Summary: This open access book presents recent research and hot topics in the field of real estate science in Japan. It features carefully selected English translations of peer-reviewed papers and excellent articles published in the Japanese Journal of Real Estate Sciences, as well as papers presented at the Japan Association of Real Estate Sciences (JARES) annual conference. The topics covered include market analyses of vacant houses, policies for reuse of vacant houses, property tax policy, issues of land for which the owners are unknown, disaster and real estate values, the siting optimization plan and its influence on real estate, big data and ICT technology for the real estate business, and public real estate management. Real estate science in Japan has developed in step with international research in the fields of law and economics, regional science, civil engineering, environmental science, architectonics, and related areas. At the same time, it has evolved into a unique discipline that focuses on policy-oriented practical science with arguments for the reform of outdated laws, regulations, and traditional customs. Asian countries are currently growing rapidly and are catching up with developing countries. The lessons learned and know-how accumulated by JARES is helpful for practitioners and policymakers not only in Japan, but also in other Asian countries.

This open access volume of the AIDA Europe Research Series on Insurance Law and Regulation offers the first comprehensive legal and regulatory analysis of the Insurance Distribution Directive (IDD). The IDD came into force on 1 October 2018 and regulates the distribution of insurance products in the EU. The book examines the main changes accompanying the IDD and analyses its impact on insurance distributors, i.e., insurance intermediaries and insurance undertakings, as well as the market. Drawing on interrelations between the rules of the Directive and other fields that are relevant to the distribution of insurance products, it explores various topics related to the interpretation of the IDD – e.g. the harmonization achieved under it; its role as a benchmark for national legislators; and its interplay with other regulations and sciences – while also providing an empirical analysis of the standardised pre-contractual information document. Accordingly, the book offers a wealth of valuable insights for academics, regulators, practitioners and students who are interested in issues concerning insurance distribution.

This open access book focuses on public actors with a role in the settlement of investment disputes. Traditional studies on actors in international investment law have tended to concentrate on arbitrators, claimant investors and respondent states. Yet this focus on the “principal” players in investment dispute settlement has allowed a number of other seminal actors to be neglected. This book seeks to redress this imbalance by turning the spotlight on the latter. From the investor’s home state to domestic courts, from sub-national governments to international organisations, and from political risk insurance agencies to legal defence teams in national ministries, the book critically reviews these overlooked public actors in international investment law.

Dieser Open Access Band bietet sowohl deutsch- als auch italienischsprachige Beiträge zu wesentlichen Bereichen des gewerblichen Rechtsschutzes und des Urheberrechts aus der Sicht des deutschen, italienischen und österreichischen Rechts sowie zum TRIPS-Abkommen samt einem Blick auf das vorläufig in Kraft getretene Handelsabkommen zwischen Kanada und der Europäischen Union (CETA). Ein Schwerpunkt ist Schadenersatzansprüchen aus der Verletzung von Immaterialgüterrechten gewidmet, wobei die bei grenzüberschreitenden Sachverhalten auftretenden Fragen der internationalen Gerichtszuständigkeit und des Kollisionsrechts speziell behandelt werden. Darüber hinaus werden Bezüge zum italienischen Verfassungsrecht sowie zum europäischen Wettbewerbsrecht hergestellt und auch wirtschaftsstrafrechtliche Aspekte angesprochen. Schließlich wird ein Ausblick auf die zukünftige Entwicklung des internationalen Immaterialgüterrechts in der Europäischen Union gegeben. Ausgangspunkt für das Buch bildete der vom Internationalen Forum für Wirtschaftsrecht getragene 1. Bozner Wirtschaftsrechtstag, bei dem besonderes Augenmerk auf die Berührung des deutschsprachigen Rechts- und Wirtschaftsraumes mit dem italienischen gelegt wird.

This open access book provides the first-ever comparative study on criminal policy concerning the illicit trade of tobacco, conducted among four comparatively new EU Member States (Lithuania, Poland, Slovakia and Romania) and two “old” EU countries (Germany and Italy). The book addresses the national legal frameworks, current criminological situation regarding illicit trade of tobacco, and the practical challenges faced by national law enforcement authorities in the countries examined. It also considers the international framework, and concludes with a horizontal report. The objective of the book is to highlight legislative and practical challenges in the fight against illegal tobacco products at the national and transnational level, and to formulate recommendations for overcoming them more effectively in Europe.

This open access book examines the multiple intersections between national and international courts in the field of investment protection, and suggests possible modes for regulating future jurisdictional interactions between domestic courts and international tribunals. The current system of foreign investment protection consists of more than 3,000 international investment agreements (IIAs), most of which provide for investment arbitration as the forum for the resolution of disputes between foreign investors and host States. However, national courts also have jurisdiction over certain matters involving cross-border investments. International investment tribunals and national courts thus interact in a number of ways, which range from harmonious co-existence to reinforcing complementation, reciprocal supervision and, occasionally, competition and discord. The book maps this complex relationship between dispute settlement bodies in the current investment treaty context and assesses the potential role of domestic courts in future treaty frameworks that could emerge from the States’ current efforts to reform the system. The book concludes that, in certain areas of interaction between domestic courts and international investment tribunals, the “division of labor” between the two bodies is not always optimal, producing inefficiencies that burden the system as a whole. In these areas, there is a need for improvement by introducing a more fruitful allocation of tasks between domestic and international courts and tribunals – whatever form(s) the international mechanism for the settlement of investment disputes may take. Given its scope, the book contributes not only to legal analysis, but also to the policy reflections that are needed for ongoing efforts to reform investor-State dispute settlement.

Florian Kamp analysiert in diesem Open-Access-Buch Grund und Grenzen von Nebenpflichten nach § 241 II BGB. Dessen Auslegung zur Suche nach Haftungsgrund und -grenzen bietet als zentralen Befund, dass einzig der historisch eindeutig belegte Einsatzzweck von Nebenpflichten zur Kompensation deliktsrechtlicher Mängel als Funktion von § 241 II BGB vollumfänglich überzeugt. Die Berücksichtigung der Ökonomik hat dabei geholfen, die verhaltenssteuernde Wirkung der Annahme einer Nebenpflicht herauszuarbeiten. Als Mantra bleibt: Nimm nur eine solche Nebenpflicht nach § 241 II BGB an, von der du zugleich wollen kannst, dass sie in vergleichbaren Fällen zum allgemeinen Gesetz werde – mitsamt der damit verbundenen marktwirtschaftlichen Konsequenzen. This book assesses the consequences of Brexit for the control of illicit trade in tobacco products in the UK and EU. Based on the currently applicable legal framework, it examines the significance of a possible non-application of the acquis communautaire in the UK in matters relating to anti-illicit trade in tobacco legislation. It also analyses the modes of future cooperation between the UK and the EU in this area, as well as possible regulatory scenarios and their consequences. The book comprises six main sections. After the introduction (Section 1), Section 2 discusses the state of play of Brexit and possible outcomes of Article 50 of the Treaty of European Union procedure. Section 3 illustrates the data and trends of illicit tobacco trade in the UK. Section 4 describes the relevant legal (e.g. trade and fiscal measures) and enforcement frameworks in the UK and suggests possible post-Brexit scenarios in control of tobacco illicit trade. Section 5 focuses on the relevance of arrangements between governments and the tobacco industry in the control of illicit trade. Section 6 then analyses the relevance of key EU and global anti-illicit trade initiatives. Lastly, Section 7 the book offers some recommendations and conclusions on how the UK could control illicit trade in tobacco after Brexit.
