The article revolves around legal and organizational aspects of tariff regulation for freight rail transport in the Republic of Poland. A detailed characterization of the Polish legislation on tariff regulation of freight transportation by rail was carried out. Its correlation with the requirements of the Directive 2012/34/EU of the European Parliament and of the Council of 21 November 2012 Establishing a single European railway area is highlighted. The main provisions of the Law of the Republic of Poland “On Railway Transport” in the part of the tariff regulation of railway freight transportation has been analysed. It has been stated, that this Law ensures the flexibility of railway transport tariffs and significantly contributes to liberalization of the national market of transport services in Poland. On the example of Poland, it has been proven that the liberalization of the tariff regulation of railway transportation ensures a reasonable balance between the economic interests of the state and private business. In general tariff regulation of railway transportation of goods in the Republic of Poland is characterized by high efficiency. It has been established that the development of the legal basis for the tariff regulation of rail freight transportation in the Republic of Poland is dominated by the trends towards the creation of a competitive rail freight transportation market; liberalization of tariff regulation of railway transportation; ensuring non-discriminatory access to railway transport infrastructure; inclusion of an investment component in tariffs for mandatory infrastructure access services. It was concluded that the outlined trends serve as a reliable reference point for the development of the legal basis for the tariff regulation of rail freight transportation in Ukraine, which is confidently moving towards integration into the EU economic system. Their consideration is an important step on the way of regulatory adaptation to the acquis communautaire of the European Union. Systematic consideration of these trends when updating industry legislation will significantly contribute to ensuring the stability, safety and economic return of rail freight transportation.

У статті розглянуто особливості функціонування інституту адміністративної відповідальності як важливий елемент системи державно-правового захисту прав інтелектуальної власності як окремої групи однорідних відносин, об’єктами яких є результати інтелектуальної, творчої діяльності особи. Визначено групу однорідних нормативно-правових актів, що регулюють досліджувані відносини: Конституція України, кодекси та закони України, Укази Президента України, постанови та розпорядження Кабінету Міністрів України, стандарти у сфері інтелектуальної власності, відомчі нормативно-правові акти, міжнародні договори та угоди. Встановлено, що в нашій державі доцільно продовжувати удосконалення системи нормативно-правового забезпечення захисту інтелектуальної власності, а сама така система повинна бути спрямованою на переорієнтацію адміністративно-правової діяльності органів виконавчої влади щодо підвищення прозорості процесу прийняття рішень щодо притягнення правопорушників до адміністративної відповідальності, що стане ефективним засобом забезпечення правомірної діяльності фізичних та юридичних осіб у сфері захисту прав інтелектуальної власності. Запропоновано законодавче закріплення категорії «адміністративна відповідальність за порушення законодавства в сфері інтелектуальної власності» як реалізації адміністративно-правової санкції, яка виявляється у застосуванні судом до винної особи, що скоїла адміністративне правопорушення у сфері інтелектуальної власності, покарання, передбаченого Кодексом України про адміністративні правопорушення та іншими законодавчими актами, згідно з визначеною законом процедурою. Визначено перспективами подальшого дослідження у цій царині теоретичне удосконалення законодавства та практичне врегулювання функціонуванням вказаного інституту як засобу державного захисту прав інтелектуальної власності особи.

Стаття присвячена дослідженню природи та сутності принципів адміністративно-правового регулювання. Розкрито засадничу роль принципів адміністративно-правового регулювання у забезпеченні системної організації та розвитку вітчизняного адміністративного права, адміністративного законодавства, адміністративно-правової доктрини, нормотворчої діяльності та правозастосовної практики. Висвітлено проблему відсутності єдиного концепту принципів адміністративно-правового регулювання як у доктрині адміністративного права, так і в сучасній юридичній практиці. Обґрунтовано необхідність вироблення єдиного підходу до розуміння принципів адміністративно-правового регулювання, заснованого на передових досягненнях сучасної юриспруденції та об’єктивних реаліях правової дійсності. Підкреслено першочергову важливість застосування такого підходу в адміністративному правотворенні та правозастосуванні, зокрема, в юрисдикційній діяльності. Проаналізовано найбільш відомі та поширені дефініції поняття “принципи адміністративно-правового регулювання”. Зроблено висновок про кардинальні відмінності сучасних наукових поглядів на природу, сутність і систему принципів галузевого регулювання, що не дозволяє вибудувати цілісну доктринальну концепцію на основі їх простого узагальнення. Констатовано недоцільність ототожнення принципів адміністративно-правового регулювання з нормативними правилами поведінки, об’єктивними закономірностями функціонування адміністративних правовідносин, підставами для виникнення таких відносин, а також із принципами публічного адміністрування (принципами адміністративної діяльності). Наголошується, що всебічне наукове уявлення про принципи адміністративно-правового регулювання повинно ґрунтуватися на загальнотеоретичному розумінні принципу, як основних засад, вихідної ідеї, що характеризуються універсальністю, загальною значущістю, вищою імперативністю і відображають суттєві положення теорії, вчення, науки, систем національного і міжнародного права, державної правової політики, політики розвитку галузей та інститутів права. Сформульовано авторське визначення принципів адміністративно-правового регулювання. Запропоновано підхід, згідно з яким принципи адміністративно-правового регулювання розглядаються як: основоположні ідеї, на яких ґрунтуються розвиток і функціонування адміністративного права та всіх його інститутів, система адміністративно-правових відносин, реалізація прав, свобод і законних інтересів їх учасників, правотворча та правозастосовна діяльність суб’єктів публічної влади.

The article deals with the issue of patenting medicinal products in Ukraine through the prism of the Association Agreement with the EU and the TRIPS Agreement. It is emphasized that Ukraine is a member of the WTO, having implemented a number of flexible provisions of the TRIPS Agreement plus fulfilled its obligations under the TRIPS Agreement. Along with Ukraine has entered The Association Agreement with the EU, and is to fulfill obligations under this Agreement. At the same time, the EU Court has banned the direct action of the TRIPS Agreement. The Association Agreement between Ukraine, on one hand, and the European Union on the other hand, requires changes concerning fulfillment of Ukraine's obligations under the TRIPS Agreement. The purpose of the article is to establish the peculiarities of harmonization of Ukrainian legislation with the EU legislation in the field of pharmaceutical patenting through the prism of the TRIPS Agreement and the Association Agreement. The subject of research is the social relations that arise in the patenting of medicinal products in accordance with the TRIPS Agreement and EU Law. The methodological basis of the study is general and special methods of scientific knowledge (formal-logical method, comparative legal, structural-logical). As a result of the study it has been found that the EU itself interprets, updates and upgrades the TRIPS Agreement for EU Member States, EU associates, states with which bilateral free trade agreements have been signed. It is established that the TRIPS Agreement by its nature can not belong to the EEC founding treaties, but it belongs to the group of sources of EU Law "international (additional) agreements with international organizations and other countries". The following features of the harmonization of Ukrainian legislation with the EU legislation in the field of patenting of medicinal products through the prism of the TRIPS Agreement and the Association Agreement are established: 1) the object of the utility model should be the device but not the methods of treatment in the legal mode of the utility model; 2) the establishment of such conditions for the provision of legal protection is industrial suitability and its novelty; 3) obligatory examination of the application for a utility model for the issuance of the patent; 4) the period of validity of intellectual property rights of 10 years; 5) establishment of an administrative procedure for the invalidation of intellectual property rights for a utility model; 6) the definition of duty for the patent office on the application of any person to provide an official search report on the application filed within the period of 6 months.
