A partir de aportes feministas e queer, sobretudo da criminologia, localizamos as bases históricas e teóricas do debate sobre violência doméstica para discutir a domesticação do feminismo da Lei Maria da Penha pelo direito e como ele reinscreve mulheres lésbicas em estereótipos de gênero heterossexistas.Palavras-chave: Violência doméstica; Lésbica; Judiciário de Minas Gerais. AbstractThis is a study on the framework that the Minas Gerais’ Judiciary produces for homosexual relationships between women for the purpose of protection from situations of domestic violence. From feminist and queer contributions, especially from criminology, we locate the historical and theoretical bases of the debate on domestic violence to discuss the domestication, by the law, of Maria da Penha Law’s feminism and how it reinscribes lesbian women into heterosexist gender stereotypes.Keywords: Domestic violence; Lesbian; Minas Gerais’ Judiciary.

Aceito em 01 de novembro de 2015.DOI: 10.12957/rqi.2016.18163ResumoO presente artigo questiona a existência de uma verdadeira cultura jurídica brasileira mediante a análise histórico-filosófica dos principais momentos em que tal estrutura teria se desenvolvido no país, o que é feito tendo em vista o pano de fundo traçado por clássicos intérpretes do Brasil, tais como Caio Prado Júnior, Darcy Ribeiro, Sérgio Buarque de Holanda, Wilson Martins e Oliveira Viana, entre outros. A investigação identificou algo que se poderia chamar de tradição da exceção no domínio da cultura jurídica brasileira, fenômeno que se traduz mediante a negação de padrões normativos abstratos e gerais, a importação acrítica de doutrinas e normatividade estrangeiras, a manutenção de formas aristocráticas de vivência social e a desconsideração do povo brasileiro enquanto sujeito político. O texto termina com uma reflexão sobre as potencialidades e os problemas do atual momento histórico, no qual pela primeira vez surge a possibilidade de uma real emancipação nacional.Palavras-chave: Brasil. Exceção.Abstract This article asks about the existence of a true Brazilian legal culture through historical and philosophical analysis of the key moments when such structure would have developed in the country, which is done in view of the background outlined by classical interpreters of Brazil such as Caio Prado Junior, Darcy Ribeiro, Sérgio Buarque de Holanda, Wilson Martins and Oliveira Viana, among others. The research has identified something that might be called the tradition of exception in the Brazilian legal culture, a phenomenon that is translated by the denial of abstract and general normative standards, the uncritical importation of foreign doctrines and normativity, the maintaining aristocratic forms of social life and the disregard of the Brazilian people as political subject. The text ends with a reflection on the potential and the current historical moment problems, which first arises the possibility of a real national emancipation. Keywords: Brazil. Culture. Right. This paper proposes a study on the normative tradition of imperial China in the context of its perceptions on mankind and nature. Its linguistic, intellectual and ethical peculiarities are taken into consideration in order to explain the reasons why liberty hasnt been a concern in classical Chinese culture. The notion is not only absent from the debates of the great Chinese thinkers, but also one cannot find in classical Chinese an ideogram that matches the idea. Why liberty, which is so constitutive of the imaginary and the prevailing discourses in the Western cultures, were absent in a civilization as sophisticated as the Chinese? In order to answer that question, we sought to expose the prevailing characteristics of imperial Chinas normativity, trying to demonstrate how its perceptions on mankind and nature tend to resist and to distance themselves from what, in the Western civilization, was thought as liberty., O presente artigo tem como objeto a tradição normativa da China imperial no contexto de suas percepções sobre o homem e o mundo. A partir de um exame de suas peculiaridades linguísticas, intelectuais e éticas, busca-se compreender as razões pelas quais não se teria produzido na cultura chinesa clássica uma preocupação com a liberdade. A noção não só está ausente dos debates dos grandes pensadores chineses, como não se encontrará na língua chinesa clássica nenhum ideograma que corresponda à ideia. Por que a liberdade, que é tão constitutiva do imaginário e dos discursos prevalecentes no Ocidente, esteve ausente em uma civilização tão sofisticada e longeva como a chinesa? Para responder essa questão, procuramos expor neste trabalho as características prevalecentes da normatividade da China imperial, tentando demonstrar como as suas percepções sobre o homem e o mundo resistem e se distanciam daquilo que no Ocidente se pensou como liberdade.

A partir de Ronald Dworkin e seu marco teórico Integridade do Direito, sob o recorte específico da Integridade na Legislação, pretende-se verificar com a presente pesquisa, a existência de omissão da República Federativa do Brasil quanto à correta responsabilização criminal daqueles que cometem atos atentatórios contra a liberdade sexual da população LGBTI. Por meio da apresentação de dados estatísticos, notadamente aqueles obtidos no Relatório sobre a Violência Contra a População LGBTI nas Américas – texto publicado pela Organização dos Estados Americanos em 2015, aqui sob o recorte específico do Brasil –, bem como por meio da apresentação de um caso específico, qual seja, o Caso Baliera (Petição de Ingresso contendo a denúncia do Estado Brasileiro junto à Comissão Interamericana de Direitos Humanos por violação ao Pacto de San Jose da Costa Rica, diante da ausência de repressão eficiente a crime cometido contra um LGBTI) e outros dados públicos, pretende-se evidenciar o número alarmante de casos de violência cometidos contra essa parcela específica da população no Brasil. Objetiva-se também demonstrar ser a liberdade sexual, aqui entendida como direito à livre orientação sexual e à livre expressão da identidade de gênero, um direito fundamental já positivado na Constituição da República Federativa do Brasil de 1.988. A promulgação da nova Constituição num momento de reabertura democrática e política foi um contexto ímpar na história das conquistas de direitos fundamentais no Brasil. Partindo dessa premissa, pretendese evidenciar que a interpretação do inciso XLI, do artigo 5º constitucional revela a omissão inconstitucional do Congresso Pátrio em criminalizar a homofobia e a transfobia. Objetiva-se ainda discutir a (in)adequação da legislação existente para punir eficazmente tais atos discriminatórios. Finalmente, apresenta-se o Mandado de Injunção e a Ação Direta de Inconstitucionalidade por Omissão como mecanismos processuais adequados para o saneamento da referida omissão. Desse modo o problema central da presente pesquisa é diagnosticar a existência ou não de omissão legislativa em criminalizar a homotransfobia, objetivando apontar mecanismos para o saneamento da referida omissão, caso essa seja confirmada. Based on Ronald Dworkin and his theoretical framework of Integrity of Law, under the specific clipping of Integrity in Legislation, we intend to check with the present investigation, the existence of an omission by the Federative Republic of Brazil regarding the correct criminal responsibility of those who commit acts against the sexual freedom of the LGBTI population. Through the presentation of statistical data, notably those obtained in the Report on Violence against LGBTI Population in the Americas - a text published by the Organization of American States in 2015, here under the specific heading of Brazil -, as well as by presenting an specific case, namely the Baliera Case (Petition for Injunction containing the denunciation of the Brazilian State in the Inter-American Commission on Human Rights for violation of the Pact of San Jose of Costa Rica, in the face of the absence of efficient repression of a crime committed against an LGBTI) and other public data, it is intended to highlight the alarming number of cases of violence committed against this specific portion of the population in Brazil. It is also intended to demonstrate be the sexual freedom, understood here as the right to free sexual orientation and the free expression of gender identity, a fundamental right already affirmed in the Constitution of the Federative Republic of Brazil of 1988. The promulgation of the new Constitution at a time of democratic and political reopening was a unique context in the history of the achievement of fundamental rights in Brazil. Based on this premise, it is intended to show that the interpretation of section XLI of article 5 of the Constitution reveals the unconstitutional omission of the National Congress to criminalize homophobia and transphobia. It also aims to discuss the (in) adequacy of existing legislation to effectively punish such discriminatory acts. Finally, the injunction and the Direct Action of Unconstitutionality by Omission are presented as adequate procedural mechanisms for the reorganization of said omission. Thus, the central problem of the present research is to diagnose the existence or not of legislative omission to criminalize homotransphobia, aiming at pointing out mechanisms for the sanitation of said omission, if this is confirmed.
