Yüksek lisans tezimizin konusunu 'Türkiye ve Kazakistan Hukukunda Taşınmaz Mülkiyetinin Kazanılması Ve Devri' oluşturmaktadır. Sosyal ve ekonomik yaşamda taşınmazlar (gayrimenkuller) büyük önem taşımaktadır. Bu nedenle taşınmaz mülkiyetinin devri için, taşınır mülkiyetinin devrinde bulunmayan ve kanunen belirlenen birçok kurallar mevcuttur. Bu kuralların tam ve doğru olarak uygulanmaması taşınmaz mülkiyetinin devrini geçersiz kılmaktadır. Tez çalışmamız üç bölümden oluşmaktadır. Birinci bölümde taşınmaz kavramı, mülkiyet, mülkiyet hakkı, mülkiyetin konusu ve kapsamı, mülkiyet hakkının türleri, taşınmaz mülkiyetini kazanmanın yolları gibi konuları incelenmiştir. Çalışmamızın ikinci bölümünde ise, taşınmaz mülkiyetinin devri, geçerlilik şartları ve devir işleminin sebebe ve şekle bağlılığı üzerinde durulmuştur. Burada, Türk ve Kazak Hukukunda sebep ve şekil kavramları, şeklin türleri, devrin geçerliliğine etki eden haller ile tapusuz taşınmazlarda mülkiyetin devri gibi konulara yer verilmiştir. Üçüncü ve son olan bölümde ise, taşınmaz mülkiyetinin devrinin hükümleri ele alınmıştır. Burada satım, bağışlama ve trampa gibi sözleşmelerde taşınmaz mülkiyetinin devrinden bahsedilmiştir., The theme of our master thesis work is ?The Achievement And Transfer Of The Right On Real Estate In The Law of Turkey And Kazakhstan?. In social and economic life the unmovable property has a great role. Therefore, there have been made and defined a lot of rules by laws for real estate and that can not be used for movable property. These defined rules must be used in a right way, in order to transfer a right for real estate. The work consists of three parts. In the first part, we gave the definitions for a property, a right for property, the real estate, the kinds of property and studied the ways to achieve a right for real estate. In the second part of work we have studied a transfer of real estate, allowed rules for it, and belongings of transfer action to reason and form. We have opened there the definitions of reason and form in Turkish and Kazakh Laws, the kinds of form, the situations that are influencing for true transfer of real estate and transfer of property for untitled deed of unmovable property. The transfer rules of real estate are given in the third and last part of the work. There the transfer rules of unmovable property in sales, grant and barter contracts have been searched.
