This article aims to understand the limitations in enforcing state responsibility on a state of Origin for Trans boundary harm caused by a health emergency by analyzing the factors of force majeure, multiparty involvement, and inability to provide reparations, and the unclear source of the virus as the chief hindrances in prosecuting such states. The authors further explore the various conditions that triggered other PHEICs in history and the consequences and actions taken due to the trans-boundary harm caused. Furthermore, the article also studies the conditions that gave rise to the wet markets and traces the shortcomings in law that hurt the Origin of the virus. After that, the article studies how countries have failed to invoke the state responsibility of trans-boundary harm caused by a PHEIC. Lastly, the article further delves into how Chinese authorities blame both pre and post-outbreak and examine how the global community can negotiate with China for adequate compensation.

The 2020 Amendment Act, of Medical Termination of Pregnancy has reinvigorated the discussion with regards to bodily autonomy and reproductive rights in India. This comes at a juncture of time, where the discussion regarding reproductive rights is an important part of the global socio-political narrative. The aim of this paper is to study the developmental trajectory of reproductive rights by gauging how the right to abortion has fared in various countries across the world by analysing specific legislations, judicial precedents and statistical data. We examine how one may secure the reproductive health rights of a woman better by analysing the two functional methods adopted thus far - either through liberal legislations that guarantee full autonomy to the woman or more restrictive laws that permit abortions only in certain circumstances - a major. The second half of this paper focuses on India, a country whose culture is traditionally perceived to be deeply rooted in orthodoxy and conservatives. The Medical Termination of Pregnancy Act was enacted in 1971, and the 2020 Amendment has garnered acclaim for its more progressive outlook and direction. Even though the amendment has addressed some of the major concerns voiced out by reproductive rights’ activists, there are still a few systemic and practical dogmas that are still pervasive in the reproductive rights domain. The paper discusses these prevalent lacunae at play at length and emphasizes on the need for comprehensive and quick solutions. These will contribute to the prevention of unwanted pregnancies while simultaneously reducing the physical and psychological harm that is caused to vulnerable women across the country.

Climate change has increasingly come to be viewed as a security threat, as well as a ‘threat multiplier’. The impact of this has become a cause for major international concern, especially in light of national contributions to climate change, by virtue of heavy industrial dependence on polluting processes. To address this issue, certain national lobbies have suggested that the United Nations Security Council should be made legislate on the issue, given its bearing on international security. This approach has been supported by nations and blocs like the United States, the EU, the Pacific Islands, etc. An alternate lobby, comprising states like India, have argued against this approach due to the UNSC’s fractured mandate, and expressed their wish to keep deliberations more representative. This paper shall evaluate the context of climate change, the legal principles underlying it, and argue in favor of the Indian stand that the UNSC is not the appropriate institution to make policy decisions on this matter.

Background: During the mid-weeks of May 2020, a superspreading event occurred in a town of Central India, where breaking bread together led to an outburst of COVID-19 cases. This led to a sudden increase of the daily average number of cases later on in the month.Methods: An epidemiological investigation was done to investigate the cause. Process of the epidemic investigation done has been described under three parts namely - Case finding, Contact tracing, Public health response.Results: Our epidemiological investigation and contact tracing of the index case confirmed a superspreading event of COVID-19 which occurred due to multiple social gatherings during mid weeks of May 2020. It was estimated that 118 cases belonged to G0 and 94 cases belonged to G1 generation of the index case.Conclusions: Most likely source of infection to the index case was from the guests who came for a social gathering on May 11, 2020 (lockdown 3) from a village across the border in Rajasthan, a high COVID-19 prevalent zone (Orange) to a low COVID-19 prevalent zone (Green).

Over-exploitation of environmental resources by humans defeats the ideal of sustainability. Trawling, a method of fishing, illustrates such exploitation. Trawling accounts for 57% of marine fish production in India. As a result of lack of selectivity by the cone-shaped trawl nets used, both target and non-target species are collected without any difference. Even endangered species such as seahorses, which are protected under Indian Wildlife Protection Act, 1972, are not spared. The Stockholm to Rio Conferences as well as Sustainable Development Goal (SDG) 14 focus on sustainable use of marine resources. Trawling activities along India’s 7516 km coastline and spanning multiple coastal states defeat this goal. This paper highlights the various impacts of trawling on marine ecosystem. The authors will analyse India's position in light of various international conventions and domestic laws, the need for strengthening the laws, and the role of the Indian judiciary in protection of marine biodiversity. Further, we will highlight measures in various countries to minimise the effects of trawling and the best practices to be adopted by India. The paper will also delve into the recent controversy that has emerged between India and Sri Lanka on the above issue.
