Dieses Werk ist eine medizinstrafrechtliche Studie, die sich mit ärztlichen Behandlungsfehlern im engeren Sinne und insbesondere mit ärztlichen Diagnosefehlern beschäftigt. Der Autor geht von einer medizinstrafrechtlichen, begrifflichen Definition des Diagnosefehlers aus und prüft seine Relevanz für die umstrittene Frage der Abgrenzung von Tun und Unterlassen bei der Diagnosestellung. Er zielt auch darauf ab, die strafrechtlichen Sorgfaltsanforderungen hinsichtlich der ärztlichen Diagnose auf der Grundlage der Fahrlässigkeitstheorien, der medizinischen Richt- und Leitlinien und letztendlich mithilfe der Rechtsprechung zu bestimmen.

Grenzüberschreitende Gesundheitsleistungen gewinnen mit der wachsenden Zahl jährlicher Touristenströme in fremde Länder, der Zunahme internationaler Ausbildungs- und Arbeitsverhältnisse und der Entwicklung der medizinischen Behandlungsmöglichkeiten, insbesondere der Entwicklung der Telemedizin, seit längerem an Bedeutung. Damit einher geht zwangsläufig auch die Häufung grenzüberschreitender Arzthaftungsfälle, die das internationale Zivilverfahrensrecht und das internationale Privatrecht vor neue Probleme stellen. Dies gilt insbesondere nach Inkrafttreten der Rom I- und Rom II-Verordnungen, die gerade in einem Sondergebiet wie dem internationalen Arzthaftungsrecht noch wissenschaftlich aufgearbeitet werden müssen. Die Verfasserin hat es sich daher zur Aufgabe gemacht, diese Regelungen mit den Bestimmungen von New York, Kalifornien und Louisiana (repräsentativ für das US-Recht) unter dem Gesichtspunkt, ob das europäische oder das US-amerikanische Modell Patienten besser schützt, zu vergleichen.
