Analisa de maneira crítica o filme Coringa pela perspectiva do princípio jurídico da fraternidade. Verifica o desenvolvimento da ideia de fraternidade no seio das sociedades, abordando os seus fundamentos e principais características. Aborda o princípio da fraternidade como dever jurídico. Debate as desigualdades sociais e a falta de eficiência estatal, tratando sobre as especificidades da sociedade brasileira. Destaca fraternidade como caminho para a concretização da dignidade humana e para a redução dos efeitos causados pelas exageradas desigualdades sociais e de oportunidades.

O direito civil-constitucional vem apresentando-se como instrumento reedificante das fronteiras do direito civil, fortalecendo a proteção aos valores existenciais, assim, o juízo de merecimento de tutela coloca-se como uma instância positiva de legitimação dos atos privados à luz dos valores da ordem jurídica unitária. A metodologia utilizada é bibliográfica, jurisprudencial, pura, descritiva e exploratória. Concluiu-se que a correta aplicação do juízo de merecimento de tutela, quando da colisão entre o direito à privacidade e o direito à informação, no caso concreto, conferirá tutela preferencial ao direito à autodeterminação informativa, por melhor realizar os valores presentes na ordem jurídica como um todo, ao passo que é consentâneo à proteção do princípio jurídico da dignidade da pessoa humana.Palavras chave: Sociedade da Informação. Direito à privacidade.AbstractThe right to privacy, in its dynamic aspect, as a right to informational self-determination, will come into collision with the right of access to information, when it should be promoted an evaluative judgment in order to gauge the interest worthy of protection. The civil and constitutional rights have been presenting itself as a rebuilding instrument the boundaries of civil law, strengthening the protection of existential values, this way, the judgment of guardianship worthiness arises as a positive instance of legitimization of private acts in the light of the unitary legal order values. The methodology used is bibliographical, case law, pure, descriptive and exploratory. It was concluded that the correct application of the merit judgment of guardianship, when the collision between the right to privacy and the right to information, in this case, grant preferential protection of the right to informational self-determination, to better achieve the values in legal system as a whole, while it is consistent to the protection of the legal principle of human dignity.Keywords: Information Society. This article intends to analyze the imposition of the regime of legal good’s separation, provided for in article 1.641, II, of the 2002 Brazilian Civil Code, from a contemporary per spective, seeking a systematic interpretation, considering the Federal Constitution of 1988, the Statute of the Elderly and Changes in civil capacity recently introduced by the Disabled Per sons Statute. It begins with a contextualization of the perception about aging, from the last cen tury to the present. It is also considers the civil capacity in the Brazilian legal system. The text analizes the regime of compulsory separation of assets, imposed on the elderly over 70 years of age, concluding for the need for its repeal. O artigo pretende analisar a imposição do regime de separação legal de bens, disposto no artigo 1.641, II, do Código Civil de 2002, sob uma perspectiva contemporânea, buscando uma interpretação sistemática, considerando a Constituição Federal de 1988, o Estatuto do Idoso e as alterações no âmbito da capacidade civil introduzidas recentemente pelo Estatuto da Pessoa com Deficiência. Para tanto, inicia-se com contextualização da percepção sobre o envelhecimento a partir do século passado até o presente momento. Em seguida, pondera-se acerca da capacidade civil no ordenamento jurídico brasileiro. Finaliza-se com a análise do regime de separação obri gatória de bens imposto ao idoso maior de 70 anos de idade, concluindo-se pela necessidade de sua revogação.

This article tries to discuss the institution of timeshares. After apresentation of how this conception has evoluted among the different concepts of private property, the issue located the discussion of timeshares on European law, since the second half of the 19th. century, regarding the rights that can be atributed in favour of its owners, and which theories of its juridical nature that can be imputed to it. Also it will be discussed about possible reception of timeshares by the Brazilian law system. O objetivo deste artigo é abordar o instituto da multipropriedade (timeshares), iniciando pela apresentação de uma breve indicação da evolução do conceito de propriedade privada para, em seguida, abordar a origem da multipropriedade (timeshares) no direito europeu na segunda metade do século passado, a indicar as teorias a respeito da natureza jurídica que lhe podem ser aplicadas, os poderes e as limitações atribuídas aos titulares do direito de multipropriedade imobiliária, concluindo por analisar a possibilidade de adoção de tal instituto pelo direito brasileiro.

O artigo aborda a evolução constitucional do controle difuso de constitucionalidade no Brasil desde a primeira Constituição Republicana até a Emenda Constitucional n 45/2004, bem como a legitimidade, os órgãos competentes para executarem tal forma de controle, os efeitos da declaração incidental de inconstitucionalidade, o papel do Senado Federal na suspensão da execução de lei declarada inconstitucional e a exigência da comprovação da repercussão geral nos recursos extraordinários para o controle difuso da constitucionalidade.

The right to a preserved cultural patrimony is formed by cultural values, which object to be protected is the meaning of such values to ethnical groups, their memories and identity. As such, cultural patrimony is a right and a garantee, since it is linked to the dignity of the human being, basis of the Brazilian republic. O direito ao patrimônio cultural preservado é formado por bens culturais, cujo objeto a ser tutelado é o valor que se traduz dos fatos relativos à memória e à identidade dos grupos étnicos formadores da sociedade brasileira, sendo, assim, um direito e uma garantia fundamental do cidadão na proporção em que a preservação da identidade e da memória do individuo atende ao princípio da dignidade da pessoa humana, base da Republica Federativa do Brasil.

Tombamento (a sort of governamental heritage trust) is a legal, Constitution based procedure used in order to preserve cultural goods which compose Brazil´s cultural heritage. Its origin remains back to the first quartel of 20th XX Century . There are several doctrinal streams which justify the legal nature of tombamento, from one that considers it as a administrative servitude, either an sui generis institue, as State´s domain or as a administrative limitation to Property Right. The administrative limitation understanding of Property Right seems to be the most acceptable, as it conforms itself with the Constitutional principle of propriety´s social function. Accordinily, its owner should atain in behalf of its faculties to the prevail of colective interest, outside of any further indenization. O tombamento é um instrumento jurídico, com sede constitucional, utilizado para preservar os bens culturais formadores do patrimônio cultural brasileiro, cuja origem no ordenamento jurídico nacional remonta ao primeiro quartel do século XX. Há diversas correntes doutrinárias para justificar a natureza jurídica do tombamento, desde a que o considera como uma servidão administrativa, um instituto sui generis, um domínio iminente do Estado ou uma limitação ao direito administrativa ao direito de propriedade. O entendimento no sentido de considerar o tombamento como uma limitação administrativa ao direito de propriedade demonstra ser o mais aceitável, vez que conforma-se com o principio constitucional de que a propriedade privada deve atender a uma função social e, desta forma, seu titular deverá, no exercício de suas faculdades, ter com primado o interesse coletivo, independentemente de indenização.

In this regard, the general concept of this right, which relates solely to the notion of the right to data protection, modified, mainly because of the technological phase and the social context of the different eras. Since the beginning of the coronavirus pandemic (covid-19), the right to privacy has become a central issue because, in an effort to control the progression of the disease, countries have implemented measures such as the use of masks and social isolation. At the same time, countries monitored the geographical situation of citizens in order to keep up with the rate of population adhesion to isolation. Consequently, personal data were (and still are) used to fight the pandemic. In Brazil, the situation did not differ. At first, however, the governments of the states of Brazil developed and implemented public policies to address the pandemic in isolation, given the lack of direction from the federal government. The Supreme Court in the Direct Action of Unconstitutionality No. 6.341/2020 trial subsequently endorsed this situation. From this point of view, the question arises: did states respect the right to data protection when developing and implementing public policies to address covid-19 developments in Brazil? More specifically, were selected the states of São Paulo, Ceará and Rio de Janeiro, since, at the beginning of the pandemic in Brazil, they were the ones that presented the most serious situation, in addition to the fact that the first official case of the country occurred in São Paulo. For the analysis of public policies, the General Data Protection Law was used, which, although not yet in force, was already used as an axiological criterion for solving problems involving the processing of personal data. To answer the question-problem, this study resorted to bibliographical, documentary, pure, exploratory and qualitative research. This research evidenced that, in the implementation of the public policies, the states did not comply with the provisions of the General Data Protection Law, and so there was no respect for the right to data protection. Por influência, sobretudo, do estágio tecnológico e do contexto social das diferentes épocas, passou da ideia de ser deixado só ao direito à proteção de dados, noção mais ampla e dinâmica. Com o início da pandemia causada pela COVID-19, esse direito passou a ocupar o debate central. Isso se deu porque, com o objetivo de controlar o rápido avanço da doença, os países implementaram medidas como o uso de máscara e o isolamento social. Aliado a isso, realizaram também o monitoramento da localização geográfica dos cidadãos, de modo a acompanhar o índice de adesão da população ao isolamento. Assim, de maneira evidente, os dados pessoais foram, e ainda são, utilizados para o enfrentamento à pandemia. No Brasil, a situação não foi diferente. Todavia, inicialmente, os estados elaboraram e implementaram políticas públicas de combate à pandemia de maneira isolada, ante a ausência de orientação do Governo Federal, situação que depois foi referendada pelo STF no julgamento da ADI 6.341/2020. Nessa perspectiva, surge o questionamento: os estados respeitaram o direito à proteção de dados na elaboração e colocação em prática das políticas públicas de enfrentamento ao avanço da COVID-19 no Brasil? Mais especificamente, foram selecionados os estados de São Paulo, Ceará e Rio de Janeiro, uma vez que, no início da pandemia no Brasil, foram os que apresentaram situação mais grave, além do fato de que o primeiro caso oficial do País ocorreu em São Paulo. Para análise das políticas públicas, foi utilizada a Lei Geral de Proteção de Dados, que, embora ainda não estivesse em vigor, já era utilizada como critério axiológico para a solução de questões envolvendo o tratamento de dados pessoais. Com o fim de responder à pergunta-problema, utilizou-se pesquisa bibliográfica, documental, pura, exploratória e qualitativa. Concluiu-se que, na implementação das políticas públicas analisadas, os estados não obedeceram aos dispositivos da Lei Geral de Proteção de Dados, de modo que não houve o devido respeito ao direito à proteção de dados. No. of bitstreams: 0 Previous issue date: 2021-11-30 This study conducted a survey of Law No. 13,465/17 in the role of urban land regularization as a way of realizing fundamental rights, indicated the evolution of this normative instrument in title to individuals and verified whether the current role of the property registration activity would be to offer a higher legal security to protect and enhance the assets of individuals in the face of the complexities of today's society. Thus, it was also verified the correlation between the registration of regularization and the possibility of creating new fundamental rights based on access to credit at lower interest rates. The research used two methodological axes, a theoretical axis based on a systemic literary review and an empirical axis with a descriptive and qualitative approach, but which used some secondary data from IPECE and IBGE. Thus, it was observed how the legal, urban and environmental measures of the aforementioned instrument can achieve their purpose in the realization of rights. Thus, this study observed the possibility of implementing the fundamental right to decent housing, which encompasses the regularization and registration of the property as an instrument for the construction of a second-dimensional Fundamental Right in order to guarantee the existential minimum. Thus, this research therefore analyzed the role of the real estate registry office and what benefits it offers to the individual, society and the State, especially in the registration of urban land tenure regularization. Furthermore, he also observed the position of the municipal entity in face of the Constitution's promises in the democratic rule of law to offer decent housing and pointed out ways to optimize urban land tenure regularization in society. Therefore, the study aimed to indicate the relevant function and benefits of the registration of land regularization in the land registry office, as well as what proposals can be made to optimize the capacity of the municipal entity to realize these fundamental rights even in the face of a budget constraint that exists in fiscal states. O presente estudo realizou uma pesquisa da lei nº 13.465/17 na atuação da regularização fundiária urbana como forma de concretizar direitos fundamentais, indicou a evolução desse instrumento normativo, em titular os indivíduos, e verificou se o atual papel da atividade de registros de imóveis estaria em oferecer uma segurança jurídica mais elevada para resguardar e valorizar o patrimônio dos indivíduos diante das complexidades da atual sociedade. Assim, ainda, foi verificada a correlação do registro da regularização e a possibilidade da criação de novos direitos fundamentais com base no acesso ao crédito com juros mais baixos. A pesquisa utilizou dois eixos metodológicos, um eixo teórico, com base numa revisão literária sistêmica, e uma eixo empírico, com uma abordagem descritiva e qualitativa, mas que utilizou alguns dados secundários do IPECE e IBGE. Dessa maneira, foi observado como as medidas jurídicas, urbanísticas e ambientais do referido instrumento podem alcançar o seu propósito na concretização de direitos. Dessa forma, o presente estudo observou a possibilidade da efetivação do direito fundamental de moradia digna que engloba a regularização e registro do imóvel como um instrumento de construção de Direito Fundamental de segunda dimensão, a fim de garantir o mínimo existencial. Destarte, a presente pesquisa analisou, portanto, a função do cartório de registro imobiliário e quais benefícios que oferece ao indivíduo, sociedade e Estado em especial no registro da regularização fundiária urbana. Ademais, observou, ainda, a postura do ente municipal diante das promessas da Constituição no estado democrático de direito em oferecer uma moradia digna e apontou caminhos de otimização para que a regularização fundiária urbana possa ser concretizada na sociedade. Portanto, o estudo teve por finalidade indicar qual a relevante função e benefícios do registro da regularização fundiária no cartório de registro de imóvel, bem como quais propostas podem ser feitas para se otimizar a capacidade do ente municipal em concretizar esses direitos fundamentais, mesmo diante de uma restrição orçamentária que existe nos estados fiscais. No. of bitstreams: 0 Previous issue date: 2021-02-23 The dissertation entitled ¿Effectiveness of the right-duty to protect the environment in the light of Precedent No. 613 of the STJ: the principle of ecological integrity in the context of judicial governance¿, now presented to the UNIFOR¿s Constitutional Law Post-graduation Program, is included in Public Constitutional Law and Political Theory concentration field and in the Human Rights research line. It is the result of investigations carried out with the research group Economic, Political, Legal and Environmental in Latin America. The study aims to contribute to the dialogue concerning the challenges of realizing the fundamental right to the ecologically balanced environment based on the understanding set out in Precedent No. 613 of the STJ, according to which the theory of fait accomplishment in environmental matters is not admitted. To this end, we investigate the scenario in which the edition of the aforementioned issue is inserted, under the focus of the global ecological crisis and of the proposals that emerged in the sense of building sustainable alternatives to the modes of production and human life, standing out the transition from an anthropocentric to an ecocentric paradigm. Furthermore, the nature and main characteristics of the right-duty of environmental protection are examined in the Federal Constitution of 1988. Then, the impacts of the summary statement on property rights are analyzed, especially with regard to the fulfillment of its socio-environmental (or eco-social) function. Finally, the contents, scope and repercussion of the summary in the scope of national jurisprudence are appreciated, in the period between its publication and the conclusion of this work. The research question consists of asking what perspectives for the realization of the right to an ecologically balanced environment arise in the light of Precedent No. 613 of the STJ. Such questioning is justified because the compatibility of constitutional guarantees with property and environmental protection constitutes a challenge to the Law, with the academy having a prominent role in the study of this problem and in the construction of legal solutions for the effective protection of the environment in a risk society contemporary. As for the methodology, the research has a doctrinal and documental source, based on which an exploratory study is developed on doctrinal concepts that involve the fundamental right-duty of protecting the environment and its implications for the rights related to the use and exploitation of property (or possession). A qualitative and theoretical-critical approach is undertaken, as it returns to knowledge and discussion of the effects of Precedent No. 613 of the STJ. Using the deductive and systemic method, the content and scope of that statement are evaluated from the main precedents that justified its edition, as well as the context of the ecological judicial governance in which it is inserted. Gathering theory and praxis, a jurisprudential examination is also carried out in order to investigate the repercussion of the summary parameter for the realization of the right-duty of environmental protection, achieving, as a result, perception about its contribution to the materialization of the principle of ecological integrity, contained in art. 225, §1, I and VII, of CF/88, which gives legal viability to the recognition of the Rights of Nature in Brazil. Tal questionamento justifica se em razão de que a compatibilização das garantias constitucionais à propriedade e à proteção ambiental constitui desafio ao Direito, possuindo a academia destacado papel no estudo dessa problemática e na construção de soluções jurídicas para a efetiva proteção do ambiente na sociedade de risco contemporânea. Quanto à metodologia, a pesquisa possui fonte doutrinária e documental, com base na qual se desenvolve estudo de caráter exploratóri o acerca de conceitos doutrinários que envolvem o direito dever fundamental de proteção ao meio ambiente e suas implicações ao s direitos relativos ao uso e exploração da propriedade (ou posse). No. of bitstreams: 0 Previous issue date: 2021-01-20 The present research, entitled ¿Civil liability for the presumption of causality and the risk of development: a possible solution for the realization of damage repair in the risk society?¿, Discussed the impacts of the risk society on civil liability, under the perspective of the formation of a filter based on the causal link, considering the possibilities of presumptions and legal adaptations, from the Brazilian doctrinal and jurisprudential context. In view of the emergence of new damages that demand a solution, which result from technological and scientific development, the objective was to analyze the supplier's responsibility for development risks and the possibility of applying the presumption of causality when it becomes costly or even impossible for the victim of the damage to prove the causal link, as a way of putting into practice the constitutional principles of human dignity and social solidarity. The methodology used consisted of an investigative discursive analysis, based on doctrine and jurisprudence relevant to the matter, with the aim of improving the theme. From all that was studied, the possibility of applying the presumption of causality in situations that demand a great effort for the victim was seen as a result, especially in the hypothesis of development risks, based on a probabilistic judgment. Probabilistic Judgment A presente pesquisa, intitulada de ¿Responsabilidade civil por presunção de causalidade e o risco do desenvolvimento: uma possível solução para a concretização da reparação de danos na sociedade de risco?¿, discorreu sobre os impactos da sociedade de risco na responsabilidade civil, sob a perspectiva da formação de um filtro baseado no nexo de causalidade, considerando as possibilidades de presunções e adaptações jurídicas, a partir do contexto doutrinário e jurisprudencial brasileiro. Em vista do surgimento de novos danos que demandam uma solução, os quais decorrem do desenvolvimento tecnológico e científico, objetivou-se analisar a responsabilidade do fornecedor quanto aos riscos do desenvolvimento e a possibilidade de se aplicar a presunção de causalidade quando se tornar oneroso ou até impossível para a vítima do dano comprovar o liame causal, como uma forma de efetivar os princípios constitucionais da dignidade da pessoa humana e da solidariedade social. A metodologia empregada consistiu na análise discursiva investigativa, com alicerce na doutrina e na jurisprudência pertinente à matéria, com o fito de aprimorar o tema posto. No. of bitstreams: 0 Previous issue date: 2020-09-29 The International Convention on the Rights of Persons with Disabilities (CRPD) and its Optional Protocol, ratified and incorporated into domestic law with constitutional strength and status, intend to discontinue the long trajectory of exclusion and invisibility that blemish the history of people with disabilities. The CRPD was the fruit of intense engagement from the Member States of the United Nations and its own beneficiaries, who postulated and debated the main issues pertaining to disability, with the intention of assembling rules that could answer, to the utmost, their demands. On the national scene, the Law nº 13.146 was published on July 6th, 2015, known as Brazilian Law on Inclusion or Statute of the Person with Disability, aiming at fulfilling the international legal obligations subscribed to by Brazil when it ratified the text of the Convention. From that point on, there has been a pursuit for constitutional conformity regarding legal categories and institutions related to the person with disability. The objective of this thesis is to assess the changes in the system of legal capacity and the provision of support services in the national legal system, taking as a starting point the text of the International Convention on the Rights of Persons with Disabilities, in order to research the possibility of planning the life of a person with a psychic or intellectual disability. For this purpose, initially, an assessment of the concept and treatment of disability is conducted, in its social and legal context, throughout time, until the provision of the social model by CRPD, guided by the principles inserted in the international statute, as well as in the proposal for unifying the rights of persons with disabilities throughout the world. Secondly, there is an evaluation of how the change of the constitutional directive affected the legal system of capacity, one of the oldest categories of all Law, from the starting point of the recognition of egalitarian legal capacity to persons with disabilities. Lastly, an analysis is conducted on the organization of the support services and its instruments in Brazilian Law and the possibility of the usage of the support services as an instrument for planning the acts of civilian life of people with disabilities is examined. The methodology used in the study is qualitative, with deductive analytic method and the type of research was bibliographic. The present work arrives at the conclusion that unified legal capacity should be recognized to every person with disability, pointing out that any restriction, no matter how small, to this human attribute clashes with the constitutional directive of the current Democratic State of Law, so it should be expunged. Through the analysis of the consolidated institutes of Civil Law, it is ascertained that the modulating element of active engagement in acts of civilian life should be legitimacy and not capacity. Lastly, from the premise of unified civil capacity, it is possible to establish a support system based upon domestic laws, integrated by instruments, both diversified and efficacious, for planning the life of the person with disability. A Convenção Internacional sobre os Direitos das Pessoas com Deficiência (CDPD) e seu Protocolo Facultativo, ratificados e incorporados ao Direito nacional com força e hierarquia constitucionais, pretendem romper com a longa trajetória de exclusão e invisibilidade que marcam a história das pessoas com deficiência. A CDPD foi fruto de intensa participação dos Estados que integram as Nações Unidas e das próprias pessoas a serem beneficiadas, que apresentaram e debateram as principais pautas pertinentes à deficiência, em prol da construção de uma norma que pudesse atender, ao máximo, suas demandas. No cenário nacional, foi publicada a Lei nº 13.146, em 06 de julho de 2015, denominada de Lei Brasileira de Inclusão ou Estatuto da Pessoa com Deficiência, com escopo de cumprir as obrigações legais internacionalmente assumidas pelo Brasil ao ratificar o texto convencional. Desde então, busca-se dar conformidade constitucional às categorias e institutos jurídicos relacionados à pessoa com deficiência. O objetivo dessa tese é avaliar as alterações no sistema da capacidade civil e a previsão de sistema de apoio no ordenamento jurídico nacional, a partir do texto da Convenção dos Direitos das Pessoas com Deficiência, a fim de investigar a possibilidade de realização do planejamento de vida da pessoa com deficiência psíquica ou intelectual. Para tanto, inicialmente, faz-se uma investigação sobre o conceito e o tratamento da deficiência, no contexto social e jurídico, ao longo do tempo, até a previsão do modelo social pela CDPD, a partir dos princípios que a norma internacional encarta, assim como a proposição de unificar as regras sobre os direitos da pessoa com deficiência no mundo. Em um segundo momento, avalia-se como a alteração da diretriz constitucional impactou no regime jurídico da capacidade civil, uma das categorias mais antigas de todo o Direito, a partir da previsão do reconhecimento da capacidade legal de forma igualitária às pessoas com deficiência. Por fim, analisa-se a organização do sistema de apoios e seus instrumentos no Direito brasileiro e examina-se a possibilidade de as medidas de suporte servirem como ferramentas para planificação dos atos da vida civil das pessoas com deficiência. A metodologia utilizada no estudo foi a qualitativa, com método dedutivo analítico e o tipo de pesquisa foi a bibliográfica. No presente trabalho, conclui-se pelo reconhecimento da capacidade civil unificada como inerente a todas as pessoas com deficiência, evidenciando que qualquer restrição, mínima que seja, a esse atributo humano confronta a diretriz constitucional do atual Estado Democrático de Direito, devendo, pois, ser afastada. Por meio da análise dos institutos consolidados de Direito Civil, verifica-se que o elemento modulador da participação ativa nos atos da vida civil deve ser a legitimação e não a capacidade. Por fim, a partir da premissa da capacidade civil unificada, é possível estabelecer sistema de apoio, alicerçado na legislação nacional, integrado por instrumentos, tanto diversificados, como eficazes, para o planejamento de vida pela pessoa com deficiência. No. of bitstreams: 0 Previous issue date: 2020-09-08 The main purpose of this dissertation research is to discuss the evident conflict between property rights and cultural rights and the ways to mitigate this conflict based on the analysis of instituted public policies and other measures that may promote harmony between these two fundamental rights, especially when it comes to the historic site located in the city of Sobral / CE. The research is justified by the fact that, in 1999, the National Historical Heritage Institute (IPHAN) fell as an architectural and urban development area of approximately 45.60 hectares in the center of Sobral / CE, considered the largest state, covering 1,100 properties at the time. As a result of the listing, owners and owners of properties located in the delimited area and surrounding area were restricted, or limited, from fully exercising the typical faculties of property law, acting in the manner in which the national order allows them, in for the greater social function of property. Immediately, considering the number of properties that are inserted within the Historic Site of the city of Sobral / CE and that the tipping not only influences the listed properties, but also those located in its surroundings, it is reflected, in view of the legal requirements and by the pertinent doctrinal bases, such as the consequences of this fall for the population directly affected, as well as what is the best way to reconcile the individual and collective interests involved. Thus, the present research aims to identify how and to what extent the tipping of real estate and the insertion of properties in the perimeter of Sítio Histórico interferes in the private relationships of the owners of the properties inserted in the site and located around it, from the qualitative analysis of the data collected from both bibliographic and documentary sources and, whenever necessary, quantitative analysis. As a conclusion, among others, suggestions are made to mitigate conflicts between the right to property and the right to cultural historical heritage. Keywords: Property law. Conflict between rights A presente dissertação tem como escopo principal discutir o conflito entre direito de propriedade e direitos culturais e as formas de mitigação desse conflito a partir da análise das políticas públicas instituídas e outras medidas que venham a promover a harmonia entre esses dois direitos fundamentais, em especial quando se trata do sítio histórico localizado na cidade de Sobral/CE. Justifica-se a pesquisa pelo fato de, no ano de 1999, o Instituto do Patrimônio Histórico Nacional (IPHAN) ter tombado como conjunto arquitetônico e urbanístico uma área de aproximadamente 45,60 hectares ao centro da cidade de Sobral/CE, considerada a maior do Estado, contemplando à época 1.100 imóveis. Por conta do tombamento, proprietários e possuidores de imóveis localizados na área delimitada de tombamento e de entorno ficaram restritos, ou limitados, de exercerem de forma plena as faculdades típicas do direito de propriedade, agindo nos moldes em que o ordenamento pátrio lhes permite, em prol da função social maior da propriedade. De pronto, considerando a quantidade de imóveis que estão inseridos dentro do Sítio Histórico da cidade de Sobral/CE e que o tombamento não influencia apenas os bens tombados, mas também os localizados no seu entorno, reflete-se, diante das imposições legais e pelos embasamentos doutrinários pertinentes, como tem sido as consequências desse tombamento para a população diretamente afetada, bem como qual o melhor modo de conciliar os interesses individuais e coletivos envolvidos. Assim, a pesquisa teve como objetivo analisar como e em que medida o tombamento de bens imóveis e a inserção de imóveis no perímetro de Sítio Histórico interfere nas relações privadas dos titulares das propriedades inseridas no sítio e localizados ao seu redor, a partir da análise qualitativa dos dados coletados tanto nas fontes bibliográficas quanto documentais e, sempre que necessária, a análise quantitativa. Como conclusão, dentre outros, tem-se o levantamento de sugestões para mitigar os conflitos entre o direito de propriedade e o direito ao patrimônio histórico cultural. In Brazil, the scenario is no different. A large portion of people is on the margins of the right to water. The lack of supply, pollution, conflicts and the commercialization of this natural resource affect a large part of the world population. In this context, the research has as its general objective to propose a resignification of the right to water based on the theory of common goods and the reinforce of its local governance. The need for identification and delimitation of common goods comes from the fact that there are countries that are converting these goods into merchandise, at the national level, with a global impact. In the event of water resources, starts from the hypothesis that there is a water crisis that result mainly from a governance problem, given the difficulty of institutions and public policies to face the complexity of the issue. The problem comprehends different areas of knowledge, due to its multidimensional character, which involves environmental, social and economic factors. To reach this objective we propose to follow script: to identify the relevant conceptual aspects technologies for the benefit of access to water, conflicts and environmental disasters, focusing on Latin America. Besides, to analyze the right to water as a human and fundamental right in the national and international scenario, basic sanitation and water markets. To verify the logic of the appropriation of common goods in order to investigate the legal nature of water. To identify the interactions between water governance and the participation of society; and, finally, to propose the bases for the construction of a model of local water governance, from the study of the Subcommittee of the Bacia Hidrográfica do Salgado ¿ CE, that originated from a local popular initiative. Thus, the debate unfolds in the legal, economic, cultural and political scenarios, so that the confrontation of the subject goes through the necessary dialogue between different areas of knowledge. It is a documentary and bibliographical research; qualitative, theoretical and empirical (case study). As a result, points out that, in Brazil, water has a legal nature as a diffuse environmental property, a concept that is compatible with that of a common property and capable of guaranteeing its right of access. Regarding to governance it appears that the ideal model must observe the local social, economic, political and cultural context that verified by granting greater administrative and financial autonomy to the Bacia Hidrográfica Committees. Therefore, and as a measure of realizing the right of access to water, there is a need to confer legal personality on these collegiate bodies. In summary, there is a necessity of fortification of effective channels for democratic participation in water governance, because, this is the only way to grant a greater degree of legitimacy to the local decisions of the committees. No Brasil, o cenário não é diferente. Parcela significativa de pessoas encontram-se à margem do direito à água. A falta de abastecimento, a poluição, os conflitos e a mercantilização desse recurso natural afetam grande parte da população mundial. Nesse contexto, a investigação tem como objetivo geral propor uma ressignificação do direito à água a partir da teoria dos bens comuns e do fortalecimento da sua governança. A necessidade de identificação e de delimitação dos bens comuns advém do fato de que há países que estão convertendo esses bens em mercadorias, no âmbito nacional, com impacto global. No caso dos recursos hídricos, parte-se da hipótese de que há uma crise hídrica que decorre, principalmente, de um problema de governança, haja vista a dificuldade das instituições e das políticas públicas de enfrentar a complexidade do assunto. A problemática abrange áreas distintas do conhecimento, por seu caráter multidimensional, que envolve fatores ambientais, sociais e econômicos. Para alcançar esse objetivo, propõe-se percorrer o seguinte roteiro: identificar os aspectos conceituais relevantes, das tecnologias em benefício do acesso à água, dos conflitos e dos desastres ambientais, com foco na América Latina; analisar o direito à água como direito humano e fundamental no cenário nacional e internacional, o saneamento básico e os mercados de água; verificar a lógica da apropriação de bens comuns com o propósito de discutir a natureza jurídica da água; investigar as interações entre a governança da água e a participação da sociedade; e, por fim, identificar as bases de um modelo de governança da água, a partir do estudo do Comitê da Sub-bacia Hidrográfica do Rio Salgado ¿ CE, que se originou de uma iniciativa popular local. Logo, o debate desdobra-se nos cenários jurídico, econômico, cultural e político, de modo que o enfrentamento do assunto passa pelo necessário diálogo entre distintas áreas do conhecimento. Trata-se de pesquisa documental e bibliográfica, qualitativa, teórica e de campo (estudo de caso). Como resultado, aponta-se que, no Brasil, a água possui natureza jurídica de bem ambiental difuso, conceito este compatível com o de bem comum. No que se refere à governança, verifica-se que o modelo ideal deve observar o contexto social, econômico, político e cultural local, o que somente se verifica mediante a concessão de maior autonomia administrativa e financeira aos Comitês de Bacia Hidrográfica. Para tanto, e como medida de concretização do direito de acesso à água, constata-se a necessidade de conferir personalidade jurídica a esses colegiados. Em síntese, observa-se a imperatividade do fortalecimento de canais efetivos para a participação democrática na governança das águas, pois só assim é possível conceder maior grau de legitimidade às decisões dos comitês. The Brazilian Judiciary decides on the most varied issues. Thus, in the field of constitutional jurisdiction, by the Federal Supreme Court, some of these decisions and other situations, which would fit in principle, are defined by the Legislative, are not. In this way, there is a need for substantial substantiation of judicial decisions in this complex society. For rationality, judges cannot use anything to justify their decision making. Decisions that, often adopt strategies specific to political or even partisan-political discourse. In the Democratic State of Law, at each decision handed down, the judge must demonstrate that he is fulfilling the oath taken at the time of his office, that is, to comply with the laws and the Constitution of the Republic. In this way, it is questioned how the Constitutional obligation to Justify the Jurisdictional Decision contributes to the unity between the Three Powers constituted in decision-making and thus to avoid the invasion of competences between them? To answer this demand, this study aims to analyze questions about the role of the Schools of Magistracy in the continuing education of Magistrates in which the substantive basis of judicial decisions are guiding in the way of guaranteeing the Democratic Rule of Law. Specifically, it seeks to examine the role of the schools of the judiciary in the judicial structure and in the Brazilian legal system, under the functional criterion; Describe the evolution of the legal-political movement known as constitutionalism, between the Liberal State and the Social State; Analyze contexts of the possibility of conciliation between constitutionalism and democracy by the summoned performance of the jurisdiction; and, Demonstrate the importance of the power of the judges to be exercised from the starting points established by the legislative text, with the concrete rule as a result of judicial interpretation, without higher instances and criteria, typical of jusnaturalism. The research seeks to outline methods to be adopted by the Schools of the Judiciary for the training of magistrates in the sense of better jurisdictional provision through the delivery of decisions that are substantiated and that respect the Democratic Rule of Law. Thus, the Deductive Method was adopted, in which the research is bibliographic, documental, doctrinal, jurisprudential, legislative, in addition to an empirical research with the magistrates that compose the public of the Higher School of Magistracy of Amazonas (ESMAM). The analyzes were performed using bibliographic and documentary procedures, where the approach is qualitative, and the nature of the research is exploratory, descriptive. These analyzes were established under three aspects: heuristic, where one seeks to understand the magistrates' worldview, evaluating their decisions; descriptive, identifying the logic by which they decide; and, finally, normative, in order to guide the future procedure of the school on the most efficient method so that the judges can substantially substantiate the judicial decisions. O Poder Judiciário brasileiro decide sobre as mais variadas questões. Assim, no campo da jurisdição constitucional, pelo Supremo Tribunal Federal, algumas dessas decisões e outras situações que caberiam, em princípio, ser definidas pelo Legislativo não o são. Verificamos, desse modo, a necessidade de fundamentação substancial das decisões judiciais nessa sociedade complexa. Pela racionalidade, os juízes não podem usar qualquer coisa para justificar suas tomadas de decisões. Decisões essas que, muitas vezes, adotam estratégias próprias do discurso político ou até mesmo partidário-político. No Estado Democrático de Direito, a cada decisão proferida, o juiz deve demonstrar que está cumprindo o juramento feito por ocasião da posse no respectivo cargo, qual seja, o de cumprir as leis e a Constituição da República. Dessa forma, questionamos como a obrigatoriedade constitucional de fundamentação da decisão jurisdicional contribui para a unidade entre os Três Poderes constituídos nas tomadas de decisões e assim evitar a invasão de competências entre estes? Para responder a tal demanda, este estudo objetiva analisar questões a respeito do papel das Escolas da Magistratura na formação continuada dos magistrados, em que a fundamentação substancial das decisões judiciais seja norteadora na forma de garantir o Estado Democrático de Direito. De modo específico, buscamos examinar o papel das Escolas da Magistratura na estrutura judiciária e no ordenamento jurídico brasileiro, sob o critério funcional; descrever a evolução do movimento jurídico-político conhecido como constitucionalismo, entre o Estado Liberal e o Estado Social; analisar contextos de possibilidade de conciliação entre constitucionalismo e democracia pela atuação convocada da jurisdição; e demonstrar a importância do poder dos juízes a ser exercido a partir de pontos de partida estabelecidos pelo texto legislativo, com a norma concreta como resultado da interpretação judicial, sem instâncias e critérios superiores, típicos do jusnaturalismo. A pesquisa procura traçar métodos a serem adotados pelas Escolas da Magistratura para o treinamento dos magistrados no sentido de uma melhor prestação jurisdicional pela via da prolação de decisões que sejam providas de fundamentação substancial e que respeitem o Estado Democrático de Direito. Assim, adotamos o método dedutivo, com pesquisa bibliográfica, documental doutrinária, jurisprudencial, legislativa, além de ser uma pesquisa empírica com os magistrados que compõem o público da Escola Superior da Magistratura do Amazonas ¿ ESMAM. As análises foram realizadas pelos procedimentos bibliográficos e documentais, sob uma abordagem qualitativa. Essas análises estabeleceram-se sob três aspectos: heurístico, buscando entender a visão de mundo dos magistrados, avaliando suas decisões; descritivo, identificando a lógica pela qual decidem; e, finalmente, normativo, com o fito de orientar o futuro procedimento da Escola sobre o método mais eficiente para que os juízes possam fundamentar de modo substancial as decisões judiciais. To this purpose, it studies the innovations in the communicational process, freedom of expression and popular participation. The era of Information Society has transformed the way of informing and communicating. Personal data has become one of the richest currencies of technology companies, markets and politics. From the artificial intelligence, the political process started to have systems capable of indicating the preferences of the electorate, pointing out demands and qualified forms of approach to influence the citizen. The Big data - a data center maintained by technological giants - is at the service of algorithms - numerical combinations designed for a specific purpose. With these tools, candidates can send specific messages to those who think similarly or advocate the same causes in so-called bubble filters. The research is justified in view of the rumored cases that occurred around the world, especially in the United States, Europe and Brazil, which indicate manipulation of the electoral process through new information technologies. Its general objective is to identify the metamorphosis of communication, generated by the internet, computers, smartphones and other modern equipment. Specifically, the objective is to investigate whether the voter is being manipulated by technological devices such as algorithms and bubble filters, pointing out, if necessary, legal alternatives such as the creation of the type, abuse of technological power, and, social to face this problem. The methodology involves interdisciplinary research with an epistemological orientation in critical theory. Thus, it brings together theory and praxis, and articulates Law, Communication and Technology. The text adopts inductive and deductive reasoning, in qualitative research, with the techniques of document analysis, statistics and bibliographic review. In this perspective, it is expected to point out the deficiencies of the current electoral system, its contradictions and imperfections that collaborate to maximize the problem amplified by technology. A pesquisa se justifica face aos rumorosos casos ocorridos em todo o mundo, especialmente nos Estados Unidos, na Europa e no Brasil, que indicam manipulação do processo eleitoral por meio das novas tecnologias de informação. Tem como objetivo geral identificar a metamorfose da comunicação, gerada pela internet, computadores, smartphones e outros equipamentos modernos. Especificamente, objetiva-se investigar se o eleitor está sendo manipulado pelos artifícios tecnológicos como algoritmos e filtros-bolha, apontando, caso seja necessário, alternativas jurídicas como a criação da espécie: abuso de poder tecnológico, e, sociais ao enfrentamento dessa problemática. A metodologia envolve pesquisa interdisciplinar com orientação epistemológica na teoria crítica. Assim, congrega teoria e práxis, e articula Direito, Comunicação e Tecnologia. O texto adota os raciocínios indutivo e dedutivo, em pesquisa qualitativa, mediante utilização das técnicas de análise documental, estatística e de revisão bibliográfica. Nessa perspectiva, espera-se apontar as deficiências do sistema eleitoral vigente, suas contradições e imperfeições que colaboram para maximizar a problemática ampliada pela tecnologia. No. of bitstreams: 0 Previous issue date: 2019-08-23 The doctoral thesis presented was produced under the Postgraduate Program in Law of the University of Fortaleza (UNIFOR), and follows the research line "Constitutional Law in Private Relations". It is based on the premise that the right to reparation for damages is a fundamental right. This recognition stems from the epistemological itinerary of civil liability, which converges with that of the theory of fundamental rights in the increasing enhancement of the protection of the person. It is aligned with factors such as the constitutionalization of private law, the horizontal effectiveness of fundamental rights and the consolidation of the civil-constitutional method. The insertion of reparability of harm in the fundamental rights catalog has repercussions on central points of civil liability, such as the expansion of the interests deserving tutelage, the strengthening of the imputation nexus and the own functional profile of the institute, which incorporates the preventive and punitive dimensions to the traditional one compensatory function. It is proposed that the Judiciary, in assessing the vast number of disputes that deal with the matter, should guide its action in the effective realization of this fundamental right. As a consequence, the Judiciary should provide a prompt and justified response to the victim, including through possible non-pecuniary sanctions against the offender. The methodology adopted for the elaboration of this thesis is characterized as bibliographical, in relation to the sources; qualitative approach to the problem; and descriptive and exploratory, with regard to the objectives. The bibliographical research includes consulting specialized magazines, periodicals, national and international electronic sites of academic and scientific nature, legislation and legal doctrines. In the purpose of apprehending the judicial action aimed at the realization of the fundamental right to reparation of damages, it is presented a survey of decisions rendered by the superior courts, especially by the Superior Court of Justice, between July 2004 and July 2019, and statistics published in the "Justice in Numbers" report of the National Justice Council (CNJ). Parte-se da premissa de que o direito à reparação por danos se reveste de fundamentalidade material. Esse reconhecimento decorre do itinerário epistemológico da responsabilidade civil, que converge com o da teoria dos direitos fundamentais no crescente aprimoramento da proteção à pessoa. Alinha-se a fatores como a constitucionalização do direito privado, a eficácia horizontal dos direitos fundamentais e a consolidação do método civil-constitucional. A inserção da reparabilidade do dano no catálogo jusfundamental repercute em pontos centrais da responsabilidade civil, tais como a expansão dos interesses merecedores de tutela, o fortalecimento do nexo de imputação e o próprio perfil funcional do instituto, que incorpora as dimensões preventiva e punitiva à tradicional função compensatória. Propõe-se que o Poder Judiciário, na apreciação do vasto número de litígios que versam sobre a matéria, deve pautar sua atuação na concretização efetiva desse direito fundamental. Como consequência, incumbe-lhe oferecer resposta célere e justificada à vitima, inclusive mediante possível aplicação de sanções não pecuniárias ao ofensor. A metodologia adotada para a elaboração desta tese se caracteriza como bibliográfica, em relação às fontes; qualitativa, quanto à abordagem do problema; e descritiva e exploratória, no tocante aos objetivos. No. of bitstreams: 0 Previous issue date: 2019-08-12 This dissertation deals with the legal controls of transition of mandates within the executive branch of the Brazilian municipalities, in order to curb bad management practices typical of the period, which is known as "dismantling", in search of the realization of the fundamental right to good public administration. The objective of this study is to investigate close and remote causes of the phenomenon (bad end-of-term management practices in Brazilian municipalities), to verify the positivity of the fundamental right to good public administration in the Brazilian legal system, as well as its possibilities of accomplishment in the period of transition of management of the municipal executive, by means of a good public control, with ductile and adapted action of the organs of control of the public administration in the critical period. The theoretical and practical relevance is extracted from the bibliographical aridity of the topic related to transition of political management and the seriousness of the phenomenon, often resulting in a solution of continuity of essential public services to the population. The research methodology used in this work is, as far as the sources, of bibliographic and documentary type, of theoretical nature, with exploratory, descriptive and normative objectives, qualitative approach, and hypothetical-deductive method. The research starts from the idea that law and politics in a complex society must be, gradually, autopoietic social systems, cognitively open and operationally closed, with reciprocal "learning" mediated by the Constitution, which serves as limit and structural coupling. It is argued that institutions play a role in promoting systemic exchange and cultural dynamism. After, through historical analysis, the degree of maturation (differentiation, cognitive openness and operational closure) of the Brazilian legal and political systems is verified. It then moves on to the right to good public administration and its recognition in Europe and Brazil. It discusses with the critics, with analysis of the counterpoints raised by the European doctrine still resistant to the concept. It also focuses on its aspect of good public control, presented as a fundamental right to a principled control, with adequate material and procedural intensity to the concrete object to be controlled, and technological, which is applicable to facing the difficulties of the transition of municipal management. Finally, the need for a rational and institutional transition is presented from the perspective of the right to the city. Foreign experiences with transition of governments were presented, as well as the main challenges and possible pragmatic solutions of adequate control for the period in the context of the Brazilian municipality, with a brief case study. The hypotheses tested and confirmed are: from a historical perspective, the Brazilian legal-political order is still strongly marked by patrimonialism, low constitutional normativity, asymmetrical implementation of rights, and, finally, immaturity of the legal and political systems; On the other hand, the right to good administration is positively observed in the constitutional principles of the Brazilian Constitution, and demands a good, publicly oriented, and principled control, which, in turn, requires a timely, proactive, integrated, balanced, and therefore substantial action and procedurally adequate of the control organs, whose intensity must adapt to the object to be controlled and its concrete circumstances (ductility); poor management practices in the transition periods of mandates of Brazilian municipal executives - still marked by low levels of rationality and institutionality - have as a remote cause the immaturity of the legal and political systems, and as close cause, insufficient legal controls; the peculiarities of the transition period of municipal management demand a particularly intense and differentiated performance of legal control organs; such adjustments have the potential to contribute to the stabilization of political institutions, fostering desirable cultural transformation and advancement of the civilizing process. Esta dissertação trata dos controles jurídicos da transição de mandatos no âmbito do poder executivo dos municípios brasileiros, a fim de coibir más práticas de gestão típicas do período, a que se convencionou chamar de ¿desmonte¿, em busca da concretização do direito fundamental à boa administração pública. O trabalho tem como objetivos perquirir as causas próximas e remotas do fenômeno (más práticas de gestão em final de mandatos nos municípios brasileiros), verificar a positividade do direito fundamental à boa administração pública no ordenamento jurídico brasileiro, bem como suas possibilidades de concretização no período de transição de gestões do executivo municipal, por meio de um bom controle público, com atuação dúctil e adaptada dos órgãos de controle da administração pública no período crítico. Extrai-se sua relevância teórica e prática, respectivamente, da aridez bibliográfica do tema referente à transição de gestões políticas, e da gravidade do fenômeno enfrentado, muitas vezes acarretando solução de continuidade de serviços públicos essenciais à população. A metodologia de pesquisa adotada neste trabalho é, quanto às fontes, do tipo bibliográfico e documental, de natureza teórica, com objetivos exploratório, descritivo e normativo, abordagem qualitativa, e método hipotético-dedutivo. A pesquisa parte da ideia de que o direito e a política, em uma sociedade complexa, devem ser, gradualmente, sistemas sociais autopoiéticos, cognitivamente abertos e operacionalmente fechados, com ¿aprendizado¿ recíproco mediado pela Constituição, a qual lhes serve como limite e acoplamento estrutural. Sustenta-se que as instituições têm papel na promoção do intercâmbio sistêmico e dinamismo cultural. Após, através de análise histórica, verifica-se o grau de amadurecimento (diferenciação, abertura cognitiva e fechamento operacional) dos sistemas jurídico e político brasileiros. Em seguida, transita-se pelo direito à boa administração pública e seu reconhecimento na Europa e no Brasil. Dialoga-se com os críticos, com análise dos contrapontos levantados por parte da doutrina europeia ainda resistente ao conceito. Adentrase outrossim na sua vertente de bom controle público, apresentado como direito fundamental a um controle principiológico, com intensidade material e procedimental adequada ao objeto concreto a ser controlado, e tecnológico, o que é aplicável ao enfrentamento das dificuldades da transição de gestões municipais. Por fim, a necessidade de uma transição racional e institucional é apresentada sob a ótica do direito à cidade. Foram ainda apresentadas experiências estrangeiras com transição de governos, bem como os principais desafios e possíveis soluções pragmáticas de controle adequado ao período no contexto da municipalidade brasileira, com breve estudo de caso. As hipóteses testadas e confirmadas são: de uma perspectiva histórica, a ordem jurídico-política brasileira ainda é fortemente marcada pelo patrimonialismo, baixa normatividade constitucional, concretização assimétrica de direitos, enfim, imaturidade dos sistemas jurídico e político; de outro lado, o direito à boa administração, enquanto direito-síntese, encontra positividade nos princípios constitucionais da Carta Magna brasileira, e reclama um bom controle público, principiologicamente orientado, o que, por sua vez, exige uma atuação tempestiva, proativa, integrada, equilibrada, portanto, substancial e procedimentalmente adequada dos órgãos de controle, cuja intensidade deve adaptar-se ao objeto a ser controlado e suas circunstâncias concretas (ductilidade); as más práticas de gestão nos períodos de transição de mandatos dos executivos municipais brasileiros - ainda marcados por reduzidos níveis de racionalidade e institucionalidade - tem como causa remota a imaturidade dos sistemas jurídico e político, e como causa próxima a insuficiência de controles jurídicos; as peculiaridades do período de transição de gestão municipal demandam atuação especialmente intensa e diferenciada dos órgãos de controle jurídico; tais ajustes tem potencial para contribuir com a estabilização das instituições políticas, fomentando desejável transformação cultural e avanço do processo civilizatório. No. of bitstreams: 0 Previous issue date: 2019-08-09 This dissertation aims to analyze the issue of urban violence as a result of socioeconomic inequality through the Ceará Pacific Project - a pact for life, as a successful experience in the Vicente Pinzón community, in view of the alarming levels of violence that plague the State, this time, it is intended throughout the research to demonstrate what shapes the adoption of the project, its form of execution, as well as the prospect of success. Through the method of research of bibliographical and documentary revision the subject Public Security is analyzed as premise of guarantee of the public order, for so much the historical process is verified from the liberal state to the democratic state, the mentions realized in the Constitutions, the formation of the police, the proposal of its demilitarization with adoption of the complete cycle and unification of the same, in addition to the culture of incarceration, the custody hearing and the necessary re-socialization of the prisoner. There is also violence against the State's omission, through the analysis of organized crime, the vulnerability of poor communities, the structure of criminal organizations and drugs as the main promoter, the use of the armed forces, the absence of public policies of effects, and the black figure. It portrays the duty of the State to provide Public Security, based on being a public service, a fundamental right, and being civilly responsible for the excesses and omissions in providing such a service. Lastly, there is Public Security in the State of Ceará, within the perspective of crime and its indicators, the police organization, the preventive and ostensive police, the repressive or investigative police and the judiciary, and the fire brigade. Finally, it is analyzed whether there is a reduction in crime rates and an increase in the security of the population of Ceará, through the implementation of intersectoral and inter-institutional actions that will provide for the construction of a Culture of Peace in Ceará. Concurrently with these actions are the initiative aimed at improving the urban context, welcoming the most vulnerable populations and facing violence as a whole, based on the articulated, integrated and shared action of state, municipal and federal public bodies and entities, and of civil society. A presente dissertação tem como objeto analisar a questão da violência urbana como resultado da desigualdade socioeconômica por meio do Projeto Ceará Pacífico ¿ um pacto pela vida, como experiência exitosa na comunidade Vicente Pinzón, tendo em vista os alarmantes índices de violência que assolam o Estado. Desta feita, pretende-se, ao longo da pesquisa, demonstrar o que molda a adoção do projeto, sua forma de execução, bem como a perspectiva de êxito. Através do método de pesquisa de revisão bibliográfica e documental, analisa-se o tema Segurança Pública como premissa de garantia da ordem pública, para tanto, verifica-se o processo histórico desde o Estado Liberal ao Estado Democrático, as menções realizadas nas Constituições, a formação da polícia, a proposta de sua desmilitarização com adoção do ciclo completo e unificação das mesmas, além da cultura do encarceramento, da audiência de custódia e da necessária ressocialização do preso. Verifica-se também a violência frente à omissão do Estado, por meio da análise do crime organizado, da vulnerabilidade das comunidades carentes, da estrutura das organizações criminosas e da droga como principal fomentador, da utilização das forças armadas, da ausência de políticas públicas de efeitos concretos e da cifra negra. Retrata-se o dever do Estado de prestar Segurança Pública, com base em ser um serviço público, um direito fundamental, e ser responsável civil pelos excessos e omissões ao prestar tal mister. Por derradeiro, verifica-se a Segurança Pública no Estado do Ceará, dentro da perspectiva da criminalidade e de seus indicadores, da organização policial, da polícia preventiva e ostensiva, da polícia repressiva ou investigativa e judiciária, e dos bombeiros. E por fim, analisa-se se há ocorrência de redução dos índices criminais e o aumento da segurança da população cearense, através da implementação de ações intersetoriais e interinstitucionais que proporcionarão a construção de uma Cultura de Paz no Ceará. Concomitantemente a estas ações está a iniciativa voltada à melhoria do contexto urbano, ao acolhimento às populações mais vulneráveis e ao enfrentamento à violência como um todo, a partir da atuação articulada, integrada e compartilhada dos órgãos e entidades públicas estaduais, municipais e federais, e da sociedade civil. No. of bitstreams: 0 Previous issue date: 2019-08-02 The main objective of this work is to investigate the existence of some epistemological standard in the application of judicial precedents in Brazil, to reflect on its application methodology, and to propose a way to improve the system. Firstly, through a bibliographical research, the traditional paradigm of epistemology is analyzed, as a philosophical branch of study of the conditions of the possibility of knowledge and, from an observation about the dichotomy between subject and object. After consolidating these fundamental notions, the conditions for the use of subsonic logic in the application of the law, especially in the field of judicial precedents, are verified. From the concept of precedent as an interpretive vector, is demonstrated that the subsonic application of judicial precedents is incompatible with a new epistemological parameter, which does not work the formation of knowledge based on the duality of subject and object, of being and must be. Using the theoretical references of Martin Heidegger and Hans Georg Gadamer, philosophical hermeneutics, as a fundamental discipline of human understanding, is the epistemological substrate to be followed for the proper use of judicial precedents. Then, in view of the historical experience of the Anglo-American system with the doctrine of judicial precedents, analyzes the main characteristics of the common law practiced in these countries, seeking to confront its methodology of action with the theoretical questions seen in the initial chapter. Subsequently, the analysis focuses on the Brazilian legal system, comparing it with the practice of precedents observed in English and American law. Based on procedural data collected within the scope of the Court of Justice of the State of Ceará, in a period of 12 (twelve) months, it is noted, mainly from the content of the decisions handed down by the Federal Supreme Court and Superior Court of Justice, that the application of judicial precedents in Brazil is based on an obsolete epistemological pattern, disagreeing with the most modern theories of law. Finally, the philosophical contributions of Hans-Georg Gadamer's hermeneutics are added to Ronald Dworkin's theory of Right as Integrity. From a detailing of Hans-Georg Gadamer's question-and-answer game and the working methodology of Ronald Dworkin's "Judge Hercules," the accusations of relativism and subjectivism of philosophical hermeneutics are overcome, resulting in a more solid epistemological path for working with judicial precedents in Brazil, capable of ensuring legal security and the desired isonomy. Este trabalho tem por objetivo principal pesquisar a existência de algum padrão epistemológico na aplicação dos precedentes judiciais no Brasil, refletir sobre sua metodologia de aplicação, e propor um caminho para a melhoria do sistema. Primeiramente, através de pesquisa bibliográfica, analisa-se o paradigma tradicional da epistemologia, enquanto ramo filosófico de estudo das condições de possibilidade do conhecimento e, ainda, a sua evolução a partir de uma observação sobre a dicotomia entre sujeito e objeto. Após a consolidação dessas noções fundamentais, verificam-se as condições de possibilidade de utilização da lógica subsuntiva na aplicação do direito, principalmente, no campo dos precedentes judiciais. A partir do conceito de precedente como um vetor interpretativo, conclui-se que a aplicação subsuntiva dos precedentes judiciais é incompatível com um novo parâmetro epistemológico, que não trabalha a formação do conhecimento fundado na dualidade de sujeito e objeto, de ser e dever ser. Utilizando-se dos referenciais teóricos de Martin Heidegger e Hans Georg Gadamer, aponta-se a hermenêutica filosófica, enquanto disciplina fundamental da compreensão humana, como o substrato epistemológico a ser seguido para a adequada utilização dos precedentes judiciais. Após, tendo em vista a experiência histórica do sistema anglo-americano com a doutrina dos precedentes judiciais, analisam-se as características principais do common law praticado nesses países, buscando-se confrontar sua metodologia de atuação com as questões teóricas vistas no capítulo inicial. Posteriormente, a análise passa a ter como foco o sistema jurídico brasileiro, comparando-o com a prática de precedentes observadas no direito inglês e americano. Através de dados processuais colhidos no âmbito do Tribunal de Justiça do Estado do Ceará, em um período de 12(doze) meses, constata-se, principalmente por intermédio da análise do conteúdo das decisões proferidas pelo Supremo Tribunal Federal e Superior Tribunal de Justiça, que a aplicação de precedentes judiciais no Brasil está fundada em um padrão epistemológico ultrapassado, discrepante das teorias mais modernas do direito. Finalmente, as contribuições filosóficas da hermenêutica de Hans-Georg Gadamer são somadas à teoria do Direito como Integridade, de Ronald Dworkin. As acusações de relativismo e subjetivismo da hermenêutica filosófica são vencidas com um detalhamento do jogo de perguntas e respostas, de Hans-Georg Gadamer, e através do uso metodologia de trabalho do ¿juiz Hércules¿, de Ronald Dworkin, resultando na apresentação de um caminho epistemológico mais sólido para o trabalho com os precedentes judiciais no Brasil, capaz de assegurar a segurança jurídica e a isonomia desejadas. No. of bitstreams: 0 Previous issue date: 2018-09-03 The Declaration of the Rights of Persons with Disabilities (DDPD) was a milestone in the construction of human rights, since it recognized persons with some type of disability as a subject of rights, however, this construction process was delayed, from absolute exclusion until the need for understanding of disability as diversity, but it was from the understanding that the problem of exclusion lay within the barriers imposed by society that developed the DDPD, with its preamble in the social model. In Brazil, DDPD was approved with the status of Constitutional Amendment, linking the whole legal system, this time, in compliance with the guidelines of the DDPD, Law 13,146, of July 6, 2015 - Statute of the Person with Disabilities, proposal of attention and guarantee of DDPD rights. Among the novelties of the legislation, it is worth mentioning the changes in the capacity regime with the repeal of provisions of the Civil Code that provided for the absolutely incapacitated. Thus, from the date of the Statute, all are presumably capable. Recognition of the capacity for all, regardless of their conditions, raised doubts regarding the validity of the legal business, and the need to guarantee a patrimonial protection for the previously considered incapable subjects. The patrimonial protection is done with the use of curatela or the decision making supported, but in the existential sphere, the will of the subject should not be disregarded. The need arises to guarantee a minimum capital to protect the assets that may be compromised due to stock decisions. The existential minimum rests on the idea of the dignity of the human person, on freedom, equality, immunities and privileges of the citizen. The absence of provisions that protect the assets of the disabled person who is unable to manage it, before a curating procedure, or even after curatorship, but when it comes from existential decisions, can face their dignity. The methodology used was analytical-descriptive, bibliographical, pure and qualitative. In this way, the present work proposes, in a generic way, to defend the need to understand disability as a diverse capacity in Brazil in order to seek, through the Statute of the Person with Disabilities, the means of protection of this person and, by minority, promote a identification of the fundamental rights that embodied the Declaration of the Rights of Persons with Disabilities and, consequently, the Disability Statute, then describe the means of protection of persons with disabilities used in some regions of the European Union (Spain, Catalonia, Portugal, France and Germany), who first initiated the need to review the treatment of persons with disabilities in those countries and, in the end, demonstrate the insufficiency of the Disability Statute in terms of guaranteeing dignity due to " minimum equity "by proposing ways to ensure efficient State protection. Finally, it is concluded that the Statute has brought more lack of protection in relation to existential decisions that reverberate in the patrimony, and the State, due to the principle of prohibition of the insufficiency to promote material means of protection. A Declaração dos Direitos da Pessoa com Deficiência (DDPD) foi um marco na construção dos direitos humanos, pois reconheceu as pessoas com algum tipo de deficiência como sujeito de direitos. Entretanto, esse processo de construção foi demorado, e partiu da absoluta exclusão até a necessidade da compreensão da deficiência como diversidade, mas foi a partir do entendimento que o problema da exclusão estava nas barreiras impostas pela sociedade que se elaborou a DDPD, com seu preâmbulo no modelo social. No Brasil, a DDPD foi recepcionada com status de Emenda Constitucional, e vinculou todo o ordenamento jurídico. Ao atender as orientações da DDPD, foi instituída a Lei nº 13.146, de 06 de julho de 2015 - Estatuto da Pessoa com Deficiência, que reproduz a proposta de atenção e garantia de direitos da DDPD. Dentro das novidades da legislação, merecem destaque as alterações do regime das capacidades com a revogação de dispositivos do Código Civil que previa os absolutamente incapazes. Assim, a partir da vigência do Estatuto, todos são presumidamente capazes. O reconhecimento da capacidade para todos, independentemente de suas condições, gerou dúvidas no tocante à validade dos negócios jurídicos e à necessidade de garantir uma proteção patrimonial para os sujeitos anteriormente considerados incapazes. A proteção patrimonial se faz com a utilização da curatela ou a tomada de decisão apoiada, mas na esfera existencial, a vontade do sujeito não deverá ser desconsiderada. Surge então a necessidade de garantir um patrimônio mínimo para proteger o patrimônio que eventualmente seja comprometido em razão de decisões existenciais. O mínimo existencial repousa na ideia de dignidade da pessoa humana, na liberdade, na igualdade, nas imunidades e nos privilégios do cidadão. A ausência de disposições que protejam o patrimônio da pessoa com deficiência que se encontre impossibilitada geri-lo, antes de um procedimento de curatela, ou mesmo após a curatela, mas quando decorrer de decisões existenciais, pode afrontar a sua dignidade. A metodologia utilizada foi analítico-descritiva, bibliográfica, pura e qualitativa. Dessa forma, o presente trabalho se propõe, de forma genérica, a defender a necessidade da compreensão da deficiência como capacidade diversa no Brasil, de forma a buscar, a partir do Estatuto da Pessoa com Deficiência, meios de proteção desta e, por menorizadamente, promover uma identificação dos direitos fundamentais que consubstanciaram a Declaração dos Direitos da Pessoa com Deficiência e, por conseguinte, do Estatuto da Pessoa com Deficiência, para, em seguida, descrever os meios de proteção da pessoa com deficiência utilizados em algumas regiões da União Europeia (Espanha, Catalunha, Itália, Portugal, França e Alemanha), quem primeiro deu início a necessidade de rever o tratamento dispensado à pessoa com deficiência naqueles países e, ao final, demonstrar a insuficiência do Estatuto da Pessoa com Deficiência no tocante à garantia da dignidade, em razão da ¿desproteção de um patrimônio mínimo¿, propondo meios para garantir um proteção eficiente pelo Estado. Por fim, conclui-se que o Estatuto trouxe mais desproteção no tocante a decisões existenciais que reverberam no patrimônio, de modo que cabe ao Estado, em função do princípio da proibição da insuficiência, promover meios materiais de proteção. The study aims at making feasible arguments to contemplate the feasibility of granting prior indemnification to the commercial renter in case of expropriation, which leads to the loss of the so-called "goodwill" and submits him to a complete legal, economic and social state of helplessness. Which overturns the guidelines of the Brazilian legal system in the light of constitutional directives, especially with regard to the dignity of the human person. In order to do so, a study of an exploratory nature is carried out, carried out through research of the bibliographic and documentary type, aiming to undertake a qualitative approach, with the purpose of evidencing the constitutional foundations that would authorize the previous indemnification to the commercial renter of expropriated property. O presente artigo tem por objetivo empreender a aferição dos aspectos jurídicos que flanqueiam os atos de desapropriação empreendidos pelo Estado, quando tais atos têm por finalidade a expropriação de imóvel comercial objeto de contrato de locação, justamente porque o locatário, por não ser proprietário do bem utilizado como local destinado à viabilização do exercício da atividade econômica, acaba sendo demasiadamente prejudicado pelo ato expropriatório, muito embora inexista previsão legal que lhe outorgue indenização prévia. O estudo visa empreender argumentos hábeis a contemplar a viabilidade de outorga de prévia indenização ao locatário comercial em caso de desapropriação, que conduz à perda do intitulado ¿fundo de comércio¿ e o submete a um completo estado de desamparo jurídico, econômico e social, o que contraria sobremaneira as diretrizes do ordenamento jurídico brasileiro à luz das diretrizes constitucionais, principalmente no que concerne à dignidade da pessoa humana. No. of bitstreams: 0 Previous issue date: 2018-07-27 This doctoral thesis presented at the Graduate Program in Law at the University of Fortaleza aims to analyze the Brazilian constitutional structures to deal with emergencies produced by military or criminal cybernetic actions that may affect national sovereignty. In the last few decades, the world has witnessed a movement for a strong renewal of the media, access and transmission of data and information, especially driven by the ever more constant use of the worldwide computer network, as well as the popularization of new technologies and equipment. This digital revolution, while bringing significant human development, created serious weaknesses in state sovereignty, which together with the process of economic globalization, forced the states to create mechanisms to protect their national interests, essential institutions, as well as critical infrastructures. The concept of sovereignty has undergone a strong theoretical shift since national boundaries, classically physical and static, are no longer able to precisely define state boundaries. International relations were strongly influenced by the new world order, especially in the face of the process of economic globalization and the diffusion of new technologies. Such a process leads the Internet to be seen as a weapon of war, using the natural fragility produced by new technologies in the concept of state sovereignty, causing the state to suffer attacks without their borders being effectively tarnished. This process affects Brazil and obliges it to create a constitutional system that can deal with such a threat, especially in view of the fact that constitutional models of defense and security are incapable of providing state entities with truly effective mechanisms to contain aggressions and cyber attacks. It identifies the constitutional void and the need to create a State of Cybernetic Emergency. The subject is situated in the area of public law, more specifically in the research line of Democratic Right of State in Brazil. The study had the nature of qualitative research, through bibliographic research. A deductive method was used. The historical evolution of the concept of state sovereignty, as well as the phenomenon of war, its causes and characteristics, especially cyber warfare, as well as the other virtual threats imposed on the state, were analyzed. Afterwards we analyzed the constitutional void in the models of states of exception and the urgent need to create the state of cyber security in the Brazilian constitutional text with the objective of creating a system that provides the necessary security to state sovereignty in a globalized and connected cybernetic world. O conceito de soberania sofreu forte ressignificação teórica uma vez que as fronteiras nacionais, classicamente físicas e estáticas, já não mais são capazes de definir com precisão os limites estatais. As relações internacionais foram fortemente influenciadas pela nova ordem mundial, especialmente em face do processo de globalização econômica e da difusão de novas tecnologias. Tal processo leva a internet a ser vista como arma de guerra, utilizando-se da natural fragilidade produzida pelas novas tecnologias no conceito de soberania estatal, fazendo com que o Estado sofra ataques sem que suas fronteiras sejam efetivamente maculadas. Tal processo atinge o Brasil e o obriga à criação de um sistema constitucional que possa fazer frente a tal ameaça, especialmente diante do fato de que os modelos constitucionais de exceção para defesa e segurança são incapazes de dotar os entes estatais de mecanismos verdadeiramente eficazes para conter agressões e ataques cibernéticos. Identifica-se o vazio constitucional e a necessidade de criação do Estado de Emergência Cibernética. O tema está situado na área de direito público, mais especificamente na linha de pesquisa de Estado Democrático de Direito no Brasil. No. of bitstreams: 0 Previous issue date: 2018-01-31 The principle of full protection, derived from the Statute of the Child and Adolescent, has as its starting point the Federal Constitution of 1988, which establishes, in its article 227, the duty of the family, society and the State to ensure the child, the adolescent and to the young, with an absolute priority, the right to life, health, food, education, leisure, housing, dignity, respect, freedom and family and community life, and to place them (the child and the adolescent) from all forms of neglect, discrimination, exploitation, violence, cruelty and oppression. On the basis of this assumption, it is possible to question whether, in the course of an alimentary execution, whose creditor is a child or adolescent, and the debtor is a person legally bound, there is, in fact, the prioritization of the child and the adolescent, or if the enforcement process is bound to the constraint of the debtor to make the payment, without presenting the appropriate protection to the child in the course of this process, or even at the end of it, when the credit is not satisfied. This time, the present work deals with the problematic experienced by those who need to execute a maintenance claim that is missing due to the default of the obligator judicially obliged. The title, which is certain, liquid and enforceable, often does not reach credit satisfaction, putting at risk the life of the lesser creditor, who concluded the executory phase without perceiving the minimum necessary at least for their survival. Thus, this work proposes that the State, using the Funds for the Rights of the Child and the Adolescent, establish a Social Bank of Alimony, in view of the constitutional responsibility assigned to it, to remove the child and adolescent from the risk situation, payment of the amount sought in the execution, subrogating itself to the rights of the maintenance claim creditor, being able to execute it as it does in the fiscal executions, including with the inclusion of the name of the debtor in the active debt register. In order to analyze the possibility of this measure, it was necessary to research in foreign legislation, especially in Spain and Portugal, which has a similar institute, considering the adaptation of the foreign institute to the reality of Brazil, and appreciating its effectiveness in those countries that assume alimony responsibility, until 18 (eighteen) years, when the absence of due benefit by the judicially required. Also, research was done in doctrines of these countries to know the effectiveness and application of this form of substitution by the State for the satisfaction of the maintenance claim credit. National doctrinal research was also used, in addition to the jurisprudence of the country, material that built the basis for the foundation of the written language. The general objective was to investigate the treatment given by the country's legal system to the search for alimony credit satisfaction and the presentation of the currently existing enforcement procedures for the embarrassment of the maintenance debtor. As a result, it was perceived that the creation of a social bank of alimony is viable, especially since there is already an organized and fully functioning structure, also revealing the extreme need for the State to assume its responsibility towards the child and youth population when absent from the provision of alimony by judicially obligated, in compliance with the principle of integral protection, giving absolute priority to materially abandoned children and adolescents. O princípio da proteção integral, advindo do Estatuto da Criança e do Adolescente, tem como marco inicial a Constituição Federal de 1988, a qual estabelece, em seu artigo 227, o dever da família, da sociedade e do Estado assegurar à criança, ao adolescente e ao jovem, com a mais absoluta prioridade, o direito à vida, à saúde, à alimentação, à educação, ao lazer, à moradia, à dignidade, ao respeito, à liberdade e à convivência familiar e comunitária, bem como de colocá-los (a criança e o adolescente) a salvo de toda forma de negligência, discriminação, exploração, violência, crueldade e opressão. Partindo desse pressuposto, é possível se questionar se, no curso de uma execução alimentar, cujo credor for criança ou adolescente, e o devedor for pessoa judicialmente obrigada, há, de fato, a priorização da criança e do adolescente, ou se o processo executório está adstrito ao constrangimento do devedor para que realize o pagamento, sem apresentar a devida proteção à criança no curso desse processo, ou mesmo no fim dele, quando não satisfeito o crédito. Desta feita, o presente trabalho trata da problemática vivenciada por quem necessita executar um crédito alimentar faltante pelo inadimplemento do alimentante judicialmente obrigado. O título, que é certo, líquido e exigível, muitas vezes não alcança a satisfação do crédito, colocando em risco a vida do menor credor, que concluiu a fase executória sem a percepção do mínimo necessário ao menos para a sua sobrevivência. Assim, este trabalho propõe que o Estado, utilizando-se dos Fundos de Direitos da Criança e do Adolescente, crie um Banco Social Alimentar para, atendendo à responsabilidade constitucional a si atribuída, retire a criança e o adolescente da situação de risco, efetuando o pagamento do montante buscado na execução, sub-rogando-se nos direitos do credor alimentar, podendo executá-lo como o faz nas execuções fiscais, inclusive com a inclusão do nome do devedor no cadastro de dívida ativa. Para se analisar a possibilidade desta medida, foi necessária a pesquisa na legislação estrangeira, especialmente da Espanha e de Portugal, que possui instituto similar, ponderando a adaptação do instituto estrangeiro à realidade do Brasil, e apreciando sua efetividade naqueles países que assumem a responsabilidade alimentar, até os 18 (dezoito) anos, quando da ausência de prestação devida pelo judicialmente obrigado. Também foram feitas pesquisas em doutrinas desses países para conhecer a efetivação e aplicação dessa forma de substituição pelo Estado para a satisfação do crédito alimentar. Utilizou-se, também, de pesquisa doutrinária nacional, além da jurisprudência pátria, material que construí a base para alicerçar o vertente escrito. Teve-se por objetivo geral investigar o tratamento dado pelo ordenamento jurídico pátrio à busca pela satisfação do crédito alimentar e a apresentação dos procedimentos executórios atualmente existentes para o constrangimento do devedor de pensão alimentícia. Como resultado, percebeu-se que a criação de um banco social alimentar se mostra viável, notadamente por já existir uma estrutura organizada e em pleno funcionamento, revelando-se também a extrema necessidade de o Estado assumir sua responsabilidade para com a população infanto-juvenil quando da ausência da prestação alimentar pelo judicialmente obrigado, em cumprimento do princípio da proteção integral, concedendo prioridade absoluta à criança e ao adolescente abandonados materialmente. No. of bitstreams: 0 Previous issue date: 2017-12-13 The scientific evolution in the field of human reproduction enabled the exercise of autonomy in family planning even after the death of one of the parents, through the use of post mortem assisted reproduction (AR) techniques. The present research seeks to analyze the compatibility of the rules established by the civil legislation, pertinent to the inheritance rights of the posthumous children generated through these techniques, with the constitutional status of the offspring, mediated by the constitutional principle of equality amongst siblings, being their parents unmarried or married. Preliminarily, it presents the evolution of the institute of the affiliation and the analysis of the AR within the scope of the Brazilian legal system. It is important to highlight the absence of a specific legislation capable to regulate this intervention in the reproductive field, especially the letter of consent of the involved parties, the limit of the application of the different techniques, the protector ship given to the exceeding embryo and the gamete, since its very substance induces the presence of human life. Although the Civil Code had expressly mentioned the use of such techniques by the couple bonded my matrimony, justifying the presumption of affiliation of the children conceived through these techniques, it had not disposed the corresponding inheritance right. Reason why an assessment of the general legislation of inheritance rights will be performed in a different moment, emphasizing the succession rights of children compared to the constitutional principle that forces equality amongst them. In order to ensure, in a third moment, the succession rights of the posthumous children, in spite of the legal gap related to the express recognition of the succession legitimacy of these children. In this opportunity, an evaluation of the positioning provided by secondary sources of law and of the bills that seek to regulate AR techniques will be made. Finally, the need to interpret, under the light of the constitutional civil principles, existing regulations, as well as the elaboration of specific laws that protect the rights involved in the collision of principles arising from the use of such techniques, the autonomous exercise of family planning of the surviving participant, the fundamental right to heritage and equality before the other siblings of these posthumous children and the same right to the heritage of the children, or, in their absence, of the heirs alive at the time of the opening of the succession, without forgetting the human dignity of all of them and the need to safeguard Legal Certainty. For such, a bibliographical and documentary research is performed, using the deductive method, since the evaluation of the Brazilian Legal System is required in order to verify if the fundamental inheritance right of posthumous children generated by post mortem AR Techniques is duly protected. We concluded that in order to solve this problem, the application of weighing, the restriction of the colliding rights through the creation of a specific law that acknowledges the legitimacy of succession of the posthumous children, as long as they are generated within 3 years, starting from the death of their parents, period in which such succession is temporary. After which, the post-mortem AR Technique may no longer be performed, and if conducted, the children generated by it may have their ancestry acknowledge but will not be entitled to a legitimate succession. A evolução científica na esfera da reprodução humana viabilizou o exercício da autonomia no planejamento familiar mesmo após o falecimento de um dos genitores, por meio do uso das técnicas de reprodução assistida (RA) post mortem. A presente pesquisa objetiva analisar a compatibilidade das regras estabelecidas pela legislação civil, pertinentes aos direitos sucessórios dos filhos póstumos, gerados por meio dessas técnicas, com o estatuto constitucional da filiação, mediado pelo princípio constitucional da igualdade entre os filhos, sejam ou não casados os genitores. Preliminarmente, apresenta-se a evolução do instituto da filiação e a análise da RA no âmbito do ordenamento jurídico brasileiro. Destaca-se a ausência de legislação específica apta a regulamentar essa intervenção na seara reprodutiva, notadamente quanto ao termo de consentimento informado dos envolvidos, o limite da aplicação das diferentes técnicas, a tutela dispensada ao embrião excedentário e ao gameta, já que a substância daquele induz a presença de vida humana. Conquanto o Código Civil haja mencionado expressamente o uso dessas técnicas pelo casal sob vínculo matrimonial, justificando a presunção de filiação dos filhos concebidos por meio delas, nada dispôs sobre o correspondente direito sucessório. Por essa razão, em um segundo momento, far-se-á uma análise das normas gerais sobre o direito sucessório, ressaltando os direitos sucessórios dos filhos em cotejo com o princípio constitucional que impõe a igualdade entre eles. Para, em um terceiro momento, afirmar os direitos sucessórios dos filhos póstumos, a despeito da lacuna legal quanto ao reconhecimento expresso de legitimação sucessória desses filhos. Nessa oportunidade, far-se-á uma análise do posicionamento dispensado pelas fontes secundárias do direito e dos projetos de lei que buscam regular as técnicas de RA. Por fim, demonstrar-se-á a necessidade de interpretação, a partir da principiologia civil constitucional, das normas já existentes, bem como da elaboração de leis específicas que resguardem os direitos envolvidos na colisão de princípios decorrente do uso dessas técnicas, quais sejam, o exercício autônomo do planejamento familiar da participante sobrevivente, o direito fundamental à herança e à igualdade perante os demais irmãos desses filhos póstumos e o mesmo direito à herança dos filhos, ou, na falta destes, dos herdeiros vivos à época da abertura da sucessão, sem olvidar da dignidade humana de todos eles e da necessidade de resguardo da segurança jurídica. Para tanto, realiza-se uma pesquisa bibliográfica e documental, utilizando-se do método dedutivo, visto que se parte da análise do ordenamento jurídico brasileiro para se constatar se há resguardo ao direito fundamental de herança dos filhos póstumos gerados pelas técnicas de RA post mortem. Conclui-se pela possibilidade de solução do problema, como a aplicação do sopesamento, restringindo-se os direitos em colisão, por meio da elaboração de lei específica que reconheça a legitimação sucessória dos filhos póstumos, desde que gerados no prazo de 3 anos, a contar do falecimento de seus genitores, prazo em que a sucessão será provisória. Depois disso, a técnica de RA post mortem não poderá mais ser realizada, e, caso seja, os filhos dela gerados terão reconhecida sua filiação, mas quedarão sem direito sucessório legítimo. This theme is inserted in the area of concentration Constitutional Law in private relations. Although this, it transcends this area, because it seeks to analyze the social function of public property in its subjective aspect. Thus, in this study is analyzed, at first, the applicability of the social function in relation to the public domain. Having overcome this question, this dissertation takes on an interdisciplinary analysis between Law, Architecture and Psychiatry, because it seeks to demonstrate how the subjective relation between man and urban space arises. In the first chapter, some notions of public property are analyzed: the source of the public property and its state, its classification as to the affectation of the good to the state activity, the evolution of the public domain and the analysis of this in Brazil in its different phases, settlement, Empire and Republic. The second chapter is dedicated to the social function of property. It is about its origin, evolution, legal nature and its approach from the economic analysis of the Law, besides contemplating the social function of property and the democratic state of law and the functionalising laws about Public property. In the last chapter, the different aspects of the social function of property, including the cultural aspect, were approached and, from this, the subjective dimension of urban space and the social function of public property were deepened. For this, the classic and contemporary doctrine on the subject was used, in addition to the pertinent legislation, so it is a bibliographic research. As for the use of results, the research is pure. O presente trabalho, embora represente uma pesquisa sobre função social da propriedade - tema inserido na área de concentração Direito Constitucional nas relações privadas -, transcende esta área, uma vez que busca analisar a função social da propriedade no seu aspecto subjetivo. Assim, neste estudo é analisado, em um primeiro momento, a aplicabilidade da função social em relação ao domínio público. Superada essa questão, esta dissertação envereda por uma análise interdisciplinar entre Direito, Arquitetura e Psiquiatria, pois busca demonstrar como surge a relação subjetiva do homem com o espaço urbano. No primeiro capítulo, foram contempladas noções relativas à propriedade pública, como o surgimento desta e do Estado, a sua classificação quanto à afetação do bem à atividade estatal, a evolução do domínio público e a análise deste no Brasil em suas diferentes fases, Colônia, Império e República. O segundo capítulo, dedicado à função social da propriedade, aborda a sua origem, evolução, natureza jurídica e abordagem a partir da análise econômica do Direito, além de contemplar a função social da propriedade e o estado democrático de direito e as normas funcionalizantes da propriedade pública. No último capítulo, foram abordados os diferentes aspectos da função social da propriedade, inclusive o aspecto cultural e, partir dele, foi aprofundada a dimensão subjetiva do espaço urbano e a função social da propriedade pública a partir deste viés. Para tanto, foi utilizada a doutrina clássica e contemporânea sobre o tema, além da legislação pertinente, logo, trata-se de pesquisa do tipo bibliográfica. The state no longer has a monopoly on the individuals´surveillance, at the same time that the great information managers exert intense control and classification on the network users, through the collection, use, sharing and processing of personal data. There is concerned with the attempt to patrimonialize existential legal situations, among which are the protection of the electronic body, digital identity and the right to informational self-determination, according to the business model. In this way, it is necessary make a readaptation on the traditional legal concepts, such as the right to privacy, in order to accommodate the demands of virtualization of life in relation. Thus, the right to privacy gains a dynamic and supportive aspect, as a right to informational self-determination, which, in turn, deserves the protection of fundamental rights and personality. The dimension of the body frees itself from physicality, to collect the set of information arranged in the virtual environment; just as personal identity bifurcates through the expression of the "virtual self." The central problem of the currently study is the verification of the compatibility of the services provided by social network providers, which carry out sophisticated forms of data collection and processing, in accordance with data protection standards in Brazil, in order to harmonize the clauses in the terms of use and in the privacy policies of the social networks selected to exercise the right to self-determination. Methodologically, it is make a quantitative analysis of the contractual clauses of social networks Facebook, Instagram, Google, Tinder and Pokémon Go, selected due to the multitude of functionalities offered, as well as by reason of the popularity in the segment of services offered. After, the data collected are qualitatively analyzed to identify possible abusiveness in the face of applicable data protection standards as well as weaknesses due to existing omissions. It is concluded that numerous clauses inserted in the terms of use and in the privacy policies of the researched social networks are null and void because they represent a waiver of the users' informational control. Furthermore, silence regarding the regulation of data relating to data processing in general and the collection, sharing and processing of sensitive data is an obstacle to the exercise of the right to self-determination. Therefore, collective tutelage imposes itself as an adequate instrument to plead the protection of the privacy of the respective social networks users. A sociedade da informação adquire, progressivamente, contornos de sociedade da vigilância e do controle. O Estado não detém mais o monopólio sobre a vigilância dos indivíduos, ao passo que os grandes gestores de informações exercem intenso controle e classificação sobre os usuários em rede, por meio da coleta, do uso, do compartilhamento e do tratamento das informações pessoais. Preocupa-se com a tentativa de patrimonialização de situações jurídicas existenciais, dentre as quais se destacam a tutela do corpo eletrônico, da identidade digital e do direito à autodeterminação informativa, por meio do condicionamento desses aspectos aos moldes negociais. Dessa maneira, evidencia-se a necessidade de readaptação dos tradicionais conceitos jurídicos, como o direito à privacidade, a fim de acolher as exigências da virtualização da vida em relação. Assim, o direito à privacidade ganha uma feição dinâmica e solidária, enquanto direito à autodeterminação informativa, o qual, por sua vez, merece a tutela dos direitos fundamentais e de personalidade. A dimensão do corpo liberta-se da fisicalidade, para acolher o conjunto das informações dispostas no meio virtual; assim, como a identidade pessoal se bifurca por meio da expressão do ¿eu virtual¿. A problemática central do estudo concentra-se na verificação da compatibilidade dos serviços prestados pelos provedores das redes sociais, as quais exercem sofisticadas formas de coleta e tratamento de dados, para com as normas de proteção de dados existentes no Brasil, com o objetivo de harmonizar as cláusulas presentes nos termos de uso e nas políticas de privacidade das redes sociais selecionadas ao exercício do direito à autodeterminação informativa. Metodologicamente, faz-se uma análise quantitativa das cláusulas contratuais das redes sociais Facebook, Instagram, Google, Tinder e Pokémon Go, selecionadas em razão da multiplicidade de funcionalidades oferecidas, bem como em razão da popularidade no segmento de serviços ofertados. Em seguida, analisam-se qualitativamente os dados colhidos, de modo a identificar possíveis abusividades diante das normas de proteção de dados aplicáveis, quanto também fragilidades em razão das omissões existentes. Conclui-se que inúmeras cláusulas inseridas, nos termos de uso e nas políticas de privacidade das redes sociais pesquisadas, são nulas de pleno direito por representar renúncia ao controle informacional dos usuários. Outrossim, o silêncio quanto à regulamentação da matéria relativa ao tratamento de dados em geral e à coleta, ao compartilhamento e ao tratamento de dados sensíveis, representa obstáculo ao exercício do direito à autodeterminação informativa. Por isso, a tutela coletiva impõe-se como instrumento adequado para pleitear a proteção da privacidade dos usuários das respectivas redes sociais. No. of bitstreams: 0 Previous issue date: 2017-08-18 The dissertation entitled "The curatorship modified by the Statute of the Person with Disabilities and the existential questions regarding the person with intellectual disability" is presented as an essential requirement for the conclusion of the master's course in Constitutional Law of the University of Fortaleza - UNIFOR - linked to the area of concentration in private law and in the research line of Constitutional Law in Existential Relationships. Its objective is to analyze the existing legislation, focusing on the Statute of the Person with Disability, based on the constitutional guidelines of 1988 and the possible needs for a more comprehensive protection for the person who is in a state of vulnerability. The justification lies in the examination of the personality rights of the person with intellectual disability and in the possible confrontations within the limits of curatorship suggested by the Convention on the Rights of Persons with Disabilities and established by Law 13146/15. The problematic verified is inserted in the existence of situations in which the person does not present the necessary discernment to decide on existential questions and it waives of a greater amplitude of the limits of the curate. The methodology was based on an analytical and critical research, since the author's professional experience as Occupational Therapist identified that not every person with intellectual disability has sufficient maturity to understand the consequences of their actions and to assume responsibilities, requiring that a Third person appropriate, not only in the face of patrimonial issues, but also in matters of existential character, allowing a greater protection to the curated. It has as an expected result an extension of the understanding that the limits of curatorship should be extended to include existential issues, when necessary, to contribute to the thesis proposal and essential antithesis to the sedimentation of values that precede the legislative elaboration, to accommodate and not leave a category of vulnerable people unprotected. A problemática verificada insere-se na existência de situações em que a pessoa não apresenta o necessário discernimento para decidir sobre questões existenciais e prescinde de uma maior amplitude dos limites da curatela. A metodologia utilizou-se de uma pesquisa com foco analítico e crítico, haja vista que a experiência profissional da autora como Terapeuta Ocupacional identificou que nem toda pessoa com deficiência intelectual apresenta maturidade suficiente para entender as consequências de seus atos e assumir responsabilidades, necessitando que um terceiro arrogue, não só frente às questões de cunho patrimonial, mas também nas questões de cunho existencial, possibilitando uma maior proteção ao curatelado. Tem como resultado esperado ampliar o entendimento de que os limites da curatela deverão ser elastecidos, a ponto de abarcar questões existenciais, quando necessário, para contribuir com a proposta de tese e antítese essencial à sedimentação de valores que antecedem a elaboração legislativa, para albergar os destinatários e não deixar desprotegida uma categoria de pessoas em estado de vulnerabilidade. No. of bitstreams: 0 Previous issue date: 2017-07-05 The present thesis aims to support the application of the punitive function in a manner mitigated to collective moral damage in the area of consumer law in Brazilian society. The application of the civil-constitutional methodology was carried out, a bibliographical research was done, consulting normative texts, doctrine, scientific articles, including collective and periodical works of national and foreign authors, besides the jurisprudence examination mainly of the Superior Court of Justice. The problem raised by the thesis is the need for a more effective response to the occurrence of collective moral damage in consumer relations in the current panorama of society. The occurrence of damage of a diffuse or collective nature in the consumerist sphere causes damages that need an effective repair so that the supplier does not cause harm once again. In the first moment the constitutive aspects of civil responsibility and the punitive function were delineated, trying to demonstrate that the civil responsibility in the contemporaneity has expansive characteristics before the consumer society. Following was treated the characterization of collective moral damage and the importance of Diffuse Rights Fund, which manages the amounts collected in the demands arising from the conviction for collective moral damage. Within the perspective of achieving the objective of the work, the importance of collective legal protection in the Consumer Defense Code, the insufficiency of the economic concept, was explained, explaining the importance of the sociological and philosophical analysis for the consumer concept, explained only through thebias of the economic issue in the Consumer Code. A parallel between the punitive function in the American and Brazilian order was demonstrated, as the punitive function has been adopted in a court of law in case of collective moral damage, supporting its suitability to consumerism. As a result, it was verified that it is growing in Brazilian doctrine, as well as in jurisprudence, the application of the punitive function in a way mitigated to the collective moral damage that occurred in the consumerist sector. A presente tese tem como objetivo geral sustentar a aplicação da função punitiva de maneira mitigada ao dano moral coletivo na seara do direito consumerista na sociedade brasileira. Utilizou-se a aplicação da metodologia civil-constitucional. Foi desenvolvida pesquisa bibliográfica, por meio da consulta a textos normativos, doutrina, artigos científicos, incluindo-se obras coletivas e periódicos de autores nacionais e estrangeiros, além do exame da jurisprudência principalmente do Superior Tribunal de Justiça. A problemática levantada pela tese é a de fundamentar no ordenamento jurídico brasileiro uma resposta mais efetiva à ocorrência do dano moral coletivo nas relações de consumo no panorama atual da sociedade. A ocorrência do dano de natureza difusa ou coletiva no âmbito consumerista traz prejuízos que necessitam de uma efetiva reparação para que o fornecedor não volte a causar dano. No primeiro momento foram delineados os aspectos constitutivos da responsabilidade civil e a função punitiva, buscando-se demonstrar que a responsabilidade civil na contemporaneidade possui características expansivas frente à sociedade consumerista. A seguir tratou-se da caracterização do dano moral coletivo e a importância do Fundo de Direitos Difusos que gerencia os valores arrecadados nas demandas oriundas da condenação por dano moral coletivo. Dentro da perspectiva de alcançar o objetivo do trabalho, foi explicada a importância da tutela jurídica coletiva no Código de Defesa do Consumidor, a insuficiência do conceito econômico, explanando-se a importância da análise sociológica e filosófica para o enquadramento do conceito de consumidor, tratado apenas no viés da questão econômica no Código. Realizado um paralelo entre a função punitiva no ordenamento americano e brasileiro, foi demonstrado como a função punitiva vem sendo adotada em julgados em caso de dano moral coletivo respaldando a sua adequação à seara consumerista. Como resultado verificou-se que é crescente na doutrina e na jurisprudência brasileira a aplicação da função punitiva de maneira mitigada ao dano moral coletivo ocorrido na seara consumerista. No. of bitstreams: 0 Previous issue date: 2016-11-30 The present research proposes an analysis of the possible tension between the exercise of parental authority and the protection of the autonomy and integrity of the child and adolescent, especially when it impairs the psychophysical integrity and general freedom, especially with respect to their freedom of belief and with a view to the possible conciliation of the principles in apparent conflict, in order to construct criteria of argumentation that help the judges in the solution of eventual cases put to the resolution. In this context, the recognition of the minor as a subject of law and the instrumental function of the family in favor of the well-being and development of the person of its members caused changes in the institute of family power, in which parents collect legal positions. With the advancement of the child's development, his ability to make free and responsible choices broadens, while conversely, parental authority is reduced. In considering the general clause of guardianship of the human person, one has to ask about the child's decisional ability to deal with existential aspects, as would be the case with religious options. The research inquires about the eventual right to religious freedom of children and adolescents in the face of parents, ascertaining the child's ability to decide on belief and worship and / or to submit to the effects of that decision by the parents. The central premise adopted was that the person endowed with the capacity for discernment should have his choices respected, especially on the level of existential questions. Through bibliographic and documentary research, based on the methodology of civil-constitutional law, it is concluded that the principle of best interest should be used as an interpretative vector in cases of conflict involving the protection of children and adolescents, in order to optimize the promote the development of the personality of children. Thus, in early childhood, parental authority will prevail, absent discernment, and adolescence will prevail self-determination of adolescents in matters relating to their privacy, except when another fundamental right of these children and adolescents is better suited to the promotion of their integral development. A presente pesquisa propõe uma análise da eventual tensão existente entre o exercício da autoridade parental e a proteção à autonomia e integridade da criança e adolescente, especialmente quando implicar prejuízo à integridade psicofísica e liberdade geral, notadamente no que diz respeito à sua liberdade de crença e culto, visando a possível conciliação dos princípios em aparente conflito, de modo a construir critérios de argumentação que ajudem os julgadores na solução de eventuais casos postos à resolução. Nesse contexto, o reconhecimento do menor como sujeito de direito e a função instrumental da família em favor do bem estar e do desenvolvimento da pessoa dos seus membros provocaram alterações no instituto do poder familiar, em que os pais colecionam posições jurídicas. Com o avançar do desenvolvimento da criança, sua capacidade de realizar escolhas livres e responsáveis se amplia, ao passo que inversamente reduz-se a autoridade parental. A considerar a cláusula geral de tutela da pessoa humana, é de se perguntar sobre a capacidade decisional da criança para tratar de aspectos existenciais, como seria o caso das opções religiosas. A pesquisa indaga sobre eventual direito à liberdade religiosa das crianças e adolescentes em face dos pais, averiguando a capacidade da criança para decidir sobre crença e culto e/ou para se submeter aos efeitos dessa decisão por parte dos pais. Adotou-se a premissa central de que a pessoa dotada da capacidade de discernimento deve ter suas escolhas respeitadas, mormente no plano das questões existenciais. Por meio de pesquisa bibliográfica e documental, fundada na metodologia do direito civil-constitucional, conclui-se que o princípio do melhor interesse deve ser utilizado como vetor interpretativo nos casos de conflito envolvendo a tutela das crianças e adolescentes, de modo a otimizar a promoção do desenvolvimento da personalidade das crianças. Assim, na primeira infância, prevalecerá a autoridade parental, eis que ausente discernimento, e na adolescência prevalecerá a autodeterminação dos adolescentes em matérias relativas a sua privacidade, salvo quando outro direito fundamental dessas crianças e adolescentes melhor se adequar à promoção de seu desenvolvimento integral. No. of bitstreams: 0 Previous issue date: 2016-08-25 The dissertation scope is to study how Law & Economics instruments can increase the effectiveness of environmental protection when it conflicts with the exercise of the property right. Three were its main axes: the property, the environment and Law & Economics that would make the three parts of the development. The three all reaches to the fourth part to use the concepts studied in order to articulate them as a method to harmonize the practical conflicts arising from the implementation of the principles of economic, specifically, property and preservation of urban natural spaces. It is used to explain, emblematic cases of assaults that threaten natural space known as Coco Park in Fortaleza. With regard to property, expressed their legal nature based on the historical evolution of this right. Serve it to the 'Magna Charta', the Roman law and the Virginia Declaration. The Declaration of Human and Citizen Rights is brought in the wake of the French Revolution. The position of the Catholic Church is studied from the papal encyclicals. The Industrial Revolution and World War draw attention to the human capacity to act on a large scale and create the risk of perishing. In part that deals with the environment deepens the notion that man can be responsible for creating their own biological impossibility. The evolution of the concerns in keeping healthy and ecologically balanced natural spaces also becomes legal. In this sense environmental problems is brought by the bias of the risk of depletion of natural resources not susceptible of exclusive appropriation. The "Tragedy of the Commons" by Garret Hardin is brought into play to identify the point of contact between environmental and economic concerns. The exploitation of natural resources above the natural regeneration capacity is scalable by indicators of the ecological footprint. This quantification discusses the economic issue: sustainability, market failures and rational allocation. The chapter dealing with the Law of Economic Analysis search tools to overcome this challenge. Arthur Pigou and Ronald Coase are called to provide the basis of economic thought that, in the fourth part offers cooperative solution, based on mutual advantage. With this comes an alternative to litigation model based on the allocation of pre-defined rights, regardless of arrangements that can provide greater benefit to interested parties. The scope of the latter part is to demonstrate that the benefit pursued may include collective interests, quantifiable ideals of justice and environmental preservation. Even in the fourth part, considerations are presented that demonstrate the usefulness of economic analysis to make effective the objectives of enhancing the results to the optimum level. The reports of disputes involving the ¿Cocó Park¿ indicate present examples in which efficiency and cooperation should be applied. The bibliographic and documentary research, with mainstay in data, makes the descriptive and exploratory exhibition, as it proposes to offer solutions to problems that evidence. To use the own economy methodology used is quantitative indicators, graphics and the most common functions to the exact sciences. Três foram seus eixos principais: a propriedade, o meio ambiente e a análise econômica do direito que viriam a compor as três partes do desenvolvimento. Delas chega-se à quarta que formula utilidade para os conceitos estudados no sentido de articulá-los como método para harmonizar os conflitos práticos resultantes da concretização dos princípios da ordem econômica, especificamente, propriedade e preservação dos espaços naturais urbanos. Serve-se para tanto, de casos emblemáticos de investidas que ameaçam espaço natural conhecido por Parque do Cocó, em Fortaleza. No que diz respeito à propriedade, expressa sua natureza jurídica baseada na evolução histórica desse direito. Serve-se para isso da Charta Magna, do Direito romano e Declaração de Virgínia. A Declaração dos Direitos do Homem e do Cidadão é trazida na esteira da Revolução Francesa. A posição da Igreja Católica é estudada a partir das encíclicas papais. A Revolução Industrial e a 2ª Guerra Mundial chamam atenção para a capacidade humana de agir em grande escala e criar o risco de perecimento. Na parte que trata do meio ambiente aprofunda-se a noção de que o homem pode ser o responsável por criar sua própria inviabilidade biológica. A evolução das preocupações em manter os espaços naturais sadio e ecologicamente equilibrado passa a ser também jurídica. Nesse sentido a problemática ambiental é trazida pelo viés do risco da exaustão dos recursos naturais insuscetíveis de apropriação exclusiva. A ¿Tragédia dos Bens Comuns¿ de Garret Hardin é trazida à colação para identificar o ponto de contato entre a preocupação ambiental e econômica. A exploração de recursos naturais acima da capacidade de regeneração natural é dimensionável por indicadores da pegada ecológica. Essa quantificação problematiza a questão econômica: sustentabilidade, falhas do mercado e alocação racional. O capítulo que trata da Análise Econômica do Direito busca ferramentas para transpor esse desafio. Arthur Pigou e Ronald Coase são chamados a oferecer as bases do pensamento econômico que, na quarta parte oferece solução cooperativa, baseada no proveito recíproco. Com isso surge alternativa ao modelo litigioso baseado na alocação de direitos previamente definido, independente de arranjos que possam oferecer maior vantagem aos interessados. O escopo da última parte é demonstrar que o proveito perseguido pode incluir interesses coletivos, ideais de justiça quantificáveis e preservação ambiental. Ainda na quarta parte, são apresentadas considerações que demonstram a utilidade da análise econômica para tornar eficientes os objetivos de potencializar os resultados ao nível ótimo. Os relatos dos litígios que envolvem o Parque do Cocó indicam apresentam exemplos nos quais eficiência e cooperação devem ser aplicados. A pesquisa bibliográfica e documental, com esteio em dados, torna a exposição descritiva e exploratória, na medida que se propõe a oferecer soluções para problemas que evidencia. Para usar a metodologia própria da economia serve-se de indicadores quantitativos, gráficos e funções mais comuns às ciências exatas. Parallel to the jurisprudential construction, there is the parental planning a doctrinal framework innovating prospects for overcoming the void and damaging formalism, already influenced by the constitutionalization of civil right, that horizons did expand the possibilities for new solutions to old demands, and that will always be present, to supplement a material need inherent in man, in their property relations. The development of this disertation is divided into chapters, with a previous evolutionary guide to the Constitution of 1988 and the new expectations for it generated, with the mark of the jurisdictional action touched by social expectations directed to the achievements that could be created from the incidence of fundamental rights in private relationships. Property Law Amparada pela justiça, segurança jurídica e boa-fé nos contratos, a jurisprudência vem se consolidando em três súmulas do STJ, relativas a negócios imobiliários, para proteger os adquirentes de bens imóveis, ainda que estes não tenham seguido preceitos expressos em Lei. O propósito da presente pesquisa é delinear os fundamentos, inclusive constitucionais, que respaldem as decisões, mesmo quando estas são contrárias a claras disposições normativas. Paralelo à construção jurisprudencial, há no ordenamento pátrio um arcabouço doutrinário inovando em perspectivas de superação ao formalismo vazio e prejudicial, já influenciado pela constitucionalização do direto civil, cujos horizontes fizeram expandir as possibilidades de novas soluções para antigas demandas, e que serão sempre atuais, para suprir uma necessidade material inerente ao homem, em suas relações patrimoniais. O desenvolvimento do trabalho encontra-se dividido em capítulos, com um roteiro evolutivo anterior à Constituição de 1988, e às novas expectativas por esta geradas, com a marca da atuação jurisdicional sensibilizada com os anseios sociais direcionados às conquistas que pudessem ser criadas a partir da incidência dos direitos fundamentais nas relações privadas. To achieve the purpose is made an approach to legal institutions governing property rights in the country, with emphasis on related to property as a fundamental right and its social function. A historical and contextualized analysis of these rights and considerations about overcoming the classic dichotomy between rights of things and personal rights are demonstrated is made. The characteristics of real rights will be exposed to it is found the relevance of recognizing the timeshares in this branch of law. As in Brazil adopts the theory selective admission and typicality, only through legal provision to timeshares can be treated as real right, with all its effects. As there is no legislation that meets the satisfaction of the institute, the development of the economic potential of this type of business is impaired. Moreover, the absence of rule creates legal uncertainty for potential investors avoid hiring without having knowledge of the legal protection. An analysis from the constitutionalization of civil law phenomenon is made, the principles interfere in these legal relations, especially the principles of human dignity and their consequences as private autonomy and the right to leisure. It will be exposed about overcoming the traditional distinction between public law and private law. O presente artigo tem por escopo analisar o tratamento jurídico dado ao instituto do direito de multipropriedade no Brasil. Para conseguir o objetivo é realizada uma abordagem dos institutos jurídicos que regulam os direitos reais no país, com ênfase nos relacionados à propriedade, enquanto direito fundamental, e sua função social. É feita uma análise histórica e contextualizada desses direitos, bem como são demonstradas ponderações sobre a superação da clássica dicotomia entre direitos das coisas e direitos pessoais. As características dos direitos reais serão expostas para que se constate a pertinência de se reconhecer a multipropriedade nesse ramo do direito. Como no Brasil se adota a teoria do numerus clausus e da tipicidade, somente por meio de disposição legal a multipropriedade pode ser tratada como direito real, com todos os seus efeitos. Como não há legislação que atenda de forma satisfatória esse instituto, o desenvolvimento do potencial econômico desse tipo de negócio fica prejudicado. Ademais, a ausência de norma gera insegurança jurídica, pois os possíveis investidores evitam contratar sem ter conhecimento do amparo legal. É feita uma análise, a partir do fenômeno da constitucionalização do direito civil, de como os princípios interferem nessas relações jurídicas, principalmente os princípios da dignidade da pessoa humana e seus consectários, como a autonomia privada e o direito ao lazer. Discorre-se sobre a superação da tradicional distinção entre direito público e direito privado. Busca-se demonstrar, a partir de exposição de problemas concretos e de experiências legislativas estrangeiras, que a multipropriedade deve ser regulamentada enquanto direito real, o que daria maior segurança jurídica aos empreendedores e estimularia o setor. No. of bitstreams: 0 Previous issue date: 2016-07-25 The property has undergone transformations throughout the history of the law, revealing characteristics of every age and social context and must be shown that nowadays has to achieve social purpose. The social function of property stems from the exercise of inherent powers to the owner that should harmonize with the social interest, without representing the socialization of property. Obtaining property by transmissive title and as a result of possessssory relationship are linked to the Public Records in originating and derived acquisitions as well as the role of standardsprinciples in registral activity. Possession is highlighted in national and foreign doctrine, both in the traditional aspect of the institute leading to the property, as well as the perspective of autonomy that recognizes other its legal effects. Based in possession, qualified for the work or the housing, the §§4º and 5 of art. 1228 of the 2002 Brazilian Civil Code provide for the legal instrument designed to protect the possessors against arbitrary evictions fulfilled by the owner, to enable the compulsory acquisition of real state they occupy. In the explanatory memoranda of the bill that led to the Civil Code of 2002, the instrument was called by Miguel Reale as private judicial expropriation, although this designation is inadequate because it is not a expropriation method, but potestative right to acquire the property based on laborpossession. National law doctrine misidentified as an adverse possession mode baucause of apparent similarity with the requirements of the disciplinary rules of the special collective adverse possession. It is notorious the disparity of interpretations and doctrinal and jurisprudential positions on national collective adverse possession and private judicial expropriation, because of the misunderstanding of the right to compulsory acquisition as a punishment for the breach of the social function of property. The magistrate has special relevance in the comprehension of unevaluated legal concepts set out in paragraph 4 of art. 1228 of the Civil Code of 2002 and the determination of mandatory payment of fair compensation to the owner. The thesis argues that possessor must demonstrate functionalization of possession carries on the real state possessed, being irrelevant to the acquisition that social function of property has been violated by the property owner. The implementation of property rights is one of possible effects of private judicial expropriation however the right to compulsory acquire, which has ben designed to the protection of possessors does not provide implementation of public policies or support the fundamental right to adequate housing. A propriedade passou por transformações ao longo da história do Direito, revelando características próprias de cada época e contexto social, devendo ser evidenciado que na contemporaneidade passou a ter finalidade social. A função social da propriedade decorre do exercício das faculdades inerentes ao proprietário que deve harmonizar-se com o interesse social, sem que isso represente a socialização da propriedade. A obtenção da propriedade por título translativo e em decorrência da posse vinculam-se aos Registros Públicos nas aquisições originárias e derivadas assim como a função das normas-princípios na atividade registral. A posse é destacada na doutrina nacional e estrangeira, tanto na vertente tradicional do instituto que conduz à propriedade, como também na perspectiva da autonomia que lhe reconhece outros efeitos jurídicos. Com fundamento na posse, qualificada pelo trabalho ou pela moradia, os §§4º e 5º do art. 1.228 do Código Civil brasileiro de 2002 dispõem sobre o instrumento jurídico concebido para proteger os possuidores contra despejos arbitrários perpetrados pelo proprietário, ao possibilitar a aquisição compulsória da propriedade imóvel que ocupam. Nas exposições de motivos do projeto de lei que originou o Código Civil de 2002, o instrumento foi denominado por Miguel Reale como desapropriação judicial privada, embora tal designação seja inadequada por não se tratar de método expropriatório, mas de direito potestativo à aquisição da propriedade em razão da posse-trabalho. O instituto também é equivocadamente identificado na doutrina nacional como modalidade de usucapião em face de aparente semelhança com os requisitos previstos na legislação disciplinadora da usucapião especial coletiva. É notória ainda a disparidade de interpretações e dos posicionamentos doutrinários e jurisprudenciais nacionais acerca da usucapião coletiva e da desapropriação judicial privada, em razão da equivocada compreensão do direito a aquisição compulsória como sanção pelo descumprimento da função social da propriedade. O magistrado tem especial relevância na assimilação dos conceitos jurídicos indeterminados previstos no §4º do art. 1.228 do Código Civil de 2002 e na determinação da obrigatoriedade do pagamento da justa indenização ao proprietário. Defende a tese que o possuidor deverá comprovar a funcionalização da posse que exerce sobre o bem possuído, sendo irrelevante para a aquisição do mesmo, se a função social da propriedade foi descumprida pelo proprietário. A concretização do direito de propriedade está situada dentre os possíveis efeitos do instrumento denominado como desapropriação judicial privada, contudo resta demonstrado que este instituto destinado à proteção dos possuidores não favorece a implementação de políticas públicas habitacionais nem efetiva o direito fundamental à moradia adequada. No. of bitstreams: 0 Previous issue date: 2016-06-29 This dissertation has as general aim to analyze constitutional adaptation for the use of Superior Court of Justice¿s (STJ) precedent as a parameter to square and to fix the quantum of compensation from individual moral damage, in order to minimize law¿s subjective and insecurity about the theme. By using civil-constitutional methodology, a bibliographic research was carried out, consulting normative texts, books and scientific articles, from collective works and periodic, from national and international authors. It was also realized a jurisprudence examination, concentrated in the interior of judgments, that analyzed the individual moral damage value from the Third and Fourth STJ Panel, in the period among the years 2010 and 2015. This work has quantitative and qualitative approaches, which were realized by the help of an informatics¿ program ordered to this research specifically. The dissertation has three chapters: a) in the first one, it was explained the theoretical configuration of individual moral damage and especially about its indoctrinated definition, its nature and its functions. After that, it were approached the main standard that are used to square and to fix this damage, brought by the legislator and completing by the doctrine; b) the second one aimed to outline the precedent¿s role in Brazilian judicial system, especially in New Brazilian Civil Procedure Code (NCPC); and c) in the third one, the theme were really analyzed as of theoretical base from the two previous chapters. From an existential perspective and from the fundaments clearly showed in the 1st article of Brazilian Federal Constitution (CF/1988), dignity and substantial equality were elected as the axial base and principle foundation of this work. Finally, it was supposed that before the potential risk to not promote the ones whole protection, cause despises the cases¿ individualities and favors formal isonomy, the precedent is not up to the standard inherent of a person dignity value and to the substantial equality principle. This way, precedent is inappropriate for the protection of existential interests involved. A presente dissertação tem como objetivo geral analisar a adequação do uso do precedente do Superior Tribunal de Justiça (STJ) como parâmetro para a liquidação e a fixação do quantum compensatório do dano moral individual, a fim de minimizar a subjetividade e a insegurança jurídica do tema. Com aplicação da metodologia civil-constitucional, realizou-se uma pesquisa bibliográfica, consultando-se textos normativos, livros e artigos científicos, de obras coletivas e periódicos, de autores nacionais e internacionais, bem como um exame de jurisprudências, concentrado no interior de acórdãos, que apreciaram o valor do dano moral individual, da 3ª e da 4ª Turmas do STJ, no período compreendido entre os anos de 2010 a 2015. O trabalho tem abordagens quantitativa e qualitativa, as quais foram realizadas com o auxílio de um programa de informática encomendado especificamente para essa pesquisa. A dissertação foi divida em 03 (três) capítulos: a) no primeiro, discorreu-se sobre os contornos teóricos do dano moral individual e, em especial, sobre a sua definição doutrinária, a sua natureza e as suas funções, após o que se abordaram os principais critérios, trazidos pelo legislador e complementados pela doutrina, que são utilizados para a liquidação e a fixação desse dano; b) no segundo, buscou-se delinear o papel do precedente no sistema jurídico brasileiro e, em especial, no Novo Código de Processo Civil Brasileiro (NCPC); e c) no terceiro, a partir da fundamentação teórica dos dois capítulos anteriores, analisou-se o tema na prática. Tendo em vista a perspectiva existencial envolvida e os fundamentos estampados no artigo 1º da Constituição da República Federativa do Brasil (CF/1988), elegeu-se a dignidade e a igualdade substancial como, respectivamente, a base axiológica e a fundamentação principiológica do presente trabalho. Finalmente, levantou-se como hipótese que, diante do risco potencial de não promover a proteção plena da pessoa, por desprezar a individualidade dos casos e privilegiar a isonomia formal, o precedente não se harmoniza às exigências inerentes ao valor da dignidade da pessoa e ao princípio da igualdade substancial, sendo inadequado, pois, para a tutela dos interesses existenciais envolvidos.
