Using command-and-control regulation of land use to produce a public good (as opposed to preventing physical off-property harms) without compensating the landowner can be expected to produce two unintended consequences: (i) management actions by landowners to reduce the land's attractiveness for production of the public good being sought and (ii) regulatory decisions made as though more costly regulation were costless. Higher costs imposed by the second consequence feed back to worsen the first. Examples from enforcement of current Endangered Species Act regulations provide illustrations. The paper uses a graphical framework to emphasize the qualitative difference between regulatory control without compensation on one hand and the rental or purchase of results on the other. The problems faced by national parks such as insufficient funding and deteriorating facilities and services could be resolved through 'corporatizing.' The term means giving park managers incentives to improve their services and facilities. This also includes allowing park managers to retain a portion of the fees they collect, implement rate increases and raise funds through donations and research missions.

The EPA's Superfund program has largely failed in its goal to clean up polluted sites since its implementation in 1980. Furthermore, cleanup costs had been driven up by lawyers' fees in court litigations to determine the liability of potentially responsible parties. Former EPA administrator William Reilly proposed a rule to streamline the process by which cleanup costs are paid by liable parties. However, the proposed rule could drive up costs by enabling freer spending by the EPA or by contractors doing cleanup jobs. The Superfund program is so defective that it would be better to scrap it altogether.

The regulations governing archaeological finds are discussed with emphasis on their advantages and disadvantages. The positive effects to landowners and archaeologists of encouraging a free market in the sale of artifacts is explored.

Sustainable development can be achieved only through market-based economic progress. In supporting institutions which foster economic growth, access to sustainable development is gained since economic well-being promotes human and environmental health. Market economies must be allowed to continue without government intervention since Western industrialized countries have generally treated their environments with care and also because economic progress raise environmental consciousness. Thus, government policies that would induce changes in technology and behavior are bound to fail.
