Abstract

Most forms of macroeconomics today, whether Keynesian or monetarist, presuppose that problems of economic instability can be treated as errors in financial management. Neither fiscal nor monetary policy recognizes the existence of systemic faults in the real economy that result in overinvestment in durable capital that turns over slowly, in contrast to forms of capital that interact more frequently with land and labor. Only by removing serious distortions in microeconomic relations can macroeconomic problems be resolved. The current global economic crisis exemplifies the limitations of policies that ignore distortions in the rate of turnover of investment capital.

The patent system typically takes credit for motivating biopharmaceutical innovation by making it profitable, while drug regulation gets blamed for burdening innovation with bureaucratic costs and delays. But FDA regulation in fact promotes profitability by prolonging exclusivity in product markets and by protecting against parallel imports. Firms may prefer FDA-administered exclusivities to expanded patent protection because they protect product markets without also adding to R&D costs. FDA-administered exclusivities may also face fewer legal and political obstacles than expanded patent protection, although as pressure mounts to constrain the rising costs of drugs, the political environment is changing. Empirical estimates of the private value of patent protection are derived for four technology areas - computers, textiles, combustion engines, and pharmaceuticals - using new patent data for West Germany, 1953-1988. Patentees must pay renewal fees to keep their patents in force as well as legal expenses in order to enforce them. A dynamic stochastic discrete choice model of optimal renewal decisions is developed incorporating both learning and depreciation as well as the potential need to prosecute infringement. The evolution of the distribution of returns over the life of a group of patents is calculated for each technology using a minimum distance simulation estimator. Results indicate that the aggregate value of protection generated per year is on the order of 10% of related R&D expenditure.

The effective patent life (EPL) of new drugs introduced into the Swedish pharmaceutical market was analyzed. Patent protection is important for pharmaceutical research companies because it affords them a chance to receive areturn on their research investments. Data on New Chemical Entities (NCE) registered with the Medical Products Agency from 1965-1988 were investigated. It was discovered that 35.5% of the NCEs did not have patent protection. The average EPL of 12.3 years in 1965 had been shortened to 8.3 years by 1988. It was suggested that patent protection of NCE should be prolonged to maintain theviability of the pharmaceutical industry.

Willful infringement of patent is intentional conduct by the infringer, with or without prior knowledge of an existing patent, believing that it will not be liable for infringement. Evaluation of willful infringement of patent by a party depends on the experience of the person who opines on the issue and the information made available to that person to arrive at the conclusion. Liability to willful infringement can be avoided by instituting a procedure to communicate in writing about the existing patent rights of others.
