La legislación española regula muy estrictamente la posibilidad de obtener, tratar y utilizar datos de carácter personal (especialmente usando tecnología informática), y limita, impide, proscribe y sanciona prácticas profesionales habituales y necesarias para ejercer el periodismo con eficiencia, responsabilidad y calidad. Este artículo analiza la confrontación entre el derecho a la autodeterminación informativa y la libertad de información y aflora la situación de grave inseguridad jurídica en la que debe ejercerse la profesión de periodista bajo la actual legislación de protección de datos de carácter personal. The Spanish legislation very strictly regulates the possibility of obtaining, treating and using personal data (especially when using computer science technology), and limits, prohibits and sanctions the regular and necessary professional practices of journalism and prevents working with efficiency, responsibility and quality. This article analyzes the confrontation between the right to informative self-determination and information freedom. It also shows the serious legal insecurity in which journalism must be exerted under the present legislation of protection of personal data.

Las facultades de verificación y control empresarial mediante sistemas de videovigilancia en el ámbito de las relaciones laborales han suscitado grandes debates en relación con su posible incidencia en los derechos fundamentales de los trabajadores. Este tema ha sido abordado en varias ocasiones por el Tribunal Constitucional, así como por el Tribunal Europeo de Derechos Humanos; con el objetivo de delimitar cuáles son las consideraciones que deben atenderse en materia de videovigilancia dentro del ámbito que nos ocupa. De esta manera, en el presente estudio se analiza la doctrina judicial más relevante en la materia, desde la perspectiva de la salvaguarda de los derechos fundamentales y, concretamente el derecho a la protección de datos. The faculty of verification and business control by systems of video vigilance in the labour relationships area, have provoked huge debates regarding their possible influence in fundamental human rights of workers. This matter has been tackled in several occasions by Constitutional Court, such as the European Court of Human Rights; With the aim of delimit which are the considerations that must be attended to in matters of video vigilance in the area which spend us. In this way, in this study is analysed the most relevant judicial doctrine in this area, since the perspective of protect the fundamental human rights and specifically the right of the protection of data. A ascensão burguesa na segunda metade do século XIX, com o advento da revolução industrial e o desejo de ser deixado só, deu início ao direito de privacidade como direito autônomo, sendo um privilégio elitista baseado no sentimento de propriedade intangível. Esta pesquisa teve por objetivo, apresentar o direito à privacidade na chamada sociedade de informação, na perspectiva da filosofia do direito e das decisões jurisprudenciais do Tribunal de Justiça do Estado do Paraná (2013-2018). O ponto de partida será o artigo ‘The right to privacy’, de Samuel Dennis Warren e Louis Dembitz Brandeis (1890), que tinha como objetivo “o direito de ser deixado só”, no sentido de isolamento ou tranquilidade. Em contraponto, com as mudanças na modernidade de sólida para líquida, de hardware para software e, com o avanço da tecnologia e o surgimento da internet na rede mundial de computadores, todo o arcabouço social se alterou e com isso, propiciou o surgimento de crimes através do meio eletrônico, seja na esfera privada ou pública, de forma geral ou específica, como o acesso indevido de informação (de dados pessoais) e/ou divulgação indevida destes materiais, que violam a proteção legal à privacidade. Isso porque, na sociedade de informação, o acesso à rede é ilimitado, ágil e rápido. Em segundos consegue-se saber notícias do outro lado do planeta, comunicar-se com habitantes longínquos, trabalhar sem estar presente em local determinado, uma sociedade pós-panóptica de acordo com Bauman. Para o autor, a privacidade morreu. Em contrapartida, segundo Rodotà (2008), existe uma enorme diferença entre a noção de privacidade no século XIX e a atual, uma vez que, com o advento da internet, propiciado pelo aperfeiçoamento das tecnologias de informação e comunicação (TIC), existe um trânsito de dados pessoais, em constante movimento, sendo possível a coleta e processamento destes. Esta pesquisa foi realizada através do método de abordagem dialético, a técnica de pesquisa é a investigação bibliográfica em meios eletrônicos, artigos científicos, dissertações, livros, coleções particulares e decisões do judiciário no Estado do Paraná, do ano de 2013 a 2018. Sendo o problema enfrentado: Considerando a auto exposição massificada em meio eletrônico, será ainda possível pleitear a proteção à privacidade? Para processar a questão, a hipótese atribuída foi negativa, no sentido de que, o direito à privacidade não protege os indivíduos em meio eletrônico, embora exista a positivação no ordenamento jurídico brasileiro. Como resultado teórico e empírico, delineiam-se duas tendências: a primeira, diz respeito a redefinição do conceito de privacidade - superando o sentido tradicional e exclusivodestinado a algumas camadas sociais, como aristocracia, burguesia, artística e intelectual, no sentido de possibilitar maior relevância ao poder de controle; a segunda, refere-se à ampliação da noção de esfera privada e com isso, um crescimento quantitativo de situações jurídicas convergentes ao tema. Assim, dentro dos limites apresentados, pôde-se concluir que existe proteção à privacidade no recorte espacial e temporal analisados, embora baseado no conceito redefinido de privacidade e ponderado em relação a outros direitos, sendo não confirmada e refutada, por fim, a hipótese negativa inicial. This research aimed to present the right to privacy in the so-called information society, in the perspective of the philosophy of law and jurisprudential decisions of the Court of Justice of the State of Paraná (2013-2018). The starting point will be the article 'The right to privacy', by Samuel Dennis Warren and Louis Dembitz Brandeis (1890), whose aim was 'the right to be left alone', in the sense of isolation or tranquility. In contrast, with the changes in the modernity from solid to liquid, from hardware to software, and with the advancement of technology and the emergence of the internet in the worldwide computer network, the whole social framework has changed and with that, it has given rise to crimes through the electronic medium, in the private or public sphere, in a general or specific way, such as improper access to information (personal data) and / or undue disclosure of these materials, which violate the legal protection of privacy. This is because, in the information society, network access is unlimited, agile and fast. In seconds it is possible to know news from the other side of the planet, to communicate with distant inhabitants, to work without being present in a determined place, a post-panoptic society according to Bauman. For the author, privacy has died. On the other hand, according to Rodotà (2008), there is a huge difference between the notion of privacy in the nineteenth century and the present one, since with the advent of the Internet, propitiated by the improvement of information and communication technologies (ICT), there is a transit of personal data, in constant movement, being possible the collection and processing of these. This research was carried out through the method of dialectical approach, the research technique is the bibliographic research in electronic media, scientific articles, dissertations, books, private collections and decisions of the judiciary in the State of Paraná, from 2013 to 2018. Being the problem faced: Considering mass self exposition in electronic media, will it still be possible to plead privacy protection? In order to process the issue, the hypothesis was negative, in the sense that, the right to privacy does not protect individuals in electronic media, although there is positivation in the Brazilian legal system. As a theoretical and empirical result, two tendencies are outlined: the first concerns the redefinition of the concept of privacy - surpassing the traditional and exclusive sense - destined to some social strata, such as aristocracy, bourgeoisie, artistic and intellectual, in order to enable greater relevance to the power of control; the second refers to the expansion of the notion of the private sphere and with it, a quantitative growth of legal situations converging to the theme. Thus, within the limits presented, it was possible to conclude that there is privacy protection in the spatial and temporal clipping analyzed, although based on the redefined concept of privacy and weighted in relation to other rights, and the negative hypothesis is not confirmed and refuted initial.

La protección de datos es un tema muy presente en la actualidad por la importancia cada vez mayor del dato como activo principal de las organizaciones. En este TFM, se recogen los aspectos más importantes de la legislación relacionada con la protección de datos con el fin de poner de manifiesto las medidas técnicas necesarias para realizar la adaptación de una compañía al Reglamento General de Protección de Datos (RGPD). Así mismo, se establece un caso práctico real de una adaptación al nuevo Reglamento Europeo. Cabe destacar que este proyecto se ha realizado en el seno del departamento de Riesgos Tecnológicos de EY (Ernst & Young), siendo en todo momento un proyecto real., The protection of data is a very present issue at present due to the increasing importance of the data as the main asset of the organizations. In this TFM, the most important aspects of the legislation related to data protection are collected in order to highlight the technical measures necessary to adapt a company to the General Data Protection Regulations (GDPR). Likewise, a real practical case of an adaptation to the new European Regulation is established. It should be noted that this project has been carried out within the Technological Risks department of EY (Ernst & Young), being a real project at all times.

Los ficheros de morosos son un mecanismo cuya única función legal es ofrecer información sobre la solvencia económica de los titulares de los datos inscritos en los mismos. Sin embargo, en la práctica, no es extraño encontrase el uso de los mismos como un medio extraordinario de cobro. This set of three case studies explores the intersection of openness, digital governance, andhigh quality information in Estonia,1 Finland, and Norway with the aim of identifying lessonsthat will support the same objectives in lower resource countries. Openness, a key aspect ofthe international agenda for increasing transparency and accountability, for reducing public sectorcorruption, and for strengthening economic performance, rests on the principle that citizenshave a right to know what their governments are doing and to benefit from using governmentinformation. Goals for open, accountable, and inclusive governance rest on the assumption thattrustworthy information is available and can be shared meaningfully through strategies for digitalgovernance. This assumption needs to be examined. Does reliable and complete informationexist across lower resource countries? Can it be accessed readily? Will it survive through time?

Проведено аналіз та порівняльні дослідження технологій розмежування доступу для захисту даних в комп’ютерних системах. Розроблено класифікацію базових технологій розмежування доступу до ресурсів комп'ютерних систем. Виявлено низку характерних особливостей, переваг і недоліків існуючих напрямів і технологій управління доступом. Визначено, що одними з найбільш перспективних напрямів моделювання процесу розмежування доступу є суб'єктно-орієнтовані технології ізольованого програмного середовища. An analysis and comparative researches of technologies of differentiating of access for defence of information is conducted in the computer systems. Classification of base technologies of differentiating of access is developed to the resources of the computer systems. Found out the row of characteristic features, advantages and lacks of existent directions and technologies of access control. Certainly, that one of the most perspective directions of design of process of differentiating of access are the subject-oriented technologies of the isolated software environment.

Проведено аналіз технологій опису моделей розмежування доступу до ресурсів комп'ютерних систем. Визначено, що однією з перспективних мов моделювання є мова XACML. Визначено основні її недоліки і запропонована концепція, що дозволяє врахувати фактор післядії в процесі моделювання розмежування доступу до ресурсів. Удосконалена модель потоків даних при розмежуванні доступу до комп'ютерної системи. Запропоновані рекомендації щодо практичного використання. Зроблено висновок про можливість зменшення часу на дозвіл запиту на доступ до комп'ютерної системи. The analysis of technologies of description of models of differentiating of access is conducted to the resources of the computer systems. Certainly, that one of perspective languages a design is language of XACML. His basic failings are certain and conception, allowing to take into account the factor of последействия in the process of design of differentiating of access to the resources, is offered. The model of flows of data is improved at differentiating of access to the computer system. Recommendations are offered in relation to the practical use. A conclusion is done about possibility of diminishing of time on permission of request for access to the computer system.

The topic of this bachelor's thesis is security and protection of data by using smartphones. The theoretical first part focuses on history of smartphones and introduces the best-known operating systems. The second part describes attacks on mobile phones, their future and the most famous attacks. Another section contains methods, which protect smartphones against attacks. Next part focuses on the comparison of antivirus program, according to specific criteria. The last part contains description of my survey. The goal of this survey is to find an answer to the question, if people care about the protection of data and realize the consequences of no good protection.

Podatki o zdravstvenem stanju pacientov, so občutljivi osebni podatki, zato morajo veljati posebna pravila glede njihove obdelave in varovanja. V diplomskem delu smo ugotavljali, kako zaposleni zdravstveni delavci upoštevajo navodila o varnosti pri delu z informacijskem sistemu ProMedica. Ugotavljamo, da zaposleni ne upoštevajo dovolj navodila o varovanju podatkov. Problem se je izkazal predvsem v nedoslednem upoštevanju uporabe gesel. Višja izobrazba zaposlenih ne vpliva na to, da bi zaposleni bolj upoštevali varnost. Mlajši zaposleni si gesla med sabo ne izmenjujejo, za razliko od starejših. Rešitve omenjene problematike vidimo v avtomatskem zaklepanju programa v primeru neaktivnosti. Na ta način bi dosegli, da gesla uporabljajo samo zdravstveni delavci, ki so jim dodeljena. The data of health condition of the patients are very sensitive personal data.That means, it is very important to follow special security and working measures. In the diploma work we have concluded that the employees do not followw the instructions about the security of data. The problem occurs in incorrect use of security code. The hypothesis has been made that there is the difference in security of protected data between a group of people with high school degree and a group of people with a university diploma. Younger employees are also more accurate. It has been found out that nurses share their security codes with their colleagues, while the doctors do not. One of the possible solutions of the problem is in automatic locking of the programme in a case of inactivity. In this way the health workers would have to use their own security codes.

Securities settlement systems should have a well-founded, clear and transparent legal basis in the relevant jurisdiction. The laws, regulations, rules and procedures governing the operations and activities of Thailand Securities Depositories (TSD) are public and accessible to participants. In particular, participants receive comprehensive documentation covering the rules, requirements, procedures and instructions of TSD. This documentation is available on request and is accessible on the TSD website. The public authorities' regulations are also available to the general public on the websites of the Ministry of Commerce (MoC), the Securities and Exchange Commission (SEC) and the Bank of Thailand (BOT). It is recommended to implement adequate legal measures that ensure the netting arrangement is legally protected even in the event of the insolvency of a participant.

The objective of this paper is to share the experiences and good practices of early business registry reformers who implemented web-enabled and automated electronic business registries (e-BRs). These lessons are hoped to be of help to EU New Member countries as they embark on delivering EU-conformant e-BRs. At the same time, policymakers in other developing countries may also find these lessons of use. This paper cites examples of good practices rather than best practices. As elsewhere in the development agenda, solutions that have worked well in some countries may not work in other local circumstances. In the case of e-BRs, success depends on a broader set of reforms; as will be discussed in a subsequent chapter, e-BRs require a supportive legal and regulatory infrastructure, such as electronic signature laws and document authentication. A needs assessment and analysis of the options in the local country context need to be conducted in order to find the most relevant best practice options for a specific country. Nevertheless, a number of practical good practices can be identified and are presented in this paper for consideration.
