RESUMEN El presente artículo se propone determinar los efectos jurídicos que producen los actos de una organización sindical constituida u operando sin el cumplimiento de las estipulaciones legales. La metodología de esta investigación es hermenéutico- documental, dado que se desarrolló a través de rastreos bibliográficos, recopilación de literatura sobre el derecho fundamental de asociación sindical y análisis e interpretación de legislación y jurisprudencia regulatoria de la materia, de acuerdo a las necesidades específicas del análisis que aquí se aborda. Como conclusión principal, los actos ejecutados por una asociación sindical que contraríen o extralimiten los términos legales establecidos no producen efecto jurídico alguno, en atención a que la legislación laboral está definida como normatividad de orden público y no produce efecto alguno aquella disposición o actuación que las desconozca, sin que para ello se requiera declaración judicial. ABSTRACT This article has the goal of determining the judicial effects produced by the acts of a union organization created and operating without the fulfilment of its legal obligations. This research’s approach is hermeneutical-documentary, given how it was performed using bibliographic inquiries, compilation of literature on fundamental law in union association and regulatory jurisprudence on the matter in accordance with the specific analytical needs of the research. As a main conclusion, the research states that the actions carried out by a union association that are contrary and overreach the legal terms established for them do not produce any judicial effect whatsoever, taking into account that the labour legislation is defined as a public order normativity and that disposition does not produce any affect or act that disown them without needing a judicial declaration for it. RESUMO Este artigo se propõe determinar os efeitos jurídicos que produzem os atos de uma organização sindical constituída ou operando sem o cumprimento das estipulações legais. A metodologia utilizada é hermenêutico-documental, uma vez que se desenvolveu através de rastreamentos bibliográficos, compilação de literatura da legislação e jurisprudência reguladora da matéria, de acordó as necessidades específicas da análise que foi abordada. Como conclusão, os atos executados por uma associação sindical que contrariem ou extra-limitem os termos legais estabelecidos não produzem nenhum efeito jurídico, em atenção a legislação trabalhista está definida como normatividade de ordem público e não produze efeito algum aquela disposição ou atuação que as desconheça, sem que para eles se requeira declaração judicial.

El ejercicio legítimo de un derecho tiene como consecuencia la generación de un efecto jurídico, sin embargo, cuando dicho ejercicio implica un abuso del derecho, aun cuando cumplan las formalidades legales pero la intención o el animus sea contrario al espíritu de la ley o a fines distintos a los establecidos por el legislador, estos actos no pueden ser generadores de un efecto jurídico. En tal sentido, con el presente trabajo se analizará cuándo el derecho de asociación sindical puede configurarse en un abuso del derecho a partir de las decisiones jurisprudenciales que se han expedido sobre la materia, estableciendo cuáles son sus consecuencias desde el punto de vista jurídico y, a título de aporte académico, determinar si es necesario generar presupuestos legales que regulen y sancionen este tipo de conductas. The legitimate exercise of a right has as a consequence the generation of a legal effect, however, when said exercise implies an abuse of the right, even when they comply with the legal formalities but the intention or the animus is contrary to the spirit of the law or different fines. To those established by the legislator, these acts cannot generate a legal effect. In this sense, this work will analyze when the right of union association can be configured into an abuse of the right based on the jurisprudential decisions that have been issued on the matter, establishing results are its consequences from the legal point of view and, as an academic contribution, determine if it is necessary to generate legal budgets that regulate and punish this type of conduct. Kolektivna delavska predstavništva v slovenski pravni ureditvi igrajo pomembno vlogo na področju zastopanja interesov delavcev, predvsem z ustvarjanjem socialnega dialoga med njimi, predstavniki delodajalcev in tudi državo. Magistrska naloga vsebuje zgodovinski pregled razvoja kolektivnih delavskih predstavništev, vzrok za pojav potrebe po njih, pravne vire, ki so urejali in sedaj urejajo to področje ter vlogo kolektivnih delavskih predstavništev v slovenskem prostoru. Podrobneje je predstavljena pravna ureditev sindikatov in svetov delavcev, kot kolektivni obliki delavskih predstavništev v Republiki Sloveniji, njune temeljne značilnosti, podobnosti in razlike. Kritično podajam tudi vzporedno delovanje obeh vrst kolektivnih delavskih predstavništev in njuno vlogo v današnjem času, ob vpogledu v statistične podatke in ob primerjalno pravni ureditvi. Podrobneje sem predstavila danski model kolektivnih delavskih predstavništev, ki ga veliko teoretikov daje za vzgled drugim državam. V magistrski nalogi podajam tudi konkretni primer dobre prakse sodelovanja med kolektivnimi delavskimi predstavništvi ter delodajalcem, pri čemer gre za gospodarsko družbo, ki posluje v Republiki Sloveniji preko hčerinske družbe ter konkretne primere iz sodne prakse kolektivnih delovnih sporov pri posameznih obravnavanih institutih. Collective workers’ representations play an important role in the field of representing workers’ interests within the Slovenian legal system, particularly by ensuring social dialogue between the workers, the employer representatives and the state. This master's thesis contains a historical overview of the development of collective workers’ representations, the reason for their occurrence, legal sources which have regulated and currently regulate this field and the role of collective workers’ representation in Slovenia. A detailed insight into the legislation governing trade unions and works councils as forms of collective workers’ representatives in the Republic of Slovenia is provided, as well as their fundamental characteristics, similarities and differences. On the basis of statistical data and comparative legal jurisdiction, the master’s thesis develops a critical perspective of the parallel operation of both types of collective workers’ representations and their current role. A detailed model of the Danish collective workers’ representation is presented, as this model is frequently set as an example for other countries. This master’s thesis also presents a concrete example of good practice of cooperation between the collective workers’ representation and an employer in a company that operates in the Republic of Slovenia through its subsidiary, as well as concrete examples from legal cases of collective labor disputes in individual institutes.

Arribamos a la edición número 42 de la revista Temas Socio- Jurídicos tras veinte años de persistente presencia en el medio académico del país, y de haber obtenido nuevamente la homologación como publicación científica por parte del comité de Colciencias. Al cierre de la edición registramos el deceso de tres juristas vinculados a los orígenes de nuestra facultad de derecho, los doctores Carlos Alberto Zuluaga Soto, Hernán Prada Niño y Alvaro Rey Ramírez, así como del humanista Jorge Enrique Valderrama en cuya memoria dedicamos este esfuerzo de la comunidad académica. We arrive at the 42nd edition of the Socio-Legal Issues magazine after twenty years of persistent presence in the media of the country, and having again obtained approval as a scientific publication by the committee of Colciencias. At the close of the edition we recorded the death of three jurists linked to the origins of our law school, doctors Carlos Alberto Zuluaga Soto, Hernán Prada Niño and Álvaro Rey Ramírez, as well as the humanist Jorge Enrique Valderrama in whose memory we dedicate this effort of the academic community.
