Questions about methods hardly featured at PhD defenses in international law at a specific university some twenty years ago. Doctrinal scholarship was the default, and its method was supposed to be so obvious that it did not require elaboration: this was simply the legal method.Some (usually external) examiners caused a stir much to the frustration of the candidates supervisors, giants in the field of international law when they insisted on corrections on the ground that the dissertation did not have a methods section. The candidate then had to justify indeed, think aboutthe method after all the substantive research had been done. Where to start for writing this add-on? Prompted by the words method and international law, Google and legal databases took the almost-Doctor to an issue of the American Journal of International Law (AJIL) that had come out in the late 1990s: Symposium on Method in International Law, edited by Steven Ratner and Anne-Marie Slaughter. To the relief of the candidate confronted with the demanding examiner, the list of methods presented in the Symposium legal positivism, the New Haven School, international legal process, critical legal studies, international law and international relations, feminist jurisprudence, and law and economics contained one that most resembled what they had been doing: legal positivism. So with reference to the Symposium, they then wrote the requested additional section by describing legal positivism, which, according to Symposium contributors Bruno Simma and Andreas Paulus, sees law as a unified system of rules. Had Martti Koskenniemi been an examiner, he would probably already in those days have taken issue with the candidate s picking a method off the shelf.

This article explores the relationship betweenthe history of international criminal law, thehistorical turn in international law, and LatinAmerica. The article argues that the «textbooknarrative» has facilitated the justification ofthe project of international criminal law at theexpense of spreading a simplistic history thatassumes that the discipline has existed in itsactual form since, at least, the aftermath ofWorld War II. The article shows how this narrative has begun to be challenged by the historical turn in international law, which has instilleda methodological concern to international legal scholarship broadly. Finally, this article arguesthat the exclusion of certain developments thattook place in Latin America during the transitions to democracy starting in the 1980s fromthe conventional history of international criminallaw points to a number of significative problemsin the historiography of the discipline. Este artículo explora la relación entre la historiadel derecho penal internacional, el giro histórico en el derecho internacional y América Latina.Argumenta que la «narrativa del manual» ha facilitado la justificación del proyecto del derechopenal internacional, a expensas de difundir unahistoria simplista que asume que la disciplinaha existido en su forma actual desde, al menos,la posguerra de la Segunda Guerra Mundial. Elartículo muestra cómo esta narrativa ha comenzado a ser desafiada por el giro histórico en elderecho internacional, que ha infundido una preocupación metodológica al estudio del derechointernacional en general. Por último, el artículoargumenta que la exclusión de ciertos desarrollosque tuvieron lugar en América Latina durante lastransiciones a la democracia a partir de la década de 1980 de la historia convencional del derecho penal internacional señala ciertos problemas significativos en la historiografía de la disciplina.&nbsp

Resumen basado en el de la publicación Se presenta un análisis comparativo, en el que se ponen de relieve tanto las similitudes como las diferencias que se desprenden de una lectura detenida de 'Everyman' y el 'Libro de Buen Amor', con el fin de interpretar sus matices ideológicos. Para ello, se estudia en profundidad la función trascendental desempeñada por el personaje de la Muerte, el cual, aparece definido por medio de los rasgos siguientes: universalidad, inevitabilidad y permanencia. También se incide en las diferencias con respecto al tema de la muerte tras la lectura de ambas obras, para ello, se presta especial atención a los siguientes aspectos: la enemistad hacia el mundo, la relación entre la muerte y el infierno y el problema del temor a la muerte. Antonio Machado considera la poesía como algo que expresa fundamentalmente intuiciones, en el sentido de experiencia externa o contacto directo con el mundo sensible. La poesía para Machado es algo que expresa esencialmente tiempo, aunque aspire a la intemporalidad, ha de darnos la medida del fluir temporal, del tiempo psíquico del poeta, y ello valiéndose de imágenes que expresen intuiciones. La investigación se propone la sistematización de esa serie de ideas, expresadas en numerosos escritos de toda índole, que Machado no quiso organizar. Incluye un apéndice que recoge, por orden alfabético, diversos juicios críticos de Machado sobre autores, novelistas, hombres de letras en general que aparecen dispersos en su obra.
