El recurso a la justicia regia y la concordia fiscal es, en nuestra opinión, un excelente índice para mostrar la funcionalidad del sistema en esa época y la integración de la nobleza en el estado, frente a las resistencias de los vasallos señoriales. À Carcassonne, le château médiéval se présente toujours comme un réduit défensif au sein de l’ensemble urbain constitué par la Cité, à proximité de l’axe de circulation qui relie le monde aquitain et le monde méditerranéen. Les origines de la forteresse restent obscures mais les recherches récentes montrent qu’elles s’enracinent dans le haut Moyen Âge et qu’un site castral devait faire office de chef-lieu à la tête d’un pagus carolingien : le Carcassés. Du point de vue monumental, la phase la plus ancienne du château, ou phase comtale antérieure au XIIe siècle, reste la plus méconnue. Elle a dû être largement perturbée et transformée, à partir de 1125, par un ensemble castral sous l’égide de la lignée des Trencavel, famille féodale devenue quasiment souveraine, stratégiquement positionnée face aux deux puissants blocs toulousain et barcelonais. Seule la croisade albigeoise a eu raison des vicomtes Trencavel, en s’emparant de Carcassonne et en ouvrant la voie au roi de France qui fait du château le siège d’une sénéchaussée dès 1226. À cette phase royale, doit être rattachée l’enceinte du château, toujours visible aujourd’hui, mise en place vers le milieu du XIIIe siècle. Non loin de la frontière méridionale du royaume de France face au royaume d’Aragon, le château et la Cité de Carcassonne acquièrent un statut stratégique d’importance mais remis en cause en 1659 par le Traité des Pyrénées. Promises à l’abandon, les fortifications carcassonnaises connaissent une nouvelle fonction à partir du XIXe siècle, celle de Monument historique, étudié et restauré par Eugène Viollet-le-Duc et son successeur. The mediaeval castle in Carcassonne continues to stand out as a defensive reduit (fortified structure) within the urban enclave of the Cité, close to the traffic artery linking the Aquitaine and Mediterranean worlds. The origins of the fortress remain unclear, but recent research shows them to be rooted in the early Middle Ages and that a castral site was to serve as the administrative centre at the head of a Carolingian pagus - the Carcassés (pagus Carcassensis). In terms of monuments, the oldest part of the castle, built by the Counts before the 12th century, is the least known. It must have been extensively disrupted and transformed, from 1125 onwards, by a fortress under the auspices of the Trencavel line, a feudal family that had become virtually sovereign and was strategically positioned with respect to the two powerful fiefdoms of Toulouse and Barcelona. Only the Albigensian Crusade managed to overcome the Viscounts Trencavel, by seizing Carcassonne and paving the way for the King of France to make the castle the seat of a senechal in 1226. This royal phase saw the building of the castle walls, still visible today, towards the middle of the 13th century. Not far from the southern border of the Kingdom of France, across from the Kingdom of Aragon, the castle and Cité of Carcassonne acquired a strategically important status that was somewhat negated in 1659 by the Treaty of the Pyrenees. Destined to be abandoned, the Carcassonne fortifications were given a new role in the 19th century, becoming a Historical Monument, studied and restored by Eugène Viollet-le-Duc and his successor.

In the aftermath of the Hundred Years’ War, the King of France, winner by arms in 1453, displays a policy, a speech, a legislative activity, in order to perpetuate peace. Much attention is paid to the restoration of judicial institutions, which contribute to the redefinition of the jurisdictional geography of a kingdom divided for many years. In this context appears a forgotten institution, which had not been mobilized for nearly half a century: the grands jours, consisting in sending for a few weeks of a group of councilors of the Parliament of Paris in a city chosen by the King, to judge on the spot rather than in Paris the appeals for a determined area. Between 1454 and 1459, seven sessions are held in Poitiers, Thouars, Montferrand and Bordeaux, then disappear again from the institutional landscape for more than twenty years. The grands jours appear in this mid-fifteenth century as a political instrument in formation, in a moment of change in both the history of the kingdom of France and in the history of the institution. This instrument allows an intensification of the judicial policy of royalty and the resumption of a judicial relationship between the king, his representatives and his subjects., Au lendemain de la guerre de Cent ans, on observe le roi de France, vainqueur par les armes en 1453, déployer une politique, un discours, une activité législative destinés à pérenniser la paix. Une grande attention est alors prêtée à la restauration des institutions judiciaires, lesquelles participent de la redéfinition de la géographie juridictionnelle d’un royaume longtemps divisé. C’est dans ce contexte qu’est mobilisée une institution oubliée de la royauté depuis près d’un demi-siècle : les grands jours, qui consistent en l’envoi pour quelques semaines d’un groupe de conseillers du parlement de Paris dans une ville choisie par le roi, pour y juger sur place plutôt qu’à Paris les appels pour un ressort déterminé. Entre 1454 et 1459, sept sessions sont tenues à Poitiers, Thouars, Montferrand et Bordeaux, puis disparaissent à nouveau du paysage institutionnel pour plus de vingt ans. Les grands jours apparaissent en ce milieu du XVe siècle comme un instrument politique en formation, dans un moment de basculement à la fois dans l’histoire du royaume de France et dans l’histoire de l’institution. Cet instrument permet une intensification de la politique judiciaire de la royauté et la reprise d’une relation judiciaire entre le roi, ses représentants et ses sujets.

En el contexto preconstituyente gaditano, Sevilla reclama a la Junta Central la restitución de su "constitución política y jurisdiccional", que entiende destruida por las recientes prescripciones regias. La ciudad parece ignorar deliberadamente que sus privilegios jurisdiccionales se habían visto definitivamente mermados con el proceso de institucionalización de la Real Audiencia de Sevilla. En la exposición consistorial se argumenta que tos privilegios judiciales de la ciudad, confirmados por el conocido como Privilegio de Bruselas de 1556, habrían tenido una vigencia sin solución de continuidad hasta ese momento. Sin embargo, el análisis de las Ordenanzas reguladoras de la Audiencia de Sevilla desvela que la pérdida del estatuto privilegiado de la ciudad fue el precipitado de una serie de reformas regias consolidadas desde mediados del siglo XVI. In the preconstitutional context of Cádiz, Seville claims to the Central Junta the restitution of his "political and jurisdictional constitution", which the city understands destroyed by the recent royal prescriptions. The city seems to ignore deliberately that its jurisdictional privileges had been definitively reduced by the process of institutionalisation of the Royal Court of Seville. It is argued in the consistorial report that the judicial privileges of the city, confirmed by the acquaintance as Privilege of Brussels of 1556, would have been in force without solution of continuity up to that moment. Nevertheless, the analysis of the regulatory Ordinances of the Court of Seville reveals that the loss of the privileged statute of the city was the cause of a series of royal reforms consolidated from mid. 16th c.
