The article addresses the topic of prospective overruling, as a technique for modifying precedents, and limits the retroactive effectiveness of judicial decisions.

The article presents the argument that contemporary societies are facing an ever-growing over-production of norms which are chocking its efficient functioning. The argument however is subsequently de-constructed, in particular through a comparative (European vs. US) analysis, pointing out that what is of great concern on this side of the Atlantic apparently is not at all on the other side. The article concludes with some possible remedies – admitting that we are facing an illness – to the current over-production. [ABSTRACT FROM AUTHOR]

La presente investigación tiene por objeto determinar y establecer los principios y reglas que estructuran el sistema de fuentes en el ordenamiento jurídico chileno, a partir de las normas positivas y las soluciones jurisprudenciales y doctrinales que se han formulado desde la entrada en vigencia de la Constitución de 1980, con la finalidad de extraer los elementos que permitan determinar las normas aplicables a un caso concreto, así como los criterios para resolver de forma adecuada los conflictos normativos que se presentan en nuestro derecho a partir de un sistema de fuentes plural y complejo.From the normative, theory and jurisprudence developed under Chilean Constitution of 1980, this research pretends to identify the structural rules and principles of the Chilean legal order. It will help to recognize the rules applicableto a single case and the guiding principles for clash of norms, in a pluralistic and intricate system of law sources.
