2. Investigating atmospheric blocking and related extreme events in Austria using observation-based datasets

- Abstract
Persistente Hochdruckgebiete (Blocking) in den mittleren Breiten können in dieser Region vorherrschende Westwinde blockieren und können Extremwetterereignisse auslösen. Ziel dieser Arbeit ist es, Trends in der Häufigkeit von Blocking über nördlichen mittleren Breiten und den Zusammenhang mit Extremwetterereignissen in Österreich zu untersuchen. Ein Algorithmus zur Detektion von Blocking und ein lineares Regressionsverfahren wurden auf ECMWF Re-Analysis Version 5 (ERA5)-Daten (1950 – 2019) zur Trendbestimmung angewandt. Zusammenhänge zwischen Blocking und Extremwetter wurden anhand von ERA5 und WATCH Forcing Data ERA5 (WFDE5) (1980 – 2018) mittels eines Monte-Carlo-Algorithmus untersucht. Die resultierenden Trends in der Blockinghäufigkeit variieren je nach Region und Jahreszeit. Seit 1950 nahm die Häufigkeit zonal über dem Nordatlantik (Januar-Mai) und Asien (Februar) um 2 % pro Jahrzehnt ab, während sie über Europa (September) und Ostasien (Juni) um 2 % bzw. 4 % pro Jahrzehnt zunahm. Einige dieser Änderungen sind auf räumliche Verschiebungen zurückzuführen. Seit 1979 zeigen die regionalen Trends eine Zunahme über den Britischen Inseln im März und eine Abnahme über dem Nordatlantik im November. Es konnten Zusammenhänge zwischen Blocking in Mittel- und Osteuropa und häufigeren Hitzewellen in Österreich sowie zwischen Blocking über Nordeuropa und selteneren Hitzewellen in Österreich nachgewiesen werden. Ebenso gibt es Zusammenhänge zwischen Blocking über Nordeuropa, dem Nordatlantik und Grönland und häufigeren Kältewellen in Österreich. Schließlich konnten Zusammenhänge zwischen Blocking über Russland und häufigeren Starkniederschlagsereignissen sowie zwischen Blocking über den Britischen Inseln und der Nordsee und selteneren Starkniederschlagsereignissen in Österreich gezeigt werden. Diese Ergebnisse tragen dazu bei, Veränderungen der Auftrittshäufigkeit von blockierenden Hochdrucksystemen und mögliche Auswirkungen auf Extremwetter in Österreich besser zu verstehen. Atmospheric blocking events are persistent high-pressure systems in the mid- latitudes that can block the westerly flow usually prevailing in this region. They have previously been demonstrated to be connected to extreme weather events. This thesis aims to analyze trends in the frequency of blocking events over the northern mid-latitudes and to investigate the connection between blocking and extreme weather events specifically in Austria. We used ECMWF Re-Analysis Version 5 (ERA5) data (1950–2019) and applied a blocking detection algorithm and ordinary linear regression to detect trends. The connection between blocking and extreme weather was investigated using ERA5 and WATCH Forcing Data ERA 5 (WFDE5) (1980–2018) by applying a Monte-Carlo algorithm. The resulting trends in blocking frequency vary by region and season. Since 1950, blocking frequency decreased longitudinally by 2 % per decade over the North Atlantic (January–May) and Asia (February) while it increased by 2 % and 4 % per decade over Europe (September) and East Asia (June), respectively. Some of these changes represent spatial shifts. Since 1979, regional blocking trends represent an increase over the British Isles in March and a decrease over the North Atlantic in November. We find a connection between blocking over Central and Eastern Europe and increased heatwave frequency in Austria and between blocking over Northern Europe and decreased heatwave frequency in Austria. We also demonstrate a connection between blocking over Northern Europe, the North Atlantic and Greenland and more frequent cold spells in Austria. Finally, blocking over Russia is connected to more frequent heavy precipitation events while blocking over the British Isles and the North Sea is associated with less frequent heavy precipitation events in Austria. Our findings can help stakeholders better understand changes in blocking frequency over the northern hemisphere in the recent decades and effects on extreme weather in Austria. 4. Mitigating public law's impact on international M&A

- Abstract
Die vorliegende Arbeit bietet einen Überblick über die relevanten Themen des öffentlichen Rechts bei internationalen und grenzübergreifenden M&A-Projekten. Als Ausgangspunkt wurde untersucht, von welchen öffentlich-rechtlichen Teilbereichen ein Modell-Industrieprozess beeinflusst wird. Da ein erfolgreiches M&A-Projekt immer einen Wendepunkt in Gestalt des Closing beinhaltet, an dem sich die Besitzverhältnisse wesentlich ändern, wird die Betrachtung dieser Rechtsgebiete im Zeitbereich angeregt: 1. Vergangenheit: z.B. das Gebaren des Targets vor der Übernahme 2. Gegenwart: z.B. die Auswirkung der Änderung der Besitzverhältnisse auf die Unternehmensführung 3. Zukunft: z.B. die künftige Änderung der rechtlichen Rahmenbedingungen Für eine effiziente Abwicklung während eines M&A-Projekts wird in dieser Arbeit eine Unterteilung des öffentlichen Rechts in drei Prioritäten vorgeschlagen: 1. Rechtsgebiete, welche das Geschäftsmodell zerstören könnten 2. Rechtsgebiete, welche potentiell hohe Strafen mit sich bringen 3. Die restlichen Rechtsgebiete Schließlich wird auf dieser Grundlage ein Beispielalgorithmus erarbeitet, der für jedes Projekt modifiziert werden kann. Das Wettbewerbsrecht kann die stärksten Auswirkungen auf das M&A-Projekt haben, da die Behörden bei kritischer Erhöhung der Marktkonzentration (Verringerung von Konkurrenz) den Firmenzusammen- schluss verbieten könnten. Deshalb sollten die wettbewerbsrechtlichen Komplikatio- nen früh untersucht werden. Ähnlich verhält es sich mit Import/Export, wo - in Abhängigkeit vom Industriegut - die Änderung der Nationalität des Firmensitzes zu wesentlichen Einschränkungen führen kann. In den Bereichen des Datenschutzes und der Korruption ist hauptsächlich auf das Gebaren des Targets in der Vergangenheit und die vorhandenen internen Regelun- 91 gen abzustellen, um so - in der Regel hohe - Strafen zu vermeiden. Es sollten aber auch - insbesondere im Bereich des Datenschutzes - Vorgänge rund um die Due Diligence nicht aus den Augen verloren werden. Schließlich sind die Rechtsgebiete des Steuerrechts, des Umweltrechts und des Arbeitsrechts zu untersuchen und deren Auswirkungen auf die Firmenübernahme auszuwerten bzw. möglichst günstige Übernahmewege zu ermitteln., Cross-border M&A makes a major percentage of the global M&A volume every year. When conducting an M&A project the exposure to effects and liabilities out of public law has to be considered. In domestic cases public law is usually known and dealt with adequately. In international cases however astonishing implications can arise from (1.) past misconduct of the target company, (2.) the closing procedure (e.g. the controlling entity becomes foreign) as well as (3.) the future development of the legislation. They can involve administrative penalties, monetary fines, the withdrawal of permits and licenses, and even the interdiction of the M&A deal. Therefore they have to be evaluated thoroughly. As this topic has not been treated scientifically as a whole so far this thesis will start out with the design of an approach for the selection of relevant fields of public law. These fields cover competition, tax, employment, environment, import/ export, cybersecurity including data protection, corruption and - as a special topic - FinTech. For each field the objectives and protective purposes are determined. Then an overview of the global legislations with a focus on recent developments as well as the potential pitfalls is given. And finally a way to mitigate the risks related to the individual field of public law is proposed. Selected topics are wrapped up with real- world examples of M&A projects affected by public law.

Electrical earthing (grounding) is necessary for the proper operation of electrical systems, machines and electronic equipment in the event of a fault, for protection against lightning and personal injury, and for reasons of electromagnetic compatibility. Earthing is understood as "making an electrical connection between a given point in a system or in an installation or in equipment and a local earth". Electrical grounding systems are designed according to national and international standards, with some of these standards occupying a significant place in the legal hierarchy in Austria and being binding. Simple structures are designed using approximate formulas given in the literature and standards; more complex arrangements use programs with analytical or numerical models for the calculation and design of grounding systems. Underground infrastructure projects require additional considerations. Starting with the technical and legal requirements, the typical process steps for the design of electrical grounding systems are shown. [ABSTRACT FROM AUTHOR]
