- Abstract
Background: After the Constitutional Court's decision on the lawsuit of Paslon Anies Baswedan with Muhaimin Iskandar and Paslon Gajar Pranowo with Mahfud MD against KPU Decision Number: 360 of 2024, where Paslon Prabowo Subianto and Gibran Rakabuming Raka were elected as Paslon, there was a discourse of a coalition party that lost, choosing as the opposition in the Indonesia government system Purpose: The discourse of the opposition, it is very interesting to conduct research with the aim of whether Indonesia, which adheres to the Presidential system with the Basis of the State of Pancasila, has the right Opposition. Methods: The type of research was chosen normative juridically, with a statute approach, historical approach, analysis (Analytical Approach) and comparison (Comparative Approach). Results: The results of the study showed: (1) The Presidential System, does not recognize the existence of opposition, (2) from the perspective of Pancasila values, political parties outside the government, more elegantly named as "Deliberative Partners" than as opposition. Conclusion: The implications of the research invite the awareness of all components of the Indonesia nation, to be proud of the nation's culture that is crystallized in Pancasila, with the Indonesia Government System being a Presidential System based on Pancasila.
