1. Navigating entangled terrain: The Supreme Court's impact and the dismissal powers of human rights tribunals

Abstract

The human rights justice system is a politically and legally complex area to navigate with legislative changes and judicial decisions shaping the administration and governance of human rights policies. This article provides a comprehensive examination of the complexities and intricacies of this system by measuring the impact of judicial rulings on the discretionary decision-making of the Ontario Human Rights Tribunal (HRTO). The impact of the Supreme Court of Canada's relevant jurisprudence in Figliola and Penner on the HRTO's discretionary powers to dismiss claims pursuant to section 45.1 of the Ontario Human Rights Code is measured by examining the outcomes of decisions made by the Tribunal. The article presents new empirical data on all early dismissal decisions (N = 1479) from 2008 to 2021 and demonstrates the effects of the Supreme Court's rulings in Figliola and Penner. The findings in this article reveal that both Figliola and Penner had significant impacts on the Tribunal's discretionary decision-making powers. Le systeme de justice des droits de la personne est un domaine politiquement et juridiquement complexe a naviguer, compte tenu des changements legislatifs et des decisions judiciaires qui faconnent l'administration et la gouvernance des politiques des droits de l'homme. Cet article examine de maniere exhaustive les complexites et subtilites de ce systeme en mesurant l'impact des decisions judiciaires sur la prise de decision discretionnaire du Tribunal des droits de la personne de l'Ontario (TDPO). Les repercussions de la jurisprudence pertinente de la Cour supreme du Canada dans les affaires Figliola et Penner sur les pouvoirs discretionnaires du TDPO consistant a rejeter les demandes en vertu de l'article 45.1 du Code des droits de la personne de l'Ontario, sont mesurees en etudiant les resultats des decisions rendues par le Tribunal. L'article presente de nouvelles donnees empiriques sur toutes les decisions de rejet anticipe (N = 1479) de 2008 a 2021 et demontre les consequences des decisions de la Cour supreme dans les cas Figliola et Penner. Abstract

Planetary exploration relies considerably on mineral characterization to advance our understanding of the solar system, the planets and their evolution. Thus, we must understand past and present processes that can alter materials exposed on the surface, affecting space mission data. Here, we analyze the first dataset monitoring the evolution of a known mineral target in situ on the Martian surface, brought there as a SuperCam calibration target onboard the Perseverance rover. We used Raman spectroscopy to monitor the crystalline state of a synthetic apatite sample over the first 950 Martian days (sols) of the Mars2020 mission. We note significant variations in the Raman spectra acquired on this target, specifically a decrease in the relative contribution of the Raman signal to the total signal. These observations are consistent with the results of a UV-irradiation test performed in the laboratory under conditions mimicking ambient Martian conditions. We conclude that the observed evolution reflects an alteration of the material, specifically the creation of electronic defects, due to its exposure to the Martian environment and, in particular, UV irradiation. This ongoing process of alteration of the Martian surface needs to be taken into account for mineralogical space mission data analysis.

5. A fuzzy logic based approach to quality of service in 802.11b wireless networks

Abstract

A generally held view is that the bulk of the data transmitted across packet switched networks in the future will be video and audio traffic. In recent years public telecommunications carriers have replaced circuit switched networks with integrated service packet networks that support both multimedia and data. One challenge with sending multimedia data is that it is delay-sensitive. To encourage the widespread use of the INTERNET as a multimedia platform it is necessary to have a minimum level of service. Guarantees are required that ensure satisfactory end to end transmission of delay-sensitive multimedia data. In wired systems the mechanisms used to provide Quality of Service (QoS) are Connection Admission Control (CAC), Usage Parameter Control (UPC) and Multi-Priority Control (MPC). An increasing number of users are connecting to the Internet through Wireless Local Area Networks (WLANs). The most widespread standard for WLAN s is that defined in the Institute of Electrical and Electronic Engineers (IEEE) 802.11b. Wireless hotspots and local area networks using equipment working to this standard are now ubiquitous. Regrettably the 802.11b standard has no mechanisms for providing QoS across wireless channels. Users of 802.11b networks cannot rely on the same support for QoS that would be available in a fixed network. This thesis proposes the redesign of 802.11b gateways using fuzzy logic to include mechanisms that deliver Quality of Service. A fuzzy controller has been developed that implements QoS with CAC, UPC and MPC. This controller was optimised for 802.11b WLANs. Fuzzy logic has been used as a control mechanism for each QoS component. It converts imprecise human observations to crisp outputs for computer processing. With fuzzy logic it is possible to enhance performance at various points in the packet transmission process. Fuzzy feedback control regulates admissions to the network (CAC) preventing a link from becoming saturated. Once an admission is made, a fuzzy controller smoothes individual flows (UPC). Traffic flows are classified and prioritised by class and then sent to the designated queue for that given class (MPC). A fuzzy packet scheduler regulates packet transfer through each wireless gateway. In this research, experiments have been carried out in real-time with CAC, UPC and MPC using fuzzy controllers for multimedia transmission over 802.11b. The results have been successful, with faster response times and throughput despite having lower processing requirements.

11. Segmentación multi-modal de imágenes RGB-D a partir de mapas de apariencia y de profundidad geométrica

Abstract

Classical image segmentation algorithms exploit the detection of similarities and discontinuities of different visual cues to define and differentiate multiple regions of interest in images. However, due to the high variability and uncertainty of image data, producing accurate results is difficult. In other words, segmentation based just on color is often insufficient for a large percentage of real-life scenes. This work presents a novel multi-modal segmentation strategy that integrates depth and appearance cues from RGB-D images by building a hierarchical region-based representation, i.e., a multi-modal segmentation tree (MM-tree). For this purpose, RGB-D image pairs are represented in a complementary fashion by different segmentation maps. Based on color images, a color segmentation tree (C-tree) is created to obtain segmented and over-segmented maps. From depth images, two independent segmentation maps are derived by computing planar and 3D edge primitives. Then, an iterative region merging process can be used to locally group the previously obtained maps into the MM-tree. Finally, the top emerging MM-tree level coherently integrates the available information from depth and appearance maps. The experiments were conducted using the NYU-Depth V2 RGB-D dataset, which demonstrated the competitive results of our strategy compared to state-of-the-art segmentation methods. Specifically, using test images, our method reached average scores of 0.56 in Segmentation Covering and 2.13 in Variation of Information., Los algoritmos clásicos de segmentación de imágenes explotan la detección de similitudes y discontinuidades en diferentes señales visuales, para definir regiones de interés en imágenes. Sin embargo, debido a la alta variabilidad e incertidumbre en los datos de imagen, se dificulta generar resultados acertados. En otras palabras, la segmentación basada solo en color a menudo no es suficiente para un gran porcentaje de escenas reales. Este trabajo presenta una nueva estrategia de segmentación multi-modal que integra señales de profundidad y apariencia desde imágenes RGB-D, por medio de una representación jerárquica basada en regiones, es decir, un árbol de segmentación multi-modal (MM-tree). Para ello, la imagen RGB-D es descrita de manera complementaria por diferentes mapas de segmentación. A partir de la imagen de color, se implementa un árbol de segmentación de color (C-tree) para obtener mapas de segmentación y sobre-segmentación. Desde de la imagen de profundidad, se derivan dos mapas de segmentación independientes, los cuales se basan en el cálculo de primitivas de planos y de bordes 3D. Seguidamente, un proceso de fusión jerárquico de regiones permite agrupar de manera local los mapas obtenidos anteriormente en el MM-tree. Por último, el nivel superior emergente del MM-tree integra coherentemente la información disponible en los mapas de profundidad y apariencia. Los experimentos se realizaron con el conjunto de imágenes RGB-D del NYU-Depth V2, evidenciando resultados competitivos, con respecto a los métodos de segmentación del estado del arte. Específicamente, en las imágenes de prueba, se obtuvieron puntajes promedio de 0.56 en la medida de Segmentation Covering y 2.13 en Variation of Information.

Abstract

The relationship amongst institutions has continued to play a pivotal role in shaping the nature of policies central to citizens and non-citizens alike. However, the phenomenon of influence and power that institutions constitutionally wield over one another in administrative agencies has been an increasing issue that is largely under-explored. More so, is the issue of installing legitimate regulatory mechanisms that ensure and preserve democratic values and practices that hold government agencies accountable. This study explores the relationship between judicial and executive institutions by examining the degree of influence the courts exercise in decisions in the Immigration and Refugee Board of Canada. Using a precedent tracing approach, this study analyzes the presence and authority of Supreme Court decisions in the determination of refugee protection cases. As administrative bodies exercise a broad range of discretion and are loosely guided by ‘soft-laws’, it is unlikely that the courts would have a high degree of influence in such agencies due to an absence of obligation to do so. The shortage of judicial influence arguably offers a nuanced explanation to the inconsistent outcomes amongst board members and the absence of and requirement for a legitimate remedial mechanism. En este artículo se presenta un estudio sobre algunas funciones para la estimación del grado relativo de enfoque de una imagen. Se propone la modificación de algunas de las funciones estudiadas para mejorar su desempeño y se desarrolla un algoritmo de búsqueda de foco para llevar a cabo enfoque automático en microscopio óptico. Se hace la implementación del algoritmo de búsqueda en un microscopio con platina motorizada en el eje Z, para obtener una total automatización del enfoque. Se describe además el sistema desarrollado para el control del movimiento de la platina del microscopio en las direcciones X, Y y Z para automatizar el proceso de adquisición de imágenes de la muestra observada. AbstractIn this paper a study of some functions for measuring the relative degree of focus of images is presented. The modification of some existing functions is proposed to improve their performance and a focus searching algorithm is developed in order to perform autofocusing. The focus searching algorithm is then implemented on an optical microscope with motorized X-Y-Z stage to achieve full automation of the focusing and image acquisition process. The description of the control system for -Y-Z movement of the stage is also presented.

Abstract

The limited depth-of-field of some cameras prevents them from capturing perfectly focused images when the imaged scene covers a large distance range. In order to compensate for this problem, image fusion has been exploited for combining images captured with different camera settings, thus yielding a higher quality all-in-focus image. Since most current approaches for image fusion rely on maximizing the spatial frequency of the composed image, the fusion process is sensitive to noise. In this paper, a new algorithm for computing the all-in-focus image from a sequence of images captured with a low depth-of-field camera is presented. The proposed approach adaptively fuses the different frames of the focus sequence in order to reduce noise while preserving image features. The algorithm consists of three stages: 1) focus measure; 2) selectivity measure; 3) and image fusion. An extensive set of experimental tests has been carried out in order to compare the proposed algorithm with state-of-the-art all-in-focus methods using both synthetic and real sequences. The obtained results show the advantages of the proposed scheme even for high levels of noise.

Everything manufactured has an impact on the environment, either by consuming unrenewable resources as raw materials, or consuming energy, or adding excess nutrients to soils and waterways, or generating greenhouse gasses, wastes or pollutants. Many environmental critics believe that the most effective way to reduce this damage is to regulate to force manufacturers to produce and distribute goods with lower environmental impacts. Others believe that consumers should be educated to demand these improvements from manufacturers. The author of this thesis believes the most effective way to persuade the private sector to reduce the environmental impacts of its products would be to convince them that this would be profitable. At this point in time, most Australian manufacturers do not believe this to be the case, otherwise there would be many more green products in the marketplace. Many marketers have a negative attitude to green marketing, while others who would like to investigate the potential of the green market lack the data to do so. The original research for this thesis takes the form of a commercial market segmentation study designed to analyse the green market and provide answers to the following questions : Which segment or segments of the Australian population are actual or potential green consumers? What are their motivations, attitudes and buying habits? What new products would they welcome in the future?
