung unter Abdelhamid Dabeiba gelang im März 2021 ein Durchbruch in den Bemühungen, die politische Spal­tung Libyens zu über­winden. Doch die Kehrseite der Übereinkunft zeichnet sich bereits ab. Bislang haben sich die politischen Akteure lediglich darauf geeinigt, innerhalb der Regierung um den Zugang zu staatlichen Mitteln zu konkurrieren. Die Verteilungskämpfe könn­ten schnell zur Zerreißprobe werden. Derweil harren zahl­reiche substantielle Streitpunkte ihrer Bearbeitung. So versucht die Regierung die Herausforderungen im Sicherheitssektor zu ignorieren. Spannungen zwischen Pro­fiteuren und Gegnern der Regie­rung drohen eine neue politische Krise zu verursachen, falls Fortschritte hin zu den für Dezember 2021 geplanten Wahlen ausbleiben. Aber auch die Wahlen selbst bergen beträchtliches Konfliktpotential. (Autorenreferat)

The review of the constitution emanates from the constitution, from the institute of constitutional review of which the latter is closely related to the dynamic processes in society as well as with the demand for sustainable stability, stability which very well it may be economic, political or social, national or international, the stability that affects even the constitutional order itself in a state. In this article, we will address the constitutional changes, the amendments over the years In Turkey and Russia which are 'proof' of the violation of the constitutional order, 'proof' of the impinging of democracy and stability in the country. Through this article, we will see that the constitutional system, rule of law, democracy or its consolidation, the stability in the country to a large extent are influenced by the way it is conducted the constitutional review process. The application or non-application of this instrument has multi-dimensional effects, negative, destabilizing ones.

The 2020 constitutional changes considerably increase presidential powers while sending mixed signals about presidential transition. The main driver of the amendments were term limits. The "zeroing" of Putin’s presidential terms enhances certainty for himself by fostering uncertainty for others. But there is more to the amendments: Numerous changes are not new, they simply align the constitutional text with subconstitutional powers the presidency had been accumulating. The embedding of term limit circumvention in a comprehensive constitutional overhaul is a risk- hedging strategy to avert resistance by weakening the signal about Putin's intentions. Constitutional changes are therefore an instrument of elite coordination. The amendments also increase presidential flexibility. This expedited regime personalization is detrimental to governance and will make repression more prevalent. But it also creates more risks for Putin. Regardless of how presidential succession will play out, Putin's legacy will be a highly personalized authoritarian regime with a constitutionally unconstrained presidency.

This thesis is a critical analysis of the constitutional and legal order of the Republic of North Macedonia, following the chronological process dating from the gaining of the county’s independence, through the armed confl ict in 2001 that brought constitutional changes, to today. The fi rst decade after the breakup of Yugoslavia was crucial for the North Macedonian state and its citizens. The writing/creation of the constitution of the new independent state was not an easy process and it did not pass peacefully nor did it pass without any problems. The complex social process and relations have initiated the need for amendments to the Constitution, which, since its adoption in 1991 until today, has been changed 32 times in order to adapt to new, emerging situations and to give constitutional and legal responses to the inherent challenges. Of course, proper changes also occurred in the political system itself as a result of numerous factors, which have more or less influenced its character and shape.

Mit dem Entwurf zum Fünften Gesetz zur Änderung der Verfassung des Freistaats Thüringen (Drs. 7/897) hat der Thüringer Landtag Überlegungen zu menschenrechtlich relevanten Änderungen der Thüringer Landesverfassung vorgelegt. Die vorliegende Stellungnahme fokussiert die Frage, wie die vorgesehenen Landesverfassungsänderungen aus der Sicht der UN-Behindertenrechtskonvention (UN-BRK) und der UN-Kinderrechtskonvention (UN-KRK) zu bewerten sind.

Kyrgyzstan's presidential election and constitutional referendum on 10 January 2021 represent the provisional endpoint of a series of violent episodes that has gripped the country since October 2020. The victory of the populist Sadyr Japarov and approval for his plan to reintroduce a presidential system of government prepares the ground for a dismantling of democratic principles and rule of law, so that politically Kyrgyz­stan is set to look more like its Central Asian neighbours. A new constitution is in preparation. The draft bears the portents of a neo-traditional roll-back that rebuffs a young generation demanding more democracy and rule of law, and has the potential to deeply polarise the nation. Die Präsidentschaftswahlen vom 10. Januar 2021 und das damit verbundene Ver­fassungsplebiszit sind das Ergebnis einer von Gewalt begleiteten Dynamik, die Kir­gistan seit Oktober 2020 in Atem hält. Mit der Wahl des Populisten Sadyr Japarov zum Präsidenten und der Zustimmung zu der von ihm forcierten Wiedereinführung eines Präsidialsystems wird der Weg bereitet für einen Abbau demokratischer und rechtsstaatlicher Prinzipien, mit dem sich Kirgistan den politischen Verhältnissen in den zentralasiatischen Nachbarstaaten annähert. Eine neue Verfassung ist in Vor­bereitung. Der Entwurf trägt die Handschrift von Akteuren, die eine Pfadumkehr unter neo-traditionalen Vorzeichen anstreben. Er düpiert eine junge Generation politischer Kräfte, die für mehr Demokratie und Rechtsstaatlichkeit eintreten, und ist geeignet, das Land anhaltend zu polarisieren. (Autorenreferat)

Indonesia presents an extremely rare quasi-experimental research case: the constitutional reforms and the transition to full presidentialism have effected a presidentialization of political parties that is largely in line with the changes predicted by the model of Samuels and Shugart [2010. Presidents, parties and prime ministers: How separation of powers affects party organization and behaviour. Cambridge: Cambridge University Press]. Especially the rise of the new president and his difficult relationship with his own party are testimony to this. But a closer look reveals that the model has to be adapted to Indonesian politics. Presidents have tools to forge grand coalitions and to overcome the dualism to an extent. The size and history of political parties as well as wider socio-economic changes, that is an increasing oligarchization of party organization, have to be considered. Moreover, highly personalized vehicle parties serving the interests of a presidential candidate have emerged. It follows that institutional and structural incentives combined have produced a party system consisting of different party types.

Belarus galt lange als Muster eines stabilen autoritären Regimes. Seit 26 Jahren herrscht dort Aljaksandr Lukašenka. Das zentrale Organisationsprinzip der Elite ist ein pyramidales Netzwerk mit ihm an der Spitze. Von dort konnte Lukašenka verhindern, dass rivalisierende Fraktionen an Machtressourcen gelangen. Noch kontrolliert er die Sicherheitsorgane, aber die Krise wird zum Dauerzustand. Obwohl die Behörden die Institutionalisierung der Opposition verhindern können, setzt sich die horizontal vernetzte Mobilisierung der Gesellschaft fort. Für das Lukašenka-Regime gibt es kein Zurück, denn die Legitimität, die sich aus staatlicher Leistungsfähigkeit und Wahlen ergibt, ist dahin. Seine Popularität und die internationale Anerkennung sind verloren. Damit sind die wichtigsten Pfeiler des belarusischen Autoritarismus ins Wanken geraten.

Russia postponed its national vote on constitutional changes to July 1, 2020. Due to restrictions on freedom of movement and assembly from COVID-19, mass protests are unlikely to result. Nevertheless, managing growing social discontent may well be the Kremlin’s next big challenge as it prepares for September’s regional and parliamentary elections. Given its upcoming EU presidency and Council of Europe chairmanship, Germany could make a positive difference in protecting human rights and EU values in Russia.

Die Proteste in Chile, die im Oktober 2019 einsetzten, haben unter anderem eine Verfassungs­initiative nach sich gezogen, die Bürgerinnen und Bürger schon lange gefor­dert hatten. Nun haben sich auch Regierungs- und Oppositionsparteien darauf geeinigt. Sie soll mit einer Volksabstimmung darüber beginnen, ob eine neue Ver­fassung ge­wünscht wird und welches Kollektivorgan sie aus­arbeiten soll. Seit dem 26. Februar befindet sich Chile offiziell im Wahlkampf für dieses Referendum. Wegen der Covid-19-Pan­demie wurde es vom 26. April auf den 25. Oktober verschoben. Die gegebenenfalls abzuhaltende Wahl des verfassunggebenden Organs soll nun erst am 11. April 2021 stattfinden. Zwar ist noch ungewiss, inwiefern eine neue Verfassung dazu bei­tragen wird, die soziale, politische und institutionelle Krise zu bewältigen. Dennoch glaubt die große Mehrheit der Bevölkerung, dass sie unabdingbarer Grund­stein für einen notwendigen neuen Gesellschaftsvertrag ist. (Autorenreferat)

The protests in Chile, which began in October 2019, have resulted, among other things, in a constitutional initiative, which citizens had been demanding for a long time. Government and opposition parties have now agreed to it. It is supposed to begin with a referendum on whether a new constitution is desired and which col­lective body should elaborate it. Since 26 February, Chile has officially been engaged in the election campaign for this referendum. Due to the Covid-19 pandemic, it has been postponed from 26 April to 25 October. The potential election of the constituent body is now scheduled for 11 April 2021. It is still uncertain to what extent a new con­stitution will contribute towards overcoming this social, political, and institutional crisis. Nevertheless, the vast majority of the population believes that it is an indispen­sable cornerstone for a necessary new social contract. (author's abstract)

Seit 2006 durchläuft Bolivien einen tiefgreifenden politischen Umbruch. Dieser war und ist überaus konfliktträchtig - die Auseinandersetzungen um eine neue Verfassung führten das Land 2008 an den Rand eines Bürgerkriegs. Gleichwohl blieb das Ausmaß politischer Gewalt gering, so dass der Veränderungsprozess bisher weitgehend friedlich und in einem grundlegend demokratischen Rahmen verlief. Dies ist aus friedens- und konflikttheoretischer Sicht erklärungsbedürftig, bedenkt man das Ausmaß an Umverteilung politischer Macht in einem Kontext, in dem in einer Situation ohnehin schwacher demokratischer Institutionen die etablierten politischen Spielregeln offen in Frage gestellt wurden. Der Beitrag fragt nach den Ursachen, die den innerbolivianischen Frieden trotz Umbruch erklären. Die Analyse verweist auf die Bedeutung der Friedensleistungen der Demokratie, zeigt aber, dass demokratische Institutionen in ihrer Wirkung ambivalent sind und ihre Fähigkeit zur friedlichen Bearbeitung soziopolitischer Konflikte nur zu verstehen ist, wenn sie als eingebettet in und im Zusammenspiel mit informellen Politikmustern, politökonomischen Konfliktkonstellationen und internationalen Kontextbedingungen betrachtet werden.

Is it still possible to conceive of the institution of the presidency being separate from Vladimir Putin, the president? The constitutional amendment that would zero out Putin’s current presidential terms and therefore allow him to run once more for president in 2024 suggest that regime personalization has further progressed. Nonetheless, it still remains analytically useful and important to distinguish between the presidency and the president: presidential power remains a polymorphous phenomenon. Putin needs to maintain control of a strong presidency to exert authority.

On January 20, 2020 - just days after his state-of-the nation speech followed by the surprising resignation of the Russian government and the appointment of a new prime minister - President Vladimir Putin submitted constitutional changes to the State Duma, the lower house of parliament. They are likely to be approved there and then legitimized by a popular vote planned for April 2020. The amendments that Putin proposed reveal much about the future of Russia’s political system and Putin’s role in it.
