Mediation with public sector entities can result in challenges for members of the construction industry. In such mediation, open meeting and bureaucratic requirements not present in ordinary mediation may have to be dealt with. If the private sector party makes itself aware of these requirements and provides for mediation soon after disputes develop, settlements can be easier to obtain.

This article first describes the bargaining process, focusing on mediation and factfinding. It then reviews several obstacles to the negotiations process. The last section of the article summarizes the effects of the process and the obstacles on the status of contract agreements in New York State in 1996.

A study was conducted to determine differences between outcomes of grievance arbitration in the public sector and those of grievance arbitration in the private sector. A total of 1127 public and 2822 private arbitration cases over the 1987-93 period were analyzed to see if differences in win, lose or compromise outcomes existed. Results showed that there was a higher winning percentage and fewer discharge cases in the public sector. In addition, there were fewer cases that led to long suspensions in the public sector.

This study utilizes discriminant analysis to determine if the characteristics of mediators and the strategies they employ predict the success of mediation in resolving impasses in the public sector in Iowa. The data were obtained from questionnaires administered to management and union negotiators in the 214 impasses reported in Iowa during 1986. The Government has reached a deal with public sector unions that will allow existing public-sector workers, such as teachers, to retire at 60 on a full pension. The Government had planned to force public-sector workers to either work until they were 65 or accept a reduced pension but threats from unions have forced the Government to back down. However, those who become public-sector workers after 2007 will have to work until they are 65.
