The rigorous thesis is focused on the analysis of the subject of conditional sentencing legislation, which represents the pillar of punishing offenders. Conditional sentencing is the most used punishment to date. It is indisputable that conditional sentencing will continue to be used in years to come. The aim of this rigorous thesis is to evaluate effective legal regulation, which also significantly evolves in the time of writing of the thesis. The amendment declares the irreplaceable role of this punishment, although the basis of the conditional sentence is unchangeable. Another aim is connection of theory and practice and to detect difficulties of legal regulation. In the introduction, the author deals with the evolution of conditional sentencing, but the main components are within chapters three and four which are dedicated to conditional sentencing and conditional sentencing with supervision. In these chapters, the author pulls examples from her experience from practice within the system, to demonstrate the faults within the legal regulation. Conditional sentence Abstract The thesis focuses on the analysis of selected problems related to conditional sentence. Even though the conditional sentence is for many people a traditional, boring and unmodern institute, it is paradoxically still the most frequently imposed punishment. However, despite more than a century of tradition, we cannot speak of its flawless content and smooth imposition practice. How to deal with the accumulation of conditional sentences? It is evident from an analysis of the current knowledge on the various partial problems of this unsatisfactory practice that this is the most pressing problem concerning suspended sentences. Through the presented proposals, it is possible to mitigate its impact, both in the imposition of sentences by the trial court and in the conversion of conditional sentences, but only a comprehensive revision of all the related institutes will ensure a truly fair and tailored sentence for each offender. Preliminary Proceedings Abstract in English The diploma thesis deals with the topic of Summary Preliminary Proceedings, which is one of the most important institutes in terms of accelerate the criminal proceedings. It is one of the three forms of preliminary proceedings, the essence of which is to enable simplification of the process for the least serious crime, so that the perpetrator of such a crime can be convicted and punished as quickly as possible. This is not only in order to make the proceedings more efficient in economic terms, but also to ensure that it has the greatest possible impact in terms of individual and general prevention. The aim of this thesis is not to discuss the above mentioned institute only in isolation, but also in its broader context. The Public Prosecutor's Office operates across the entire criminal procedure and is entrusted with partial powers in other types of proceedings, while this work deals with the public prosecutor's powers in criminal proceedings. Following this determination of the limits, which is the main aim of the thesis, it gives the tightest definition of police provocation, it solves possible criminal law consequences of police provocation and it brings a brief analysis of admissibility of further forms of behaviour that can result in an intention of other person to commit a crime. MEDIATION IN CRIMINAL MATTERS Abstract The subject of this thesis is mediation between the victim and the offender and its setting in the framework of criminal proceedings. Mediation in criminal matters is one of the programs of restorative justice, which emphasizes meeting the needs of the victim and holding the offender accountable for the consequences caused by the crime. It also involves other affected persons and the relevant community in the consideration of the solution. Mediation is a voluntary and confidential alternative dispute resolution of the conflict and consequences of a crime between the offender and the victim with the participation of an impartial third party mediator. The thesis elaborates the legal regulation of mediation in criminal cases, which falls under the competence of the Probation and Mediation Service. Protection of a victim of a criminal offence Abstract This thesis adresses the protection of victims of crime, a serious and currently very topical issue. The initial part of the thesis is devoted to victimology as a scientific field, the subject of which is mainly the victim of crime. This chapter introduces basic victimological concepts that are important for a comprehensive understanding of the issue under study. The next chapter provides a brief overview and comparison of the definition of a victim across basic international documents, EU legislation, and the legal order of the Czech Republic. Furthermore, this section proceeds to analyse and evaluate the currently valid definitions of victim and particularly vulnerable victim as defined in the Victims Act, and offers a brief introduction of the Act. Non-criminal competence of public prosecution and its utilization in criminal proceedings with a focus on economic crimes Abstract This rigorous thesis focuses on the non-criminal competence of the public prosecutor's office and its interconnection with the criminal competence with a focus on bankruptcy crimes. The aim of this thesis was, on the one hand, to describe the content of the non-criminal competence of the public prosecution as a whole, the procedural position and legitimacy of the different levels of the public prosecution when participating in civil court proceedings and, on the other hand, to focus on the acquisition and use of knowledge gained from the non-criminal competence in criminal proceedings. Agreement on guilt and punishment Abstract The subject of the work is the institute of an agreement on guilt and punishment as a special way of handling criminal cases. The essence of an agreement on guilt and punishment is an agreement between the public prosecutor and the accused, in which the accused confesses to committing the act for which he is being prosecuted, in exchange for imposing a lesser punishment than that which would threaten him in standard criminal proceedings. It is a form of diversion in criminal proceedings, which is intended to speed up and simplify criminal proceedings. The agreement on guilt and punishment is enshrined in the Czech legal system for a relatively short period of time. It was introduced in 2012. As the guilt and punishment agreement did not materialize in practice in the following years, certain changes had to be made. These occurred in 2020 when, for example, an agreement on guilt and punishment was made possible for particularly serious crimes. The work is structured into six chapters. Hate Crimes and their sanctions Abstract This thesis focuses on the legal regulation of the punishment of hate crimes in the Czech Republic and attempts to provide a comprehensive overview of the principles, methods and type of punishment for this type of crime. The thesis first discusses the constitutional and legal basis of the sanctioning of hate crimes, with an emphasis not only on international legal documents but also on the Czech legislation. Next, the author attempts to define this type of crime, focusing in particular on the so-called hate motive, as this is the core of hate crime and has a significant impact on the imposition of penalties on perpetrators of hate crimes. Chapter 2 describes the methods of imposing criminal sanctions, their history and the individual sanctions that can be imposed on offenders under Czech law. The statistics on the imposition of sanctions for the year 2016-2020 show that alternative punishments are most frequently imposed - suspended imprisonment, fines, community service. This thesis is dedicated to the introduction of criminal law instruments for the fight against organized crime and their current legal regulation in the criminal law of the Czech Republic. The introductory part of the thesis is focused on briefly introducing some criminological definitions of organized crime, its definitions in selected international documents and last but not least, the definition of the organized criminal group in Czech criminal law. The second part is devoted to the legal instruments against organized crime regulated by substantive criminal law, namely the offence of participation in an organized criminal group and the issue of punishing the perpetrator of an offence committed for the benefit of an organized criminal group. COOPERATING DEFENDANT Abstract The aim of the thesis is to present and analyse the current legislation of the cooperating defendant in the Czech Republic. The thesis is divided into 6 chapters. This diploma thesis deals with the topic of the competence and organization of the prosecutor's office in criminal proceedings, namely in the Czech Republic and in the Federal Republic of Germany. The institute of the Public Prosecutor's Office is a very important part of the functioning justice system, especially for the protection of justice and society from crime. The given topic can be perceived as very broad, and therefore this work is focused primarily on the comparison of the legislation in selected areas, where the differences that the legislation in question shows. In the legal systems of both states, it is possible to find a number of differences, but also similarities. Secondary victimization of victims of sexual offenses Abstract The submitted rigorous thesis on the topic of secondary victimization of victims of sexual offenses aims to acquaint its readers with the issue of secondary victimization, especially in relation to particularly vulnerable victims of sexual offenses. The thesis introduces the basic concepts important for the issue and then focuses on secondary methods of victimization of rape victims and child victims of sexual offenses, while also discussing specific options for preventing and alleviating secondary victimization of these victims. The title of this diploma thesis is "The Role of a Public Prosecutor in Criminal Proceedings". In the Czech Republic, it is Public Prosecution that is granted the right by the Constitution to prosecute criminal offenses on behalf of the country. Activities arising from this right are the main duties of a public prosecutor. The aim of this thesis is therefore to describe said activities. It is done so chronologically with regard to the different phases of criminal proceedings. Other goals include trying to find problematic areas of the laws that govern public prosecutors, trying to come up with possible reasons behind them and proposing their solutions. The first chapter introduces the basic concepts essential for the definition of adhesive proceedings and related terms. These are primarily the definition of entities and parties to criminal proceedings, including the introduction of the institutes of harm as an overarching term, which includes damage, non-material damages and unjust enrichment. 1 Abstract This dissertation thesis discusses the problems of entitlement to a claim of the injured party in adhesion proceedings. Concretely the procedure and conditions of a claim of the injured party in adhesion proceedings were introduced and the differences between a civil and adhesion claims were identified, especially in the relation to determining the amount of damage or other than proprietary loss. Academic literature, internet sources, relevant legal regulations, case law from not only the supreme court but also other sources, such as many personal meetings with specialists in given area, or practical experience gained during a study-related internship, were used to obtain information. This issue is currently often debated due to, among other reasons, a change in the legal regulation of compensation for pecuniary and non-pecuniary harm effective from January 1, 2014. The specificity of this subject lies in the combination of two legal branches - criminal and civil law, as collateral proceedings are part of criminal proceedings and decide on claims which are of a civil nature. The aim of the thesis is to investigate the crime of Trafficking in human beings from the point of view of substantive criminal law in the Czech Republic, to analyze its weaknesses and propose their solution. The investigation should include an assessment of whether the Czech Republic's regulation is in line with international law obligations to criminalize this crime. In this work, compilation, legal-historical, analytical and general and legal interpretation methods are used. The first part is an introduction to the issue of human trafficking. This part introduces the subject of the social deviant phenomenon and points out the necessity of its perception in various, not only legal, fields. This crime is the most common and at the same time the most serious tax crime which is significant by high rate of latency. The aim of this thesis is to present complex overview of current tax fraud legislation problematics. Several parts of this thesis are dedicated to the basic features of tax fraud. This diploma thesis deals with the aspects of unconditional imprisonment. Unconditional imprisonment, as a term of criminal law, is the most severe punishment used in the Czech Republic, it is also a universal punishment that can be imposed for any crime. Imprisonment is executed in a prison with security, in a maximum-security prison, or in a special unit of remand prison. The rights and obligations of convicts are governed, in particular, by the Act on Imprisonment and Imprisonment Rules. Various educational programs and leisure activities, as well as the employment of the convicts, are carried out during the execution of the imprisonment. The institute of conditional release is an important instrument for the reduction of the prison population, yet it is underused. The prison problems are especially a high number of prisoners, overcrowded prisons, low financial literacy and high indebtedness of convicts, substance abuse problems, cumulative prison sentences and prisoners' pay-to-stay fees. The main aim of this thesis is comprehensive description of the essence and of the domestic applicable legislation of these actions, and also the analysis of possible problematic points and deficiencies. Currently, the mentioned Code in its title nine called procedure prior to initiation a criminal prosecution defines types of these actions in an enumerative way. The aim of the present thesis was to determine the problems of the current legislation of the criminal liability of legal persons and to consider whether it is possible to adopt the legislation as it is applied in England and Wales and use it into the legal order of the Czech Republic in compliance with the development of Czech legislation and England and Wales. Due to the extensiveness of the issue, only certain problematic parts of the legal order of the criminal liability of legal persons in the Czech Republic were selected. Attention was focused on the questionable parts selected only from the substantive part of the law. The approach to criminal liability of legal persons is diverse in the Anglo-American system. Variation can be seen at the level of individual states belonging to the system and at the federal and state levels. The Crime of Money Laundering under Section 216 of the Czech Criminal Code Abstract The diploma thesis aims to examine the crime of legalization of proceeds of criminal activities in its narrower sense, i.e. the crime under S. 216 (2) of the Czech Criminal Code. This crime is referred to as "the crime of money laundering" throughout the thesis, as opposed to the crime of possession of stolen goods under S. 2016 (1) of the Czech Criminal Code.
