[ES] Este trabajo de investigación analiza y profundiza en la temática de la catarsis y la metamorfosis y su trascendencia en el ámbito artístico contemporáneo. Explorando la carga psicológica desde el punto de vista genético, social, familiar y cultural. El arte una herramienta de la superación de una carga invisible, heredada o autoimpuesta que impide a la persona el desarrollo de sí mismo. Esta carga invisible se deriva en la idea de liberación a través del ritual. Como han demostrado en el ámbito del arte contemporáneo artistas como: Gunter Brus, Gina Pane, Marina Abramovic, Patty Chang, etc. Como ya es sabido el arte ha demostrado ser una herramienta idónea de comunicación entre las personas que también sirve para hacer de vehículo de liberación de la carga y de las experiencias traumáticas, abriendo las puertas de uno mismo para poder llegar al resto de personas, el colectivo. El ser humano tiende a instigarse y a recrearse en el dolor y la culpa, por eso el arte se convierte en una herramienta de testimonio y liberación, para romper el círculo vicioso que tiende a repetirse en la psique del individuo. De este modo el arte interdisciplinar y la video-performance se convierten en una herramienta conductiva en la necesidad de la aceptación de los hechos, las emociones y las incertidumbres que oprimen al individuo y al artista de manera psíquica. Exploring the psychological burden from the genetic, social, family and cultural point of view. Art is a tool for overcoming an invisible, inherited or self-imposed burden that prevents the person from developing himself. The human being tends to instigate and recreate in pain and guilt, that is why art becomes a tool of testimony and liberation, to break the vicious circle that tends to repeat itself in the psyche of the individual. In this way, interdisciplinary art and video-performance becomes a conductive tool in the need to accept the facts, emotions and uncertainties that oppress the individual and the artist in a psychic way. Contemporary art being a fundamental element in communication with the viewer and in the liberation of the feeling of burden.

El presente trabajo consiste en un estudio de profundización, su fin es determinar si la improcedencia de la pena sustitutiva de prisión en el lugar de residencia por su falta de regulación en el código penal militar, constituye una forma de trato desigual entre militares y civiles, una forma de afectación del interés superior del menor, de la dignidad humana y también de la naturaleza propia de la justicia penal militar. Para el desarrollo de la investigación se acudió a un modelo explicativo con un enfoque mixto (cualitativo- cuantitativo) donde se analizaron normas jurídicas, decisiones judiciales proferidas por el Tribunal Superior Militar y la Corte Suprema de Justicia en relación con el tema, así como varias posturas doctrinarias. Los resultados evidencian que la voluntad del legislativo en no incluir la prisión domiciliaria en el código penal militar constituye una postura acertada a partir de una interpretación exegética del ordenamiento jurídico, sin embargo desde la teoría de los principios constitucionales se encontraría una excepción tratándose de casos de militares padres y madres cabeza de hogar que podrían acceder a la sustitutiva al reunir los requisitos del código penal común y la Ley 750 de 2002, en la medida que se involucra el interés superior del menor como principio prevalente. (Texto tomado de la fuente) The present work consists of a deepening study, its purpose is to determine if the inadmissibility of the substitute punishment of house arrest due to its lack of regulation in the military criminal code constitutes a form of unequal treatment between the military and civilians, a form of affectation of the the best interest of the minor, of human dignity and also of the nature of military criminal justice. For the development of the research, an explanatory model with a mixed (qualitative-quantitative) approach was used, where legal norms, judicial decisions made by the Superior Military Tribunal and the Supreme Court of Justice in relation to the subject, as well as several doctrinal positions. The results show that the will of the legislature not to include house arrest in the military criminal code is an accurate position based on an exegetical interpretation of the legal system, however, from the theory of constitutional principles, an exception would be found in cases of military fathers and mothers head of household who could access the alternative by meeting the requirements of the common criminal code and Law 750 of 2002, to the extent that the best interests of the child are involved as a prevailing principle. La realidad lacerante de la criminalidad que daña el tejido social y vulnera los derechos fundamentales de la persona, es una razón impostergable para analizar y revisar los conceptos sociológicos de delito y pena, a fin de ver de cerca y desde adentro lo que hay detrás de los índices de criminalidad, para repensar desde la perspectiva de la Criminología contemporánea y con una visión holística, posibles alternativas de solución al peligroso problema de la desviación social que en nuestro país ya deterioró el principio de autoridad y rebajó la dignidad de la persona humana. The excruciating reality of criminality that will damage the social fabric and violates the fundamental rights of the human, is an urgent reason to analyze and revise the sociological conceptions of crime and punishment, to see up close and from inside what is behind the crime rates, for rethinking from the perspective of contemporary Criminology and with a holistic vision possible alternative solutions to the dangerous problem of social deviation than in our country already impaired the principle of authority and lowered the dignity of the human person.

Ante el lamentable desconocimiento y olvido ocasionado por el legislador al dejar fuera del ámbito de competencia especial de que trata el Régimen Disciplinario de las Fuerzas Militares2 al soldado que presta el servicio militar obligatorio en sus distintas modalidades a saber: Regular, Bachiller, Campesino, es necesario analizar en el presente trabajo quien es el competente para investigar y sancionar al soldado que presta el servicio militar obligatorio en el Ejército Nacional dado la condición de servidor público que ostenta de carácter transitorio, para llevar a cabo el mismo se empleara la metodología descriptiva para llegar a concluir que el régimen aplicable al soldado que presta el servicio militar obligatorio ante la carencia de sanción en la ley 836/2003, es el Código Único Disciplinario ante la condición se servidor público por lo tanto el competente es la Procuraduría General de la Nación. Στην παρούσα μελέτη περίπτωσης ερευνήσαμε τους τρόπους με τους οποίους οι εκπαιδευόμενοι του παραρτήματος του Σχολείου Δεύτερης Ευκαιρίας Πάτρας (2012 – 2013), το οποίο λειτουργεί στο Κατάστημα Κράτησης Πάτρας, συμμετέχουν στη διαμόρφωση της γνώσης, που έχουν τη δυνατότητα να συγκροτήσουν, αλλά και τους παράγοντες που οριοθετούν αυτή τη διαδικασία, και κατ' επέκταση το περιεχόμενο αυτής της γνώσης. Επιπλέον, κρίναμε σκόπιμη και τη διερεύνηση της επίδρασης της λειτουργίας του παραρτήματος του Σχολείου Δεύτερης Ευκαιρίας Πάτρας (2012 – 2013) στο πειθαρχικό έργο του Καταστήματος Κράτησης Πάτρας. Για την επίτευξη του ερευνητικού μας σκοπού, πραγματοποιήσαμε 15 ημιδομημένες συνεντεύξεις με τους εκπαιδευόμενους, που φοιτούσαν στο συγκεκριμένο ΣΔΕ την περίοδο διεξαγωγής της έρευνας, την προϊσταμένη του ΣΔΕ και την υπεύθυνη του Καταστήματος Κράτησης για την εκπαίδευση των κρατουμένων. Στο περιεχόμενο των συνεντεύξεων πραγματοποιήθηκε ποιοτική ανάλυση περιεχομένου. Η ανάλυση έδειξε ότι οι εκπαιδευόμενοι του ΣΔΕ συμμετέχουν στη διαμόρφωση της γνώσης, που έχουν τη δυνατότητα να συγκροτήσουν, μέσα από μία σειρά τρόπων. Ωστόσο, η διαδικασία αυτή φάνηκε να οριοθετείται από ορισμένους περιορισμούς και απαγορεύσεις που επιβάλλονται στους εκπαιδευόμενους, κυρίως από το πλαίσιο της φυλακής. Τέλος, κατά τη λειτουργία του ΣΔΕ, διαπιστώθηκε η εφαρμογή ενός αριθμού πειθαρχικών τεχνικών, οι οποίες επιδρούν θετικά στο πειθαρχικό έργο της φυλακής. In this present case study we researched the ways in which the students of the department of the Second Chance School of Patras (2012-2013), which operates in the Prison of Patras, participate in the formation of knowledge and have the capability of composing, also the factors which limit this process as well as the content of knowledge. Furthermore, we decided that it was also necessary to research the effects of the operation of the department of the Second Chance School of Patras (2012-2013) on the disciplinary work of the Prison of Patras. To achieve the goal of our research we took 15 semi-structured interviews from the students who attended the Second Chance School at the time the research was conducted, the Head Director of the Second Chance School and the Head Manager of Education of the Prison of Patras. We analyzed the content of the research in detail. The analysis conveyed that the students of Second Chance School took part in the formation of knowledge which they have the capability of obtaining in a variety of ways. However, the procedure seemed to be limited by certain limits and prohibitions which are imposed on the students basically from the framework of the prison. Finally, during the operation of Second Chance School a number of disciplinary techniques were established which had a positive effect on the disciplinary work of the prison.

Geçmişten günümüze işgörenlerden maksimum düzeyde nasıl yararlanılabileceği, işgörenlerin performanslarını üst düzeylere taşıma kaygıları işverenin sorunlarından olmuştur. This problems push them to think about how can we benefit from employees on max level and how can we improve employees performans on max level? To achive this they try lots of methods. Some think that, result of punishing employees will show expected behaviour, others think that rewarding will push the employees to show expected behaviours and this will be more effective then punishing. Result of this lots of idea appear and they used all of them to find out which one is true. İn thesis we try to find out whats the effect of rewarding and punishing on performans, employes want what kind of reward and punish, effect level of the all punishment and all reward on performance, which reward and which punish got most effect on performance. Thereby, the writer tells in this article, ad for theoretically and practice of, how the ability of this science in determining the early time of salat, instruct Qiblat, and early month; moon of Qamariyah at one particular place. Truth and correctness of can be proved pursuant to the formula specified by pertinent science. Especially early time of salat, instruct Qiblat, and determination early month; moon of Ramadhan and early month; moon of Syawal, for the feast day of Ramadhan of Idul Fitri, the result of Ru’Yah and Hisab earn proved and justified scientifically.

This article refers to the arriving of slaves to Peru, their daily live in the different places where they lived and where they were carried, the wealth of their cultural contribution, and the different ways to confront slavery: from complete passivity to open rebelliousness. Without impassioned and cultural limits, I think that the Sesquicentennial of the abolition of the slavery in Peru, would be an opportunity to learn more from the past and to think about the future of afro-peruvian people., Este artículo pretende reflexionar sobre la llegada de los esclavos al Perú, sus vidas cotidianas en los diferentes lugares donde fueron llevados, la riqueza de sus aportes culturales, además de las diferentes formas de enfrentar la esclavitud: desde la pasividad más absoluta hasta la rebeldía frontal. Sin caer en juicios de valor, romanticismos ni estrechez cultural, creo que el Sesquicentenario de la abolición de la esclavitud en el Perú debe servir fundamentalmente para aprender del pasado y preocuparse por el futuro de la población afroperuana.
