The speed and uncertainty of environmental change in the Anthropocene challenge the capacity of coevolving social-ecological-technological systems (SETs) to adapt or transform to these changes. Formal government and legal structures further constrain the adaptive capacity of our SETs. However, new, self-organized forms of adaptive governance are emerging at multiple scales in natural resource-based SETs. Adaptive governance involves the private and public sectors as well as formal and informal institutions, self-organized to fill governance gaps in the traditional roles of states. While new governance forms are emerging, they are not yet doing so rapidly enough to match the pace of environmental change. Furthermore, they do not yet possess the legitimacy or capacity needed to address disparities between the winners and losers from change. These emergent forms of adaptive governance appear to be particularly effective in managing complexity. We explore governance and SETs as coevolving complex systems, focusing on legal systems to understand the potential pathways and obstacles to equitable adaptation. We explore how governments may facilitate the emergence of adaptive governance and promote legitimacy in both the process of governance despite the involvement of nonstate actors, and its adherence to democratic values of equity and justice. To manage the contextual nature of the results of change in complex systems, we propose the establishment of long-term study initiatives for the coproduction of knowledge, to accelerate learning and synergize interactions between science and governance and to foster public science and epistemic communities dedicated to navigating transitions to more just, sustainable, and resilient futures.

This article explores the trade-offs in the decarbonisation of the energy sector by analysing the legal arguments in favour of and against hydropower in EU law. It contends that the EU regimes in climate, energy and environmental law each value the advantages and disadvantages of energy production in different ways. In contrasting the approaches in these three areas of EU law, the article analyses how EU law governs the decarbonisation process in the context of hydropower. The analysis reveals a promising opportunity to reconcile the friction among climate, energy and environmental law while improving the ecological sustainability of hydropower production. The relationship between water security and water governance across different water-using sectors remains under-researched. We apply the Organisation for Economic Co-operation and Development's (OECD) Water Governance Indicator Framework with revised principles and criteria to analyse three sectors critical to water security in Finland: bioeconomy, mining and water infrastructure. Our findings indicate that water security as a concept helps to both assess and clarify governance priorities, while well-functioning governance with engagement of key actors is a prerequisite for broader water security. Given the differing interests and emerging pressures related to water, ensuring water security requires well-resourced public sector agencies to coordinate interaction across sectors and actors. Browning of surface waters, also known as brownification, is a process of decreasing water transparency, particularly in boreal lakes surrounded by intensively managed forests and wetlands. In this paper, we review the ecological consequences and ecosystem‐based management (EBM) of browning through a systematic review approach and adopt an interdisciplinary approach to formulating new governance of this complex phenomenon. To understand the effects of browning on the recreational value of freshwaters, we present primary survey data on public perceptions of recreational fishing tourists on water quality in Finland. We identify a need to develop EBM beyond the EU's Water Framework Directive (WFD) to fully account for the extensive implications of browning. We also highlight the need for a better understanding of the within‐lake microbial processes to estimate the browning‐associated changes in the greenhouse gas balance of lakes. Tourist perceptions of the quality of waterbodies in Finland were largely in agreement with the general proportion of waterbodies classified in a good or excellent ecological status class, but these perceptions may be detached from biological quality assessment criteria. Consequently, we suggest that the EBM of inland waters should improve the utilization of information on not only biogeochemical processes but also users' perspectives on aquatic ecosystems beyond the EU WFD. Global biodiversity loss is most severe in freshwaters, particularly in river ecosystems. Hydropower is one of the main culprits. While being promoted as a carbon free source of renewable energy, hydropower disrupts the flow, habitats, and biota of rivers. Environmental policies and programs seek to mitigate the damage hydropower causes. Any policy action aiming at making the utilization of our rivers more sustainable must be ecologically, economically, and legally feasible. We show that the interdisciplinary feasibility of mitigation measures divides existing facilities into three categories (i) large facilities in which biodiversity mitigation measures are needed but electricity generation and balancing the electricity grid should remain as their main focus, (ii) small facilities in which dam removal and full scale river restoration measures can be taken by assisting the facilities to seize operations, preferably just before their next big investments, and (iii) medium facilities where benefits and trade‐offs associated with alternative paths should be analyzed case‐by‐case to determine the most feasible path forward. Policy action is feasible in all three categories but in different ways: requiring fish passes in the case of large facilities, helping remove dams and restoring the rivers in the case of small facilities, and focusing cost–benefit analysis efforts on the non‐trivial group of the medium sized facilities. The achievement of a radical global reduction of greenhouse gases requires a legal-institutional setting capable of facilitating such a transition on a wide range of renewable technologies. This paper identifies and critically evaluates the key institutional, procedural and substantive legal mechanisms facilitating or preventing sustainable production of blue renewable energy with Finland as a case study country. The focus is on offshore wind power and hydropower. While we approach energy transition from the perspective of an EU member state, we simultaneously shed light on the relevant parts of the EU legal framework that significantly affect national legal frameworks.
