The article revolves around legal and organizational aspects of tariff regulation for freight rail transport in the Republic of Poland. A detailed characterization of the Polish legislation on tariff regulation of freight transportation by rail was carried out. Its correlation with the requirements of the Directive 2012/34/EU of the European Parliament and of the Council of 21 November 2012 Establishing a single European railway area is highlighted. The main provisions of the Law of the Republic of Poland "On Railway Transport" in the part of the tariff regulation of railway freight transportation has been analysed. It has been stated, that this Law ensures the flexibility of railway transport tariffs and significantly contributes to liberalization of the national market of transport services in Poland. On the example of Poland, it has been proven that the liberalization of the tariff regulation of railway transportation ensures a reasonable balance between the economic interests of the state and private business. In general tariff regulation of railway transportation of goods in the Republic of Poland is characterized by high efficiency. It has been established that the development of the legal basis for the tariff regulation of rail freight transportation in the Republic of Poland is dominated by the trends towards the creation of a competitive rail freight transportation market; liberalization of tariff regulation of railway transportation; ensuring non-discriminatory access to railway transport infrastructure; inclusion of an investment component in tariffs for mandatory infrastructure access services. It was concluded that the outlined trends serve as a reliable reference point for the development of the legal basis for the tariff regulation of rail freight transportation in Ukraine, which is confidently moving towards integration into the EU economic system. Their consideration is an important step on the way of regulatory adaptation to the acquis communautaire of the European Union. Systematic consideration of these trends when updating industry legislation will significantly contribute to ensuring the stability, safety and economic return of rail freight transportation. Purpose: is to develop the menu of contracts for the model of tariff regulation of natural monopolies in the areas of heat supply, water supply and sanitation, to ensure the economic security of subjects of the tariff regulation system.Methods: the article uses a systematic approach. The theoretical basis of the study is the synthesis of the theory of tariff regulation, the theory of contracts and the theory of economic security. The work also applies special methods used in calculating tariffs: economically justified costs (expenses) and tariff indexation.Results: the presented study substantiates the model of tariff (antimonopoly) regulation of subjects of natural monopolies, taking into account their economic security. Using the provisions of the contract theory, a new menu of contracts for consumers has been developed and tested, allowing them to be included in the process of influencing the size of tariffs, stimulating demand, taking into account low-level indicators in tariff regulation and solving the problem of fulfilling the production programs of monopolists.Conclusions and Relevance: existing practical and theoretical models of tariff regulation do not ensure the economic security of natural monopolies and consumers. In this regard, a substantiation of the model of tariff (antimonopoly) regulation of subjects of natural monopolies and the development of a new menu of contracts for consumers, providing for their choice of one of two types of contracts, were made. The main conclusions of the study can be used to improve the state tariff policy.

This article is aimed at expanding the applicability of meso-institutional concept in the markets of natural monopolies in the context of a new institutional economic theory. Within the framework of the considered concept the impact of the institutional environment level on evolutionary development of energy and housing and public utilities markets is evaluated alongside with modern approaches of digitalisation. In the first part of the current article the author describes theoretical foundations of the meso-institutional environment concept in respect to the energy and housing and public utilities markets. The definition of the concept and its usage domain are given. Besides, the goals difference of meso- and macro-institutions are analysed in detail. The theoretical part also covers approaches of A.E. Shastitko applied to the energy and housing and public utilities markets. Moreover, the hypothesis of conflict resolution between macro- and meso-institutions is described in framework of markets regulation mechanisms. Also, the regulation mechanisms of the two markets are analysed, including market power instruments of meso-institutions. In addition, the article covers the problem of maintaining a balance of market participants’ interests through these mechanisms. In conclusion, the author offers the concept of improving market mechanisms with the help of the meso-institutional development strategy. It is designed to solve the problem of maintaining a balance of market participants’ interests and predetermine the formation of a new improved institutional environment in the energy and housing and public utilities markets.

The materials presented in the article reflect changes in the mechanism of cross-subsidization in the electric power industry, where price discrimination of consumers has taken place until recently. Historically, the established practice has been expressed in the redistribution of the burden of paying for electric energy between consumer groups, ensuring the containment of tariff growth. However, the reduction of tariffs for some categories of citizens was achieved by increasing them for others, social justice was violated and, for some buyers, the price is set above marginal costs, and for others—lower, although, in general, it led to prices corresponding to average costs. This policy was considered by the state as a measure of social support for the population but, at the same time, led to some negative consequences. The presented conceptual provisions for the creation of unified energy zones aimed at ensuring a fair redistribution of cross-subsidization between electricity consumers and a gradual reduction in its consumption will make it possible to form a unified energy space of Russia. On a concrete example, the socio-economic effects of the introduction of the author's approach to the distribution of cross-subsidization between groups of consumers of electric power transmission services are identified and shown. They show the degree of influence of the amount of cross-subsidization paid by the consumer company on the cost of the final products that this company produces. The price of electric energy, which is part of the cost of production, significantly changes the consumer cost of energy-intensive production. The implementation of the proposals contained in the article will create economic incentives for the development of economically lagging regions and will make it possible to form an effective state tariff policy in the process of regulating the socio-economic development of the Russian Federation, defining an effective state tariff policy. The necessity of state regulation in economy is explained by objective possibilities to prevent and smooth out adverse characteristics of economic laws, relationships between participants, macro- and micro- economic and geopolitical factors. At the current stage of development state acts not only as a regulator, but also as an equal active participant of social and economic processes, which implies realization of state dirigism. Through regulation mechanism state exerts accurate and composite impact on economy ensuring its sustainable development. The goal of the research is to shape lines in state regulation of the electric power complex in order to eliminate disproportions in social and economic development. The subject of the research includes economic relations arising in the process of state impact on economic processes in the electric power complex. The research is based on academic and specific methods of studying objective reality. During the research the authors used information of the Federal Antitrust Service, the Federal Service of State Statistics, materials of global independent analytical agencies and informational portals. The authors identified key lines in state regulation and development of competitive relations in the field of electric power engineering. The obtained findings can be used to shape well-balanced risk-oriented policy of state regulation that takes into account all risks of economic development.

The subject of the study is public relations in the field of administrative and legal regulation of the customs and tariff mechanism of foreign economic activity. Methodology. The instrumental and methodological apparatus of the research is formed by the applied methods of economic analysis of the activities of organizations, statistical methods, selective observation, the method of economic modelling, grouping, generalization, expert assessments, methods of economic theory, marketing, etc. The aim of the article is to analyse the administrative and legal aspects of the mechanism of customs and tariff regulation in modern conditions in Ukraine and the world. The research results in a comprehensive consideration of the system of administrative and legal regulation of the customs tariff mechanism in Ukraine and the world, within which: the impact of the customs tariff mechanism on foreign economic activity is assessed; the modern foundations and principles of tariff benefits and protectionism policy are highlighted; the analysis of the administrative legislation of the studied area is carried out; weaknesses and problems of administrative and legal support of the customs tariff mechanism are identified, and ways of their solution are proposed. Conclusion. Customs and tariff regulation acts, on the one hand, as an effective regulator that promotes greater openness of the market, on the other - as the most common foreign trade instrument of protectionism. Therefore, improving the problems of customs and tariff regulation in modern conditions is simply necessary to overcome the crisis phenomena in the domestic economy and ensure the economic security of the state. After all, it requires the determination of the maximum level of tariff rates of import duties, which, under the normal functioning of the economy, will not increase and may be reduced in the future. Such plans may shock many sectors of the domestic economy. These primarily include agriculture, the food industry, the pharmaceutical industry, and the leather and shoe industry. Customs and tariff regulation is designed to promote the goals and objectives of foreign economic activity, as well as ensuring the security of the country and protecting national interests. The methods of customs and tariff regulation are more consistent with the nature of market relations and therefore play a major role in regulating foreign economic activity. In modern conditions, customs and tariff regulation can and should become an effective tool for mitigating and gradually overcoming crisis phenomena in the economy.

We develop a two-stage formulation to estimate seaport performance and to understand the drivers of efficiency, which could potentially include specialization, ownership, competition and tariff regulation. The first-stage non-parametric, slacks-based measure estimates the technical efficiency of each port. For the second-stage analysis, we develop a set of contextual variables including an absolute measure of specialization and a berth-level measure of ownership structure. To measure competition, we develop spatial measures that quantify the level of competition as a function of distance. We subsequently apply this formulation to major Indian seaports, covering a period of 21 years, from 1995 to 2015. The first-stage results suggest that average seaport efficiency has increased gradually over time. The second-stage fixed effects regressions show that specialization and external stakeholder participation have significant positive impacts on seaport performance. Perhaps surprisingly, we find that, in a tiered governance framework, competition between major seaports and local seaports has a significant negative impact on performance, potentially due to excessive infrastructure. As part of the long tradition of EKO, we try to supplement the work of academic researchers with that of experts working in the field. This set of articles concerns the challenges facing the Russian heat supply system. We have asked S.V. Bukharov, a representative of the energy sector, to take part in the discussion. S.V. Bukharov has more than 15 years of experience in the financial and economic management of the energy sector (including with the Novosibirskenergo group, OJSC TGK-13, and the Association NP Market Council et al.). As a consultant, S.V. Bukharov has helped prepare materials for an appeal to the Russian government to classify the urban-type settlement of Linyovo (Iskitimsky District, Novosibirsk Oblast) as a heat supply price zone. This article describes the possible effects for the industry and consumers resulting from the transition to the "alternative boiler plant" model, including a description of the mechanisms for equalizing the price effects for consumers after the transition. The Aim. Analysis of effects according to digital pricing system advent in energy and communal sphere in Russia as a part of new industrial revolution.Purpose of a research. Review of a current world trends on energy markets, determination of ways and instruments for tariff regulation digital development on the energy and communal markets, definition of possible results from complex digitalization of tariff regulation system.Methodology of a research. During research of this article were widely applied instruments of complex theoretical analysis, cause-effect relations were tested between theoretical hypothesis and practical realization of digital tariff regulation models.Result of a research. By the author were written and systematic defined concept of pricing digitalization system on the Russian energy and communal markets according to analysis of main world trends in this economic sphere. The term of digital platform of tariff regulation was developed.Output. Digitalization of tariff regulation could develop premises for deregulation of energy and communal spheres in Russia enable the competence development and lower the entrance barriers for new market players what can lead to higher innovation and investment level recruited in these important markets.

In the regulation of network tariffs, the compensation for the opportunity costs of capital through the Weighted Average Costs of Capital (WACC) plays a crucial role. Determining the appropriate level for the WACC is, though, problematic because of the uncertainty about the future conditions in capital markets. When the WACC is set above the future opportunity costs of capital, consumers will pay too much, while when the WACC is below that level, network operators may be unable to finance investments affecting quality of network services. In this paper, we explicitly take this uncertainty into account when we determine the optimal WACC for the tariff regulation of an electricity network. By trading off consumer surplus and expected disruption costs in the electricity grid, we conclude that from a social-welfare perspective in most cases the optimal WACC in tariff regulation is above the historical mean costs of capital. Only in case of high uncertainty about the true costs of capital while network operators are able to quickly increase investment levels, the optimal WACC is below the historical mean because then it is less likely that the WACC is constantly insufficient to cover actual costs of capital. However, when network operators cannot quickly increase investment levels the optimal WACC is always above the historical mean cost of capital. [ABSTRACT FROM AUTHOR]

A country of billion people, India has witnessed a sharp increase in its economic activities in the past few decades, fulfilling the needs of its ever-growing population, which has come at the expense of a considerable sum of energy and carbon emission. With rising global concern on climate change and India's commitment toward reducing carbon emission, the country is gradually shifting towards harnessing energy through renewable energy (RE), and in recent times, the electricity generation via RE covers about 20%. The road towards RE comes with many challenges, especially when most of its economic activities heavily rely on conventional energy sources. The article highlights the ever-increasing energy requirements of India and the contributions that the RE is making. Being the most contributor among all the RE in India, wind energy has a significant role. This paper presents some of the critical aspects of wind power development, current statistics, potential, and challenges. There upon, it provides some essential recommendations for wind power development, market value addition, tariff regulation, grid connectivity, research and development, and future scope of offshore wind farms in India.

The high degree of monopolization of the power complex in the Russian Federation, on the one hand, and state regulation, on the other hand, can cause a decline in the efficiency of entrepreneurial structures’ functioning in electric engineering. From the point of view of theory and methodology the research studies possibilities to shape competitive relations in electric engineering and analyzes regular risks in electric engineering companies’ work. In practical view the lines in raising the efficiency of entrepreneurial structures are investigated. The authors show feasibility of using DEA methods and the standard method for raising the efficiency of electric engineering companies’ work and fixing a grounded tariff on electric power. As a scientific tool for conducting the research the authors chose such general academic and specific methods as the method of system analysis, the method of retrospective analysis, analytical methods of data research. Empiric materials of the research are presented by information of the Federal Service of State Statistics, public data of monitoring the adopted tariff solutions provided by the Federal Antitrust Service.

The paper proves the necessity of revising the methodology of housing and communal services pricing in connection with the implementation of the city development concept within the framework of the green agenda and the strategies and programs development aimed at ecologically important problems resolution, clean technologies development, natural resource conservation, and the increase in the population living standards as well. It is shown that the creation of ecologically sustainable urban systems requires not only the development and implementation of innovative technologies and attraction of financial resources but also the assessment of their consequences, such as changes in the volumes of consumed housing and communal services and tariffs for them. Adjustments to the methodology of housing and communal services pricing should ensure the process of providing quality services at affordable prices for consumers. The main results of the study demonstrate that modern cities should utilize innovative solutions aimed at changing the approach to operating and managing housing and communal services to meet the requirements of ecological safety and sustainability. Implementing the recommendations to improve the ecological situation and sustainability of housing and communal services can become a key factor in creating a peaceful, successful, and efficient urban environment.

The article considers the problems of promoting the export activities of Ukraine. One of the tasks of the state in the context of European integration is the development and improvement of export activities of Ukrainian enterprises, which is impossible without measures to support and promote it on the part of the state. The integration of Ukraine into the European Union has contributed to the emergence of an objective need for reforming customs legislation and rethinking the methodology of its customs policy, as an element of the state policy for the protection of the national borders and security of Ukraine. The aim of the article is to justify the promoting effect of the customs regimes in Ukraine, the commodity structure of exports and the logistics component on the development of an export-oriented economy in the context of balancing the interests of exporters and the state under conditions of intensified foreign trade. In the framework of the study, the customs policy of Ukraine is analyzed, the essence of a customs regime is revealed, and the types of customs regimes are determined. The analysis of customs regimes in Ukraine showed that one of the most used ones is export. Furthermore, the structure of Ukraine exports is investigated, the top 10 current product groups are identified, and promising sectors of the economy are described. The comparison of the export structure of Ukraine with the world structure made it possible to determine that the commodity orientation of Ukraine’s exports is consistent with the global trends. Successful functioning in the international trade space is impossible without mainstreaming the logistics concept, continuous development of the functions, methods and tools of international logistics. A review of the regulatory support of logistics activities at intensifying exports in Ukraine is carried out and the main conventions on the regulation of international transport are systematized.

In the article the Russian experience of formation of tariff policy for subjects of natural monopolies (further - NM) during 2013-2016 and its main consequences for economy is considered. Considering the influence the natural monopoly branches in the Russian economy observed within the entire period of its existence, the tariff policy in these branches exerts not only direct impact on the enterprises in these branches, in particular, on their investment and personnel policy, but also significant indirect effect on other industrial branches which are consumers of goods of subjects NM. The author shows in the present article that the tariff of natural monopolies can be used as the tool of industrial policy, however, efficiency of its use depends on creation or development of additional market incentives which would allow to increase competitiveness of the industrial enterprises, but not to use the low prices of goods and services of natural monopolies for subsidizing of own inefficiency.

In Europe, gas market mergers aim at reducing restrictions on gas wholesale markets. Market mergers also allow network users to book transport capacity at different gas transmission system operators (TSOs), which may give rise to inter-TSO competition. Our theoretical analysis reveals the incentive for TSOs, operating under a revenue-cap regulation in merged markets, to charge lower tariffs at borders where different TSOs offer capacity, compared to borders where only one TSO offers capacity. This incentive does not directly result from revenue-cap regulation but is due to efficiency benchmarking. We test this hypothesis by applying a panel data analysis to tariffs charged at German border points between 2015 and 2018. In line with our hypothesis, we find lower tariffs at those border points where network users have a choice between different TSOs. An additional sensitivity analysis differentiating between transit and meshed networks confirms this result. We conclude that German TSOs, operating in merged markets and under a revenue-cap regime with efficiency benchmarking, compete for demand at borders at which different TSOs offer capacity. We evaluate the relationship between hospital ownership and responses to a policy providing large financial incentives for vaginal deliveries and financial disincentives for C-sections. We compare for-profit, nonprofit, and public hospitals operating in a public health care system organized according to the quasi-market model. We first theoretically show that hospital ownership matters insofar different hospitals are characterized by different ethical preferences. We also show that competition makes ownership less important. We then consider the case study of Lombardy in Italy. We exploit spatial variation in hospital ownership and in market concentration at the local level to evaluate the relationship between ownership and the probability of C-section. According to theory, empirical results strongly suggest that competitive pressures from alternative providers tend to homogenize behaviors. However, in local monopolies, in presence of a strong monetary incentive toward vaginal deliveries, we do observe less C-section from private for-profit hospitals than from public and private nonprofit hospitals, especially when C-sections are medically appropriate. For the last several years, the Russian Federation has been artificially restraining the growth of tariffs for the services of natural monopolies. A simple decision, which is taken hastily a few years ago as a short-term anti-crisis measure, has every chance of becoming a "solution" for many years to come. The authors attempt to analyze the short-term and long-term effects of the tariff regulation and present the results obtained in the framework of the basic research program of the Higher School of Economics on the impact of tariffs in the energy sector on the main macroeconomic indicators, most often used as arguments in favor of tariff restraint. It is shown that tariffs, including the ones for electricity networks, should cover all efficient costs of regulated companies in full which enables reliable and safe power supply for sustainable and efficient development of industries and wellbeing of the population. The authors present for the first time the results of the estimations of the efficiency of the operational costs of electric networks in Russia obtained on the models developed by the Institute of Pricing and Regulation of Natural Monopolies. The models are based on the data envelopment analysis (DEA) technique, one of the most advanced and most common methods in contemporary tariff setting.

The relevance of the topic is to elucidate the role of trade diplomacy in efficiency of realization the foreign policy of the state. Special importance this issue has taken in light of the prospects of economic development of the Republic of Belarus in the modern international economy. Object of research – trade diplomacy in modern international economy. The research purpose – identification of theoretical bases of use of trade diplomacy in international economic relations as a form of effective implementation of foreign trade policy and the advantages in the international market, to search for mutually acceptable solutions, expand and deepen international cooperation. Methodological basis of research - system approach, methods of the analysis and synthesis, the subject and object, quantitative and qualitative, historical and logical analysis. Results of research – basis of identification of tendencies of development of international economy, the possibilities and prospects of use of trade diplomacy as a form of foreign policy at the bilateral, regional and multilateral basis, to promote the development of the national economy and ensure the foreign trade interests in the framework of the general foreign policy of the state in order to improve international competitiveness. Scope of results: development of strategic tools for the effective implementation of foreign trade policy and the advantages in the international market that can be achieved by means of trade diplomacy. Conclusion: 1. It is obvious that trade diplomacy is at the intersection of foreign policy, foreign policy and foreign economic activities of the state and is a form of realization of foreign policy of the state, providing favorable conditions for national actors by forming a rational trade regimes in relations with trading blocks, individual states and corporations. 2. Currently, trade diplomacy, given the processes of internationalization and interdependence in the global economic system, can realize the effect in two dimensions of globalization and regional integration in three forms – bilateral, regional and multilateral solving assistance, assistance, protection and lobbying of the national foreign trade interests is complex and systemic nature, working closely with government agencies, organizations, economic and trade structures. 3. Liberalization of national economies and their interaction through trade and international investment, a growing number of actors in the international economy – transnational corporations, banks, investment and integration groups, large and increasing dependence of the economies of independent states from the international markets of goods and services, investment, technology, forcing them to adjust their foreign trade policy. Foreign trade policy has at its disposal in addition to non-tariff barriers, competition rules, monetary parity, tax harmonization, convergence of economic systems, new tools, practical activities and methods of active influence, such as information and communication technology, marketing, advertising, negotiation skills etc. All of the above is the basis for the trade diplomacy of a strategic nature that allows us to develop conceptually and well-supported export program and increases the level of coordination between the institutions involved in the implementation of export-import operations.

The purpose of the paper is to analyze the issue of applying by Ukraine of mechanisms developed in the legal framework by the World Trade Organization to protect the internal market in order to prepare appropriate recommendations to state power authorities empowered to carry out trade policy. Methodology. The study is based on studying the experience of Ukraine to revise its commitments on tariff lines for the first three-year period after the accession to the WTO, as well as on the analysis of the most resonant steps to protect the internal market taken by Ukraine and the consequences of these steps. Result. The issue of applying by Ukraine of tools developed by the World Trade Organization to protect the interests of national producers has been described in this article. The situation of the use by Ukraine of a right to review the conditions of membership in the WTO has been reviewed step by step starting from the studying of this issue within the country and to the statements by the Government not to use this feature. All the stages of the process of using the possibility to revise the conditions of membership in the WTO have been analyzed as well as the mistakes that led to the absence of the desired result in the end. Also, the basic tools of protection of the domestic market in the WTO system, such as anti-dumping investigation and the investigation concerning the subsidized imports has been considered The dynamics of the use of such investigations by all WTO member countries since the establishment of the WTO, with particular emphasis on the period of the financial and economic crisis of 2008-2010 has been reviewed. The number of successful investigations led to the application of certain protective measures also has been determined. The risks that arise in the absence of the Government of Ukraine steps to improve the efficiency of representation of interests in the WTO have been analyzed. Recommendations improving the use of WTO mechanisms to protect domestic producers have been offered. Changes in the legislative framework of Ukraine, which will help to improve the practice of defending the interests of national producers in compliance with WTO rules, have been proposed. Special attention is paid to the issues under discussion by WTO committees and the impact that will have the decisions taken in these committees on the WTO member countries. The main objectives of participation of WTO member countries in the work of these committees have been systemized and the main benefits of active participation in their work have been indicated. The practical significance. The data obtained can be used by public authorities of both Ukraine and other countries that have recently acceded to the WTO in order to improve the use of institutions and mechanisms created by this organization for the realization of their national economic interests. The same analysis of the experience of the first attempts to revise by Ukraine of its commitments to the WTO will be useful during the second revision of the conditions which, according to the rules of the WTO, occurs every three years.

Water and sanitation regulation in Brazil shall be addressed as part of a major problem that involves institutional disputes and legal uncertainty. The paper investigates the hypothesis that the complex institutional framework plays a central role in explaining country's poor performance in the sector. Methodology is mainly qualitative, presenting an analysis that shows how political, institutional and legal hurdles play a major role in explaining the government's inability to secure a financially self-sustainable structure to the sector.
