Šiame straipsnyje kritiškai analizuojama oficialių statistinių XX a. 3–4 dešimtmečio nužudymų šaltinių patikimumas ir siekiama įvertinti jų trūkumus. Atsižvelgiant į gautus rezultatus, bus mėginama padaryti galimas prielaidas apie nužudymų tipus ir tendencijas tarpukario Lietuvoje. Straipsnyje susitelkiama į medicinos įstaigų duomenų su mirties priežastimis ir policijos skelbtų nužudymų statistikos analizę, atsiribojant nuo teismų pateikiamos nužudymų bylų kiekybinės informacijos. Nužudymų statistiniai duomenys nuo 1924 m. buvo skelbiami Statistikos biuleteniuose ir Lietuvos statistikos metraščiuose. Šie statistikos šaltiniai nužudymų tyrime kelia klausimų dėl savo patikimumo, dėl neaprašytos duomenų rinkimo metodologijos, skirtingos nužudymų terminijos vartojimo, dirbtinio miesto ir kaimo vietovių apibrėžimo, Lietuvos teritorijos ir gyventojų skaičiaus kitimo. XX a. 3 deš. nužudymų skaičiaus negalime nustatyti dėl nužudymų terminijos kaitos ir jos turinio. 1924–1931 m. vartotas terminas prievartos mirtys, išskyrus savižudybes, o nužudymai nebuvo išskirti atskirai. 1932–1939 m. prievartos nusikaltimai skirstyti į keturias grupes: nusižudymus, nužudymus, nelaimingus atsitikimus ir kitokią prievartą. XX a. 4 deš. išsamesni duomenys atskleidė, kad vyrai buvo nužudomi 3–4 kartus dažniau nei moterys ir priklausė 15–29 ir 29–44 metų amžiaus grupėms, o moterys – 15–29 metų amžiaus grupei. Labiausiai paplitęs nužudymo būdas – nušovimas. Policijos publikuotuose nužudymų statistiniuose duomenyse taip pat išryškėja sąvokų problema. Remiantis Lietuvos baudžiamuoju statutu, kaip gyvybės atėmimas buvo apibrėžti nužudymai, pavainikių kūdikių nužudymai, abortai, rengimasis ir pasikėsinimas nužudyti, suteikimas priemonių ir kalbinimas nusižudyti. Tačiau policijos statistikoje ši terminija atsispindėjo tik iš dalies, 1927–1930 m. policija vartojo žmogžudysčių terminą ir jas skirstė į padarytas: pasipelnymo tikslu, per muštynes ir kitokias. Nesantuokinių vaikų žudymas buvo išskirtas atskirai. Jei neskaičiuotume kitokių nužudymų, infanticidas buvo dažniausias nužudymo tipas tarpukario Lietuvoje. Nuo 1931 m. policijos duomenyse gyvybės atėmimas buvo skirstytas į septynis tipus pagal įvykio motyvą: pasipelnymo tikslu, per muštynes, ginant savo ar kitų gyvybę, per neatsargumą, pavainikių kūdikių žudymas, gemalo sunaikinimas ir kitais tikslais. Nusižudymai, nelaimingi atsitikimai ir rasti mirusiųjų kūnai į šias kategorijas neįėjo. Išanalizavus 1931–1938 m. gyvybės atėmimo duomenis, neskaičiuojant abortų, nužudymai varijavo tarp 200–300 atvejų per metus, tačiau palyginus visus gyvybės atėmimus su nužudymais pagal mirties priežastį darytina išvada, kad šie skaičiai pateikti su rengimusi ir pasikėsinimu nužudyti bei suteikimu priemonių ir kalbinimu nusižudyti. Taigi, dėl sąvokų kaitos ir pasikėsinimų priskaičiavimo prie nužudymų policijos statistinius duomenis galima laikyti nepatikimais. Tiksliausiai kiekybiškai nužudymus apibrėžia mirties priežasčių rodikliai, kurie 1932–1938 m. Lietuvoje fiksavo gana stabilią 93–139 nužudymų per metus amplitudę. Remiantis policijos statistinių duomenų analize galima identifikuoti bent keturis pagrindinius nužudymų tipus tarpukario Lietuvoje: reprodukcinį – nesantuokinių kūdikių žudymą ir abortus, agresyvųjį – nužudymai muštynių metu, ekonominį – siekiant pasipelnyti, netyčinius nužudymus per nelaimingus atsitikimus. This article calls into question the reliability of the official historical statistical sources of homicides in 1920s-1930s Lithuania and aims to evaluate the limitations of the mentioned sources. With this in mind, we will attempt to make some assumptions about homicide types and trends in interwar Lithuania. The Central Statistical Bureau had been publishing statistical data relevant to the investigation of homicides in Statistical Bulletins and the Statistical Yearbooks of Lithuania since 1924. These statistical sources in the homicide study were problematic due to an unclear data collection methodology, the use of different homicide terms, unrealistic definitions of urban and rural areas and changes in Lithuania’s territory and population. We cannot determine the exact rates of the 1930s homicides due to the change in the homicide terminology and its content. Between 1924-1931 the term violent deaths, except suicides, was used, and homicides were not singled out. The analysis also shows that until 1931 violent deaths included homicides and accidental deaths too. From 1932 to 1939 violent deaths were divided into 4 groups: suicide, homicide, accidents and other violence. The more detailed data of the 1930s have revealed that the most frequent victims of homicide were in the 15-29 and 29-44 age groups for men, while the 15-29 age group stands out for females. The most common method of killing was shooting. The police-published homicide statistics also reveal a problem of terminology. According to the Penal Statute of Lithuania, deprivation of life was distinguished into the crimes of homicide; infanticide; abortion; preparation to murder; attempted murder and persuasion and help to commit suicide. However, this terminology was only partially reflected in the police statistics, as between 1927-1930 the police used the term homicides and classified them into the ones committed: for-profit; during brawls; for other purposes. Infanticide was separated from homicides. Leaving out others, infanticide was the most common murder type in interwar Lithuania. Since 1931 the statistics of the police had been using the term of deprivation of life and distinguished it into the 7 types according to the motive: for-profit; during brawls; defending one’s own life or the lives of others; involuntary; infanticide; abortion and for other purposes. It did not include dead bodies found, suicides and accidental deaths. After analysing the 1931-1938 data on deprivation of life, excluding abortions, homicides would vary from 200 to 300 per year. When comparing all the deprivations of life with homicides by the cause of death, it can be concluded that these figures included preparation for murder and attempted murder as well as persuasion and help to commit suicide. Thus, due to the change in the terminology and the inclusion of attempted murders, the police statistics can be considered unreliable. Homicides are the most precisely quantitatively defined by the rates of causes of death, which in 1932-1938 Lithuania were relatively stable with an amplitude of 93-139 murders per year. On a basis of the analysis of the police statistical data, it is possible to identify at least 4 main types of homicides in interwar Lithuania: reproductive – infanticide and abortions, aggressive – killings during brawls, economic - for profit as well as unintentional homicides that happened during accidents. Straipsnyje nagrinėjamas istoriografijoje negvildentas XIX a. bajorų istorijos aspektas – stambios dvarininkės Apolinaros Žabaitės-Pliaterienės (Apolinara z Żabów Platerowa, ~1780–1847) savarankiškas tėvoninių dvarų valdymas. Tai vienintelis aptiktas atvejis, kai moteris valdė vyro nuosavybę jam gyvam esant, kas prieštaravo Lietuvos teisei. Pagrindinis dėmesys skiriamas dvarininkės pastangoms apsaugoti nuo konfiskacijos Aluotų, Dusetų ir Padustėlio dvarus, sudariusius Kazimiero Pliaterio (Kazimierz Plater, 1779–1819) ir jo sūnų Vladislovo (1808–1889) bei Cezario (1810–1869) Pliaterių tėvoniją. Aptariamas moteriškos ir vyriškos nuosavybės susidarymas, paliečiamas sutuoktinės pasoginio kapitalo ir brangenybių hipotekos klausimas, dvarų skolų atsikratymas ir teisinės priemonės, leidusios pasiekti moters vienvaldystę tėvonijoje. Pirmą kartą plačiai naudojami Dusetų dvaro archyvo dokumentai, saugomi Lietuvos valstybės istorijos archyve. Making extensive use for the first time of the surviving archives from Dusetos manor, the article analyses the attempts by the landowner Apolinara z Żabów Platerowa (~1780–1847) in the first half of the 19th century to become the sole owner of large estates. The laws of the Grand Duchy of Lithuania did not prevent women from inheriting their parents’ manors and managing them under the supervision of their husbands, and widows were granted lifelong support from their late husbands’ manors. However, Apolinara Plater sought to take over the property of her husband Count Kazimierz Plater (1779–1819) while he was still alive, and this was against Lithuanian law. Her main intention was to protect the estates at Aluotos, Dusetos and Padustėlis, which formed the inheritance of Kazimierz Plater, and his sons Władysław (1808–1889) and Cezary (1810–1869), from confiscation. The article analyses how men’s and women’s property was formed in the 19th century, how women’s capital mortgages operated, and what debt relief measures were in place. Countess Plater was forced to seek to independently manage her husband’s estates, because of the political activities of the Lithuanian nobility, which might have led to the confiscation of the property. She succeeded by legal means in proving that she was the sole owner of the estates when Plater joined Napoleon’s army and was exiled. She used the same legal tools when her husband returned and demanded his property back. She dared to oppose the late Plater’ will, according to which the administration of the manors had to be handed over to the legal guardians of his underage sons. After the November Uprising (1830–1831), she did everything she could to save the property of her sons, who participated in the insurrection. She managed to retain the manors of Aluotos, Dusetos and Padustėlis, which were only confiscated by the state treasury after her death. As the manager of the manors, with the help of administrators, Countess Plater dealt with complex economic issues. However, her talents were most evident in the field of finance and credit, when she had to repay millions to creditors to cover her husband’s and his brother’s debts. The repayment of the large debts depended not only on the ability to make the manors profitable, but also on taking out new loans to cover the debts. She was probably the only female landowner in Lithuania who managed to carry out a large-scale debt settlement operation in the 19th century.

Straipsnio tikslas – aptarti išlikusių XVII a. pradžios Žemaitijos pilies ir žemės teismų knygų turinį kaip pagrindinę šaltinių bazę teismo įgaliotinių (advokatų) istorijos tyrimams, sudaryti pirminį įgaliotinių sąrašą. Based on surviving court books, the article examines the work of early pre­lawyers, known as attorneys­at­law, in the courts of Samogitia in the first decade of the seventeenth century. A preliminary list of such attorneys was compiled and is included in the article, the nature of the disputes they represented in court is discussed, some of the most active attorneys are identified, and their origins are discussed. The article aims to investigate the possible sources used by the authors of the 1447 Casimir Jagiellon’s charter for the Grand Duchy of Lithuania and examine the feasible sources of its individual fragments (its articles and clauses). The process of textual criticism made it possible to suggest the direct sources of both the individual articles and clauses of this charter. The conducted analysis allows us to conclude that the authors of the 1447 charter drew mainly upon the 1440 charter of the Novogrudok Land and then on the act of the 1413 Union of Horodło, and a charter issued by the Grand Duke of Lithuania Sigismund Kęstutaitis. However, most of the borrowed articles of the 1447 charter are taken from the 1440 charter of the Novogrudok Land (eight out of thirteen).

The history of the law in the Grand Duchy of Lithuania has always attracted the attention of researchers. The productive period in its study was the activity of the Commission for the Study of the History of Western-Ruthenian and Ukrainian Law of All-Ukrainian Academy of Sciences (hereafter AUAS). The theoretical achievements of the commission are significant. Nowadays some of its members’ works have been republished with modern commentaries, and separate studies have been devoted to them. But there are such members whose works do not have any historiographical researches despite their great scientific achievements. One of them is the historian Stefan (Stepan) Hnatovych Borysenok (May 17, 1891 – November 14, 1937). Borysenok was a talented and extraordinary researcher. This article presents his biographical data as well as the theoretical achievements of the scientist are analyzed. The scientific achievements of the researcher in the field of law history are not very large. They are about 10 works (thorough scientific articles) and several reviews. They were significant for that time. However a few decades later after writing of these articles modern researchers point to a significant number of inaccuracies and errors in his works. S. Borysenok’s works were highly appreciated by his contemporaries and scientific mentors M. Vasylenko and O. Malynovsky. First of all they were impressed by the fact that he always tried to turn to primary sources and was critical to the works of his predecessors. His works show an excellent knowledge of the historiography of a particular research problem. In addition S. Borysenok being a lawyer by education was able to analyze in more details the certain problems that were not always clear to historians. The issues related to the First Lithuanian Statute and the history of the Bar in the Grand Duchy of Lithuania had been researched by S. Borysenok since the middle of 1920s. In particular the main subject of his research in Moscow archives was "History of the Bar in Ukraine in the 16th–18th Centuries. The special articles of the researcher are interesting and original. Among them are such articles as "Formation of a Professional Bar in the Lithuanian-Ruthenian State", "Lawyer's Fee in the Lithuanian Principality in the 16th–17th Centuries" (The latter was published in the 7th issue of the "Proceedings of the Commission for the Study of the History of Western-Ruthenian and Ukrainian Law". But that issue was destroyed). One of the greatest work by S. Borysenok concerns the history of the Bar formation in the first half of the 16th century. Also in the late 1920's the researcher had been preparing for publication a thorough work with focus on the Lithuanian Statute (history of drafting the code, sources, lists). Correspondence with Lithuanian researcher A. Janulaitis (the ancestor of the Lithuanian Statutes historiography) indicates that the manuscript of this work (or a significant part of it) probably existed. At the same time the facts of cooperation with Lithuanian historians are recorded and they give us the opportunity to hope that the lost achievements of the researcher can still be found and introduced into scientific circulation. And we are convinced that they will be the impetus for the new scientific research and will cause a significant number of scientific discussions. In the early 1930's S. Borysenok was an employee at the library. He actively worked at the acquisition of the library fund with foreign professional publications. He tried to establish and systematize international exchange. On September 23, 1937 S. Borysenok was arrested on trumped up charges of alleged involvement in an "anti-Soviet nationalist organization". On October 25 of the same year he was sentenced to death via shooting (executed on November, 14).

M. Römeris tapo Nuolatinio Tarptautinio Teisingumo Teismo teisėju ad hoc Klaipėdos krašto Statuto aiškinimo byloje. Šios bylos nagrinėjimui jis skyrė nemažai lapų savo dienoraščiuose. Juose teisininkas atskleidžia bylos nagrinėjimo detales. Dėl medžiagos gausos šį tyrimą sudaro keturių straipsnių ciklas: „Bylos kilmė ir rengimasis Teismui“, „Nuolatiniame Tarptautinio Teisingumo Teisme“, „Nuolatiniame Tarptautinio Teisingumo Teisme: sprendimas“, „Grįžus į Lietuvą, Teismas, teisėjai“. Römeris became an ad hoc judge of the Permanent Court of International Justice in the case of interpretation of the Statute of the Memel Territory. He devoted a lot of pages to this case in his diaries. In them, the lawyer reveals the details of the trial. Due to the abundance of material, this study consists of a cycle of four articles: „The Origin of the Case and Preparation for the Court“; “In the Permanent Court of International Justice“; „In the Permanent Court of International Justice: Judgment“; „Court, Judges, after Returning to Lithuania“. The title of entire series of articles is „The Case of Interpretation of the Statute of the Memel Territory in the Diaries of M. Römeris“. In this article, we present the preliminary opinions of the judges regarding the main and essential question – whether the governor of the Memel Territory had the right to remove the chairman of the Directorate from his position. This article is focused on the evolution of the constitutional position of the President of Lithuania in the Lithuanian Basic Laws. The analysis concerns the regulations of the three Lithuanian Basic Laws of the interwar period (of 1922, 1928 and 1938), two of which were an attempt to legitimize the political situation after the coup d’état against the constitutional government of the Republic of Lithuania in 1926 and also to implement the authoritarian government of President Antanas Smetona. The article also assesses the most important legal provisions concerning the constitutional position of the President, as well as compares the Lithuanian constitutional provisions with constitutions of other countries, primarily with the Polish Constitution of 1935. The research goals have been achieved thanks to the applied research methods, especially the comparative method, supplemented with the historical method and the method of institutional and legal analysis, which is used to analyse normative acts elaborated by legal bodies.

Lietuvių Vilniaus konferencija savo rezoliucijoje nustatė atkuriamos valstybės demokratinio politinio režimo gaires, nuo kurių Lietuvos taryba stengėsi nenukrypti. Lietuvos valstybės tarybos priimtuose konstituciniuose aktuose buvo įtvirtinti svarbiausi demokratijos struktūriniai elementai: tautos suverenitetas, rinkimai ir parlamentarizmas. Lietuvos valstybės taryba ir ją sukūrusi Lietuvių Vilniaus konferencija laikėsi tautos suvereniteto doktrinos ir stengėsi ją įtvirtinti savo aktuose. Tauta kaip valstybės elementas ir suverenas susidėjo iš visų Lietuvos gyventojų. 1918 m. ir 1919 m. laikinosiose konstitucijose expressis verbis nustatyti visuotinių, lygių tiesioginių rinkimų ir slapto balsavimo principai. Lietuvos valstybės taryba iš dalies atitiko parlamento sampratą, nes vykdė modernaus parlamento klasikines funkcijas: įstatymų leidyba ir tarptautinių sutarčių ratifikavimas, vykdomosios valdžios parlamentinė kontrolė, valstybės institucijų steigimas ir jų vadovų skyrimas ir atleidimas, biudžeto tvirtinimas ir jo vykdymo priežiūra. In its resolution, the Vilnius Conference of Lithuanians set out the guidelines for the democratic political regime of the restored state, from which the Council of Lithuania tried not to deviate. The most important structural elements of democracy were enshrined in the constitutional acts adopted by the Council of the State of Lithuania: national sovereignty, elections and parliamentarism. The Council of the State of Lithuania and the Lithuanian Vilnius Conference, which established it, adhered to the doctrine of the sovereignty of the nation and tried to enshrine it in its acts. The nation as an element of the state and a sovereign consisted of all the inhabitants of Lithuania. The temporary constitutions of 1918 and 1919 expressis verbis established the principles of universal, equal direct elections and the secret ballot. The Council of the State of Lithuania partially complied with the concept of the parliament, as it carried out the classical functions of the modern parliament: legislation and ratification of international treaties, parliamentary control of the executive power, the establishment of state institutions and the appointment and dismissal of their heads, the approval of the budget and the supervision of its implementation.

The historiography of cities in the Grand Duchy of Lithuania (GDL) has long been dominated by themes such as the expansion of a network of city-type settlements and the spread of Germanic law (Magdeburg and other versions). The GDL’s capital Vilnius, belonging to the category of large cities, is often compared in literature to other cities in the Polish-Lithuanian Commonwealth, primarily to Krakow. More recent historiography has begun to devote greater attention to the ‘agglomerate’ character of Vilnius: a number of jurisdictions not subject to Germanic law existed in the city alongside the Magdeburgian jurisdictions. Even though none of them have ever had a whole monograph devoted to their analysis, the object of Kamil Frejlich’s book, the jurisdiction of the Vilnius horodnictwo (or jurydyka horodnictwa wileńskiego: horodniczy, ‘castle supervisor’, jurydyka, ‘the territorial entity subordinate to him’) has been researched by others, in addition to the prewar author Euzebiusz Łopaciński. Raimonda Ragauskienė has taken an interest in 16th-century castle supervisors, and Domininkas Burba has analysed 18th-century record books from this jurisdiction. Thus, the monograph by this young Polish historian does fill this gap, shedding more light on the object of research in the 17th century. Before going into detail, it can be stated that after the publication of the excellent monographs by David Frick and Tomasz Kempa in the last decade, and a swathe of source publications, this has proven to be another serious tome bringing the history of 17th-century Vilnius closer to the public, and is very necessary, as the 700th anniversary of the city approaches. Įprasta M. Römerį laikyti Lietuvos konstitucinės teisės kūrėju. Tačiau jo akademinė ir visuomeninė veikla liudija tai, kad jis buvo ir Lietuvos administracinės teisės pradininkas. M. Römeris profesionaliausiai ir nuodugniausiai domėjosi administracinės teisės klausimais Lietuvoje, ypač kuriant administracinio teismo koncepciją. Būtent šis mokslininkas parašė pirmąją monografiją lietuvių kalba „Administracinis teismas“, susijusią su administracinės teisės institutu (administracinių aktų teisėtumo kontrole). Maža to, administracinės teisės tematiką teisininkas plėtojo savo straipsniuose, kitose knygose, studijose, dienoraščiuose, Vyriausiojo Tribunolo praktikoje, taip pat rengdamas Valstybės Tarybos statutą, Administracinio teismo įstatymo projektą, rašydamas įstatymų projektams aiškinamuosius raštus, konsultuodamas Seimo komisiją, rengusią vėlesnius Administracinio teismo įstatymo projektus. Norėdamas dėstyti administracinę teisę, valstybinės teisės paskaitų metu analizavo administracinių aktų teisėtumo kontrolės institutą profesionaliau nei tai darė administracinės teisės lektoriai per administracinės teisės paskaitas. Kviesdamas Paryžiaus universiteto profesorius skaityti viešas paskaitas Lietuvos teisininkams apie Prancūzijos administracinę justiciją, norėdamas įsteigti Politikos mokslų mokyklą ir Administracinių mokslų institutą, siekdamas, kad Lietuvoje veiktų administracinis teismas ir trokšdamas būti jo teisėju. It is customary to consider M. Römeris as the creator of Lithuanian constitutional law. However, his academic and social activities testified to the fact that he was also a pioneer of Lithuanian administrative law. M. Römeris was most professionally and thoroughly interested in issues of administrative law in Lithuania, especially in developing the concept of an administrative court. The first monograph in Lithuanian language related to the institute of administrative law (control of the legality of administrative acts or judicial review), “The Administrative Court”, was written by this scholar. Not only that, but Römeris also developed the topic of administrative law in his articles, other books, studies, diaries, and the case-law of the Supreme Tribunal. Further, Römeris was also involved in drafting the Statute of the Council of State, drafting the Law on Administrative Courts, writing explanatory notes to draft laws, advising the Seimas Commission on drafting the Law on Administrative Court, teaching students about judicial review, inviting professors of the University of Paris to give public lectures on administrative justice to Lithuanian lawyers, trying to establish a School of Political Science and an Institute of Administrative Sciences, and finally desperately trying to establish an administrative court in Lithuania. The scientific foundation of this article consists of the material of five funds stored in the Manuscript Departments of the National Central State Archives of Lithuania, Martynas Mažvydas National Library, the Wróblewski Library of the Lithuanian Academy of Sciences, and Vilnius University Library. The historical, comparative, analytical, descriptive, and document analysis methods were used in the research.

M. Römeris dienoraščiuose neretai rašydavo apie konstitucinės teisės dėstymą, literatūrą, paskaitų, seminarų ir kolokviumų metu su studentais gvildentas temas, santykį su studentais. Rašė ir apie savo monografijas bei akademinės veiklos kulminaciją žymintį veikalų ciklą „Valstybė ir jos konstitucinė teisė“. Apie konstitucinę teisę jis rašė nuo 1922 m. iki pat savo mirties. Čia matyti, kaip M. Römeris tobulėjo ir kaip pedagogas, ir kaip konstitucinės teisės profesorius. Be to, dienoraščiai atskleidžia Lietuvos konstitucinės teisės doktrinos ir dėstymo disciplinos pradžią ir raidą. In his diaries, M. Römer often wrote about the teaching of constitutional law, literature, topics discussed with students during lectures, seminars and colloquia, and the relationship with students. He also wrote about his monographs and the cycle of works marking the culmination of his academic activity „The State and its Constitutional Law“. He was writing about constitutional law from 1922 until his death. You can see how M. Römer developed both as an educator and as a professor of constitutional law. In addition, the diaries reveal the beginning and development of the doctrine and teaching discipline of Lithuanian constitutional law.

M. Römeris dienoraščiuose neretai rašydavo konstitucinės, administracinės, civilinės, baudžiamosios, tarptautinės teisės klausimais. Rašė jis nemažai ir apie teisėjo, advokato vaidmenį. Tačiau jo dienoraščių 34 tomas ypatingas tuo, kad čia daug lapų skirta Klaipėdos krašto Statuto aiškinimo bylai Nuolatiniame Tarptautinio Teisingumo Teisme. Tai visai nestebina, nes šios bylos nagrinėjime teisininkas dalyvavo tiesiogiai – jis atliko nacionalinio teisėjo, arba teisėjo ad hoc, vaidmenį. Aprašydamas bylos nagrinėjimą, autorius gvildeno ir tarptautinės, ir konstitucinės teisės klausimus, ir Nuolatinio Tarptautinio Teisingumo Teismo bylų nagrinėjimo procesą, teisėjo ad hoc vaidmenį, santykį su nuolatiniais Teismo teisėjais, aptarė teisėjų asmenybes, diskusijų, vykusių tarp teisėjų, ypatumus, psichologines priežastis teisėjams apsisprendžiant dėl kokio nors dalyko, išgyvenimus, susijusius su kova dėl Klaipėdos krašto. In his diaries M. Römeris often wrote on constitutional, administrative, civil, criminal, and international law issues. He also wrote a lot about the role of a judge and a lawyer. However, volume 34 of his diaries is characterized by the fact that many pages are devoted to the case of the interpretation of the Statute of the Memel Territory at the Permanent Court of International Justice. This is not at all surprising, because the lawyer participated directly in the trial of this case – he played the role of a national judge (judge ad hoc). When describing the trial, the author discussed the issues of both international and constitutional law, the process of hearing cases at the Permanent Court of International Justice, the role of the judge ad hoc, the relationship with the permanent judges, discussed the personalities of the judges, the peculiarities of the discussions that took place between the judges, the psychological reasons when the judges decided on one or another, experiences related to the struggle for the Memel Territory. This study consists of a cycle of four articles: „The Origin of the Case and Preparation for the Court“; „In the Permanent Court of International Justice“; „In the Permanent Court of International Justice: Judgment“; „Court, Judges, after Returning to Lithuania“. Šio tyrimo tikslas – remiantis teisės normomis, teismų praktika ir mokslo doktrina nustatyti teisinių papročių reikšmingumą Lietuvoje 1918–1940 metais. Šiame straipsnyje sprendžiami uždaviniai: 1) nustatyti, kurioms socialinėms grupėms ir kokia apimtimi buvo taikomi papročiai pagal Lietuvoje galiojusią Rusijos imperijos teisę; 2) atskleisti konstitucinės nuostatos dėl prieš karą galiojusios teisės recepcijos reikšmę teisiniam papročiui; 3) atskleisti įstatymų leidėjo požiūrį į teisinį paprotį, įstatymų nustatytas papročių taikymo ribas ir įstatymų leidybos šiuo klausimu tendencijas. 1918 metais priimtas ir įtvirtintas Konstitucijoje sprendimas palikti galioti tuos įstatymus, kurie galiojo Lietuvoje prieš karą (kiek jie neprieštarauja Konstitucijai), buvo labai palankus teisiniams papročiams – Rusijos imperijoje paprotine teise buvo reguliuojama daug valstiečių santykių, ypač smulkių turtinių ginčų, globos ir paveldėjimo srityse. Teisinis paprotys buvo reikšmingas teisės šaltinis ir kitoms socialinėms grupėms – pirkliams, pagoniams ir kt. Bylose dėl prekybos ir aiškinant sutarties sąlygas paprotys net buvo svaresnis už įstatymą, o remtis papročiu galėjo visi teismai, ne tik luominiai valstiečių teismai. Rusijos imperijos Valdančiojo senato sprendimuose paprotys apibrėžiamas kaip tokios įstatymuose nenustatytos elgesio taisyklės, kurių nuolat laikomasi atliekant tam tikrus teisiškai reikšmingus veiksmus (pvz., sudarant sutartis), ir kurios suvokiamos kaip privalomosios. Vietiniu papročiu laikoma tokia elgesio taisyklė, kuri nors ir nėra išreikšta įstatyme, bet jos nuolat laikosi tam tikros teritorijos gyventojai, pripažindami ją sau privalomąja. Papročiui taikyti reikia arba įstatymo spragos, arba įstatyme išreikšto leidimo taikyti paprotį. Teismas negali remtis papročiu, kai yra nagrinėjamai bylai tinkamas įstatymas. Įstatymo leidžiamais atvejais vietinių papročių taikymas yra toks pat privalomas teismui kaip ir įstatymų taikymas. Papročiams taikyti nėra būtinas abiejų šalių byloje sutikimas. Aiškinant sutartį pagal jos šalių ketinimus ir bona fide teismas gali vadovautis papročiais net jeigu bylininkai nesiremia papročiais. Papročio buvimą galima įrodinėti liudytojų parodymais, pareigūnų patvirtinimais (liudijimais) ir kaimo sueigų sprendimais – toks paprastas teisinio papročio buvimo fakto įrodinėjimas hipotetiškai turi skatinti šalis byloje grįsti savo poziciją papročiais, o teismą – taikyti juos. Nauji nacionaliniai įstatymai laipsniškai siaurino teisinių papročių galiojimo sritį, naikindami tas prieš karą galiojusių įstatymų normas, kurios leisdavo taikyti papročius. Itin nepalankus papročiams buvo 1921 m. gruodžio 2 d. Steigiamojo Seimo priimtas „Civilinių įstatymų pakeitimas ir papildymas“, panaikinęs, inter alia, Įstatymų sąvado X tomo 1 dalies 1184 straipsnio 5 punktą, kuris nustatinėjo ypatingą valstiečių turto paveldėjimo tvarką. Šis pakeitimas turėjo įtakos gausiausios Lietuvoje socialinės grupės narių interesams ir likvidavo vieną iš nedaugelio gyvenimo sričių, kuriose papročiai buvo svaresni už įstatymus. The aim of this study is to determine the significance of legal customs in Lithuania in 1918–1940 based on legal norms, case law, and the scientific doctrine. This article addresses the following tasks: 1) to determine in relation to which social groups and to what extent were the customs applied in accordance with the law of the Russian Empire enforced in Lithuania; 2) to disclose the significance of the constitutional provision regarding the reception of pre-war law for legal custom; 3) to disclose the attitude of the legislator to the legal custom, the limits of the application of customs established by law, and the tendencies of legislation in this regard. The decision adopted and enshrined in the Constitution in 1918 to maintain the laws in force in Lithuania before the war (as long as they do not contradict the Constitution) was very favorable in terms of legal customs. In the Russian Empire, the customary law was applied to regulate many legal relationships among the peasantry, especially in the branch of deciding upon small proprietary disputes, guardianships, and matters of inheritance. The legal custom was also a significant source of law for other social groups – merchants, pagans, etc. In trade cases and in the interpretation of contract terms, the custom was even more important than the law, and custom could be relied on by all courts, not just peasant courts. The judgments of the Russian Empire’s Senate defined a custom as such non-statutory rules of conduct that are consistently followed under certain legal actions (i.e. while concluding contracts) and are deemed to be obligatory. The local custom is understood as a legal rule, though not expressed in the law, but the inhabitants of a certain locality submit to it, finding it obligatory for them. The application of a custom requires either a loophole in the law or a permission to apply the custom expressed in the law. When a law applicable to the instant case exists, the court could not be guided by a custom. The application of a local custom, allowed by law, is obligatory in the same way for the court as the application of the law. The application of a legal custom is not conditioned by the consent of both litigating parties. Within expounding the contract upon the intention and in good faith, the court is allowed to be guided by a custom, though the litigants did not refer to it. The existence of a custom could be proved by: (a) witness testimony and (b) based on the certificates of officials and the verdicts of village meetings – the easiness of proving the existence of a legal custom could hypothetically help its application. The newly-adopted national legislation of Lithuania gradually diminished the sphere of the application of the custom, abolishing those provisions of pre-war law that allowed customs to be applied. The “Amendment and Supplementation of Civil Laws” adopted by the Constituent Seimas on December 2, 1921 was a particularly unfavorable decisions for customs. It repealed, inter alia, Item 5 of Article 1184 of Part 1, Volume X of the Restatement of Laws of the Russian Empire, which established a special procedure for the inheritance of peasants’ property. This change affected the interests of the members of the largest social group in Lithuania and eliminated one of the few branches of life where customs were more important than the law.

Konstitucijos kaip „gyvo“ dokumento samprata yra plačiai palaikoma tiek Lietuvos teisės mokslininkų, tiek ir paties Konstitucinio Teismo teisėjų. Tačiau konstitucinėje teorijoje taip pat yra gerai žinoma kita konstitucijos interpretavimo teorija, kuri teikia prioritetą „autentiškosios konstitucijos“ sampratai ir žinoma originalizmo pavadinimu. Ši teorija kol kas yra palikta išsamių mokslinių tyrimų užribiuose, nors jos teorinius argumentus jau galima matyti naudojant Lietuvos Konstitucijai aiškinti. Turint bendrąjį ketinimą kurti savas konstitucines teorijas, kurios atlieptų Europos statutinės teisės tradicijos kontekstą, šio straipsnio objektu tampa Lietuvos teisės mokslo išsamių tyrimų užribiuose palikta konstitucijos interpretavimo teorija – originalizmas, analizuojami jo pagrindiniai argumentai, kaip turėtų būti interpretuojama konstitucija. Straipsnyje pasirinktos analizuoti dvi originalizmo teorijos kryptys: „pirminių intencijų originalizmas“ ir „autentiškos akivaizdžios žodžių reikšmės originalizmas“, nes jos yra laikomos svarbiausiomis konstitucinių teorijų diskurse. Pristatomi pagrindiniai jų argumentai ir nustatomi trūkumai, išryškėję mokslinių diskusijų platformoje, atskleidžiama originalizmo teorinė raida. Tyrimas rodo, kad šiandieninis originalizmas nereiškia konstitucijos „raidės“ absoliutizmo įvedimo į konstitucinę teisę, jau sudaro galimybę suderinti originalizmą su „gyvuoju“ konstitucionalizmu ir siūlo labai aiškų požiūrį, kaip turi būti dirbama su konstitucijos tekstu. Bet tai nereiškia, kad ši teorija turi būti akontekstiškai perkeliama į kontinentinę Europos statutinės teisės dirvą. The concept of the constitution as a “living” document is a well-known and accepted approach for interpreting the Lithuanian Constitution among scholars and the Constitutional Court justices. However, constitutional theory also refers to a different theory of interpreting the Constitution, known as originalism, the proponents of which argue that the constitutional text ought to be given the original meaning. This theory has not received much attention among Lithuanian scholars, although its theoretical arguments can already be seen in the attempts to interpret the Lithuanian Constitution. Intended as a starting point for developing constitutional theories more suitable in the context of European statutory legal tradition, the object of this paper is originalism, the constitutional theory that has not received much attention in Lithuanian scholarship. This paper analyzes originalism and presents and evaluates the main arguments of this constitutional theory and its approach to interpreting the constitution, including the shortcomings of this constitutional theory. The paper analyzes two prominent members of the family of originalism theories: “original intentions originalism” and “original public meaning originalism,” investigating their main benefits and shortcomings as identified by American scholars in the American constitutional debate and presenting its theoretical evolution. The analysis shows that originalism today does not mean the absolutism of the letter of the constitutional text and that this letter determines constitutional doctrine. Moreover, this theory finds a way to reconcile originalism and “living” constitutionalism and offers a clear methodology on how to approach the constitutional text and work with it. However, the paper does not make the point that originalism should become the reality of European statutory legal tradition in full force. Iki 1989 m. pabaigos okupuotoje Lietuvoje veikusi Lietuvos TSR Aukščiausioji Taryba nebuvo laisvuose demokratiškuose rinkimuose renkamas parlamentas. Tai buvo pseudoparlamentinė struktūra, kurios sudarymą ir veikimą tiesiogiai ir visiškai kontroliavo Sovietų Sąjungos komunistų partijos valdžios teritorinis padalinys Lietuvoje. Sovietų Sąjungos okupacijos laikotarpiu vykdavę LTSR Aukščiausiosios Tarybos deputatų „rinkimai“ buvo farsas, skirtas tikrajam deputatų korpuso sudarymo būdui maskuoti, o LTSR Aukščiausiajai Tarybai – neva „suverenios Sovietų Sąjungos respublikos“ tariamam legitimumo įvaizdžiui sukurti. Tik 1990 metais pirmą kartą buvo leista surengti laisvus LTSR Aukščiausiosios Tarybos rinkimus, kuriuose Sąjūdžio remiami kandidatai buvo pagrindiniai valdančiosios komunistų partijos remiamų kandidatų politiniai konkurentai. Sąjūdžio dalyvavimas tokiuose LTSR Aukščiausiosios Tarybos rinkimuose atitiko jo politinės programos nuostatą – panaikinti 1940 m. SSRS įvykdytą Lietuvos Respublikos aneksiją parlamentiniu būdu. Lietuvos Persitvarkymo Sąjūdis 1989 m. vasario 16 d. priimtoje deklaracijoje jau buvo deklaravęs galutinį tikslą – atkurti nepriklausomą Lietuvos valstybę. 1990 m. vasario 3 d. Vilniuje Sporto rūmuose Sąjūdis surengė konferenciją „Lietuvos kelias“ ir joje priėmė programą, skirtą LTSR Aukščiausiosios Tarybos rinkimams. Sąjūdis savo deklaruotą konstitucinį tikslą – atkurti nepriklausomą Lietuvos valstybę rinkimuose gavęs tautos mandatą – įsipareigojo realizuoti, neatidėliotinai paskelbdamas Lietuvos valstybės atkūrimo aktą: „Sąjūdžio remiami kandidatai, dalyvaujantys 1990 m. vasario 24-osios dienos rinkimuose į Lietuvos TSR Aukščiausiąją Tarybą, gavę Lietuvos visuomenės mandatą įgyvendinti šią programą, sieks atkurti nepriklausomą, demokratiškai tvarkomą Lietuvos valstybę. Sąjūdis numato, jog artimiausiu metu būtina parlamentiniu būdu konstituciniu keliu panaikinti Lietuvos aneksiją ir paskelbti Lietuvos valstybės atkūrimo aktą.“ SSRS komunistų partijos padalinys Lietuvoje, 1989 m. gruodžio 20 d. paskelbęs apie savo atsiskyrimą nuo SSRS komunistų partijos kaip savarankiška Lietuvos komunistų partija, savo rinkiminėje platformoje deklaravo Sąjūdžio įsipareigojimui iš esmės alternatyvų „žingsnis po žingsnio“ politinį kelią, tenkinantį M. Gorbačiovo deklaruojamus Sovietų Sąjungos pertvarkos planus didinti SSRSS respublikų savarankiškumą – siekti „lietuvių tautos apsisprendimo teisės realizavimo“ ir nepriklausomos Lietuvos valstybės „atkūrimo tam tikrais etapais“, „derybų keliu, sutarčių pagrindu“ siekiant lygiateisio bendradarbiavimo su SSRS „Centru“ ir respublikomis. Savo pagrindinio tikslo – atkurti okupuotos Lietuvos valstybės nepriklausomybę – Lietuvos Sąjūdis nutarė siekti pasinaudodamas pakeista LTSR konstitucija ir rinkimų į LTSR Aukščiausiąją Tarybą įstatymu, taip pat panaudodamas tuo metu veikiančias sovietines valdžios struktūras ir jų veiklos reglamentavimą. Todėl 1990 m. vasario 24 d. formalus rinktos LTSR Aukščiausiosios Tarybos pavadinimas buvo toks pat kaip ir ankstesnių sovietinių Aukščiausiųjų Tarybų. Tačiau ji savo esme nuo jų visiškai skyrėsi, nes pirmą kartą po 1940 m. įvykdytos Lietuvos sovietinės okupacijos ji buvo renkama laisvų ir demokratinių rinkimų būdu. 1990 m. vasario 24 d. rinkimų į LTSR AT pirmajame ture iš 90 jau išrinktų deputatų buvo išrinkti 72 deputatai, įsipareigoję su Lietuvos Sąjūdžiu atstatyti Lietuvos valstybės nepriklausomybę. Antai, visose šešiolikoje Kauno miesto rinkiminių apygardų sąjūdininkai laimėjo rinkimus pirmajame ture. Provincijos apygardose rinkimus laimėjo septyni kandidatavę Sąjūdžio Kauno tarybos nariai. Pirmajame rinkimų ture buvo išrinkti tik 14 deputatų, kurie rinkimuose dalyvavo su alternatyvia politine LKP platforma „suvereniteto žingsnis po žingsnio“.Visose apygardose, kuriose pirmajame ture deputatai nebuvo išrinkti, antrasis balsavimo turas buvo numatytas kovo 10 d. Jau po pirmojo rinkimų turo tapo aišku, kad naujai išrinktoje 141 vietų Aukščiausioje Taryboje Sąjūdis turės absoliučią deputatų daugumą ir rinkėjų patvirtintą mandatą nepriklausomos Lietuvos valstybės atstatymo aktams priimti. Pirmajame ture su Sąjūdžio platforma išrinkti deputatai jau vasario 28 d. susirinko į pirmąjį pasitarimą dėl išrinktos Aukščiausiosios Tarybos pirmosios sesijos parengimo. [...] On 24 February 1990, for the first time since the occupation of Lithuania by the Soviet Union in 1940, free elections were held to the puppet Supreme Council of the Lithuanian Soviet Socialist Republic. The Lithuanian Sąjūdis (the National Freedom Movement) in its official election program pledged on behalf of the new Lithuanian Supreme Council to declare without delay the restoration of an independent, democratic state of Lithuania. This was in accordance with the Lithuanian Sąjūdis striving to abolish the Soviet annexation of Lithuania by parliamentary resolution. After the first round of the 24 February 1990 elections, it already became clear that Lithuanian Sąjūdis candidates would win the election by a large margin. After the second round of elections, on 10 March, the Lithuanian Sąjūdis anticipated a majority of around two thirds in the national parliament of 141 deputies, and obtained a strong majority mandate from the nation to restore the independent state of Lithuania. On 1 March 1990, those Sąjūdis deputies that had been elected in the first round of elections formed their ad hoc working groups, and started the process of drafting legal acts regarding the regulation of the structure and legislative process of the first democratic Lithuanian parliament, as well as of fundamental legal acts for the restoration of the independent state of Lithuania. Working groups had to complete this drafting process before the first session of the new Lithuanian Supreme Council, which was scheduled to start on 10 March. The main working group, then often called the principal Commission, was led by Sąjūdis leader V. Landsbergis. The Commission assumed responsibility for the creation of the basic legal acts regarding the restoration of the independent state of Lithuania. The Commission consisted of 8 deputies from Sąjūdis and one non-deputy lawyer. The author of this article, one of the members of the Commission, when analysing the archival sources of the Commission’s work, reconstructed in detail the drafting process of the Act on the Restoration of the Independent State of Lithuania and four other legal acts logically interconnected with the Act. On 2 and 4 March, the Commission, chaired by V. Landsbergis, started its meetings with a discussion on the mechanism of the restoration of the Lithuanian state – i.e., the structure of the necessary legal acts, the sequence of their adoption, and the principal provisions. On 6 March, the Commission preliminarily agreed that four documents should be prepared and adopted, namely: (i) the Declaration of the Supreme Council of Lithuania on authorisation of its deputies; (ii) the Declaration on the Continuity of the State of Lithuania; (iii) the Declaration on the renewal of the validity of the Lithuanian Constitution of 1938; and (iv) the Act on the Suspension of the 1938 Constitution and the approval of the Provisional Constitution. This article reveals the process of elaborating and improving the legislative language of the abovementioned documents during the Commission’s intensive meetings which took place on 6–9 March. During this time, the provisions of the abovementioned documents were rectified, and the titles of the documents were clarified to better reflect their essences and main principles. The Commission produced a final package of draft legal acts for the restoration of the Lithuanian state on 9 March. This package consisted of the following: 1. Declaration on the authorisation of the deputies of the Lithuanian Supreme Council. 2. Law on the Name and State Emblem of the Lithuanian State. 3. Act on the Restoration of the Independent State of Lithuania. 4. Law on the temporary restoration of the validity of the Constitution of Lithuania of 12 May 1938. 5. Law on the approval of the Temporary Fundamental Law of the Republic of Lithuania. The legal acts named above, in restoring the independent state of Lithuania on 11 March, entrenched the main principle of State continuity. This principle was directly embedded in the Act of the Supreme Council of the Republic of Lithuania on the Restoration of the Independent State of Lithuania, declared on 11 March 1990 (“The Act”). The Act proclaimed that: “The Act of Independence, established on 16 February 1918, as well as the Resolution of the Constituent Parliament on the restored democratic state of Lithuania, established on 15 May 1920, has never ceased to have legal force and continues to serve as the constitutional basis for the Lithuanian state”. The application of this principle was also reflected in the Law of the Republic of Lithuania on the Name and the State Emblem of the restored State. The provision regarding the continuity of the State of Lithuania was also consistently endorsed by the Law on the Restoration of the Validity of the Constitution of Lithuania of 12 May 1938, which was adopted following the enactment of The Act. The Temporary Fundamental Law of the Republic of Lithuania suspended the short symbolic validity of the Constitution of the Republic of Lithuania of 12 May 1938, and substituted it as the Temporary Constitution for this transitional stage. In legal terms, the Temporary Fundamental Law restored the continuity of Lithuanian constitutionalism that was interrupted by the Soviet occupation. It prompted new Constitutional development without any connection to the surrogate Soviet constitution that was forcibly imposed on Lithuania in 1940.

Straipsnyje nagrinėjama Lietuvos narystės Tautų Sąjungoje reikšmė mūsų šalies valstybingumui įtvirtinti. Remiantis istoriniais šaltiniais ir moksline literatūra analizuojamas tarpukario Lietuvos santykis su gimstančia tarptautine teise grįsta pasaulio tvarka, priežastys, nulėmusios jaunos valstybės ištikimybę teisės viršenybei tarptautiniuose santykiuose. Analizuoti dokumentai ir juose atspindėtos istorinės aplinkybės pagrindžia, kad būtent narystė Tautų Sąjungoje įtvirtino Lietuvos valstybingumą. Po Pirmojo pasaulinio karo kurta nauja tarptautinių institucijų sistema turėjo užtikrinti visuotinę taiką ir saugumą, o pagrindinis vaidmuo siekiant šio tikslo buvo numatytas detaliai reglamentuotam taikaus tarptautinių ginčų sprendimo mechanizmui. Tautų Sąjunga turėjo ne tik užkirsti kelią kilti karui ateityje ir sudaryti sąlygas taikiai spręsti konfliktus, bet ir iš tiesų būti naujos progresyvios tarptautinės sistemos, sukurtos ant karo pamatų, pagrindu. Lietuvos narystė Tautų Sąjungoje buvo grindžiama suvoktais daugiašalės tarptautinės sistemos pranašumais, teisės viršenybės nauda mažoms regiono valstybėms. To meto pareiškimai ir politikų atsiminimai patvirtina, kad visuotinai pripažįstamomis taisyklėmis pagrįstos tarptautinės tvarkos idėja viliojo Lietuvos elitą. Be to, tarptautinio teisingumo, valstybių lygiateisiškumo ir jėgos nenaudojimo principai, kuriais buvo grindžiamas Tautų Sąjungos projektas, buvo neatskiriami nuo Lietuvos nepriklausomybę įtvirtinusios tautų apsisprendimo teorijos. Be teritorinio vientisumo įtvirtinimo, narystė Tautų Sąjungoje turėjo suteikti ir tarptautinį pripažinimą de jure, būtiną valstybingumo požymį. Sunku paneigti, kad Lietuva ieškojo savito kelio saugumui užtikrinti balansuodama tarp didžiųjų valstybių interesų ir tarp savo kaimynių. Tačiau akivaizdu, kad daugiašališkumo ir tarptautinės teisės viršenybės teikiamos saugumo garantijos buvo keliamos aukščiau dvišalių santykių. Iš istorinių dokumentų daroma išvada, kad Vilniaus okupacijos, Klaipėdos krašto klausimo sprendimas vadovaujantis tarptautine teise tuo metu Lietuvai buvo vienintelis priimtinas pasirinkimas. Lietuvos Vyriausybės diplomatinis susirašinėjimas patvirtina, kad privalomas teismo sprendimas, priimtas vadovaujantis tarptautinės teisės normomis, buvo vienintelė viltis išspręsti aštrėjančius teritorinius konfliktus ir užkirsti kelią naudoti jėgą valstybių tarpusavio santykiuose. This article examines the significance of Lithuania’s membership in the League of Nations for the consolidation of its statehood. Based on historical sources and scientific literature, the paper analyses the relationship of interwar Lithuania with the emerging new world order based on international law, and the reasons that determined the young state’s allegiance to the rule of law in international relations. The documents and the historical circumstances underline the role of membership in the League of Nations in establishing Lithuania’s statehood. The new system of international institutions created after the First World War was intended to ensure global peace and security, and the detailed mechanism for the peaceful settlement of international disputes had an important role in achieving this goal. Lithuania’s membership in the League of Nations was based on the perceived advantages of a multilateral international system and the benefits of the rule of law for small states in the region. As confirmed by statements and memoirs of politicians of the time, the idea of an international order based on universally accepted rules was attractive to the Lithuanian elite. Moreover, the principles of international justice, the equality of states, and the non-use of force, on which the project of the League of Nations was based, were inseparable from the theory of self-determination of peoples, which underpinned the independence of Lithuania. In addition to the consolidation of territorial integrity, membership in the League of Nations was thought to bring de jure international recognition, an indispensable attribute of statehood. It is hard to deny that Lithuania sought its own distinctive way to balance the interests of the great powers with those of its neighbours. However, the security guarantees offered by multilateralism and the primacy of international law were placed above bilateral relations. Historical documents show that the occupation of Vilnius and the resolution of the Klaipėda issue in accordance with international law was the only acceptable option for Lithuania. The diplomatic correspondence of the Lithuanian Government confirms that a binding court decision, made in accordance with the norms of international law, was seen as the only hope to resolve the escalating territorial conflicts and to prevent the use of force in relations between states.

Kamilio Frejlicho monografija parengta pagal 2017 m. Varšuvos universitete apgintą daktaro disertaciją. Tyrimo objektas – Vilniaus pilininko jurisdika XVII a. The article examines legislation of the early modern period, namely Lithuanian Statutes of the Grand Duchy of Lithuania through the prism of gender analysis. The term “gender” is used not in the biological sense but as a system of interpersonal interactions, that is as a social construct which makes the basis for the stratification of society by gender. Gender is considered one of the three (along with race and class) most important elements which form synergetic systems of domination and subordination. Therefore, legislation of the 16th–17th centuries is considered in relation to equality of rights and possibilities for different sexes. Given the fact that the problem of relationships between a man and a woman lies in the plane of gender history, it should be studied by using gender history methods. The first (1529) and the second (1566) editions of the Lithuanian Statute are the subject matter of gender examination in this article. The third edition (1588) is not considered since Ukrainian lands became part of the Commonwealth as a result of the Union of Lublin (1569). Hence, the Statute of 1588 did not apply to those territories, whilst the Statute of 1566 continued to be in force there. The article analyses regulations of those parts of the Statute which formed foundations of social institutions and first of all that of the family and therefore directly affected gender relations. Having analysed legal regulations of the Lithuanian Statute, the author argues that legislation of the early modern period was based on gender norms and gender identities, ensured preferential attitude towards men and denied equal rights and opportunities for women. Thus, already at the legislative level regulations of the Lithuanian Statute laid conditions for gender asymmetry. That resulted in discrimination against women and dominance of men.

Nacionalinę teismų instancinę sistemą projektuoti pradėta netrukus po Kovo 11-osios. Tačiau gajus sovietmečio paveldas, atgimimo inspiruotas impulsas gręžtis į Pirmosios Respublikos palikimą ir intensyvi nepriklausomybės atkūrimo pradžios įvykių dinamika formavo unikalias šio proceso aplinkybes. Įvertinus istorinį kontekstą, galima konstatuoti, jog 1990–1992 m. laikotarpis tapo lemtingu formuojant beveik tris dešimtmečius gyvuojančią nacionalinę teismų sistemą. Šiame tyrime keliamas tikslas atskleisti ne tik nacionalinės teismų instancinės sistemos pradmenis, okupacinio periodo tranziciją ir teisės normų raidą, tačiau taip pat įvertinti to laiko įvykius, vyravusius naratyvus ir argumentus, tapusius lemtingais priimant sprendimus dėl teismų instancinės sistemos. The formation of the national court instance system began shortly after March 11, 1990. However, recent Soviet heritage, the impulse to turn to the legacy of the First Republic, and the intense dynamics of the events at the beginning of the restoration of independence formed the unique circumstances of this process. The object of this research – the court instance system (instance de recours) – can be defined as a structure of the organization of courts, formed for two purposes: the implementation of justice in a specific case; and the development of a harmonious legal system. The fundamental purpose of the instance system is control over court decisions, which creates conditions for verifying a lower court’s decision, judgment, or ruling in a higher instance. In the pre-occupation period, the work of general jurisdictional courts was based on prescriptive procedural legislation, and before the loss of independence, the first republic had a three-instance, four-tiered court system formed by the judicial reform implemented in 1933. On June 15, 1940, the evolution of the legal system of the First Republic of Lithuania was interrupted by an act of external aggression. The purpose and place of the court in the system of government changed, and the Soviet model of the organization of courts of first instance and cassation instance came into force. The half-century-long Soviet occupation kept both the model of the judicial system and the totality of its operating principles essentially unchanged. Throughout this period, the suppression, opposition, and annihilation of historical memory resulted in the heritage or principles of the Western European tradition becoming largely unknown in the judicial system. On the day of restoration of independence, Lithuania decided to accept Soviet-era law until the relevant laws were adopted. It was understood that would not be possible to quickly create a qualitatively new model of the legal system. After the restoration of independence, it was recognized that changes in the instance system must be in line with the traditions of democratic European states. On January 30, 1991, a working group was formally set up to prepare the Law on the Judiciary and the Status of Judges. Informally, however, work on this issue between researchers and practitioners had begun much earlier. It was decided to choose the 1933 judicial organization as the starting point for the reform of the judicial system. On February 6, 1992, the new Law on Courts was adopted. The new court instance system repeated Lithuania’s interwar experience. In the new model, first instance cases are divided between two courts, and the appellate instance is also concentrated in two appellate courts. The Supreme Court of Lithuania is provided as an exclusive cassation instance. The period from 1990–1992 was only the first step in Lithuania’s implementation of the new court instance system.

Straipsnyje analizuojama priesaika kaip juridinės kultūros elementas Žemaitijos žemės ir pilies teismuose XVII a. pirmajame dešimtmetyje. Tyrime naudojamasi keliasdešimt rankraštinių Žemaitijos žemės teismo bylų knygų ir vienintelės išlikusios to laikotarpio Žemaitijos pilies teismo knygos medžiaga. Priesaika nagrinėjama kaip LDK teisenos elementas, parodantis žemaičių bajorijos juridinės kultūros lygmenį. The work is focused on the use of the oath in Samogitian land and castle court books at the beginning of seventeenth century. The oath was administered quite often and it was the fastest way to resolve one instance of litigation or another. According to the submitted examples of seventeenth-century court books, oaths were incriminating or exculpatory. Incriminating oaths (those of the plaintiff party) were more frequent. Administering an oath did not necessarily mean it would be fulfilled as they often ended in a reconciliation or postponement. Reconciliation under oath did not always mean that the defendant would be exempt from financial sanctions, which courts often imposed even after a formal conciliation. Partial oaths were also practiced: the oath would be divided into several segments and a person would swear to one segment of a charge and not to another. The postponement or withholding of oaths resulted not only from formal reasons but also from the desire not to err in hasty administration of justice. The purpose of the article is to shed light on the main areas of social and economic life influenced by the functioning of bridges and dikes in the period from the latter half of the fifteenth century to the end of the sixteenth century. The choice of this period was imposed by some significant changes in Lithuanian legislation and administration, resulting in an increased number of charters granted to feudal lords. The exemplifications, primarily based on entries to the Lithuanian Metrica, reflect the everyday use of bridges and dikes as a means to facilitate communication, generating revenue in the form of tolls, or serving as landmarks, being a source of disputes, or an element of pond management.

Atlikta analizė leidžia manyti, kad XVII a. antros pusės pilies teismo dokumentų rengimo ir registravimo sistema bei darbo procedūros buvo gana griežtai reglamentuotos. LDK egzistavo tam tikri teisinių dokumentų žanrai, formavęsi nuo XVI a. pabaigos iki XVII a. vidurio. Iš tiriamų aktų pavyko išskirti daugiau kaip 30 dokumentų rūšių. Paminklo kalbiniai bruožai yra tiesiogiai susiję su ypatingos kultūrinės LDK situacijos, grindžiamos valstybės daugiaetniškumu, evoliucija. XVII a. viduryje teisinėje kanceliarijoje buvo vartojamos dvi kalbos - lenkų ir rusėnų. Lenkų kalba aiškiai lenkė rusėnų pagal vartojimo dažnį. Analizė rodo, kad apie 56 proc. nagrinėjamų aktų sudaryti tik lenkų kalba, apie 8 proc. - rusėnų kalba, apie 36 proc. - abiem kalbomis. Pasakytina, kad kalbos pasirinkimą kiekvienu atveju lėmė ir dokumento rūšis, ir kliento kalbiniai polinkiai bei išmanymas. The paper deals with the local court records of the Grand Duchy of Lithuania (GDL) from the collection of Vilnius University. The study of Trakai Castle Court documentation of 1660-1661 (F7-TPT, 1660-1661) allows us to conclude that the chancery work in local courts in the GDL was highly developed at the time. The system of documents' drawing up and registering was clearly regulated and structured, taking into account the needs of state and public life. Almost all types of court records were composed according to well-defined canons, owing to which we can speak about certain genres of legal documentation that had developed apparently by the end of the 16th and the middle of the 17th centuries. The manuscript written in Polish and Ruthenian languages is important for research of Lithuanian, Polish and Byelorussian history. The abundance of accumulated information enables us to consider it as unique reference book that reflects changing sociolinguistic situation of the GDL. From the middle of the 17th century, Polish starts to significantly dominate in legal documentation, thus forces Ruthenian out of court by the end of the century.

Šio tyrimo tikslas yra nustatyti 1791 m. gegužės 3 d. Konstitucijos taisymo leistinumą, poreikį ir perspektyvą hipotetiškai suėjus pirmajam 25 metų jos galiojimo terminui, t. y. 1816 metais. Autorius siekia identifikuoti kintamąją Konstitucijos dalį, t. y. tuos ją sudarančius aktus ir tas jų nuostatas, kurias buvo leista keisti po 25 metų; nustatyti taisytinas Konstitucijos nuostatas, t. y. iš paties Konstitucijos teksto analizės padaryti išvadą dėl „probleminių“ nuostatų, kurias reikėtų taisyti atsižvelgiant į konstitucinį reglamentavimą, Konstitucijos dvasią, jos vidinę logiką. Autorius daro išvadą, kad nekintamajai 1791 m. Respublikos Konstitucijos daliai priklauso (visa apimtimi) Pamatinai neliečiami įstatymai, Abiejų Tautų tarpusavio įsipareigojimas ir Suderintos sutartys – jų korekcija neįmanoma nei po 25 metų, nei vėliau. Kintamajai Konstitucijai daliai priklauso (iš dalies) Valdymo įstatymas, Seimo deklaracija, Seimelių įstatymas ir Miestų įstatymas, kurių nuostatas leidžiama taisyti kas 25 metus; dalis šių aktų nuostatų yra perkelta į juos iš nekintamosios Konstitucijos dalies arba sukurta remiantis nekintamosios dalies nuostatomis, todėl priskirtina nekintamajai daliai, negali būti taisoma nei po 25 metų, nei vėliau. Nekintamoji 1791 m. Konstitucijos dalis eliminavo iš galimo Konstitucijos tobulinimo srities sąjunginius tarpvalstybinius Lietuvos ir Lenkijos santykius ir paliko nedaug galimybių esminiams pokyčiams tame Konstitucijos segmente, kuris paklojo valstybės funkcionavimo pamatus. Tačiau tokių esminių taisymų poreikio nebuvo, nes Konstitucijoje įtvirtinti modernieji demokratinės valstybės principai suteikė Konstitucijai labai didelį egzistencinį potencialą, viršijantį 25 metų perspektyvą. Pagrindinis Konstitucijos trūkumas – įtvirtinta teisine nelygybe grindžiama visuomenė, suskaidyta į bajorų, dvasininkų, miestiečių ir valstiečių luomus. Kadangi šios nuostatos yra nekintamos, neįmanoma evoliuciniu būdu, laipsniškai taisant Konstituciją, pereiti prie pilietinės visuomenės. The purpose of this study is to determine the permissibility, necessity and perspective of the amendment of the Constitution of 3 May 1791 after the hypothetical expiry of the first 25 years of its validity, in 1816. The author seeks to identify the alterable part of the Constitution, i.e. those constituent acts and those provisions which have been authorized for amendment after 25 years; to establish the provisions of the Constitution to be amended, i.e. to draw a conclusion from the analysis of the text of the Constitution itself regarding the “problematic” provisions, the correction of which arises from the constitutional regulation itself, the spirit of the Constitution itself, its internal logic. The author concludes that the inviolable part of the Constitution includes (in its entirety) the Fundamental Unalterable Laws, the Reciprocal Guarantee of Two Nations and the Articles of Agreement – their correction is not possible after 25 years or later. The alterable part of the Constitution includes (in part) the Government Act, the Declaration of the Convention (Seimas), the Law on Local Conventions and the Law on Cities, the provisions of which may be amended every 25 years; part of the provisions of these acts have been transferred to them from the unalterable part of the Constitution or have been created on the basis of the provisions of the unalterable part, therefore attributable to the unalterable part, may not be amended after 25 years or later. The unalterable part of the Constitution eliminated the cross-border relations between Lithuania and Poland from the field of possible improvement of the Constitution and left few opportunities for fundamental changes in the segment of the Constitution that laid the foundations for the functioning of the state. However, there was no need for such substantial amendments, as the modern principles of a democratic state enshrined in the Constitution gave the Constitution a very high existential potential beyond a 25-year perspective. The main shortcoming of the Constitution is the establishment of a society based on legal inequality, divided into nobles, clergy, townspeople and peasants. As these provisions are unalterable, it is not possible to move to civil society in an evolutionary way, with a gradual revision of the Constitution.

Remiantis XVII a. pradžios Žemaičių žemės ir pilies teismų knygų medžiaga, straipsnyje analizuojama, kaip sprendžiant bylas iš esmės naudotasi pateiktų raštiškų įrodymų patikra, liudininkų parodymais ar bylos aplinkybių tyrimu incidentų vietose. Raštiškų įrodymų tyrime svarbiausia buvo jų patikimumas. Daugiausia dėmesio skirta dokumento autentiškumui ir liudininkų patikimumui. Summary Based on the manuscripts of the early-seventeenth-century books of Samogitian land and castle courts, the article shows that the examination of the cases was based on the verification of the submitted written evidence, testimonies of witnesses, or investigation of the circumstances of cases at the scenes of incidents. Reliability was the most important aspect in the study of written evidence. The main focus was placed on proving the authenticity of the document. A slightest suspicion that the document had been corrected or supplemented immediately provoked protests from the opponents. The origin of the witnesses and their property status were the main reliability criteria. In courts, testimonies given by local nobility were considered more valuable than the testimonies of peasants, and testimonies of non-native nobles (mostly arrivals from Poland) or even their origin were often questioned. Scrutiny, or the examination of the circumstances of the case at the scene of the incident, was not frequent, although this action was sometimes performed without including the term ‘scrutiny’ as such in court books.

The purpose of this article was to make a brief comparative analysis between the Spanish Constitution of 1812 and the Polish-Lithuanian Constitution of 1791. With this intention, the most characteristic features of each constitutional text were set out, and both the historical and social context prior to its promulgation and the circumstances that led to the drafting of both legal acts were analyzed. The similarities and contrasts of the political models established with both constitutions were observed, as well as the rights and freedoms recognized. Reference was also made to the founding fathers of the Constitutions and the ideological context that influenced them. Finally, the author mentioned the fate of both constitutions that were only in force for a short period of time. The article aimed to present these two legal acts that were a milestone in the constitutional and political history of each nation.

Ne viename traktate pažymėta, kad dabartinės Lietuvos teritorijoje lietuviškos rašytinės teisės tradicijos nebuvo iki pat 1918 m. Tačiau ir tarpukariu teisinės lietuvių kalbos vartojimas viešajame, valstybiniame, oficialiame gyvenime buvo problemiškas. Tai buvo sąlygota kelių dalykų. Pirmiausia tarpukario Lietuvoje galiojo keturios civilinės teisės sistemos – carinės Rusijos, Vokietijos imperijos, Suvalkijos (Napoleono kodeksas) ir Palangos valsčiaus (Vietos gubernijų įstatymų rinkinys) civiliniai įstatymai – ir dvi baudžiamosios teisės sistemos – Rusijos ir Vokietijos. Per visą nepriklausomybės laikotarpį taip ir nebuvo priimti nacionaliniai baudžiamasis, civilinis kodeksai, o buvo naudojamasi neoficialiais carinės Rusijos kodeksų vertimais į lietuvių kalbą. Antra, lietuvių kalba kalbančių ir rašančių teisininkų buvo vos kelios dešimtys, tačiau dauguma jų teisės mokslus studijavo carinės Rusijos, Vokietijos aukštosiose mokyklose ne lietuvių kalba. Taigi 1918 m. vasario 16 d. paskelbus Lietuvos valstybės nepriklausomybę, teisininkams vienu metu reikėjo rengti teisės aktus, formuoti lietuvių teisės terminiją, teisės doktriną, nagrinėti ginčus, ugdyti naują teisininkų kartą. It has been noticed in several treatises that the current legal traditions in the territory of Lithuania did not exist until 1918. However, even in the interwar period, the use of the legal Lithuanian language in public, state and official life was problematic. This was due to several aspects. First, in interwar Lithuania, four civil law systems were in force – the civil laws of Tsarist Russia, the German Empire, Suwalki (Napoleon‘s Code) and Palanga Parish (Local Governments Code), and two criminal law systems – Russia and Germany. During the whole period of independence, no national criminal and civil codes were adopted, and unofficial translations of the codes of Tsarist Russia into Lithuanian were used. Secondly, there were only a few dozen lawyers who wrote and spoke in Lithuanian. Also, most of them studied law in non-Lithuanian higher education institutions in Tsarist Russia and Germany. Thus, after the proclamation of the independence of the Lithuanian state, lawyers had to prepare legal acts, form Lithuanian legal terminology, examine disputes, and educate a new generation of lawyers.

Straipsnyje analizuojama baudžiamosios atsakomybės už autorystės pasisavinimą raida Lietuvoje carinės Rusijos teisės aktų taikymo laikotarpiu nuo XIX a. trečiojo dešimtmečio iki Lietuvos nepriklausomybės atgavimo XX a. pradžioje, skirstant dėstymą į tris struktūrines dalis: 1) pirmuosius baudžiamuosius įstatymus, įtvirtinančius baudžiamąją atsakomybę už autorystės pasisavinimą, 2) autorystės pasisavinimą 1845 m. Kriminalinių ir taisomųjų bausmių statute ir 3) autorystės pasisavinimą 1903 m. Rusijos baudžiamajame statute. Straipsnyje ieškoma seniausios autorystės pasisavinimo baudžiamosios normos ir padaroma išvada, kad pirmasis baudžiamąją atsakomybę už autorystės pasisavinimą įtvirtinęs teisės aktas, galiojęs ir Lietuvoje, yra 1830 m. Rusijos imperijos Cenzūros statuto priedas „Nuostatai apie kūrėjų, vertėjų ir leidėjų teises“ (rus. Polozhenije o pravah sochinitelej, perevodchikov i izdatelej), kurio 24 straipsnyje įtvirtintas autorystės pasisavinimas, už kurio padarymą numatyta sankcija savo represiniu pobūdžiu atitinka baudžiamosios atsakomybės turinį. Straipsnio prieduose taip pat nuosekliai pagal teisės akto galiojimo datą pateikiamos ir autorystės pasisavinimo normų citatos originalo (XIX a. rusų) kalba ir jų vertimas į lietuvių kalbą bei grafikas, vaizduojantis skirtinguose teisės aktuose įtvirtintas autorystės pasisavinimo normas ir jų koreliaciją, tekste palyginant skirtingu metu galiojusių normų turinį; padaroma išvada, kad, priėmus Kriminalinių ir taisomųjų bausmių statutą, kurį laiką galiojo du tarpusavyje nesuderinti teisės aktai, numatę skirtingo pobūdžio baudžiamąją atsakomybę už autorystės pasisavinimą. Geriausiai ištobulinta autorystės pasisavinimo norma pripažintas 1903 m. Baudžiamojo statuto su 1911 m. pakeitimais 620 straipsnis, kuris Lietuvoje buvo taikomas ne tik nuo jo priėmimo, bet ir visą tarpukario laikotarpį; o pačioje Rusijoje norma su visu gana moderniu 1903 m. Baudžiamuoju statutu buvo panaikinta po 1917 m. Spalio perversmo, tokiu būdu Rusijoje pradedant intensyvius autorių teisių apsaugos regreso procesus, galiausiai pasiekusius Lietuvą sovietų okupacijos metais XX a. 5 dešimtmetyje. This article analyzes the development of criminal liability for misappropriation of authorship in Lithuania in the period of application of the legal acts of Tsarist Russia from the 3rd decade of 19th century until the restoration of Lithuania‘s independence in the beginning of 20th century. The analysis is divided into three structural parts: 1) the first criminal laws establishing criminal liability for the misappropriation of authorship, 2) misappropriation of authorship in the 1845 the Code of Criminal and Correctional Penalties, and 3) misappropriation of authorship in 1903 Penal Code of Russian Empire. The author of the article searches for the oldest criminal norm for the misappropriation of authorship and concludes that the first legal act establishing criminal liability for misappropriation of authorship, was the 1830 Annex to the Statute of Censorship of the Russian Empire „Regulations on the Rights of Creators, Translators and Publishers“ (Russian: Polozhenije o pravah sochinitelej, perevodchikov i izdatelej), Article 24 of which provides for the misappropriation of authorship, the execution of which is punishable by a sanction that is of a criminal legal nature. The appendices of the article also consistently present the citation of the norms of misappropriation of authorship in the original (19th century Russian) language and its translation into Lithuanian, as well as a graph, depicting norms of misappropriation of authorship, established in different legal acts, their correlation at different times and the content of the norms in force with each other; it is concluded that after the adoption of the the Code of Criminal and Correctional Penalties, two non-harmonized legal acts have been in force for some time, providing for different types of criminal liability for misappropriation of authorship. The best perfected norm of misappropriation of authorship was recognized in 1903 Penal Code of Russian Empire, as amended in 1911, Article 620, which has been applied in Lithuania not only since its adoption, but also throughout the interwar period. Meanwhile in Russia itself the norm with all the fairly modern 1903 Criminal Statute was repealed after the Russia‘s Bolshevic coup d‘état in 1917, thus starting intensive regression of copyright protection in Russia, which finally reached Lithuania during the years of Soviet occupation in the 5th decade of XX century.

Pateikta keliasdešimt pavyzdžių iš pilies ir žemės teismų knygų. Aptarti teismo sprendimų priėmimo būdai stengiantis pagreitinti teisingumo vykdymo procedūrą, kurią vilkindavo begaliniai ginčai, apeliacijos ar bylų nukėlinėjimas. The article examines several types of legal dispute resolutions in Samogitian castle and land courts in the first decade of the seventeenth century. These are non-appearance decisions and reconciliations between litigants. Dozens of examples from castle and land courts are provided. The ways of arriving at the court decisions discussed were measures aimed at accelerating the administration of justice, which was not quick enough due to endless disputes, appeals, or postponement of cases in the courts of Samogitia. Reconciliation was often achieved on the eve of oaths in court. At the same time, efforts were made to reduce the enormous workload of the courts in the region.

Europoje administracinės teisės šaka intensyviau ėmė rutuliotis XIX a. antroje pusėje. Daugelis Europos valstybių steigė administracinius teismus, kūrė administracinių procedūrų kodeksus. Tarpukario Lietuvoje nebuvo įsteigtas nei administracinis teismas, nei priimtos administracinių procedūrų taisyklės ar Valstybės tarnybos įstatymas, Vyriausybės darbo reglamentas ir kiti svarbūs administracinės teisės aktai. Taip atsitiko ne tik todėl, kad ką tik atsikūrusi valstybė susidūrė su ekonominiais, užsienio politikos sunkumais, bet ir dėl to, kad nebuvo administracinės teisės specialistų. Teisių fakulteto personalas suvokė, kad reikalingas administracinės teisės specialistas, kuriam būtina buvo gilinti administracinės teisės žinias užsienio valstybių, kuriose administracinės teisės formavimasis jau buvo pažengęs, universitetuose. Šiame straipsnyje analizuojamos administracinės teisės studijos tarpukario Lietuvoje, mokslinės stažuotės to meto aukštojo mokslo įstaigose bei vertinami jų rezultatai. Toks tyrimas padeda suvokti ne tik Lietuvos administracinės teisės ištakas, bet ir tai, kaip administracinės teisės doktrinos plėtojosi kitose valstybėse. European administrative law began to develop intensively in the second half of the 19th century. Many countries established administrative courts and adopted codes of administrative procedure. In interwar Lithuania, administrative courts, rules of administrative procedures, civil service law, Government Regulations and other important administrative legal acts were not established or adopted. This happened not only because the state that faced economic, foreign policy complaints but also because there were no administrative law specialists. The staff of the Faculty of Law realized that Lithuanian specialists of administrative law needed to deepen their knowledge at universities in foreign countries where the formation of administrative law had been already advanced. This article analyzes administrative law studies in interwar Lithuania, scientific internships in higher education institutions of that time and evaluates their results. Such research helps to understand not only the origins of Lithuanian administrative law, but also how the doctrines of administrative law have developed in other countries.

Etnografinio principo sąvoka, aptinkama politinėje ir mokslinėje literatūroje, regis, neturi aiškios visuotinai priimtos to principo juridinės kvalifikacijos. Bet istoristinis požiūris į procesus rytinėje Europos dalyje XIX a. antroje pusėje–XX a. pirmoje pusėje leistų teigti, kad etnografinis principas – tai esminė Vidurio Rytų Europos regiono formavimosi ypatybė. Straipsnyje atlikta lietuvių, čekų, bulgarų ir lenkų tautų – kaip atvejų, sudarančių prielaidą regiono tipologizacijai, – raidos apžvalga liudytų, kad etnografinis principas orientavo į šio regiono tautinės valstybės teritorijos nustatymą, siekiant tai valstybei sudaryti sąlygas saugiai bei efektyviai egzistuoti. Kartu straipsnyje pasirinktas tyrimo rakursas leidžia naujai pažvelgti į minimo regiono valstybių probleminę raidą Vakarų ir Rusijos priešpriešos kontekste. Straipsnyje konstatuojama, kad etnografinis principas neįgijo juridinio principo statuso, bet jis gali būti naudingas kaip istorinė kategorija tyrinėjant naujųjų laikų istoriją ir ypač sovietmetį. The concept of the ethnographic principle is rarely found in the literature, and there is hardly a legal qualification for it. However, historical material (in cases of the Lithuanian, Czech, Bulgarian and Polish peoples) indicates that the ethnographic principle is a significant political and geopolitical phenomenon. This phenomen is especialy characteristic of the development of the peoples of the region of Central and Eastern Europe. First, the ethnographic principle was closely related to the national principle, although it did not coincide with it. The concept of the ethnographic principle points to the special anatomy of nation states, where the basis is ethnic / linguistic culture. Secondly, the advancement of culture to the fore indicated the recognition of its significance, which had not happened before. Consequently, it was a question of freeing this culture from the restrictions imposed on it and even compensating for the damage caused to it. Thirdly, the culture, raised to the state level, needed appropriate guarantees for the future. The article reveals the tendency of great states at the level of their policies and propaganda to act according to the ethnographic principle, thereby encouraging the formation of national states. However, when the latter became a fact, another tendency arose: the Western world began to apply the criteria of a liberal civil society to new states (according to the principle of jus civis romanus sum). This was too hard for the new states. In this context, the alternative was the Soviet ethno-federalist protectorate, which, although under the conditions of a repressive system, actually continued to implement the projections of the ethnographic principle. A fixed paradox: the ethnographic principle, which originated in the West as a variant of democratization, gained strength thanks to Russia, while the West remained, as it were, in aristocratic opposition to this course. The ethnographic principle has not yet acquired a clearer legal legitimacy. But as a historical category, it can serve as a study of the history of Modern times, and especially the Soviet period.

Although the theoretical assumptions of the concept of the rule of law have been developed in the continental tradition only in the 19th century, its systemic elements have their roots deep in history. In this contribution, the author analyses selected examples from the field of legislation and legal culture of the Great Sejm era (1788–1792). She focuses in particular on the problems of articulation and functioning of the supremacy of the constitution in the legal order and the innovative shaping of the responsibilities of key state authorities. These issues notably seem to reflect the suspension between the domestic heritage and the modernity of constitutionalism. At the same time, both cases prove that the ratio legis of these solutions was primarily of a practical, not conceptual nature.

Oskar Kanecki’s book considerably broadens the state of knowledge of the judiciary of the Grand Duchy of Lithuania during the interregnum periods (16th–18th century). The work deals with the genesis, organisation and process before these courts in an interesting and wide-ranging way. It seems that a drawback of the book is the incomplete use of the Statute of Lithuania and legislation.

Straipsnyje siekiama ištirti tarpukario Lietuvos seksualinių nusikaltimų teisinį apibrėžimą, išaiškinti seksualinių nusikaltimų prieš moteris bendrąsias tendencijas ir pristatyti šių nusikaltimų prevencijos idėjas to meto akademinėje bendruomenėje. Analizuojant 1918–1940 m. Lietuvos baudžiamosios teisės norminius aktus, išskiriamos dvi lytinių nusikaltimų grupės – gašlavimas ir sanguliavimas. Atlikta lytinių nusikaltimų statistinių duomenų ir teismų praktikos analizė leidžia teigti, kad dažniausias tarpukario Lietuvoje užfiksuotas seksualinis nusikaltimas prieš moteris buvo išžaginimas. Analizuotų nusikaltimų prevencijai tarpukario Lietuvoje dėmesio skirta nedaug, nors akademinėje bendruomenėje buvo aptarinėjamos eugenikos idėjos, siūlančios kastruoti arba sterilizuoti seksualinius nusikaltėlius, tačiau jos taip ir liko diskusijomis, nepasiekusiomis įstatymų lygmens., This article aims to investigate the legal definition of sex crimes in interwar Lithuania, to reveal general tendencies in sex crimes against women and to present ideas in the academic community at that time for the prevention of such crimes. In researching the 1918–1940 criminal law, two groups of sex crimes are distinguished: sanguliavimas – illicit sexual intercourse and gašlavimas – lewd acts. The analysis of sex crime statistical data and case law suggests that rape was the most common sexual crime against women in interwar Lithuania. The prevention of sex crimes during that period has received little attention, although in the academic community eugenics ideas were discussed that suggested sterilization or castration for sex offenders as a preventative and punitive measure, but this remained beyond the reach of the legal debate.

Der Artikel soll zeigen, dass Piotr Rojzjusz, ein Richter am koniglichen Assessoral­Gericht in Vilnius, das romische Recht als Auslegungskriterium fur das Magdeburger Recht herangezogen hat. Das romische Recht diente der Auslegung der Bedeutung der fragwur- digen Begriffe des deutschen Rechts. Der Verfasser sprach sich auch fur die subsidiare Anwen- dung des romischen Rechts bei Lucken im nationalen Recht aus. Sein Werk Decisiones [...] de re- bus in sacro auditorio Lituanico ex appellatione iudicatis (Krakau 1565) stellt einen Kommentar zu funf Gerichtsentscheiden dar. Das Magdeburger Recht ist die Grundlage des Urteilens, aber die Ausfuhrungen des Autors enthalten zahlreiche Verweise auf das romische Recht und auf die Werke von Glossatoren und Kommentatoren.

Straipsnyje, kritiškai įvertinus neskelbtą dokumentinę medžiagą ir publikuotus šaltinius, siekiama atskleisti abortų problemą tarpukario Lietuvoje. Abortas, įvykstantis savaime, šio tyrimo kontekste nėra svarbus, todėl kaip darbo objektas išskiriamas dirbtinai nutrauktas nėštumas. Dėmesys skiriamas teisiniam abortų reglamentavimui, dirbtinio nėštumo nutraukimo priežasčių išryškinimui bei priemonėms, kuriomis jis buvo atliekamas. Siekiama parodyti skirtingus abortų vertinimus, vyravusius tarpukario Lietuvos visuomenėje. Iki 1935 m. baudžiamajame statute buvo numatyta, kad už visus dirbtinius abortus turi būti baudžiama. 1935 m. priimtu įstatymu legalus dirbtinis nėštumo nutraukimas buvo galimas tik tada, jeigu moters gyvybei grėsė pavojus arba ji tapo nusikaltimo auka. Toks pokytis leidžia spręsti apie tam tikrą pažangą to meto visuomenėje, tačiau tyrimas parodė, kad to nepakako. Moterys nutraukti nėštumą pasirinkdavo vedamos tokių motyvų kaip sunki ekonominė padėtis, taip pat dėl neigiamo visuomenės požiūrio į netekėjusią besilaukiančią merginą ar asmeninio apsisprendimo neturėti vaikų. Tokia priešprieša tarp įstatymų ir kasdienio gyvenimo turėjo įtakos tam, kad abortai buvo atliekami slapta, itin kenksmingomis sąlygomis bei priemonėmis. Susiklosčiusi ydinga praktika lėmė sunkius nėščiųjų susirgimus ar net mirtis. To meto visuomenėje abortai buvo vertinami kaip sunkus moralinis nusižengimas, tačiau kartu atkreiptas dėmesys, kad tik įstatymų nepakanka siekiant išspręsti dirbtinio nėštumo nutraukimo problemą. The main aim of this article is to show the problem of abortions in Lithuania in 1919–1940. To begin with, it is important to mention that abortion caused by natural circumstances is not important in the context of this research. This means that attention in this article is given mostly to the legal regulations of abortion, to motives why abortions were made in the first place and also how they were made. During the research author points out and shows different public opinions on abortion in Lithuania in 1919–1940. Until 1935 all abortions in Lithuania were illegal. But in 1935 new law was adopted which stated that abortion was legal only on two conditions – then women’s life was in danger and then pregnancy was the result of crime. This change of opinion on abortions suggests that society was improving but as the research showed it was not enough. The most common motives for induced abortion were: harsh economic situation, negative attitude of the society on unmarried pregnant women or personal decision not to have children. These differences of view, misunderstanding between the Law and everyday life of the people led to situation where abortions were made in very toxic environments by using harmful tools and measures. Moreover, this situation was the main cause of serious illnesses or even death of the pregnant. Also, society viewed abortions as great moral felony. However, it is hard to deny that there was an understanding between some that the Law itself is incapable of solving this induced abortion problem.

Im November 1918 erlangte Polen die Unabhangigkeit zuruck. Dies war je- doch Beginn des Aufbaus der Grenzen des wiedergeborenen Staates. Bevor das Vilniuser Gebiet im Jahre 1922 an Polen angeschlossen wurde, wurde die Macht uber diese Region von 1919 bis 1920 durch die Polnische Armee und durch die polnische Verwaltung, die als Zivilverwaltung der ostlichen Gebiete tatig war, ausgeubt. In ihrem Rahmen wurde die polnische Gerichtsbarkeit geschaffen, deren Funktionieren in der angenommenen Form den bolschewistischen Einmarsch im Sommer 1920 unterbrach und beendete.

[only abstract and summary in English; full article and abstract in Lithuanian] The very first law under which Lithuanian administrative courts were established was adopted in 1999. However, the predecessors of the Administrative Court (the Commission of Legal Ministerial Advisors, Complaints and Remanding Commission of the Seimas, State Council) were created in the third decade of the 20th century. Notwithstanding this, these authorities could not match the judicial review of public administrators’ activity. Consequently, the first draft laws on the Administrative Court were drafted in the fourth decade. There were over ten of such drafts but only two remained. The goal of the article is to reveal the content and the background of draft laws on the Administrative Court developed in 1932 and 1940, which were found in the Wroblewski Library Manuscript Division. Summary The predecessors of the administrative court were created in the third decade of the 20th century in Lithuania. Notwithstanding, these authorities could not match the judicial review of public administrators’ activity. It is noteworthy that sometimes the Senior Tribunal performed the functions of the administrative court and reviewed the legality of administrative acts. However, some laws did not provide the possibility to challenge administrative acts in the courts. That was the main reason to create Law on the Administrative Court of the Republic of Lithuania. There were a number of attempts to establish judicial review in Lithuania in various laws: in Constitutions, State Council Statute, Law on the Judicial System. Around 10 draft laws on the Administrative Court were prepared by the State Council and the Seimas Commission. However, these attempts were unsuccessful. The first draft law on the Administrative Court was drafted in 1932 by the State Council. The main proposals of this document were: first, the Administrative Court is an Administrative Division of the Supreme Court of Lithuania; second, the Administrative Court disposes general jurisdiction of judicial review of individual or regulatory administrative acts due to the violation of subjective rights of natural or legal person; third, the Administrative Court is the only judicial instance and before bringing an action into court, a plaintiff must go through all lower review processes. The draft law created in 1940 by the Seimas Commission was almost the same but more detailed in the provisions of administrative process, what is more, the Administrative Court was proposed to be a separate judicial body. The main initiators of the Law on the Administrative Court were two lawyers: member of the State Council, judge of the Senior Tribunal, ad hoc judge of the Permanent Court of International Justice, constitutional and administrative law scholar M. Romeris and Memel Territory Governor, Meyer of Kaunas, member of the Seimas and last Prime Minister A. Merkys.

Ratifikavus Klaipėdos Krašto konvenciją, kilo klausimų dėl centrinės valdžios ir autonominių Krašto institucijų santykio. Krašto gubernatoriaus instituto teisinė analizė atskleidžia kai kuriuos šio santykio aspektus, taip pat kai kurias Krašto socialinio kultūrinio gyvenimo aktualijas. Tyrimas padarytas atsižvelgiant į mokslinę literatūrą, teisės aktus, Lietuvos valstybės centriniame archyve (LCVA) saugomus gubernatorių raštus centrinės ir vietos valdžios atstovams, pasitarimų su valstybės vadovu protokolus, žymiausias gubernatorių pro memoria. The ratification of the Memel Territory Convention raised questions regarding the relationship between the central government and autonomous territorial institutions. The legal analysis of the institute of the governor of Memel Territory reveals some aspects of this relationship and some topicalities of the social and cultural life of the Territory. The article studies historical documents: legal acts, governors’ correspondence with the representatives of central and local bodies, minutes of meetings with the head of the state, prominent pro memorias of governors that are stored in the Central State Archive of Lithuania.

The article reviews Reform of Lithuanian judiciary in 1933 insofar as it relates to the judiciary of the Memel Territory. Issues related to the implementation of this reform are discussed, as well as the demands of the Germany and Signatory States. The research is done mainly on the bases of the documents found in the Central State Archives of Lithuania: pro memoria of the governors of the Memel Territory, the letters of Lithuanian ministers and officials of the Directorate of the Territory, conversations between representatives of Germany, Signatory States and Lithuania, statutes of the Memel Territory, and case law of the Senior Tribunal of the Republic of Lithuania. Commentaries on Lithuanian laws and publications by interwar Lithuanian scientists and mass media have been used as well.

XV–XVI a. Lietuvos Didžiosios Kunigaikštystės (LDK) rašto kultūros tyrėjų diskusija dėl dokumentų juridinės galios teismo procese skatina atidžiau analizuoti rašytinio dokumento naudojimo ir reglamentavimo LDK teisenoje chronologiją, vietą įrodymų sistemoje bei reikšmės sampratą bajorų teisinėje sąmonėje. Lietuvos Metrikos Teismų bylų knygose įrašyti teismo protokolai ir sprendimai atskleidžia procesą, kai, plintant rašto kultūrai ir išaugus dokumentų poreikiui valstybės vidaus gyvenime, rašytinis dokumentas įgijo savarankiško ir teisėto įrodymo teisme funkciją. Civilinėse (pirmiausia – žemėvaldos) bylose dokumentų juridinė galia įrodymų sistemoje buvo pripažinta jau XV a. viduryje (nors imperatyviai jų dar nereikalauta), o aprobuota Pirmojo Lietuvos Statuto išplėstinėje redakcijoje. Teisminių įrodymų struktūroje ilgai viešpatavę „spalvingi teisingumo rūbai“ (priesaika, gestas, kepurės statymas) XV–XVI a. sankirtoje viršenybę užleido dokumentui, kuris imtas laikyti patikimesniu už asmeninę priesaiką, o tam tikrais atvejais – ir už liudijimą, įrodymu. Toks požiūris ilgainiui įsitvirtino ir bajorų sąmonėje, jie įvairius sandorius stengėsi sudaryti raštu, o tai praversdavo teisme sprendžiant konfliktus. Juolab kad Lietuvoje, skirtingai nei Lenkijos karalystėje, ir viešieji, ir privatūs dokumentai laikyti vienodai svarbiais įrodymais. The discussion on the legal power of documents generated by the researchers exploring the written culture of the Grand Duchy of Lithuania in the fifteenth and sixteenth centuries invites for a more detailed analysis of the usage of a written document in the legal process, the chronology of its legal regulation, the document’s place in the system of evidence as well as its meaning in the legal consciousness of the nobles. The legal proceedings and rulings recorded in the judicial affairs books incorporated into the Lithuanian Metrica reveal the process when, with the development of the written culture and the increase of the demand for documents in the state’s internal affairs, the written document evolved into an independent and sound legal evidence in the judicial process. In the civil cases, primarily concerning the land ownership, the legal power of a written document was recognized already in the middle of the fifteenth century (although there was no peremptory requirement to present written documents in the judicial process), and approved by the extended edition of the First Statute of Lithuania. In the late fifteenth and early sixteenth centuries, the long-lived “colorful robes of justice” (the oath, the gesture, the placing of one’s cap) were replaced in the system of legal evidence by written documents which, from then on, were considered as more reliable evidence than a personal oath, and, in some cases, even a testimony. Eventually, this view found its place in the consciousness of the nobles who documented their transactions and used documents to solve legal conflicts. Moreover, in Lithuania, unlike in the Kingdom of Poland, the judges considered not only the public, but also the legitimate private documents as legal evidence of equal importance. Although, the hierarchy of legal evidence, that prioritized the documents was embedded only in the Second Statute of Lithuania (chapter IV article 52, entitled “On evidence and defense” (O dovodech i otvodech), the analysis of sources allows to decisively affirm that the main source of the aforementioned article was the practice of the courts in the late fifteenth and early sixteenth centuries.

Atlikti tyrimą apie filmų priežiūrą tarpukario Lietuvoje įkvėpė VDU Teisių fakulteto studento V. Alseikos 1937 m. parašytas diplominis darbas. Studijų laikotarpiu jis 1931–1932 m. dirbo žurnalo „Kino naujienos“ kino apžvalgininku, kritiku, 1934–1935 m. buvo žurnalo „Kinas“ redakcinės kolegijos narys. Tad nenuostabu, kad studentas atliko to meto filmų priežiūros instituto Lietuvoje teisinę analizę. Šis darbas buvo ir iki šiol tebėra pirmas bandymas atlikti ne tik teisinę, bet ir filmų demonstravimo Lietuvoje istorinę apžvalgą. Tačiau darbas vertingas dar ir dėl to, kad studentas rėmėsi Kauno miesto ir apskrities viršininko (toliau – Kauno apskrities viršininkas) administracijos Spaudos ir draugijų skyriaus archyvine medžiaga, kurios dalis 1954 m. buvo sunaikinta. Taigi šis diplominis darbas kai kuriais atžvilgiais tapo vieninteliu šaltiniu, iš kurio galima sužinoti apie atitinkamus dokumentus, iliustruojančius filmų cenzūrą Lietuvoje, ir ne tik. Straipsnyje daugiausia remiamasi Vilniaus universiteto bibliotekos Rankraščių skyriuje, Lietuvos centriniame valstybės archyve, Lietuvos nacionalinėje Martyno Mažvydo bibliotekoje rastais dokumentais bei literatūra. Research on film screening in interwar Lithuania was inspired by the final thesis written in 1937 by V. Alseika, a student of Faculty of Law at Vytautas Magnus University. During his studies he worked as a member of the editorial board of “Kinas” magazine from 1934 to 1935. It is not surprising, then, that Alseika supervised film screening. This article is the first attempt to conduct both a legal review and an historical review of film screening in Lithuania. However, the value of this artilce is enhanced by its relying on the archives of the Kaunas County Press and Associations’ Department, some of which were destroyed in 1954. Thus, this article has become the only source of relevant documents illustrating censorship of film screening in Lithuania and beyond. The article is mainly based on documents found in the Department of Manuscripts of Vilnius University Library and the Central State Archives of Lithuania.

Istoriografijoje aptinkama teiginių, jog 1588 m. patvirtinto Trečiojo Lietuvos Statuto baudžiamosios teisės normos dėl savo griežtumo nebeatitiko XVIII a. Lietuvos Didžiosios Kunigaikštystės bajoriškos visuomenės poreikių. Vis dėlto tyrimų, kurie atskleistų bajoriškų teisingumo vykdymo institucijų praktiką, trūksta. Šiame straipsnyje analizuojamos Trakų vaivadijos pilies teisme XVIII a. antrojoje pusėje nagrinėtos bylos dėl nusikaltimų asmens gyvybei, sveikatai ir garbei. Stengiamasi nustatyti, kokiais įstatymais rėmėsi šis teismas skirdamas bausmes nusikaltusiems žmonėms. Tyrimas atskleidė, jog XVIII a. antrojoje pusėje Trakų vaivadijos pilies teismas dažniausiai savo nuosprendžius bylose dėl nusikaltimų asmens gyvybei, sveikatai ir garbei grindė nuorodomis į konkrečius Trečiojo Lietuvos Statuto straipsnius. Tiesa, pastarieji ne visada taikyti taip, kaip buvo numatyta šiame teisės kodekse. Įstatymų raidės griežčiau laikytasi teisiant nekilminguosius, o bajoriškos kilmės kaltinamiesiems paprastai stengtasi skirti švelnesnę bausmę, nei numatė įstatymai. This article explores legal cases considered in the Trakai Castle Court in the second half of the eighteenth century that dealt with crimes against life, health and the honour of a person. Various opinions expressed in the historiography assert that during this period the strict norms of criminal law recorded in the Third Statute of Lithuania (adopted in 1558) were no longer meeting the needs of the nobility. Little research has been conducted on noble court practices as institutions that administered justice at this time. The article explores the laws on which this court based its verdicts handed down on criminals and asserts that in the vast majority of cases dealing with crimes against life, health and honour of a person, the Trakai Castle Court based its verdicts on the specific articles of the Third Statute of Lithuania. Notwithstanding, the latter were not always delivered in the way as provided for by the legal code. Indeed, the letter of the law was more strictly adhered to in cases of accused commoners, whereas the defendants of noble origin were treated more leniently by the court and received less severe punishments than those provided for by the laws.

Purpose. To consolidate development of legal law in Lithuania and to synthesize the value and perspective of the discipline in it. Design/methodology/approach. The research uses a set of systematic analysis, content analysis, generalization, linguistic, analytical and descriptive social sciences methods. Research limitations/implications. This paper does not claim to presuppose a detailed development of the history of law or historiography analysis, to capture or evaluate personal or institutional merits for development of science. The research efforts are purposefully focused to identify a place and shift of the history of law in relation to other scientific disciplines, to distinguish research methods and problems that are relevant today, and to look at the perspective of scientific change. The scope of the publication is the statehood period of the Republic of Lithuania. Originality/Value. This research can be considered as an intention to identify tendencies and problems of the legal history science that determine researchers and practitioners' working methods. Simultaneously, it may be seen as an attempt to actualize the science of legal history in general, in order to inspire interest in this interdisciplinary and complex branch of science and to ascertain its value in the future. Practical implications. This work aims to reveal changes in the discipline of legal history in Lithuania and to contribute to a more effective research and practical work: by revealing global changes in the discipline, effective work methods, indicating possible challenges for the researcher and practical benefits of science.

The objective of the paper is to present the current state of research on the silhouette and activity of Pedro Ruiz de Moros (Roysius), as well as on his work Decisiones Lituanicae, and put forward research postulates. The author presented in particular the results of research conducted by Tomasz Fijałkowski and Andrzej Kremer, and proposed directions in which these studies should be supplemented. One of the postulates is to take a closer look at Roysius as a Renaissance expert in Roman law. Another postulate is to conduct in-depth research into elements of Roman law in Decisiones, and then determine the influence of this work on judicial practice. Another area of research is the activity of Roysius in the Grand Duchy of Lithuania, in particular his role in the work on the Second Statute of the Grand Duchy of Lithuania and the development of the Statutes of the Samogitian chapter. Next, the postulate of publishing Decisiones’ translation into Polish was presented, and difficulties and doubts related to the translation were indicated.

Po Lietuvos krikšto visuomenėje senąsias pagoniškas tradicijas keitė krikščioniškosios normos, prisitaikydamos prie vietos papročių. Nors krikščionybės ir senųjų tradicijų susiliejimas Lietuvos Didžiojoje Kunigaikštystėje (LDK) istorikų jau tyrinėtas, kaip tai keitė santuokos institutą, išsamiau nebuvo tirta. Santuoka LDK dažniau analizuota remiantis sutuoktinių turto (kraičio, dovio) institutų analize. Šiame straipsnyje susitelkiama į XVI a. LDK santuokos institutą ir santuokos teisėtumo sampratą. Tyrime analizuojama pasaulietinė LDK teisė, kuri buvo kodifikuota XVI a. Lietuvos Statutuose, bet išsaugojo dalį vietinių santuokos papročių, ir pasaulietinių teismų paskirų bylų medžiaga. Santuokos teisėtumo samprata straipsnyje analizuojama pasitelkiant rusėniškas sąvokas венчание (vinčius) ir шлюб (šliūbas), kurios pasaulietinėje teisėje fiksavo teisėtos (bažnytinės) santuokos sudarymą, reikšmių turinį ir jų kaitą. Išsiaiškinus abiejų sąvokų įsitvirtinimo LDK visuomenėje aplinkybes, aptariamos jų vartojimo tendencijos. Sąvokų turinio analizė atliekama aiškinantis, kaip šiuos terminus suprato ir vartojo skirtingų luomų (nelaisvųjų, valstiečių, bajorų) atstovai. Tai leidžia parodyti ne tik tai, kaip Lietuvos Statutų normos reglamentavo teisėtą santuoką, bet ir atkleisti teisėtos santuokos sampratos funkcionavimą praktikoje. After the conversion of Lithuania, Christian norms changed the old pagan traditions in society by adapting them to local customs. Although the blending of Christianity with old traditions in the Grand Duchy of Lithuania (GDL) has already been studied by historians, previous research has not provided a clear picture of how it changed the institution of marriage. Marriage in the GDL has usually been studied based on an analysis of the institutions of matrimonial property (dowry, dower). This article focuses on the institution of marriage and the concept of the validity of marriage in the 16th-century GDL. The author investigates the secular laws of the GDL, which, despite being codified in the Statutes of Lithuania, preserved some local elements of the marriage custom, and individual secular court cases. The concept of the validity of marriage is analysed by exploring the meanings of the words венчание and шлюб and their evolution. These two Ruthenian concepts described the act of a valid (ecclesiastical) marriage in secular law. The author describes their establishment in the society of the GDL, before discussing their use. A content analysis of both concepts is performed by explaining how the terms were understood and used by the members of different estates (unfree people, peasants, nobility). This allows the author to show not only the regulation of a valid marriage in the norms of the Statutes of Lithuania, but also to reveal how the notion of the validity of marriage functioned in practice.

Straipsnyje siekiama atskleisti administracinio teismo instituto formavimosi raidą pasaulyje ir tarpukario Lietuvoje, analizuojant M. Romerio monografijos „Administracinis teismas“ turinį. Monografija „Administracinis teismas“ parašyta sudėtinga, nelengvai suprantama kalba. Priežastis – administracinės teisės terminų ir studijų lietuvių kalba trūkumas. Be to, akivaizdu, kad pats autorius, rašydamas šį kūrinį, mokėsi ir bandė perprasti administracinės teisės bei administracinės justicijos fenomeną. The article is dedicated to the 140th anniversary of the birth of Mykolas Romeris, the most famous and most deserving Lithuanian lawyer of all time. The article aims to reveal the development of the institute of administrative court in the world and in Lithuania by analyzing the content of M. Romeris’ monograph „Administrative Court“. The monograph „Administrative Court“ is written in a complex language. The reason for this is the lack of administrative law terms and studies in Lithuania. Moreover, it is obvious that the author himself, while writing this work, studied and tried to understand the phenomenon of administrative law and administrative justice.

In 1760, the nobility of the Słonim poviat launched an initiative for law reform. Jerzy Michalski once suspected that it was aimed at drafting the Fourth Statute of Lithuania. However, the draft prepared by the noblemen attached to the instructions for members of the Parliament is not known. A draft of changes regarding the court system, prepared two years earlier by the nobility of the same poviat, has been preserved in Vilnius. This article outlines the content of the latter.

The purpose of the article is to determine the place of the elders’ court within the judicial system of Samogitia in the period from 1450 (i.e. from the time when Jonas Kesgaila, or Kesgailaitis, took office) to the legal and administrative reform carried out in 1566. Only a few hypotheses have been presented for the earlier years. It is possible to divide the analysed time into two periods: before and after the First Lithuanian Statute (1529). Based on ca 200 documents from various manuscript collections and the Metrica of the Grand Duchy of Lithuania it is possible to reconstruct some aspects of this court’s operations, including its jurisdiction, attitude towards the courts of grand dukes and courts of tenutaries, its composition, the court of vice-elders, and the place and time of court sessions.

The article presents the study of the judicial system that operated on the territory of Belarus from 1797–1840, i. e., from the time of Paul I reforms to the abolition of local features in the sphere of justice by Nikolai I and the introduction of the Russian model of judicial system and legal proceedings. At this time, the judicial system of the region was significantly different from that in the inner provinces of the empire. In this judicial system, retaining of the local judicial legal tradition of the times of the Grand Duchy of Lithuania and the Polish-Lithuanian Commonwealth was combined with the use of Russian law. This judicial system has been operating, albeit with some changes, for more than 3 decades, while under the influence of the anti-Russian uprising of 1830–1831 the autocracy did not proceed to eliminate local features in the judicial sphere. The historical approach enables us to perceive the specific legal phenomenon as continuous and to study the antecedents of current (or even future) legal challenges. This article discusses the possibilities of invoking the historical notion of ius commune (and various new concepts based on it) in a contemporary legal discourse on the future of the European Union (EU) law. Since issues of integrity and homogeneity remain central to the consideration of further legal developments of the EU legal framework it is especially relevant to look back at one of the most prominent phenomena in the Western legal tradition - ius commune, which to some extent united legal thought throughout pre-modern Europe. By analysing inherent characteristics related to its sources, methods and interaction with other (local) legal systems, we attempt to define the limits of such historical analogy. This may allow answering the questions as to whether and to what extent the model of medieval-originated ius commune could inspire further development of the EU legal framework (as a new ius commune).
