Climate change is happening and it will have severe effects on human wellbeing and prosperity. These natural hazards will affect coastal, rural and urban areas. Besides effects on biodiversity and humans also property might be damaged or decrease in value. This requires disaster management, ranging from prevention to recovery. In order to manage the adverse effects, measures to increase resilience are necessary. These measures can be stimulated or done by the government, or by citizens themselves. This chapter focuses on the role of property rights in contributing to resilience. It discusses what property rights are—in common law and civil law systems, infringements of property rights, the remedies against these infringements and finally it reflects on the situation that natural hazards cause damage to property and different recovery mechanisms. The notion of property rights is placed in the wider context of justice.

Although flood risk is usually framed as a physical problem, there is also an important socio-spatial side to the issue, such as urbanization in floodplains, the increasing share of sealed land, or the development of real estate values, which are influenced by a large number of individual decisions (such as location choice, or private flood protection measures). Flood risk management is shifting towards including these elements through responsibilization of spatial planners and civil society. However, since flood risk management in Belgium is strongly government-led and solutions were usually confined within the boundaries of the water system itself, there is little knowledge on how to do this. Therefore, this paper looks into the point of view of citizens, more specifically residents of flood-prone areas, based on a survey (n=183) in the Dender basin (Flanders, Belgium). The paper first discusses three themes: the relation of residents to their residence and their willingness to move, their sense of responsibility, and potential seeds of self-initiative. The survey shows that residents are very much attached to their homes, but at the same time take very little action. Remarkable is that even though Belgium has a relatively weak tradition in spatial planning, they place responsibility for living in flood-prone areas on the government, and therefore they feel entitled to public protection. The paper then reflects on how formal flood risk management and society interact, and how this reciprocal relation can be more fruitful.

‘Open ruimte’ en ‘Vlaanderen’ zijn twee begrippen die vele Vlamingen niet aan elkaar kunnen knopen. Het algemeen beeld van Vlaanderen is er één van een nevelstad: een nagenoeg volgebouwde ruimte met maar weinig resterende open ruimte, met hier en daar nog een fragment bos of natuur en een lap landbouwgrond. Maar is de Vlaamse open ruimte wel zo beperkt in oppervlakte als we denken? En door wie wordt de open ruimte nu gebruikt?

Door verstedelijking is de Vlaamse open ruimte niet langer een monofunctioneel productielandbouwgebied, maar kent ze een complexe gefragmenteerde structuur met verschillende dichtheden en functies. Deze paper, in het kader van het Steunpunt Ruimte en Wonen, wil hierin inzicht bieden door te focussen op vier onderschatte niet-agrarische landgebruiken: wonen, bedrijvigheid, privaat gebruik (o.a. privéweiden, moestuinen) en recreatief medegebruik. De paper analyseert de relatie tussen deze ‘nieuwe’ functies en maakt een inschatting van hun ruimtelijke impact aan de hand van negen casestudy’s. Deze inzichten kunnen bijdragen aan een beleid dat beter afgestemd is op de huidige ontwikkelingen in de Vlaamse open ruimte.

De Vlaamse ruimte is sterk bebouwd en versnipperd. Dit geeft aanleiding tot het stereotiepe beeld van Vlaanderen als één homogeen verstedelijkt veld. Analyses van de bebouwing en versnippering tonen echter aan dat er binnen de Vlaamse ruimte belangrijke verschillen zijn. Deze analyses leveren niet enkel meer gedetailleerde inzichten in de ruimtelijke realiteit van Vlaanderen, maar stellen ook de gangbare manier van denken over verstedelijkte ruimte in vraag. Zeker wat betreft de open ruimte worden bebouwing en versnippering vaak als een eenduidige verstoring gezien, die het gebied eensklaps minder waardevol maken. Deze conservatieve houding gaat voorbij aan de unieke eigenschappen en potenties van dergelijke gebieden. Gebieden met veel verspreide bebouwing vergen immers een andere ontwerpaanpak dan verlinte of verkavelde gebieden, en ook kleinere openruimtefragmenten kunnen een belangrijke socioculturele en zelfs ecologisch rol spelen. Het exploreren van deze potenties komt niet enkel de waarde van deze versnipperde ruimten ten goede, maar kan ook een interessant uitgangspunt vormen voor het nadenken over toekomstige verstedelijkingsprocessen.

Participation is an often-demanded process in disaster risk reduction (DRR). However, it is often unclear who understands what under this term. International organizations such as the United Nations have promoted participation in their DRR strategies since the 1980s, but further research is needed on its opportunities and limitations. Here we highlight what is understood by participation according to different actors and various international contexts. This study was motivated by a workshop where flood-risk and resilience experts from 14 countries perceived the nature of participation and the lack of its implementation differently. To unravel the multitude of these perspectives, 27 expert interviews were conducted in seven countries: Belgium, Germany, Indonesia, Iran, Nepal, Pakistan and Peru between March and August 2020. Results show that constraints on the conduction of participation are not only related to the specific country context but differ even within countries. Limitations such as capacities and willingness to participate as well as the role and importance of participation are common issues across the investigated contexts and countries.
