The aim of the article is to conduct research on the issue of whether compulsory vaccination, enshrined in international and national legal acts, violates labour rights. The main research method was a comparison method, which helped to compare the experience of different countries in restricting labour rights in the context of compulsory vaccination against COVID-19. Moreover, the main characteristics of restrictions on labour rights during the COVID-19 period were highlighted using the method of system analysis. The evolution of compulsory vaccination was analysed using a historical-logical method. A formal legal method was applied to generalise, classify, and systematize research results, as well as to present these results. The current outbreak of COVID-19 has provoked trends in discriminatory behaviour in the workplace. Therefore, the restrictions on labour rights must comply with international human rights standards, which, however, largely reflect a position that does not support compulsory vaccination.

The development of globalization processes in the world economy allows reconciling supply and demand for staff regardless of the employee's country of origin and leads to international labor migration. The experience of highly developed countries shows that a country's economy and its subsequent growth largely depend on the effective recruitment and use of skilled labor. The COVID-19 pandemic has led to a drastic restriction on population mobility and, consequently, worsened the economic and social situations in countries where labor migration was a widespread phenomenon. The ensuing economic crisis has not only altered trends in labor migration but has also brought new challenges to its legal regulation. The article aims to determine the features of migration trends and policy in the COVID-19 environment, examine them in the context of new regulations adopted to protect the labor rights of migrants under the current circumstances, suggest effective measures to regulate the situation in the labor market, and address the economic crises in the countries of destination and origin. The examination of this issue involved a complex methodological framework where the general scientific dialectical method was central to the research. The conducted research provides a foundation for overcoming the social and economic crises caused by COVID-19, which contributes to its practical significance.

In the context of active legislative prospects of the labour legislation of Ukraine in the aspect of their European integration, there are issues of developing and implementing effective remuneration systems and optimising them, which should be aimed at solving the problems of developing the Ukrainian economy, ensuring a combination of economic and social interests and goals of individual employees and managers of enterprises. This requires the application of new approaches to the organisation of wages, considering the specifics of enterprises and the experience of domestic and foreign companies, as well as scientists in the field of wages. The establishment of effective mechanisms in the remuneration system, which should ensure social and economic justice in labour relations, plays a significant role in resolving the relevant issues. This is primarily the observance, protection and restoration of the subjective rights of employees to pay in case of violation. If most of the outlined general social and economic problems cannot be solved by one means or another, it is not only possible but also necessary to formulate priority purely legal tasks related to the optimisation of legal regulation of wages. The article reflects: 1) the international legal basis for the establishment of an appropriate level of wages, 2) foreign experience in the establishment of optimised wages and 3) scientific and applied approaches to optimising wages in the Ukrainian economy under the influence of European integration processes. During the writing of this article, for a comprehensive disclosure of the issues, to achieve an objective scientific result and formulate appropriate conclusions, the authors used general and special methods of cognition (dialectical, functional, Aristotelian, comparative legal, hermeneutic, method of comparison). The article concludes that the existence of many intra-industry tariff grids in Ukraine in practice only complicates law enforcement. If there really was a Unified Tariff Grid, which would consider all professions, their features and the specifics of working conditions, there would be no need for each sector of the economy to develop its own tariff grid. Currently, there is a situation when within the UTS itself there is a significant number of other internal tariff grids in various areas and industries. The UTS should be developed based on the Dictionary of Occupational Titles, as it is the unified act that contains a list of professions that exist in the economic life of Ukraine. Therefore, each of these professions must be assigned its own tariff coefficient and the corresponding category. Wage growth should depend on the employee's qualifications, level of education, and productivity

The article presents a brief analysis of the situation in Belarus and Ukraine with the spread of coronavirus COVID-19 and measures taken by employers to optimise labour and social security relations during 2020. A brief overview of the decisions taken by Presidents, Parliaments, Governments and Ministry of Healthcare of both countries aimed at containment of coronavirus infection is presented. The latest changes in the Labour Code of Belarus and Labour Code of Ukraine, which regulated remote work since 2020, were touched upon. Attention is paid to the concept of self-isolation under the legislation of Belarus and Ukraine, restrictive measures that must be observed when self-isolating citizens in connection with COVID-19 infection, as well as level 1st and 2nd contacts. The authors analyse the new legislative provisions governing home and remote work, introduced into the labour legislation in Belarus in 2020, in Ukraine in 2020 and 2021. The article presents the specific experience of Belarus, where the presidential decree extended the rights of employers to temporarily transfer employees without their consent, as well as to change essential working conditions, and without making changes to the Labour Code. The authors give an assessment of such legislative innovations. The article deals with some issues of social support for employees who find themselves in a situation of downtime due to the suspension of the activities of organisations that are idle, as well as self-isolation. At the end of the article, some suggestions and recommendations are made for further adaptation of labour and social security legislation in Belarus and Ukraine in the context of the COVID-19 pandemic. © 2021, National Academy of Legal Sciences of Ukraine. The formation of a competitive system in a country’s economy is always determined by the possibilities of using tools that stimulate development and form an independent picture for the external environment. In this regard, the study determines the efficiency of antimonopoly regulatory authorities in establishing the criteria and limits of regulation. At the same time, there are cases when antitrust regulation is understood primarily as a form of economic pressure on business entities. The novelty of the study lies in a new consideration of the limits of antitrust regulation. The authors demonstrate that antitrust regulation in its current capacity constitutes a form of limiting the growth of the company and is aimed primarily at reducing the dependence of the market on one stakeholder. The paper identifies the possibilities of additional consideration of the criteria for limiting antitrust regulation in the context of the formation of economic security of a business entity. The paper covers the aspects of determining the limits of state support of economic security of business entities. The practical significance of the study is determined by the need for a more practical harmonization of the legislation of the country with global business standards and a decrease in the level of regulation of the business environment, coupled with its protection from hostile takeovers. A non-competition agreement is a very common way to protect an employer's interests. In many countries there is such a legal instrument as a non-competition clause. On the other hand, the non-competition agreement is a new and unusual phenomenon for Ukraine, so there is a need to study its legal regulation with the experience of foreign countries. The aim of the article is to study the legal regulation of the nature of the non-competition agreement with the experience of different countries in this matter and the feasibility of applying this experience in Ukraine. The study was conducted using such special legal scientific methods, as historical and legal, comparative legal and formal. The article presents the comparative-legal analysis of the practice of conclusion of non-competition agreements in such countries as France, Germany, Italy, China, Great Britain, the USA and Ukraine. On the basis of this analysis, proposals for Ukraine are made. In particular, the article considers the problems of including non-competition provisions in civil legislation. Also analyzed is the judicial practice of violations of the terms of contracts containing non-competition provisions.

The robotization process leads to the emergence of new subjects of legal regulation, which includes the search for new solutions in various areas of legal, economic and social development. The aim of the study. based on the analysis of international legal acts, the legislation of developed countries, as well as doctrinal provisions in the field of legal regulation of artificial intelligence, so it is necessary to characterize the directions, review the current state of research, list the main trends, and also make a comparative legal analysis of the development of legal regulation of artificial intelligence in labor law. It was made an analysis of the existing positions on a controversial issue among the authors. The authors have been made a classification of the approaches to the legal understanding of artificial intelligence, which were proposed in the scientific literature previously. The provisions of the legislation of developed countries in the field of legal regulation of artificial intelligence were compared, which made it possible to use positive experience to develop proposals for improving the norms of legislation. It is highlighted the need to create a convention at the international level that would be binding and standardize the legal regulation of artificial intelligence at the global level. It is argued that the responsibility for the actions or inactions of artificial intelligence is borne by the person who develops and programs the artificial intelligence.

PurposeThe purpose of this paper is to examine the international regional system of the preservation of the right to health in the European human rights system through the work of the ECtHR, to analyse the case law of the ECHR based on the human right to health. This purpose determines the following tasks: to identify the features of the realization of the right to health in the European mechanism of human rights protection; to study the mechanism of realization of the right to health in the activity of the ECtHR; to describe the case law of the ECtHR in terms of the right to health.Design/methodology/approachThe “black letter” law methodology is used to focus attention on conducting research on the letter of the law and the desire to conduct a descriptive analysis of legal norms, based on primary sources.FindingsOn the basis of the conducted researches, it is possible to draw a conclusion that the ECHR, albeit implicitly, refers to the right to health as well.Originality/valueThe right to health is included in the catalogue of the most important universally recognized human rights and is most often considered as an integral part of socio-economic human rights, but there is no special universal or regional mechanism for protecting this category of rights.

Se utilizaron metodos de analisis y sintesis, generalizacion teorica, historica, cientifico-analitica, sistematizacion y clasificacion para identificar las bases cientificas y teoricas de la migracion laboral. La trascendencia practica de los resultados obtenidos radica en la posibilidad de utilizar los resultados del estudio para superar las consecuencias socioeconomicas de la crisis coronaria por paises; para mejorar las actividades de los servicios de migracion. EnglishThe purpose of the article is to identify and evaluate the main measures of migration policy and legal regulation in the field of combating the effects of the economic crisis, effective ways to regulate the situation on the labor market and employment and measures to address the economic crisis in the country of destination and origin. Methods of analysis and synthesis, theoretical generalization, historical, scientific-analytical, systematization and classification were used to identify scientific and theoretical bases of labor migration. The practical significance of the obtained results lies in the possibility of using the results of the study to overcome the socio-economic consequences of the coronary crisis by countries; to improve the activities of migration services.

The aim of this article is to study the issues of inclusiveness in Ukraine and analyse the National Strategy for Creating a Barrier-Free Environment regarding its consistency with the facts of life in Ukraine. It considers the international experience in creating a barrier-free inclusive society and the implementation of the most effective achievements in Ukraine. It analyses the National Strategy and singles out its specific features, key elements, and main aims in creating a barrier-free environment in Ukraine. Analysis of the National Strategy was conducted in the context of inclusion and ensuring equal opportunities.

The relevance of the study is based on the development of scientific and technological progress and the expansion of the labor market, including in the framework of international cooperation. Moreover, the introduction of quarantine due to the spread of Covid-19 has led to increased attention to remote work. The aim of the study is to analyze the legal aspects of remote work in accordance with the labor legislation of Ukraine and the European Union, focusing on the concept of remote work, the rights and obligations of remote workers. In our study, we determined that in the European Union, the key points in relation to the rights granted to teleworkers, which the countries parties to the agreement have undertaken to incorporate into their national legislation and collective agreements, are data protection; the voluntary nature of telecommuting; equipment; organization of working time; privacy. The originality of the study is based on more effective ways to improve labor productivity in Ukraine, labor discipline, compliance with labor guarantees for remote work. It is necessary to revise and legislatively regulate the key principles of compliance by employees with labor discipline, providing the employee with proper working conditions, supporting the employer in search of new opportunities to provide employees with work, improving the technical aspects of ensuring the relationship between business and government, responsibility for results and the labor process.

Today, the successful competition of any domestic enterprise in the market of goods and services is conditioned on the use of new technologies and production processes. Such activity is innovative and plays a leading role in its life. Exacerbation of competition and decrease of competitiveness of domestic enterprises necessitate their innovative development. Information, intelligence, knowledge and innovation, which are the backbone of the country's human resources, are of particular importance in this context today. Therefore, the driving factors in the way of formation of personnel component of innovative development of the state economy are the training of innovative personnel – skilled workers, capable of creative work, professional development, introduction of high-tech technologies on the basis of development of the system of lifelong learning. The issues of professional development of employees are becoming especially relevant in the context of globalization, as well as the European and innovative integration of Ukraine. The author investigates the peculiarities of transformations of modern theoretical and legal approaches to professional development of employees in the context of European integration, human-centered and innovative approaches to doing business, in particular, the following tasks are solved: (1) the essence of the concepts of ‘professional development’, ‘functions of professional development of employees’, ‘professional training’ as legal categories is revealed; (2) leading functions of professional development of employees are generalized; (3) the vectors for further reform of the legal regulation of professional development of employees are determined; (4) the prospects and problems of influence of professional development of employees on the innovative development of individual enterprise and Ukraine as a whole are established. The author substantiates that the professional development of employees produces its direct impact both on individual enterprises and on the state as a whole in the sphere of innovative transformations. Undoubtedly, the gradual introduction of European standards and requirements, the adaptation of foreign legal regulation to the domestic realities and features of the legal system will allow to increase the economic potential, innovative component and competitiveness of Ukraine in the world market, as well as to bring the prospects of gradual accession into the European Union.

Given the insufficient level of regulation of the health insurance institute in Ukrainian legislation, the article attempts to investigate global experience in the context of this issue. In particular, a number of international documents were investigated, their content was characterized and the main provisions were highlighted. Based on collected and analyzed data, the authors outlined the areas of adaptation of Ukrainian legislation to the highest standards of the EU, made a proposal for the ratification of the conventions of the International Labor Organization. Supported a proposal for the development and adoption of a separate special law on general-compulsory state health insurance, which would regulate issues related to health insurance.
