Refereed/Peer-reviewed The United States has engaged in well over 100 Open Skies Agreements with other ICAO member state partners reaching all parts of the globe. These Open Skies Agreements have established a practice of liberalization for airlines to have the most freedom to choose when, where, how often, and for how much they fly to locations. Despite a majority of ICAO member state partners engaging in Open Skies, there has been a reluctance of the member states to engage in the same practices with other aviation partners for similar access. A similar pattern is also evident for liberalization through the Freedoms of the Air, a key philosophical understanding set forth through ICAO practices describing the ways in which airlines can fly between the member states in the interest of international aviation. This paper evaluates the trend among the member states to engage in more liberalized aviation through their granted access to reduced government oversight of foreign airline access to sovereign airspace and the number of rights granted to their respective operational international partners. While the overwhelming number of agreements may not be fully liberalized Open Skies, there does appear to be an increasing desire to promote practices that connect member states at greater efficiencies and give travelers more options and more access to airline choice.

El turismo en Colombia ha conseguido cifras positivas nunca antes vistas a lo largo de su historia, y en gran medida éstos índices se han dado por los beneficios que se han generado en la celebración de ciertos convenios bilaterales en la materia, situación que motiva el presente documento en el cual se realiza un análisis de los factores, características y beneficios que emanan éstos acuerdos en pro del sector turismo y su alcance en materia de desarrollo en otros campos como el sector aeronáutico y gubernamental, por lo cual, se hace referencia al impulso de la conectividad que se genera a través de la industria aérea en el turismo sobre el cual se destacan instrumentos bilaterales y acuerdos de liberalización del transporte aéreo que pueden hacer más prósperos muchos sectores sociales y de la economía. Colombia´s tourism has achieved positive figures never seen before throughout its history, and to a large extent, these indices have been given by the benefits that have been generated in the celebration of certain bilateral conventions in the matter, situation that motivates the present document in which it conducts an analysis of the factors, characteristics and benefits that emanate these agreements in favor of the tourism sector and its scope in terms of development in other fields, such as the aeronautical and government sector, therefore, reference is made to the momentum of the connectivity that is generated through the airline industry in tourism which highlights on the bilateral instruments and air transport liberalization agreements that can make it more prosperous to social and economy sectors.

Nel contributo, all'interno della terza edizione rinnovata del testo, viene esaminata la disciplina dei servizi di trasporto aereo con particolare attenzione alle possibili evoluzioni del quadro normativo. Il capitolo è corredato, inoltre, dall'appendice recante testi giurisprudenziali e normativi di rilevante interesse.

Anche alla luce delle più recenti pronunce giurisprudenziali, il contributo intende offrire un’analisi approfondita della disciplina dei servizi aerei nell'ordinamento nazionale, europeo ed internazionale. In particolare l’approfondimento ha ad oggetto l’analisi dei seguenti temi scanditi nei paragrafi del contributo: 1. La Convenzione di Chicago del 1944: le «libertà dell’aria». 2. Gli accordi aerei bilaterali. 3. Gli Open Skies Agreements. 4. I servizi aerei in ambito europeo: il Regolamento (CE) n. 1008 del 24 settembre 2008. 5. Le sentenze della Corte di giustizia del 5 novembre 2002 sugli Open Skies Agreements tra Stati Uniti e otto Stati membri. Il Regolamento (CE) n. 847 del 29 aprile 2004. 5.1. L’«Accordo sui trasporti aerei» tra Stati Uniti, Unione europea ed i suoi Stati membri. 5.2. Gli accordi aerei bilaterali tra l’Unione europea e la Russia: problematiche di legittimità. 6. I servizi aerei nel quadro del Codice della navigazione. 7. Il cielo unico europeo. 8. La c.d. slot al location. Nel contributo vengono analizzate le differenti discipline applicabili ai servizi di trasporto aereo tra località situate in Stati diversi alla luce delle Convenzioni internazionali, degli accordi bilaterali e delle regole comunitarie. Il contributo, inoltre, è corredato da note bibliografiche contenenti ampi riferimenti alle pronunce giurisprudenziali e alle opinioni della dottrina rinvenibili in materia

Il contributo intende offrire una analisi approfondita della discplina dei servizi aerei nell'ordinamento nazionale ed internazionale. In particolare l'approfondimento ha ad oggetto l'analisi dei seguenti temi analizzati nei per paragrafi: 1. La Convenzione di Chicago del 1944: le "libertà dell'aria" 2. Gli accordi aerei bilaterali. 3. Gli Open Skies Agreements. 4. Evoluzione della normativa sulla liberalizzazione dei traffici aerei in ambito comunitario. 5. Il Regolamento (CE) n. 847 del 29 aprile 2004 relativo alla negoziazione e all'applicazione di accordi in materia di servizi aerei stipulati dagli Stati Membri con i Paesi Terzi. 5.1. L' "Accordo sui trasporti aerei" tra Unione Europea e Stati Uniti. 6. I servizi aerei extracomunitari nel quadro del Codice della navigazione. 7. La slot allocation 7.1. Le modifiche introdotte dal Regolamento (CE) 21 aprile 2004, n. 793. Nel contributo vengono analizzate le differenti discipline applicabili ai servizi di trasporto aereo tra località situate in Stati diversi alla luce delle Convenzioni internazionali, degli accordi bilaterali e delle regole comunitarie.

We find robust evidence of a positive and significant relationship between the volumes of traffic and the degree of liberalization of the aviation market. An increase in the degree of liberalization from the 25th percentile to the 75th percentile increases traffic volumes between countries linked by a direct air service by approximately 30 per cent. In particular, the removal of restrictions on the determination of prices and capacity, cabotage rights and the possibility for airlines other than the flag carrier of the foreign country to operate a service are found to be the most traffic-enhancing provisions of air service agreements. The results are robust to the use of different measures of the degree of liberalization as well as the use of different estimation techniques.
