Holocaust restitution claims have succeeded by showing how wealth was unjustly transferred from victims to institutions and individuals and arguing for the return of that wealth. The case of slavery is more difficult because the stolen wealth has been disseminated over time and is no longer easily traceable. Political solutions, such as social programs, may be the best form of restitution realistically available to those who have inherited the harms of slavery.

From the 1876 case of The Medina before the UK's Court of Appeal into the 1980s in Australian cases, maritime remedies have been granted in commercial transactions where one party sought an unjust benefit by applying pressure. The courts have not remedied those bound by hard bargains or for having agreed to a commercial imbalance.

The UK House of Lords dealth with the issue of unjust enrichment in Banque Financiere de la Cite v. Parc (Battersea) Ltd. The Lords stated the defendant was unjustly enriched by its refinancing at the plaintiff's expense and then analyzed the parties' intentions as if a case of equitable subrogation. The decision appears to eliminate the right of restitution in cases of voluntary payment of another's debt.
