This article analyses the position of the customary and traditional courts within the framework of the Statute of Autonomy of the Valencian Community, arguing their position as institutions of the Generalitat over which different statutory powers can be deployed. The work begins by contextualising the Valencian statutory text in the wording given by the reform introduced in 2006, followed by a comparative analysis with other statutes of autonomy, which allows us to conclude the relevance that the customary and traditional courts based in the Valencian Community have for the Generalitat and the margins for articulating mechanisms to guarantee their wider recognition and development. It then goes on to analyse the material spheres in which the political action of the Generalitat has been projected, identifying the jurisdictional titles most closely related to the function exercised by these courts, and shows the possibilities that still remain to be explored, formulating specific proposals for a more ambitious Valencian statutory development. The study concludes by formulating a proposal for statutory reform, with the aim of placing all the customary and traditional courts, three of the four of which are in the Valencian Community, on an equal footing, as well as the different possibilities for statutory development offered by the different jurisdictional titles involved.
