Abstract

In the age of deep and wide digital transformation disrupting both democratic accountabilities and the administration-citizens nexus, there is a need for a methodological approach that allows for the establishment of trust between all the platform actors, and that can adapt to each particular context. It is also a question of integrating the legal and democratic issues inherent in the sustainable deployment of territorial digital trusted third parties. The objective is to propose, evaluate and experiment with a process of creation and sustainable operation of a trusted third party, i.e., the definition of a scientifically validated process of governance and the use of the platform, and the integration of specific modules into its digital architecture. It is a method that acts as a permanent catalyst for trust-in-context, going beyond abstract modeling and keeping the necessary transversality to consider applications that go beyond them.

Abstract

Lo studio si occupa della digitalizzazione dell'amministrazione giudiziaria civile, con l'obiettivo di migliorare l'efficienza del sistema. Tuttavia, si delinea anche una prospettiva più ampia a livello europeo, dove la digitalizzazione è vista come un mezzo per migliorare l'accesso alla giustizia. Questo concetto, ampiamente discusso nella letteratura e a livello istituzionale in UE come in Italia, mira a soddisfare i bisogni dei destinatari delle decisioni giudiziarie, garantendo loro un accesso equo e efficace al sistema giudiziario. Questo studio esplora, dunque, il connubio tra digitalizzazione e accesso alla giustizia, evidenziando la necessità di un equilibrio tra l'efficienza del sistema e la soddisfazione dei bisogni dei cittadini.

Abstract

At the aftermath of the pandemic laypeople and policy makers experience a common challenge. How to integrate scientific knowledge and technological advances into the decision-making processes that impact on the quality of life of everyone combining scientific soundness and public accountability. Social responsiveness of choices that lay at the basis of highly impacting policies today must be ensured. This article traces a critical path to raise some concerns and to put forth a proposal as to the governance of the science/democracy connubium. The argument herein touches upon the different levels where digital transformation disrupts the interactions between citizens (and their rights) and the healthcare sector, the interaction between medical doctors and healthcare professions on the one hand and the automation on the other hand, the interaction between efficiency and inclusiveness under the waves of technological and scientific transformation. 6. Costo, ritualità, valore. Le qualità della giustizia nell’era digitale

Abstract

Tre ondate di riforme hanno assegnato un sempre più alto grado di priorità alle innovazioni tecnologiche e digitali in quanto strumenti efficaci nella promozione di maggiore efficienza, minore costo di accesso alla giustizia e maggiore tutela di trattamento eguale per tutti. Oggi è tempo di mettere la digitalizzazione e le sue tre componenti, dematerializzazione, quantificazione, e standardizzazione nel contesto di un più ampio paradigma di valutazione della qualità della giustizia. Si prendono qui le distanze da una visione riduzionista della tecnologia, che la vorrebbe “semplice” strumento di efficientamento, e si accetta, fra le premesse, quella secondo cui innovazione e ritualità possono e devono combinarsi in modo virtuoso. La prospettiva proposta intende tenere conto, sulla base di un principio di bilanciamento e di complementarietà, delle diverse componenti che intervengono nel processo di legittimazione della giustizia (fra cui anche la dimensione della ritualità e quindi quella del simbolo e del valore della unitarietà degli spazi e dei tempi della celebrazione del processo). La posizione di chi scrive è tesa a valorizzare, ciascuno nel proprio contesto, i diversi metodi di risposta alla domanda di giustizia e le diverse forme con cui si organizza, nello spazio-tempo, l’agire giudiziario ed amministrativo nel sistema giustizia. Una tesi che nega il riduzionismo e che accetta, sulla base di una visione composita e plurale delle forme della normatività che intervengono nel sistema giustizia, che sia necessario non perdere di vista l’aspetto del rito, senza per questo rinunciare al potenziale di miglioramento e di resilienza che viene proprio dall’utilizzo della parte più avanzata della tecnologia digitale, così come oggi essa si affaccia all’orizzonte del post-emergenza pandemica e della attuazione del Piano nazionale di rilancio e di resilienza.

Abstract

This book takes five contexts to trace the paths and to prospect an idea. It does not pretend the exhaustivity nor the completeness. The promotion of the culture of lawfulness, where the education to the law and the primacy of the rule plays an essential role, the design and use of inter-connected spaces to meet the demand of justice, where different forms of intelligence are led to interplay, the adoption of a method to govern the organizational changing processes triggered by the automation where the balance between human and automated intelligence is pivotal, the reframe of the trust building processes within the healthcare sector due to the break-out of the e-medicine and the robotics, where the legitimacy of the professionalism demands high consideration, the use of digital finger-prints into a smart city governance based on trust, where the citizens’ engagement encounters the complexity and the interdependence, are, altogether, windows opened on a new world that is coming. Access to justice gained over the last two decades the undiscussed first rank position in the international policies promoting the rule of law and the quality of the users-courts interaction. A wide range of empirical evidence – both in quantitative and qualitative terms – is today available through the regular monitoring exercise carried on by governmental and non-governmental agencies at all institutional levels. Spanning from the world justice project to the CEPEJ, to make just two leading examples, it is today clear that access to justice plays a strategic and undeniably essential role in the quality of social and economic processes and the quality of life of people. Furthermore, it is patent that when access to justice is affected by uneven patterns and the pathways to the courts or the legal remedies feature barriers for disadvantaged people courts may become an unexpected and still severe source of inequalities. Drawing lessons from practices set up in many countries the international organizations engaged in promoting comprehensive strategies to improve the access to justice, via digital tools, communication policies, a costs-benefits ratio sensitive approach, and a timeline-focused organization of the case management and legal services delivery. Despite the steps undertaken the relationship between law and society and more specifically between the legal and judicial services and the demand for justice and rights enforcement coming from people and social actors remain somehow sub-optimal since many barriers turn out to lay in the sequences of actions and initiatives that are to be taken once courts have been accessed. In the context of justice and legal service for indigenous people the experience of encountering the law and the law in action is marked by distinctive barriers and critical knots. Linguistic barriers are addressed the most by scholars and practitioners. These barriers seem to be hardly removed by the “mere” introduction of tools supporting translation and inter-linguistic interplay/dialogue. However more severe barriers relate to the common sense of the law, and the way people expert legal and justice systems be effectively fair mechanisms to settle disputes. Furthermore, the availability of legal professionalisms is a critical matter as it relates to the policies each country adopts to ensure the quality of these – being sure that the quality must be here understood as a combination of professional proficiency, ethics, pluralism, and cultural competences.

Il libro nasce da un’esperienza di dialogo che si è sviluppata fra uffici giudiziari, istituzioni locali e università. Al centro si trova un tema di fondamentale importanza per cittadino e imprese: il buon funzionamento dell’amministrazione della giustizia. Al lettore si offre una fotografia chiara e documentata da fatti, dati di ricerca e analisi comparate, delle modalità con cui i territori e gli uffici giudiziari si sono fatti di recente promotori d’innovazione, miglioramento delle performance, trasparenza e affidabilità dell’amministrazione giudiziaria. Gli autori propongono inoltre chiavi di lettura capaci di gettare luce sulle debolezze di un sistema ad alta imprenditorialità organizzativa, per il quale è di essenziale importanza un centro capace di valorizzare le esperienze di successo, garantendo l’uniformità di servizio necessaria al cittadino e al buon funzionamento di un Paese democratico.

Abstract

In questo contributo, gli Autori inquadrano prima da un punto di vista teorico il valore del dissenso all’interno della teoria democratica; passano poi ad indagare quali siano gli effetti benefici del pluralismo e del conflitto inter-istituzionale e intra-istituzionale, soffermandosi poi ad indagare sulle dinamiche di conflitto che coinvolgono l’istituzione giudiziaria (rispetto ad altre istituzioni) e su quelle che si verificano all’interno di questa istituzione. Il contributo si chiude rilevando un apparente paradosso: il dissenso – pur espletando un’importante funzione di autocorrezione e auto-mutamento all’interno del regime democratico – rischia, ove esasperati i momenti di conflittualità, di comportare dei costi sul piano della stessa legittimazione delle istituzioni (e sulla fiducia che, in esse, i cittadini ripongono, come forse avvenuto nel caso del calo di fiducia nella magistratura).

Abstract

A study of the channel $e^{+}e^{-}~\rightarrow~\mu^{+}\mu^{-}\gamma_{\ sc ISR}$, where $\gamma_{\sc ISR}$ is an initial state radiation photon, is presented using data collected by the DELPHI experiment from 1991 to 1994. The total cross-section at effective annihilation energies ($\sqrt{s'}$) below the $Z^0$ peak is obtained by using the events with relatively hard initial state radiative photon(s) ($E_{\gamma}~ ~$~1~GeV). The differential cross-section as a function of the muon polar production angle is also determined in order to extract t s alhe forward-backward asymmetries for the reaction $e^+ e^- \rightarrow \mu^+ \mu^-$ at energies $\sqrt{s'}$ between 20 and 87~GeV. The ratio of the helicity cross-sections $\frac{\sigma_{LL}+\sigma_{RR}}{\sigma_{RL}+\sigma_{LR}}$, where the two subscripts stand for the helicities of the incoming $e^-$ and outgoing $\mu^-$ respectively, is extracted from the differential cross-sections in order to test the Standard Model and to look for new physics near 80 GeV. No deviations from the Standard Model were found.

Judicial networks have proved effective in influencing recent judicial policies enacted by both old and new EU member states. However, this influence has not been standard. This volume seeks to improve our understanding of how networks function, as well as the extent they matter in the governance of a constitutional democracy. The authors examine the judicial function of networks, the way they cross the legal and territorial borders that confine the jurisdiction of the domestic institutions, and whether or not they are independent of the capacity and the leadership of their members. Abstract

In all European countries courts and public prosecutor offices have been undergoing a long and comprehensive process of reform, target several different components of their organization and management. This phenomenon can be explained as the outcome of two combined forces: an increase demand of justice and a pressure from the international and supranational institutions. Accordingly, innovation has become a major issue in the judicial sector. Despite the attention devoted to it, much less effort has been made to comprehend the mechanisms that make organizations innovative. To what extent is leadership important? How may different organizational cultures facilitate or create obstacles to innovation? And to what extent can innovation be implemented through a top down approach in a peculiar organization, such as a judicial office? This article tells the story of a case study on a public prosecutors’ office located in the South of Italy. The pilot study has been framed and conducted as both normative and empirical in its own nature. Moreover, it represents a case study with a certain number of policy effects, as it turned into a roadmap which was adopted by the judicial office to improve its own organization and human resource management. This is the first study carried out in Italy using such methods with the objective to: a) describe the implementation of organizational innovation (in this respect there had already been a study of the General Registry Office), b) map intra-organizational routines and inter-connections between administration and the General Registry Office and between the GRO and the criminal records Office etc; c) Identify skills to adapt and learn skills from daily routines and execution of specific tasks, as they are done in all public sectors.
