El presente artículo tiene por objeto analizar desde una perspectiva humanista la figura de la acción penal por particular que se consagra en las actuales leyes Mexicanas, lo cual se abordará desde las perspectivas; denominativas, gubernamentales y de formalidad legal, para así, mediante estos factores, dirimir si el proceso establecido por los legisladores garantiza la seguridad jurídica y equidad procesal de quienes desempeñan el papel de acusados, imputados o indiciados, de la misma manera, el derecho de la víctima, garantizando su equidad procesal y estado de derecho. Para desarrollar esta investigación, se utilizó una metodología jurídica dogmática, la cual implicó el análisis crítico y sistemático de las normas jurídicas, la doctrina y la jurisprudencia relacionadas con el tema de estudio. Se emplearon diversas técnicas de investigación, como el análisis de textos legales, la consulta de bibliografía especializada y la revisión de jurisprudencia relevante. Obteniendo como resultado que, la acción penal por particular, si bien representa un avance en la tutela de los derechos de las víctimas, debe ser implementada y ejercida con extrema cautela y dentro de un marco legal robusto que proteja los derechos de todas las partes involucradas.

The purpose of this study is to analyse the constitutionality of Law 19/2022, based on the theory of the rights of nature, specifically its compatibility with the constitutional framework used by the Spanish State (Art. 149.1.23 of the Spanish Constitution) as a regulatory basis in the new field of the rights of nature and its impact on the regulatory possibilities of the autonomous communities. The article analyzes the Supreme Court's ruling on May 14, 2024, regarding an administrative appeal related to Royal Decree 1053/2022 on bovine farms. The appealing company questions the retroactive application of the regulations, arguing that it affects their intensive livestock farming project. Decree-law 3/2024, of February 6th, aims to simplify and rationalize administration in Andalusia in order to improve citizen relations and promote economic activity in the region. Measures will be implemented to improve regulation, transparency, and reduce administrative burdens. From a Wittgensteinian perspective on the meaning of words, Mexican legislation and jurisprudence are analyzed to determine the concept of hate speech in Mexican law. It is found that hate speech can be considered a manifestation of ideas and information that simultaneously constitutes the execution of one or more reprehensible actions. However, inconsistencies in court decisions do not allow for the establishment that such speech is punishable. This characteristic should be inferred from the legal system. Its indeterminacy implies not only a lack of conceptual clarity but also legal uncertainty within the system. [ABSTRACT FROM AUTHOR]

The aim of this essay is to describe the (non)observance of state obligations regarding the legal security of housing awarded through the Great Housing Mission Venezuela (GHVV). The review is carried out from the human rights-based approach (HRBA) because it places people as rights holders and the State as the main bearer of obligations. International transfers of personal data have been challenging for companies in recent years, in particular, from Europe to the US. The lack of legal certainty that decisions on the matter have caused, has increased the regulatory risks inherent to international transfers of data to third countries that have no adequacy decision. El ensayo analiza el concepto de seguridad jurídica cuestionando la generalizada asunción de que la seguridad jurídica sea una cuestión de predictibilidad. La seguridad jurídica, se argumenta, no es una cuestión de mera predictibilidad de los resultados de las decisiones judiciales, sino más bien una cuestión atinente a la correcta identificación de las consecuencias jurídicas de un determinado caso. Teniendo en cuenta esta aclaración, el ensayo ofrece un tentativo escrutinio acerca de cuál es el lugar de la seguridad jurídica en la teoría y en la práctica del Estado constitucional.

La evolución tecnológica que se ha presentado en la sociedad mexicana y el resto del mundo, en las últimas décadas, obliga a realizar cambios en las conductas humanas, ya sea de forma voluntaria u obligada. En materia fiscal la autoridad competente ha implementado la tecnología como herramienta en el cumplimiento de las obligaciones fiscales, por parte de los contribuyentes. Tal es el avance de la fiscalidad electrónica, que incluso se ha adoptado el modelo en la defensa del contribuyente. Sin embargo, en la misma medida del avance tecnológico, se han dejado atrás principios elementales como lo son la certeza jurídica, legalidad y por supuesto seguridad jurídica.

Ronald Dworkin y H.L.A. Hart han mantenido un debate sobre los fundamentos del Derecho que ha perdurado y, medio siglo después de su inicio, aún sigue abierto entre sus seguidores. Por una lado, se proclama la suficiencia del derecho normado, por otro la necesidad de que se justifique en principios superiores. Este debate resulta de especial interés en la era del relativismo, en la que el ser humano busca respuestas a la preguntas que fundamentan su civilización. En el Derecho español, y muy especialmente en el Derecho Civil, simultáneamente se ha desarrollado una controversia paralela entre dos formas distintas de entender el Derecho, una fundada en la sacrosanta seguridad jurídica y otra en la supremacía de la justicia a través de cláusulas generales. Es también un debate abierto, si bien tanto en el ámbito del Common Law, como en el Derecho español prima el positivismo y la seguridad jurídica sobre la noción de justicia. Ante la imposibilidad de cerrar estos debates, termina este trabajo con una propuesta para buscar vías alternativas que puedan guiar la aplicación del Derecho en el camino hacia la justicia

Actualmente, la SUNAT continúa enfocada en mantener un desempeño rígido de su función fiscalizadora. A pesar de poseer herramientas y medios para intercambiar información con las autoridades aduaneras de todo el mundo, realiza lánguidos esfuerzos para facilitar la acreditación de la expedición directa y el acogimiento a los beneficios arancelarios por parte de los importadores. En el presente artículo, el autor analiza que la postura que ha adoptado la SUNAT entorpece el transporte de las mercancías en las actividades de importación. Asimismo, reflexiona acerca de la incertidumbre que existe en la delimitación de competencia para emitir opinión técnica entre la SUNAT y el MINCETUR.

El principio de fe pública registral ha vuelto a estar en boca de todos a raíz de la sentencia del tercero de buena fe del Tribunal Constitucional peruano. Si bien se reafirmó su constitucionalidad, el principio de fe pública registral sufrió un enorme cambio que da pie a la pregunta ¿todavía existe el principio de fe pública registral? En el presente artículo, el autor resume el accidentado recorrido del principio de fe pública registral en el Perú y su concepción al día de hoy, recordando su fundamento teórico y práctico, y realizando una crítica a su concepción actual.

En países como Colombia, donde coexisten en el territorio múltiples actores armados legales e ilegales que impiden el monopolio de las armas por parte del Estado, las Fuerzas Militares han dejado de ser ultima ratio y se encuentran legitimadas por el discurso de la seguridad internacional para actuar contra amenazas que no siempre atentan contra la soberanía y la seguridad nacional y que, por tanto, están ubicadas fuera del ámbito del Derecho Internacional Humanitario (DIH), y a su vez no tienen un amparo en el ordenamiento jurídico interno, por ejemplo, para el uso de la fuerza letal. Este artículo se centra en analizar la tensión que genera en el orden interno la incorporación de las amenazas construidas por este discurso de la seguridad internacional, en particular en el caso del accionar de las Fuerzas Militares contra los grupos armados vinculados con el crimen organizado, donde el uso de la fuerza letal puede derivar en vulneraciones a los derechos humanos y falta de seguridad jurídica para los miembros de la Fuerza Pública.

El precedente jurisprudencial en el derecho ecuatoriano debe ser analizado desde su ámbito de aplicación en las sentencias de la Corte Constitucional. Por ello el objetivo será analizar los alejamientos ilegítimos entre los fallos emitidos por esta alta Corte. Se considera además desde una perspectiva jurisprudencial y normativa el derecho a la seguridad jurídica, mismo puede ser vulnerado por el desviamiento injustificado que en ocasiones ha realizado la Corte de sus propios precedentes; sin que esta actuación se encuentre debidamente motivada y fundamentada. Lo anterior ocasiona que no exista certeza de los criterios que aplicará el foro constitucional en sus decisiones, lo que genera desconfianza en el sistema de justicia constitucional.

Este artículo pertenece a la sección monográfica "Derecho y confianza” El libro del profesor Tommaso Greco La legge della fiducia destaca por la originalidad y actualidad de su planteamiento, ya que representa un cambio de rumbo en los estudios sobre el significado de la legislación en la hora presente. Frente a la tendencia, predominante en los últimos años, de aludir a la crisis de la ley, el profesor Greco defiende la confianza en la ley, siempre que se trate de una ley merecedora de confianza. Tres son las razones que hacen digna de confianza intelectual la propuesta teórico-jurídica que Tommaso Greco nos expone en su libro. La primera, hace referencia al pasado, Se trata de la vexata quaestio de si la ley debe basarse en el optimismo o en el pesimismo antropológico. La segunda se inscribe en el presente por su idoneidad para fortalecer la garantía de dos valores básicos que sustentan a las sociedades democráticas: la educación cívica y la seguridad jurídica. La tercera posee una vocación de futuro, ya que concierne al papel de la ley en la sociedad tecnológica y a las proyecciones de la Inteligencia Artificial en la producción legislativa.

El tratamiento doctrinal y jurídico del deslinde urbano en Cuba es defectuoso y genera inseguridad en la protección de la relación jurídica real. La ley sustantiva vigente posibilita el ejercicio de este derecho por los propietarios mediante acuerdo; sin embargo, la autorización del deslinde es facultad atinente a la administración, persistiendo el desapoderamiento del titular. El objetivo este artículo es fundamentar teórica y normativamente el deslinde inmobiliario urbano en Cuba para el logro de una protección adecuada de la relación real inmobiliaria y su tráfico jurídico. Los métodos de la investigación utilizados son el análisis-síntesis e inductivo-deductivo, el análisis jurídico comparativo, el hermenéutico, el exegético jurídico y la observación científica indirecta. La construcción teórica-jurídica del deslinde inmobiliario urbano constituirá un soporte para el perfeccionamiento, interpretación y aplicación en el derecho patrio de esta institución jurídica civil, sustituyendo las deficiencias en el marco de la protección de la relación jurídica real inmobiliaria, en pos de ofrecer mayor seguridad en el tráfico jurídico. La determinación de las lindes de las heredades contiguas puede realizarse mediante acuerdo privado, que debe elevarse a público ante notario como negocio escriturado; lo cual propicia la rectificación de los títulos de propiedad y su inscripción registral.

Las personas tienen la dificultad de conocer, identificar y comprender las disposiciones normativas, las cuales al ser abundantes coexisten con la jurisprudencia zigzagueante, la doctrina, entre otros insumos cognitivos jurídicos. En atención a ello, la presente investigación tiene el propósito de intentar superar el problema de la cognoscibilidad del derecho a través de dos aplicaciones prácticas de inteligencia artificial —sistemas expertos jurídicos informativos y sistemas cognitivos—, a fin de procurar que las personas tengan mejores condiciones de acceso, identificación y comprensión del derecho, y así orientar adecuadamente sus conductas. Este escenario logra configurar una nueva interacción entre la información jurídica y las personas, a efectos de alcanzar una mayor cognoscibilidad del derecho como estado ideal de la seguridad jurídica.

Dentro del análisis de la diversidad y multiplicidad de procedimientos y procesos sancionatorios que existen en el Perú, en el caso no tan hipotético de que se haya ventilado un caso o hecho, primero administrativamente, que concluya con una sanción disciplinaria y, a posteriori, en el ámbito penal privativo (castrense), y consecuentemente en el fuero común u ordinario, es factible que, en materia penal, por la existencia de mecanismos procesales de persecución, se sancione a un sujeto que cometió una infracción, y que sea motivo suficiente para que un mismo hecho pueda ser objeto de una regulación sancionadora administrativa y de otra índole penal privativa y penal común u ordinaria. En este escenario, el principio de ne bis in idem es una garantía básica que rodea a todo proceso sancionatorio, y que admite solo una posibilidad de un segundo proceso, a través de una revisión de sentencia, ya que el objetivo de dicho proceso es preservar la necesidad de consolidar un derecho y los principios como el que se ha investigado, a fin de evitar alguna injusticia. Así, pues, a través de este principio se busca lograr que un Estado de derecho disipe la incertidumbre y se sostenga dentro de una seguridad jurídica y respeto por el ciudadano y su dignidad, como base fundamental del mismo Estado y su organización social.
