This research project is a study of state legislation in the Russian Federation on religious freedom and freedom of thought, as well as of canon law in the Russian Orthodox Church and the Catholic Church concerning legal rights within a specific territory. It is above all an analysis of its origins and development. This analysis will include a study of the creation of ecclesiastical vocabulary, both ministerial, canonical and nomocanonical, in so far as it was used by the secular legislator, that is the Roman emperors of the East (from Constantine to Theodosius II), and the Czars and Emperors of Russia from the 16th to the 20th centuries. It will also include a study of legislation during the soviet era (1917-1991) and that of the contemporary Russian Federation (law of 1997) and its relationship to religious organizations, freedom of thought and religious freedom. The term “canonical territory” itself originated very recently. However, despite its recent creation, it undoubtedly expresses a very ancient ecclesiological phenomenon. In fact, the principles of non-intrusion on an ecclesiastical district which had been placed under another’s jurisdiction, and the rejection of all forms of ecclesial polyarchy led to the establishment of a precise body of canonical laws concerning ecclesiastical organization. The Russian Federation is a modern example where the jurisdictions of several churches are represented within the framework of state legislation on freedom of conscience and religious freedom.; Dans ce projet de recherche visant à une étude de la législation étatique de la Fédération de Russie en matière de liberté religieuse et de liberté de conscience, ainsi que de la législation canonique de l’Église orthodoxe russe et de l’Église catholique en matière de compétence de juridiction sur un territoire délimité, il s’agit avant tout d’analyser une genèse-processus. L’analyse passe, d’une part par l’étude de la formation du vocabulaire ecclésiastique ministériel et canonique ou nomocanonique, dans la mesure où il est employé par le législateur séculier, en l’occurrence les empereurs romains d’Orient (de Constantin à Théodose II), les Tsars et les Empereurs de Russie du XVIe au XXe siècle. Une autre partie de l’étude concerne la législation de l’époque soviétique (1917-1991) et la législation de la Fédération de Russie contemporaine (loi 1997) en matière de rapport avec les organisations religieuses, la liberté de conscience et la liberté religieuse. La notion de « territoire canonique » en elle-même est très récente. Mais, elle exprime, sans aucun doute, une construction juridique très ancienneEn effet, les principes de non-empiétement sur une circonscription ecclésiastique, placée sous la juridiction d’un autre, et le refus de toute forme de polyarchie ecclésiale, menèrent à l’établissement de règles canoniques précises concernant l’organisation administrative des Églises. La Fédération de Russie constitue un exemple moderne où les juridictions de plusieurs Églises sont représentées dans le cadre de la législation étatique en matière de liberté de conscience et de liberté religieuse.

espanolEste estudio analiza la organizacion territorial de la Iglesia hispana en los siglos iv y v. En el se pone de manifiesto que en el complejo proceso de configuracion del mapa eclesiastico hispano primaron los criterios que hacian coincidir el ordenamiento eclesiastico con el civil. Solo en contadas ocasiones los factores politicos, y/o personales, y/o la dinamica interna de la Iglesia influyeron en la creacion de sedes episcopales o en la consolidacion de ordenamientos jurisdiccionales o limites territoriales distintos al civil. La Iglesia siguio tambien la division provincial, aunque la consolidacion de la autoridad metropolitana en la provincia fue problematica y tardia. El mapa eclesiastico hispano constituido fue, por tanto, versatil y refleja tanto situaciones de continuidad como de ruptura con el ordenamiento civil tardorromano, que han de ser tenidas en cuenta al realizar paralelismos y comparaciones entre la organizacion territorial eclesiastica y la civil. EnglishThis study analyses the territorial organization of the Hispanic church in the fourth and fifth centuries. It reveals that in the complex configuration process of the Hispanic ecclesiastical map, criteria that matched the ecclesiastical order with the civil one prevailed. On only a few occasions did political, and/or personal factors, and/or the internal dynamics of the Church, influence the creation of episcopal sees or the consolidation of jurisdictional orders or territorial boundaries other than the civil ones. The Church also followed the provincial order, although the consolidation of the metropolitan authority in the province was problematic and late. The Hispanic ecclesiastical map was, therefore, versatile and reflects both situations of continuity and rupture with the late Roman civil order. This fact has to be taken into account to draw parallels and comparisons between the ecclesiastical and the civil territorial systems. francaisCe travail analyse les formes d’organisation territoriale adoptees par l’Eglise hispanique aux ive et ve siecles. Il met en evidence comment, dans le processus complexe de configuration de la carte ecclesiastique, les criteres faisant coincider l’ordre ecclesiastique avec l’ordre civil ont prevalu. Ce n’est qu’en quelques occasions que des facteurs politiques et/ou personnels, ou encore parfois la dynamique interne de l'Eglise, ont influence la creation de sieges episcopaux ou la consolidation des ordres juridictionnels ou des limites territoriales autres que civiles. L’Eglise a egalement suivi la division provinciale, bien que la consolidation de l'autorite metropolitaine dans la province ait ete problematique et tardive. La carte ecclesiastique hispanique ainsi constituee etait donc polyvalente et reflete des situations de continuite comme de rupture avec l’ordre civil romain tardif, qui doivent etre prises en compte pour etablir des paralleles et des comparaisons entre les organisations territoriales ecclesiastique et civile.
